The Golden Valley - Crystal - New Hope Joint Water Commission (JWC) meeting was called
to order at 1:33 pm.

Policy
Moved by Bertholf and seconded by Bell to approve Resolution 23-04 Making Annual

3M PFAS Class Action Settlement

Summary
There is a proposed class action settlement between 3M and public water systems in the
United States related to PFAS contamination in drinking water. In the proposed national
settlement, 3M will pay out somewhere between $10.5-12.5 billion. The funds will be split
between two groups.
•Phase one eligible claimants are public water systems that have detected PFAS before
the settlement date [currently deemed June 23, 2023].
•Phase two eligible claimants are public water systems that have not detected PFAS
before the settlement date but are either required to test their drinking water for PFAS
contamination pursuant to UCMR-5, or serve more than 3,300 people according to
the Safe Drinking Water Information System.
All active public water systems that meet one of the bullet pointed phases above will
automatically be included in the class settlement but will need to file forms and provide
additional documentation to support claims within a yet to be determined deadline. While a
small number of Minnesota cities are excluded because of prior settlements with 3M, there are
over 200 Minnesota cities who will need to decide whether and how to file claims within this
deadline.
There will be an opt-out period, likely 60 days, from the date the settlement is approved. Court
approval may happen any day which will prompt individual notices being sent to impacted
cities. Cities will need to decide if they should opt out or stay in this class settlement.
Payments to class participants are proposed to start as early as July 2024 and go through 2036.
There will be different deadlines and payouts for different phases over the next thirteen years.
The League of Minnesota Cities has been working closely with the Minnesota Attorney
General's Office and Minnesota Rural Water to understand the issues cities should consider in
these decisions. The Minnesota Attorney General's Office plans to join a bipartisan group of
more than 20 attorneys general in filing an objection to some of the proposed settlement
provisions.
Annika Bankston and George Kraynick from Minneapolis Water Works are here to present
information about their PFAS monitoring results to date and information about the
settlement that they have learned through the Association of Metropolitan Water Agencies
(AMWA) town halls with attorneys who have negotiated the settlement.
Recommended Action

SUBJECT: JWC valve replacement project at 41st Ave and Douglas Dr
Background
Annually, the JWC allocates funding to valve replacement work along JWC water mains. The valves along water
mains are used to control water flow between sections of pipe. Valves can be used to isolate sections of water
mains for emergency repairs or planned work. The most recent example of this was the water main break earlier
this year on the JWC main on 42nd Ave near Georgia.
One of the proposed valves to be replaced this year is located at the intersection of 41st Ave and Douglas Drive.
Due to the scope of the work, the city solicited quotes from contractors to assist with this project. As noted in the
quotes, this project will involve both city and contractor staff.
Quotes
Two quotes were obtained for this work:
• Valley Rich $34,900
• United Water and Sewer $39,400
Project Cost
Valley Rich was the low quote. As noted previously, there are a variety of other costs associated with this project,
such as restoration, that will be paid by the Joint Water Commission. City staff time will be paid by the city.
Project Funding
The JWC CIP has over $100,000 allocated for valve replacements.

Valley-Rich Co., Inc. will provide labor and equipment needed to excavate, remove manholes for the replacement
of a 24” gate valves at above address. We will also cut in 24” tee and install a new hydrant/valve lateral. All
parts, trucking (soils in/out), vac truck, traffic control and restoration are by the city.
Base Bid: $34,900
Note:
This proposal is good for 15 days from the bid date in order to lock in our material prices with our vendors.
The maximum depth of trenches and structures is assumed to be 10 feet when information is not provided.

1. Towers – New Hope
• MLR Tower – move to 2025 construction, up budget to closer to $3M, include
altitude valve, 8’ no climb fence, and new gate, security cameras. NH to continue
working with KLM on design.
2. Pumps
• Pumphouse Project Update
1. Bolton and Menk updated Proposal – design ongoing
A. Working with electrical engineer HVAC
B. Moving transfer switch inside GV station
2. Including items below, GV in 2024/2025, Crys 2025/2026
A. Pump #4 at GV reservoir is original and needs to be replaced. Will include
VFD.
B. Pump #3 at Crystal is original and needs to be replaced.
C. GV replacing valves and actuators between pump and manifold tee.
1. Waiting for pumping to slow down
2. Actuators have arrived
D. Purchase parts with battery backup, approximately $60,000 of work – has
been approved and ordered.
E. Parts will be installed by GV Utilities (and Crystal and NH?) crews (currently
24-26 week lead time on parts).
F. GV pump #5 is out of service, pump #4 needs replacement, GV working off of
two pumps – waiting on battery back up rotork actuators from Vessco.
Crystal will need to pump while GV replaces valves.
G. Need to fix both GV pumps before valve work at Crystal reservoir and NH Tower.
H. Valves Fall/Winter work
I. GV pumps 2&3 only two in service until repairs and replacement of pump #4
is complete (24/25).
J. GV will inspect motors and electrical annually once pump #4 is replaced.
3. Valves -
• Crystal – valve replacement around pump house was moved future project to
finalize scope of work and logistics. NEED TO MOVE START DATE BACK UNTIL GV
PUMP HOUSE HAS REPLACED ACTUATORS – SEE NOTE ABOVE (Summer 2023?)
• Meter update at same time as valve replacement in Crystal (~$40,000)
• Olympia and Louisiana – bad gear box, need to evaluate scope of repair.
• Will now do valves at 41st and Douglas this year – move Crystal pump house valves
back. Need to order more adapters to replace inventory. Valley Rich low bid, valve
on 41st Ave done in fall 2023
• NH – 16” GV @ 42nd @ RR Bridge – if funding allows this fall

B. Fiber - TAC agreed running fiber to all facilities is a long-term goal.
