South Tyrol Park Play Structure Reconsideration Prepared By Sheila VanSloun, Parks & Recreation Administrative Assistant Rick Birno, Parks & Recreation Director Summary A number of residents from the South Tyrol Park neighborhood approached City Council members and city staff requesting additional play structure equipment after the neighborhood-selected amenity was installed the summer of 2022. Residents feel the play structure is smaller than other park locations and would like an additional play amenity added. The City Council met with staff regarding this request at the January 10, 2023 Council Work Session, and after discussion, directed staff to not invest any additional Park CIP funds. In addition, Council also directed staff that accepting a donation from the neighborhood for a park amenity upgrade would also not be considered. South Tyrol Park neighborhood residents then attended the January 17, 2023 open forum at the City Council meeting outlining their request for an addition to the play structure at South Tyrol Park. The City Council suggested they should approach the Open Space and Recreation Commission (OSRC) to share their request. The OSRC met with representatives from the South Tyrol Park neighborhood to hear input and discuss opportunities to improve the current play structure. After much discussion and reviewing potential play structure additions, the OSRC has asked staff to work with the City Council to reconsider both initial directives. The recommendations from the OSRC are as follows: • If excess funds are available from the 2023 Parks CIP budget, up to $15,000 should be made available for staff to work with the play structure contractor to add an improvement to the amenity at South Tyrol Park. Staff would work with the vendor to determine potential options and take input from the neighborhood as to their preference for the improvement. The update would then be installed in 2024. • OSRC would also like to make the option available to the neighborhood to potentially raise funds and donate to increase the amount from the Park CIP for the new improvement. OSRC does not know if the neighborhood would be interested in the idea of hosting a fundraising event, however, they 2 would like to make this option available. Financial or Budget Considerations $15,000 of excess funds from the 2023 Parks CIP Budget. Adult Use Cannabis Regulation Prepared By Maria Cisneros, City Attorney Summary During the 2023 legislative session, the Minnesota legislature passed a law legalizing adult use cannabis in Minnesota. The new law legalizes the possession, use, manufacturing, and sale of certain cannabis products within the state. The law created the Office of Cannabis Management (the "OCM") to regulate the full range of cannabis activities in Minnesota, including the adult use cannabis market, the state’s medical cannabis program, and the lower-potency hemp edibles market. Under this regulatory scheme, the OCM will create and enforce statewide rules in areas such as: product labeling and packaging business licensing plant cultivation product testing pesticide and fertilizer use energy and water usage cannabis product disposal OCM response to municipal complaints The new cannabis law is broad and complex. This memorandum is not a comprehensive summary of the legislation, nor does it discuss every issue the City must respond to as a result of the legislation. Rather, it is intended to provide a summary of the issues over which the Council may choose to exercise control. New issues may arise as the legislation is implemented and the OCM issues further regulation. The City Attorney will continue to monitor legal developments and provide relevant updates to the Council and City departments. Retail Sales Under the new law, cannabis products and hemp derived consumer products may only be sold in a business with a license issued by the OCM. The regulatory framework will take time to develop and will require input from communities throughout the state. Therefore, retail sales of authorized cannabis products are not expected to begin until the first quarter of 2025. While cities may not require additional licenses to sell cannabis products, the licensing processes requires the OCM to consult with cities in which a cannabis business will be located. The OCM will forward applications to 4 the City to certify whether the proposed cannabis business complies with the City's local zoning ordinance and, if applicable, whether the proposed business complies with the state fire and building code. The OCM may not issue a license to a cannabis business that does not meet local zoning and land use laws. In addition, upon receipt of an application for a cannabis license, the OCM will contact the City and allow 30 days to provide input on the application. This is the City’s opportunity to provide the OCM any additional information the City believes is relevant to the OCM’s decision on whether to issue a license, including but not limited to identifying concerns about the proposed location of a cannabis business, or sharing public information about the applicant. Before a cannabis business begins making retails sales, it must register with the City. The City has the option to delegate its registration authority to the County. City staff recently met with staff from Hennepin County Public Health to discuss this option. Staff does not recommend delegating this authority to the County. It is in the City's interest to retain the ability to provide input to the OCM regarding potential licensees and to retain control over interpretation of its zoning ordinances. The City Attorney, City Manager, and Community Development Director will work together to create a process to handle registration requests. Additionally, Cities are required to conduct compliance checks on retail cannabis businesses. The OCM will develop standardized forms and procedures for these compliance checks. The City Attorney will work with Police leadership to implement a retail sales compliance check program. Finally, the new law allows the City to consider limiting the number of retail establishments in the City. A city that issues cannabis retailer registrations may, by ordinance, limit the number of licensed cannabis retailers to no fewer than one registration for every 12,500 residents. In addition, if a county has one active registration for every 12,500 residents, a city within the county is not obligated to register any additional cannabis businesses. If the Council wishes to pursue limiting the number of cannabis retailers, staff recommends a robust process to study the impacts of a limitation, including but not limited to the potential loss of opportunity for business owners. This is especially relevant in light of the overlap between the Council's equity goals and the law's social equity goals, including creating opportunities for social equity entreprenuers. See Minn. Stat. § 342.17 (stating that social equity applicants include people who were convicted of possessing or selling marijuana, family members of someone who was convicted of a marijuana offense, veterans or active military who lost honorable status due to a marijuana offense, residents of neighborhoods that "experienced a disproportionately large amount of cannabis enforcement," and farmers from underrepresented communities). Consideration of a limitation would require a team of staff members to study the options and impacts, collect input from the community, and develop a proposal for Council consideration. Such a project would require input from several City departments and is not included in any existing workplans or budgets. If the Council wishes to pursue this option, staff will require additional resources or direction about reprioritizing existing goals. Tax A tax equal to 10% of gross receipts from retail sales of taxable cannabis products will be imposed on any taxable cannabis product retailer that sells cannabis products to customers. The state sales tax and local sales taxes apply to cannabis and hemp-derived cannabinoid products. Revenues from the retail 5 sales of cannabis products will be divided, with 80% going to the state's general fund and 20% to the local government cannabis aid account. Cities will receive 50% of the amount certified to the local government cannabis aid account. Cities will receive a distribution proportional to the number of cannabis businesses located in the city as compared to the number of cannabis businesses in all cities. Therefore, if the City choses to limit the number of cannabis retailers permitted in the City, the City will receive less tax revenue both from the state and from the local sales tax, should it be approved by voters in the current election. Lower Potency THC Regulation Seltzers, gummies and other consumable products made using up to 5mg of hemp-derived THC are currently available at retailers and restaurants in Golden Valley and remain legal under the new regulatory scheme. Regulation of these products will move to the Minnesota Department of Health temporarily, and then transfer to the OCM on March 1, 2025. The City currently has licensing and zoning ordinances applicable to the sale of lower-potency hemp-derived THC products. In accordance with the regulatory changes, the City's licensing ordinance must be repealed before the OCM begins issuing licenses. Staff recommends repealing the ordinance before the end of 2023 because (1) under the new law, all businesses selling these products to consumers were required to register with the Minnesota Department of Health by October 1, 2023; (2) the current licensing scheme will become defunct as soon as the OCM begins issuing licenses; and (3) eliminating the City license requirement will lessen confusion and cost and eliminate duplication for retailers preparing to comply with the new law, thereby reducing barriers. Beginning in 2025, licensing of all THC products will be handled by the state. Zoning Under City Code, section 113-92(e)(1), establishments that sell THC products must be located at least 500 feet from all youth-oriented facilities. Youth oriented facility means a school, park, athletic field, or playground. This requirement mirrors the zoning requirements applicable to tobacco retail sales and was enacted after several rounds of community engagement and consideration by the Planning Commission and City Council last year. The zoning ordinance may remain in place, or the Council may chose to reconsider it in light of the changes related to retail sales. It is staff's opinion that the current requirements are sufficient and do not need to be revisited. Public Use City Code, section 14-21 already prohibits smoking and vaping cannabis products in public places and places of work, within 25 feet of public places and places of work, within 25 feet of outdoor dining areas, and in public parks and recreation facilities. Staff does not recommend adopting any additional regulations regarding public use of cannabis at this time. Financial or Budget Considerations Compliance with the new statewide requirements will require additional staff time to process registrations, make zoning determinations, enforce regulations and conduct compliance checks. The cost of these responsibilities can be covered by fees. Additionally, permitting cannabis retailers to operate in the City would allow the City to receive a tax revenue. By fiscal year 2027, the Minnesota Department of Revenue estimates that recreational marijuana sales could generate roughly $21.5 million for local governments. The department estimates state and local governments could take in more than $300 million in tax revenue from fiscal year 2024 to 2027. Legal Considerations 6 See summary section of this memorandum. Equity Considerations If the City Council directs staff to pursue any of the regulatory options outlined herein, a thorough equity review will be included in the process and decision making. Recommended Action Staff is available to answer any question from the Council regarding cannabis regulation and requests Council guidance on the following questions: 1. Does the Council support repealing the existing THC licensing ordinance prior to 2025? 2. Does the Council support leaving existing zoning requirements applicable to Cannabis retail sales in tact? 3.
