Housing Improvement Area (HIA) Policy for the City of Golden Valley Prepared By Christine Costello, Housing & Economic Development Manager Summary In 2023 the Housing and Redevelopment Authority (HRA) work plan, a housing strategies to be considered for implementation is a Housing Improvement Area (HIA) policy. The intent of an HIA policy allows for the renovation of older common interest communities within Golden Valley. An HIA allows these communities with an association expanded rehabilitation options for their community. Those commonly interested in an HIA are townhomes and condominiums, but manufactured home parks can also be included; though none are located within Golden Valley. Recently City staff received an inquiry from a local condominium association about the potential interest in establishing an HIA. Though interest was expressed from one condominium association the proposed policy would be available for consideration citywide to all townhome and condominium associations who met the goals and criteria of the proposed HIA policy. Generally, HIAs are a tool that cities can utilize to financially facilitate general improvements to townhomes and/or condominiums upon receiving a majority of the association’s approval and support. It can often be more difficult for buildings or structures (townhomes and condominiums) under shared ownership to obtain financing for improvements, particularly for condominiums as the individual units often cannot be counted as sufficient collateral when securing a loan from a bank. Through an HIA, cities can act as the initial funding source, through general obligation bonds, for the improvements, which are then paid back over the term of the HIA through a special assessment. As part of the evaluation criteria a townhome or condominium association will have to provide evidence that they have explored other funding sources and that an HIA was a last resort for financing. HIA financing is structured so that it is paid in the shortest term possible while remaining affordable for the association members. It is important to note that bonding for HIAs does not impact the City’s bond rating. Legal Considerations The attached HIA policy has been reviewed by legal counsel to ensure its compliance with State Statute. In addition, the policy was formatted in the City's new policy template to allow for easy review and access in the future. 2 Equity Considerations The HIA policy would assist in preserving and promoting economically diverse housing options in our community by maintaining quality housing stock in Golden Valley for households with a variety of income levels, ages, and sizes. Purpose & Scope: This Housing Improvement Area Policy (this “Policy”) establishes the condi�ons under which HIAs may be approved by the Golden Valley City Council and provides a framework within which requests for the establishment of HIAs will be considered. Defini�ons: • Associa�on means a homeowners associa�on or similar en�ty. • Blight or Blighted Area has the meaning given to it in Minn. Stat. § 469.002, as may be amended from �me to �me. • Enabling Ordinance means the ordinance adopted by the City Council establishing the Housing Improvement Area. • Housing Improvement Area (“HIA”) means a defined area within the city where housing improvements are made or constructed and the costs of the improvements are paid in whole or in part from fees imposed within the area. • Housing improvements has the meaning given in the city's enabling ordinance. Housing improvements may include improvements to common elements of a condominium or other common interest community or to a manufactured home park. • Housing Unit means real property and improvements thereon consis�ng of a one-dwelling unit, or an apartment or unit as described in chapter 515, 515A, or 515B, respec�vely, or a manufactured home in a manufactured home park that is occupied by a person or family for use as a residence. • Naturally Occurring Affordable Housing (NOAH) means exis�ng owner-occupied or rental residen�al housing (a) where at least 20% of the units are affordable to 60% AMI; (b) that is classified in the Class B or C real estate categories; or (c) was constructed between 1940 and 1990. Authority Pursuant to Minnesota Statutes, Sec�ons 428A.11 to 428A.21, the City of Golden Valley (“City”) is authorized to establish HIAs within its corporate limits. Within an HIA the City may lend funds to an Associa�on for the purpose of funding the cost of improvements made to common elements of their property(s). The City may lend funds to the Associa�on from 4 either available City cash or proceeds from the City’s issuance of taxable bonds. Loan repayment is accomplished through the imposi�on of HIA fees on the owners of units included in the HIA. It is the judgement of the Council that HIAs shall be created on a selec�ve basis. The City will consider the establishment of a HIA only when the applicant can demonstrate a benefit to the public and only on a last resort basis, when the Associa�on is unable to obtain other financing for needed repairs or improvements. The Council considers the crea�on of a HIA to be a privilege, not a right. Although approval for another HIA may have been granted previously by the City for a similar project, the Council is not bound to approve subsequent requests based on earlier approvals. Each applica�on will be considered separately based on the criteria in this Policy and the City’s financial posi�on. II. HIA Goals and Eligible Uses The City will consider using HIA financing to assist private property owners only in those circumstances in which the proposed private project addresses one or more of the following goals: A. To promote neighborhood stability and revitaliza�on removal or remedia�on of blight or the upgrading of the exis�ng Housing Units in the City. B. HIA Financing shall not be used to remove, displace or disenfranchise communi�es, including, but not limited to communi�es of color, low socio-economic status, immigrant, and those at the intersec�on of these or similar iden��es. C. To correct housing or building code viola�ons. D. To maintain or obtain FHA mortgage eligibility for an Associa�on within the designated HIA. E. To increase or prevent the loss of the tax base of the City in order to ensure the long-term ability of the City to provide adequate services for its resident. F. To preserve Naturally Occurring Affordable Housing (NOAH). G. To preserve a variety of housing styles and values within the community. H. To stabilize or increase the number of owner-occupied Housing Units within a neighborhood or associa�on. I. To meet other public policy goals of the City Council as adopted from �me to �me, including but not limited to the promo�on of quality urban design, quality architectural design, energy efficiency or conserva�on, or decreasing the capital or opera�ng costs of the City. III. Evalua�on Criteria The City will only consider establishing a HIA if all of the following criteria are met: • The project is compliant with the City’s Comprehensive Plan, zoning ordinances, City code and state and federal laws, regula�ons and policies. • The project meets one or more of the HIA goals listed in sec�on II herein. • The HIA financing complies with all applicable City financial policies. • The HIA funds will not provide 100% of the funding for the Associa�on’s long range replacement schedule and the Associa�on is also contribu�ng its own current and future funds to the project. • The association must have a third party conduct a facility needs assessment to determine and prioritize the scope of improvements. The association may be required to make changes to its bylaws to ensure adequate enforcement authority to protect common area improvements financed through the HIA from substandard building components for which the homeowner is responsible. • The association must adopt a financial plan that has been prepared by an independent third party with designation as a Community Associations Institute (“CAI”) certified reserve specialist which must conform to CAI reserve study standards and comply with Minnesota Statutes 515B.3-114 through 515B.3-1141. 5 • The Associa�on has explored all other funding sources and has provided evidence that none are feasible. HIA financing is last resort financing and shall not be provided to projects unless no other financing op�ons are available. The Associa�on must provide at least the following to show that no other financing op�ons are available: o Verifica�on that the Associa�on has completed an assessment showing that no other financing op�ons are available; and o Leters from at least two private lenders confirming a lack of financing op�ons. • The term of any bonds or other debt incurred for the HIA mature in 20 years or less. The term shall be determined by the City in its sole discre�on. • The HIA financing is structured so that it is paid in the shortest term possible while remaining affordable for Associa�on members. • The Associa�on enters into an agreement with the City (the “Development Agreement”) that requires, at a minimum, the following terms: o Establishment of a reserve fund o Staffing requirements o Annual repor�ng and financial audi�ng requirements with regular updates to the financial plan not less than once every five years o Condi�ons of disbursement o Required dues increases o No�fica�on to new owners of levied fees, including the individuals that purchase property a�er the ini�al development o Limita�ons on prepayment of fees, if any o Minimum number of bids to be submited for the project work o Development and construc�on plans rela�ng to the project o Hiring of a construc�on manager and/or owner’s representa�ve to monitor performance of the general contractor • The Associa�on provides the City adequate financial guarantees to ensure the repayment of the HIA financing and its performance of all its obliga�ons in the Development Agreement. Financial guarantees may include, but are not limited to, the pledge of the Associa�on’s assets, including its reserves, opera�ng funds or property. • The project, including the use of HIA financing, is supported by a majority of the owners within the Associa�on. The Associa�on shall provide official verifica�on of the results of a vote of the Associa�on’s membership. • The Associa�on has adopted a financial plan that provides sufficient financing for the con�nued maintenance and opera�on of the Associa�on’s common elements and a long-range plan to complete and finance capital improvements therein. Said financial plan shall not rely on HIA financing. • All improvements financed by the HIA are solely to the Associa�on’s common elements, as that term is defined in Minnesota Statutes, Chapter 515B, and are primarily exterior improvements and other improvements integral to the habitability of the building, for example, boilers, HVAC, structural improvements and the like. All improvements must be permanent in nature and the scope of improvements must be determined and documented by a facility needs assessment conducted by a third party. • The project must: o Provide significant improvement to the HIA; o Comply with all applicable federal, state and local laws, regula�ons, and policies; o Provide a significant increase to the tax base or prevent the loss of tax base; and o Not be of poor quality. • The financial structure of the project must receive a favorable review by the City’s Finance Director, or their designee, the City’s Municipal Advisor, and the City’s Bond Counsel. The review must include a review of the performance and level of outstanding debt of previous HIAs. • The association shall provide adequate financial guarantees to ensure repayment of the financing and the performance of the administrative requirements of the development agreement. Financial guarantees may 6 include but are not limited to the pledge of the homeowner association’s assets including reserves, operating funds and/or property. • The Associa�on must be current on all charges, fees, taxes, special assessments and other debts and obliga�ons payable to the City. IV. Other Provisions • The Associa�on shall submit the required applica�on, along with all required suppor�ng documenta�on, including a pe��on signed by at least 60% of the property owners of the Associa�on, prior to any City review. A housing improvement area (HIA) is a defined area in a city in which housing improvements in condominium or townhome complexes may be financed with the assistance of the city, or the city’s economic development authority (EDA) or housing and redevelopment authority (HRA). Prior to 1996, cities needed special legislation to establish an HIA. In 1996, cities were granted the authority under general law. The general law, codified in Minnesota Statutes, sections 428A.11 to 428A.21, sunsets June 30, 2028. What improvements can be made in an HIA? The improvements that can be made under this law include improvements to the common elements in a condominium complex or townhome development. Examples include roofing, siding, landscaping, roadways, and walkways. How is an HIA established? At property owners’ request. An HIA can only be established at the request (petition) of at least 50 percent of the owners of the housing units in the proposed area. If the petition is filed, then the city prepares an ordinance that: describes the area specifically; states the basis for imposing fees and the number of years the fees will be imposed; makes a finding that without the HIA, the proposed improvements could not be made; and specifies if the city, the EDA, or HRA will implement the ordinance. In addition, the city must fully disclose the public expenditures and financing for the projects, and determine whether the association or the implementing agency will contract for the work. Notice, public hearing, ordinance. Before adopting the ordinance, the city must hold a public hearing at which the proposed improvements, affected housing units, and the exempt units are listed. Potentially affected property owners may testify at the hearing. Objection and appeal. Prior to the adoption of the ordinance or at the hearing, a property owner may file a written objection with the city clerk to the imposition of a fee for the reason that the property will not benefit from the improvements. The city must make a determination regarding the exclusion of the property in the HIA within 60 days. Within 30 days after that determination is made, a property owner may appeal the city’s decision to the district court. The ordinance may be adopted within six months after the conclusion of the public hearing. If 45 percent or more of the affected residents file an objection, the HIA is not established. 9 Housing Improvement Areas How are the improvements financed? The city may finance the housing improvements by: 1)advancing funds available to the city and then recovering the costs by charging the property owners fees; or 2)issuing bonds and then imposing fees to repay the bonds. The bonds are not included in the city’s net debt and no election is required for their issuance. In addition to adopting the ordinance establishing an HIA, the city must adopt a resolution imposing the fees, and must provide public notice and hold a public hearing on the proposed resolution. Within six months of the conclusion of the public hearing, the city may adopt the resolution. Fees can be imposed on the basis of the tax capacity (value) of the housing unit, total square footage of the housing unit, or a method determined by the city and specified in the resolution. Before a city uses an alternative method to set fees, it must make a finding that the alternative basis is more fair and reasonable. The city, HRA, or EDA may collect the fees in the same manner as provided for the collection of property taxes. The due dates, penalties, and interest applicable to property taxes apply to fees collected under this authority. What plans or reports are required? Before the city imposes and collects the fee, the condominium or townhome association must develop a long-term plan to maintain the complex. The plan must address operations, maintenance, and necessary capital improvements of the common elements. It must identify financing for the projects. This tax aims to fund the Local Affordable Housing Aid (LAHA) program, designed to foster affordable housing development and preservation. LAHA distributes proceeds to metro cities in two equal installments annually, and began in July, 2024. LAHA aid will be disbursed to cities based on their share of metro cost-burdened households. Golden Valley's share for 2024 is 0.83%, resulting in a projected allocation of $137,095.15. State projections for 2025 could rise slightly since the tax was only collected for a portion of 2023. Qualified Uses Funds must be utilized by the end of the fourth year after receipt, or transferred to a local housing trust fund for future qualifying projects. Eligible projects include emergency rental assistance, support for nonprofit housing providers, and financing for homeownership or rental housing developments meeting income criteria. Additionally, funding can be allocated to accessible multi-unit building construction or rehabilitation. Several ongoing initiatives in Golden Valley align with LAHA criteria, including the HOPE program, support for PRISM and the West Hennepin Affordable Housing Trust (WHAHLT). Recommendation Staff recommends leveraging the first year of LAHA funds to expedite and enhance existing projects such as the HOPE program, ensuring utilization within the allocated time frame. Staff suggests priority be given to help offset development costs of the HOPE program. Concentrating on existing projects in the short term would also give staff the opportunity to consider potential development of new programs aligned with future Council priorities. Any programming should also consider that future legislatures may discontinue this sales tax. Adult Use Cannabis Regulation Prepared By Emily Goellner, Community & Economic Development Director Maria Cisneros, City Attorney Jacquelyn Kramer, Senior Planner Summary During the 2023 legislative session, the Minnesota legislature passed a law legalizing adult use cannabis in Minnesota. The law legalizes and decriminalizes the possession, use, manufacturing, and sale of certain cannabis products within the state. The law created the Office of Cannabis Management (the "OCM") to regulate the full range of cannabis activities in Minnesota, including the adult use cannabis market, the state’s medical cannabis program, and the lower-potency hemp edibles market. Under this regulatory framework, the City's regulatory authority and responsibilities are limited. On October 10, 2023, the City Council discussed this topic and directed staff to draft a Cannabis Registration Ordinance and monitor developments in cannabis legislation on the state level. The following proposals are based on this direction. According to the OCM, cities can expect retail sales of cannabis products to begin in first quarter 2025. Staff looks forward to discussion with Council prior to the proposed ordinances advancing to the Planning Commission and City Council for official action in November so that staff can begin implementation and be ready to work with the business community in 2025. Retail Sales Registration Ordinance Under the new law, cannabis products and hemp derived consumer products may only be sold in a business with a license issued by the OCM. The licensing process requires the OCM to consult with cities in which a cannabis business will be located. The OCM will forward applications to the City to certify whether the proposed cannabis business complies with the City's local zoning ordinance and, if applicable, whether the proposed business complies with the state fire and building code. The OCM may not issue a license to a cannabis business that does not meet local zoning and land use laws. The proposed registration ordinance is designed to comply with state law and the OCM's draft regulations. The City Manager, City Attorney, and Community & Economic Development Director will work together to create standard operating procedures to handle registration requests and temporary 12 event permit requests. Additionally, cities are required to conduct compliance checks on retail cannabis businesses. The OCM is developing standardized forms and procedures for these compliance checks. The City Attorney will work with police leadership to implement a retail sales compliance check program. Zoning Minnesota’s cannabis law gives cities the authority to adopt zoning ordinances relating to the operation of state-licensed cannabis businesses and lower-potency hemp edible retail businesses. Planning staff are drafting a zoning ordinance amendment based on state statutes and guidance from the OCM. In general, cannabis uses will be permitted wherever the corresponding non-cannabis uses are currently allowed. The land use definition section will contain new uses as well as revisions to existing uses to incorporate cannabis businesses. For example, cannabis retail will fall under the general retail land use. The land use summary table will be revised to permit cannabis uses in the same zoning districts and with the same conditions that corresponding non-cannabis businesses currently have. For example, cannabis retail would be a permitted use wherever general retail is a permitted use. Planning staff have scheduled the informal public hearing with the Planning Commission on November 13 and the formal public hearing with the City Council on December 3. Financial or Budget Considerations Compliance with the new statewide requirements will require additional staff time to process registrations, make zoning determinations, enforce regulations, and conduct compliance checks. The cost of these responsibilities can be covered by fees. Staff proposes the following fees be imposed, which are the highest allowed by statute: Cannabis Registration Fee (Initial): lesser of $500 or 1/2 of the amount of the applicable initial license fee paid to the state Cannabis Registration Fee (Renewal): lesser of $1,000 or 1/2 of the amount of the applicable renewal license fee paid to the state If cannabis businesses are located in Golden Valley, the City will also receive tax revenue from cannabis sales, which will help defray costs. Legal Considerations See summary section of this memorandum. Equity Considerations If the City Council directs staff to pursue any of the regulatory options outlined herein, a thorough equity review will be included in the process and decision making. Findings & Purpose The purpose of this ordinance is to implement the provisions of Minnesota Statutes, chapter 342, which authorizes the City of Golden Valley to protect the public health, safety, and welfare of Golden Valley community members by regulating cannabis businesses within the boundaries of the City. The City Council of the City of Golden Valley finds and concludes that these regulations are appropriate, lawful, and necessary to protect the health, safety, and welfare of the Golden Valley community and that these local regulations are in the public interest and for the public good. b. Authority The City has the authority to adopt this ordinance pursuant to: i.Minnesota Statutes, section 342.13(c), granting local units of government the authority to adopt reasonable time, place, and manner restrictions relating to the operation of cannabis businesses and hemp businesses. ii.Minnesota Statutes, section 342.22, regulating local registration and enforcement requirements applicable to state-licensed cannabis businesses and lower-potency hemp edible businesses. iii.Minnesota Statutes, section 462.357, granting local units of government the authority to adopt zoning ordinances relating to the operation of state-licensed cannabis businesses and lower-potency hemp edible retail businesses. c. Severability If any section of provision of this ordinance is held invalid, such invalidity will not affect other sections or provisions that can be given force and effect without the invalidated section or provision. d. Enforcement The City Manager, or their designee, shall be responsible for the administration and enforcement of this ordinance. Any violation of the provisions of this ordinance or failure to comply with any of its requirements shall constitute a misdemeanor and is punishable as defined by law. Violations of this ordinance can occur regardless of whether or not a permit or registration is required for a regulated activity. e. Definitions Unless otherwise noted herein, the words and phrases contained in Minnesota Statutes, section 342.01, et. seq (the “Act”) or the rules promulgated by the Office of Cannabis Management pursuant to the Act, shall have the meanings ascribed therein and as may be amended from time to time. For purposes of this ordinance, the words below shall have the following meanings: 15 i.Cannabis Business: Any of the following licensed by OCM: 1. Cannabis microbusiness 2. Cannabis mezzobusiness 3. Cannabis cultivator 4. Cannabis manufacturer 5. Cannabis retailer 6. Cannabis wholesaler 7. Cannabis transporter 8. Cannabis testing facility 9. Cannabis event organizer 10. Medical cannabis combination business ii.Cannabis Retail Business: A retail location of a cannabis microbusiness, cannabis mezzobusiness, cannabis retailer, medical cannabis combination business, or lower- potency hemp edible retailer. iii.Cannabis Retailer: Any person, partnership, firm, corporation, or association, whether foreign or domestic, that offers cannabis products for sale to a consumer and does not offer any cannabis products in any form for the purpose of resale. iv.Office of Cannabis Management or OCM: The Minnesota Office of Cannabis Management. v.Preliminary License Approval: A pre-approval for a cannabis business license issued by OCM for an applicant that qualifies under Minnesota Statutes, section 342.17. vi.Retail Registration: An approved registration issued by the City to a state-licensed cannabis retail business. vii.State License: A license issued by OCM to a cannabis retail business. II.Registration of Cannabis Businesses a. Registration Required No individual or entity may operate a state-licensed cannabis retail business within the City without first obtaining a retail registration from the City. b. Application & Fees The City shall issue or renew a registration to a state-licensed cannabis retail business that adheres to the requirements of Minnesota Statutes, section 342.22. i.Application Requirements & Submittal An application for a retail registration to sell licensed products shall be made on a form provided by the City. The application shall contain the full name of the applicant and the property owner, the address, email address, and telephone number of the applicant, the address and parcel ID for the property for which the retail registration is sought, certification that the applicant complies with the requirements of local ordinances, and any additional information the City deems necessary. ii.Fees No registration shall be issued under this section until the appropriate permit fee shall be paid in full. All fees under this chapter, including fees for initial, annual, temporary, and renewal registrations, shall be fixed and determined by the City 16 Council in the City's Fee Schedule and may be amended from time to time. Such fees shall not exceed the limits provided in Minnesota Statutes, chapter 342.All application fees shall be non-refundable once processed. iii.Approval & Grounds for Denial Pursuant to Minnesota Statutes, chapter 342, within 30 days of receipt of a request for retail registration from OCM, the City shall certify in the manner required by OCM whether a proposed cannabis retail business complies with local zoning ordinances and, if applicable, the state fire code and building code. Prior to certification of compliance to the state or issuance of a retail registration, the City may conduct a preliminary compliance check to ensure compliance with local ordinances. The City may deny a request for retail registration if: 1. The applicant does not comply with local regulations 2. The applicant does not comply with the state building code 3. The applicant does not comply with the state fire code 4. The applicant fails to pay the applicable fee 5. There are past-due fees or taxes associated with the property on which the cannabis retail business is or will be located c. Location Change A state-licensed cannabis retail business shall be required to submit a new application for registration if it seeks to move to a new location still within the legal boundaries of the City. d. Suspension The City may suspend a cannabis business’s registration if the City determines the business has violated local regulations or the business poses an immediate threat to the health and safety of the public. The City shall immediately notify the cannabis business and the OCM in writing of the grounds for suspension. A cannabis retail business registration may suspended be for up to 30 calendar days, unless OCM suspends the license for a longer period, in which case the registration may be suspended for the same period as the license. The business may not make sales to customers if its registration is suspended. The City may reinstate a registration if it determines that the violations have been resolved. The City shall reinstate a registration if OCM determines that the violations have been resolved. e.Compliance Checks All premises licensed under this subdivision shall be open to inspection by the City during regular business hours. From time to time, but at least once each calendar year, the City shall conduct compliance checks in accordance with the requirements of Minnesota Statutes, section 342.22, subd. 4 and all applicable OCM regulations. f.Civil Penalties Subject to Minnesota Statutes, section 342.22, subd 5(e), the City may impose a civil penalty as specified in the City’s Fee Schedule, for registration violations, not to exceed $2,000. III.Temporary Cannabis Events 17 a. Permit Required No individual or entity may operate a temporary cannabis event within the City without first obtaining a permit from the City. b. Application & Fees i.Application Requirements & Submittal An application for a temporary cannabis event permit shall be made on a form provided by the City not less than 45 days before the first date of the proposed event. The application shall contain the full name of the applicant and the property owner, the address, email address, and telephone number of the applicant, the address and parcel ID for the property for which the temporary event is sought, certification that the event complies with the requirements of local ordinances, and any additional information the City deems necessary. ii.Fees No permit shall be issued under this section until the appropriate permit fee shall be paid in full. The fee for a permit under this section shall be established by the City Council and adopted in the City fee schedule and may be amended from time to time. All application fees shall be non-refundable once processed. iii.Approval & Grounds for Denial The application shall meet all the requirements of this section, state law, and City Code, section 26-9 (Special Events). The City may deny a request for Retail Registration if: 1. The applicant does not comply with local, state or federal regulations 2. The applicant does not comply with the state building code 3. The applicant does not comply with the state fire code 4. The applicant fails to pay the applicable fee 5. There are past-due fees or taxes associated with the property on which the temporary cannabis event will be located An application that meets the requirements of this of this section shall be approved.
