Approved Unanimously. 5. Approval of Minutes 5.A. PEACE Meeting Minutes 4.11.24 MOTION to amend minutes to include attendance of Commissioner Parkes. MOTION to approve minutes for 4.11.24 as amended by Commissioner Frisch, 2nd by Commissioner Crosby. Approved unanimously. 6. Discussion/Action Items a. Flock LPR Camera Input Chair Gladney acknowledged the work of all commissioners, but especially Vice Chair Cisneros for gathering all of the commission’s perspective and crafting the document to share the PEACE perspective on Flock LPR cameras. Chair Gladney asked the commission to provide input if they’d like to. Williams shared that the city appreciates the input and that he will follow up with next steps. b. Data Dashboard Input Staff Liaison Williams read a draft document sent from the Data Subcommittee providing recommendations on a new GVPD Data Dashboard. Commissioner Parkes brought up that in a discussion 3 City of Golden Valley PEACE Commission Meeting May 9, 2024 — 6:30 PM 2 with Chief Green he and the Data subcommittee asked for the dashboard to display complete demographic information. Commissioner Frisch is asking that the dashboard be easily adjustable. Chair Gladney asked that the dashboard include a map displaying where offenses take place. Dr.Raj asked that we include the level of offense associated with a crime. Commissioner Crosby asked the Data subcommittee if they’ve reviewed other city’s dashboards to inform our recommendation. Parkes shared that they reviewed Minneapolis’s dashboard. Parkes shared that police leadership were looking for what data should be shared in the dashboard. Staff Liaison Williams asked if PEACE still wanted the dashboard to include a function where community were able to provide officer recognition or report an officer, giving community the ability to see what areas on a map are having positive and negative interactions with GVPD. Dr.Raj shared that city staff attended a “Understanding and Responding to Mass Incarceration” conference where a tool called “Twelve Watch” was shared. Dr.Raj shared that Twelve Watch is an application that allows cities and community to get an officers professional history prior to employment and during an interaction. Dr. Raj shared that it might be a good idea for PEACE to meet with the Twelve Watch staff. Chair Gladney shared that the data subcommittee will refine their input and get back to him to submit input to GVPD. c. Subcommittee Updates Commissioner Frisch shared that the subcommittee has been focused on interviews. Frisch shared that Assistant Chief Perez spoke highly of the PEACE Commission and its contributions to the PD. Commissioner Crosby asked if interviews can take place during the weekend, so more commissioners can participate. Commissioner Glass shared that the community survey is complete and has been reviewed by Dr.Raj and Staff Liaison Williams. Glass also stated that the community engagement subcommittee is planning a listening session for public safety this summer and joint listening session with public safety and other community in the early fall. Frisch asked the group to mindful of planning around Jewish holidays in the fall. Commissioner Glass asked for Williams to share the survey with the commission for more input. Chair Gladney asked if Williams can secure a table for PEACE at Golden Valley Pride festival so that we can share the survey. Frisch recommended that PEACE table at Market in the Valley. Dr.Raj asked if there was a Juneteenth event that PEACE can survey at. Williams shared that he will reach out to Sweet Potato Comfort Pie to see if there is room for collaboration. Council Liaison Harmon shared that there is a Showcase at the trailhead that could be an opportunity. Crosby shared that we need to lock in a location for the next listening session and that we should consider one of the schools in Golden Valley. Crosby also shared that we need to continue to get youth voice. Dr.Raj recommended that we reach out to student councils to recruit because they want to be more engaged. Glass asked if Williams can send a cultural/spiritual holiday and days of recognition calendar. Williams shared that the commission was sent a calendar to fill in with their availability and that the commission needs to mindful of all days of recognition when planning. Staff Liaison Williams shared the Chief provided a brief update on the school resource officer position. Williams stated that the Chief shared that PD is focusing on increasing patrol staffing and that once this need is met PD will focus on the SRO position. Adjournment 8pm 5 May 9,2024 To:Golden Valley Police Department,City Council,and City Manager From:PEACE Commission Re:Flock Camera Systems We have been asked by the City of Golden Valley to consider the community implications of an adoption of Flock Camera Systems by the Golden Valley Police Department.This document reflects the collective research,conversations,work,and commitment of the diverse expertise of PEACE Commissioners.We also requested and reviewed information from Golden Valley Chief of Police including,but not limited to the,“FAQ-GVPD FLOCK LPR,”“GVPD Flock Safety LPR cameras capture license plates and vehicle characteristics”powerpoint and “GVPD Flock Safety Presentation”to make sure we understood the technology from our Police Department’s perspective.The focus of this PEACE Commission inquiry was centered around community impact and the following represents varying input from our Commissioners. Benefits of Flock Camera System use in Golden Valley: ●License plates can be run against law enforcement watch lists for abducted children, stolen cars,and missing people. ●Flock Camera System would only be used for the purpose of ALPR (automatic license plate recognition)and not facial recognition. ●The camera system offers PD resources to monitor a range of community and safety situations. Concerns regarding Flock Camera System use in Golden Valley: ●The Fourth Amendment acts to constitutionally protect individuals and this adoption would be a partnership between private and governmental entities,raising questions about the applicability of the Fourth Amendment to protect our rights of citizens. ●Surveillance Camera Systems are often placed in areas that disproportionately track and target Black and brown community members,perpetuating discriminatory practices.1 ●Flock is a private company,which raises concerns about the lack of transparency/oversight especially in regards to our private data and protection from officers violating data privacy including but not limited to selling it.2 2 Gurman,S.,&Tucker,E.(2023,December 4).AP:Across US,police officers abuse confidential databases.AP News.https://apnews.com/general-news-699236946e3140659fff8a2362e16f43 1 The threat to privacy and civil liberties with Automatic License Plate Readers.ACLU of Oklahoma.(2023,December 21). https://www.acluok.org/en/news/threat-privacy-and-civil-liberties-automatic-license-plate-readers#:~:text=Flock%20m aintains%20the%20system%20is,in%20the%20criminal%20legal%20system. 6 ●Community members can be flagged as “provisionally”suspicious which could move PD to gather more data on people than necessary or appropriate. ●IPVM (Internet Protocol Video Market)research group found that Flock’s systems are not always accurate.3 ●Accuracy issues with ALPR systems such as Flock have led to many national incidents where innocent people have been subject to trauma and harm. ●The overall quality of a public space is impacted when we,the public,are being surveilled. ●Use of Flock Camera Systems ALPR data could be used by law enforcement to alert immigration authorities which could lead to deportations as Golden Valley is not a Sanctuary City under statute.4 ●Flock Camera Systems runs all plates against state police watchlists and the FBI’s primary criminal database,and the National Crime Information Center (NCIC)creating a national database of private citizens’information. ●Community members have concerns about their individual privacy and see Flock Camera Systems as over-policing. ●There is no need to collect data on our comings and goings without consent including the government tracking us as community under no suspicion. ●A license plate is not a person and is only one piece of data. ●There is concern that the camera systems will be placed near or around our residential areas. ●There is no information at this time that demonstrates that benefits of the system outweigh the costs. ●Flock Camera Systems can create a false sense of security,leading to neglect of and potential siphoning of funds for more effective crime prevention measures. ●No clear information on a measurable metric on effectiveness and questions regardings data on how the implementation of this system prevents crime. At this time,the PEACE Commission has generated many concerns that potentially outweigh the potential benefits of the Flock Camera System. If Golden Valley pursues the adoption of Flock Camera Systems after these community benefits and concerns we recommend the following: ●That the Golden Valley Police Department provide their expected benchmark goals 60 days prior to adoption of Flock Camera Systems. ●That the city of Golden Valley commits to a scheduled audit of the cameras one year after the date they are adopted to see if they have met the benchmark goals set forth by Golden Valley PD. 4 Vaughan,J.M.,&Griffith,B.(2024,April 12).Map:Sanctuary cities,counties,and States.CIS.org. https://cis.org/Map-Sanctuary-Cities-Counties-and-States 3 Ipvideomarket.(2021,January 6).Flock Safety Falcon LPR tested.IPVM.https://ipvm.com/reports/flock-lpr 7 ●That the city of Golden Valley commits to dismantling the Flock Camera Systems if Flock Camera Systems are deemed to be ineffective and/or disproportionately harms historically marginalized communities in said audit. ●That the following language be absolutely added by law or as an addendum to Flock contract per recommendations from the ACLU:5 ○“Notwithstanding any provision to the contrary,ALPR photos or data captured by the customer ’s Flock camera,or otherwise provided to or shared with Flock by the customer,or any data generated therefrom,shall be deleted and destroyed by Flock no more than three minutes after such photos or data are first captured by,provided to,or shared with Flock,unless otherwise required by applicable law.” ○“Notwithstanding any provision to the contrary,ALPR photos or data captured by the customer ’s Flock camera,or otherwise sent to or shared with Flock by the customer,or data produced therefrom,shall not be sent to,shared with,or used by or for any other person or entity.” ○“Notwithstanding any provision to the contrary,ALPR photos or data captured by the customer ’s Flock camera,or otherwise sent to or shared with Flock by the customer,or data produced therefrom,may be compared only to hot lists created by the government Agency that provided the ALPR photo or data.” We would like to thank the city of Golden Valley for the directive to provide community voice in this decision making process and we look forward to continued collaboration.
