23-109 (12-19) Suspending THC Licensing Requirements in City Code, Section XIXRESOLUTION NO. 23-109 A RESOLUTION SUSPENDING THC LICENSING REQUIREMENTS IN CITY CODE, ARTICLE XIX WHEREAS, on August 16, 2022, the City Council approved Ordinance No. 741 establishing licensing requirements for retailers wishing to sell cannabis and tetrahydrocannabinol (THC) products within the City limits; and WHEREAS, during the 2023 legislative session, the Minnesota Legislature passed a new law legalizing adult use of cannabis, establishing the State Office of Cannabis Management (“OCM”), and creating a statewide licensing scheme; and WHEREAS, at its October 10, 2023, work session, the City Council directed staff to modify City Code Article XIX to align with state law in the area of cannabis regulation; and WHEREAS, the OCM has not yet issued statewide regulations relating to cannabis licensing and the City wishes to wait for additional guidance from the OCM prior to approving amendments to the City Code; and WHEREAS, for reasons of efficiency and fairness, the City wishes to temporarily suspend its requirement that THC product retailers obtain a license to operate within the City. NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF GOLDEN VALLEY, MINNESOTA that this Council directs staff to suspend enforcement of the licensing requirements contained in City Code Article XIX until the earlier of the date the OMC begins issuing lower-potency hemp edible retailer licenses or the City Council adopts an ordinance amending or repealing City Code Article XIX. BE IT FURTHER RESOLVED, that all zoning regulations applicable to THC and cannabis retail sales in the City remain in effect.
