In addition to the Commissions recommendation, staff has requested that the City Attorney review the city's current labiality insurance and determine if its liability coverage is adequate. The PDF includes a letter from the attorney recommending that the City purchase additional coverage for $1,500.00 to cover volunteers engaged in the buckthorn removal program. I understand that the volunteers may use heavy equipment including chain saws and so forth. Liability issues for the City arise in such a program because of the possibility of serious injury to the volunteers or serious injury caused by the volunteers, The LMCIT has an accident coverage program for City volunteers. Golden Valley provides coverage for volunteers who are board and commission members, but it does not buy the additional coverage necessary'to cover volunteers engaged on construction or demolition projects. In my opinion, the City would have to purchase additional coverage in order to cover them. Attached for your review is a handout from LMCIT. It is three pages in length and provides that the City could cover all such volunteers on the buckthorn removal program if it would buy the additional insurance at a maximum cost of $1,500.00. It is trey recommendation that the City purchase the additional coverage for $I,S00.00 to cover volunteers engaged in the buckthorn removal program before it undertakes any such program. The insurance would cover injuries to the volunteers and the pre-existing insurance that the City has would cover injuries caused by the volunteers. I hope this is sufficient for your purposes. This coverage provides a schedule of benefits to compensare city volunteers who are injured while performing volunteer services for the city. Who is covered by the program? With only a few exceptions, all city volunteers working under the city's direction and control will be automatically covered on a blanket basis if the city chooses to add this coverage. This could include, for example, coaches and instructors in recreation programs, volunteers working on a .,city -sponsored festival or celebration, "clean-up day" volunteers, etc. The city will not need to list the individuals who are to be covered, either by name or by project; nor will the city need to keep track of the time the various volunteers put in. Four classes of volunteers are not automatically covered: Volunteers who are covered by workers compensation. Certain volunteers are defined to be "employees" for purposes of workers compensation, and are therefor eligible for workers compensation benefits if they are injured. These include volunteer firefighters, ambulance attendants, first responders, law enforcement assistance volunteers, and civil defense volunteers. Since these volunteers are already protected by workers compensation, they are not covered under this plan. 2. City council, board; committee, and commission members. Other coverage options are already available for these people. The workers compensation law gives cities the option to extend workers compensation coverage to elected and appointed officials. LMCZT has also for several years offered an accident policy underwritten by CIGNA for members of city councils, boards, and committees. I Members ofprivate organizations which provide services or participate in city -sponsored activities as a group. 4. Volunteers working on construction or demolition projects. These volunteers will not be covered automatically. however, for an additional charge, the city can add coverage for volunteers on a specific construction or demolition project. What benefits would an injured volunteer receive? The plan provides three basic benefits: I. Disability benefit A, volunteer who is unable to engage in the activities of his/her normal occupation because of an injury suffered while performing volunteer services for the city will receive a disability benefit of $400/week for up to 26 weeks. 2. Death benefit. If a volunteer dies as a result of an injury suffered while performing volunteer services for the city, a death benefit of $100,000 will be paid to the volunteer`s survivors or estate. 3_ Impairment benefit If a volunteer suffers a permanent impairment or disability as a result of an injury suffered while performing volunteer services for the city, the volunteer will receive a lump sum payruent as compensation for that impairment. Payments are based on the percentage of disability, ranging from $750 for a 1% disability to $100,000 for 100% disability. The percentage of disability is determined in the same manner used for impairment compensation in the workers compensation system. Foran additional charge the city can add coverage for up to $1000 of medical costs. This limited medical coverage is intended to pick up relatively minor first aid costs. On more serious injuries, it could also be applied to costs which the individual would otherwise have to bear under his/her own health coverage's deductible or co -pay provisions. What does it cost? The cost is based on the city's population. The basic annual charge is &10 per capita, subject to a minimum premium of $150 and a maximum premium of $1500. The additional cost to add the optional medical coverage is 45% of the basic premium. A volunteer coach being hit in the head by a barred baseball might be an example of the latter situation. The volunteer accident coverage protects the volunteer on a "no-fault" basis. The benefits are automatically payable if the injury occurs while the volunteer is performing services for the city, regardless of whose fault it was. Besides protecting the volunteer whose injury isn't caused by the city's negligence, having these ao-fault benefits available could also help avoid litib tion in cases where the city (or a city officer, employee, or other volunteer) is or may be at fault. The injured volunteer can receive these benefits without getting into an adversary situation against the city. Of course, if the volunteer's injuries exceeded the benefits paid under this coverage, he/she would still be able to make a tort claim against the city for those excess damages, if the injury was caused by the city's negligence. Why did LMCIT create a whole new program? Why not just offer a "voluntary workers' compensation endorsement" and provide workers compensation benefits to volunteers? The LMCIT Board chose this approach for several reasons. It's substantially less expensive to the city than providing workers compensation benefits would be, reflecting the more limited scope of benefits provided. Administration is simpler for the city, since the city doesn't have to keep records of how manly hours were worked by how many volunteers, etc. It eliminates the problem of determining what the appropriate indemnity rate is for an unpaid volunteer. Environmental Commission Report on Citizen Participation and Buckthorn Removal Project Prepared By Jeannine Clancy, Director of Public Works Al Lundstrom, Environmental Coordinator Summary At the June 2004 Council/Manager meeting, Council reviewed a proposal from Jan Olfe, a member of the South Rice Lake Association, to remove buckthorn from a portion of the South Rice Nature Area in Golden Valley_ Because of restrictions in the existing city code and funding issues, staff recommended that the request be referred to the Environmental Commission for study. The Environmental Commission has completed their study and has prepared the attached memorandum for review and consideration by the City Council. Rich Baker, Chair of the Commission and Al Lundstrom, Environmental Coordinator, will attend the meeting to review the memorandum with Council. If Council concurs with the Commission's findings, staff will: 1. Begin work to revise the code to allow removal of buckthorn in City parks and right-of- ways under certain circumstances. 2. The Environmental Commission reviewed the proposed revisions to City Code at their May 23 meeting. The Commission was asked to put their comments in the meeting minutes, which are attached. Revisions to the Commission's bylaws, to encompass the changes made to the City Code, were discussed at the June 27 meeting. The draft of the bylaws will be reviewed at the July 25 Commission meeting. I can forward these minutes to you after the Commission approves them. 2. The Environmental Commission has had ongoing discussions to provide feedback on Envision. To date, we do not have a cohesive, stand-alone document for this feedback. Ordinances - each board and commission was going to review the proposed ordinance. I have not received any comments. If the review occurred and there were no comments, please let me know. I will probably review with Linda Loomis to determine if the proposed changes should be inserted before Council consideration, or if she doesn't recommend changing (in which case I hope she will let them know). 2. Envision - They were supposed to do their Envision review and get comments to the Council by Sept. 23. Let me know what form the review has taken with your group. If you are already done, please forward a copy to me. If not, let me know your anticipated time schedule and what type of report/product you anticipate will be prepared. I think Tom wants me to pull the outcome of efforts from all of the Boards and Commissions into a comprehensive report, but since we weren't very specific about reporting out, I don't have a handle on how it will all come together. Buckthorn in Golden Valley While there are other invasive plants in Golden Valley, buckthorn, an aggressive, non-native, woody plant, is quietly invading parks and wood - lots, wetlands and yards throughout Golden Val- ley. Of all the invasive species, buckthorn is the big- gest problem here," says Golden Valley Environ- mental Coordinator At Lundstrom, after a recent environmental assessment of the city. "And right now, education is our main tool of control." Both common buckthorn, also called European, and glossy buckthorn are well-established in Min- nesota. They are recognizable as tall understory shrubs or small trees with brown bark and silvery projections that grow to 20 feet high. Brief Buckthorn History Buckthorn was brought to the US from Europe in the 1800s, mostly by people who liked that it grew fast and created privacy fences. For years buckthorn went unchecked. Then in the 1930s, the common type was identified as an alternative host to oat crown rust, a fungus that destroys oat crops, and sales were stopped. But buckthorn continued to thrive, and the State of Minnesota officially listed common buckthorn as a "restricted" noxious weed in 1999. By 2001, glossy buckthorn was an outlaw plant, too. While the transport or sale of buckthorn is illegal, the plant continues to thrive throughout the Midwest. This task force will include three members of the Environmental Commission, two members from the Open Space & Recreation Commission and four residents. As noted in the minutes, Mayor Loomis will be contacting the Chair (of both Commissions) to ask you to nominate people from the Environmental Commission to fill these three positions. The Council has asked Mayor Loomis to "balance the slate" geographically and with persons who favor and oppose herd management. Appointment of this task force is likely at the Council's first meeting in January 2006 (January 3), and as such, Mayor Loomis would require your nominations in advance of the Environmental Commission's regular meeting in January. As this is obviously a time -sensitive issue, Vice Chair Jon Pawluk asked for volunteers at last night's meeting, and subsequently volunteered to serve with leanings toward "con -management." Tracy Anderson has volunteered to be the "neutral" participant. Jon and the rest of the Commission assumed that you would be interested in serving in a "pro -management" capacity. (Today, I am mailing you an excerpt of the minutes from the December 13, 2005 Council/Manager meeting that was distributed to Commission Members at last night's meeting.) This task force will include three members of the Environmental Commission, two members from the Open Space & Recreation Commission and four residents. As noted in the minutes, Mayor Loomis will be contacting the Chair (of both Commissions) to ask you to nominate people from the Environmental Commission to fill these three positions. The Council has asked Mayor Loomis to "balance the slate" geographically and with persons who favor and oppose herd management. Appointment of this task force is likely at the Council's first meeting in January 2006 (January 3), and as such, Mayor Loomis would require your nominations in advance of the Environmental Commission's regular meeting in January. As this is obviously a time -sensitive issue, Vice Chair Jon Pawluk asked for volunteers at last night's meeting, and )sequently volunteered to serve with leanings toward "con -management." Tracy Anderson has volunteered to be the neutral" participant. Jon and the rest of the Commission assumed that you would be interested in serving in a "pro - management" capacity. Should you disagree with these nominations, or if you are unable to serve on this committee, please contact the Environmental Commission Members to appoint substitute participants.
