A regular meeting of the Planning Commission was held at the Golden Valley City Hall,
Council Chambers, 7800 Golden Valley Road, Golden Valley, Minnesota, on Monday,
March 26, 2001. The meeting was called to order by Chair Pentel at 6:00 PM.

Hoffman referred to the section in the guidelines about acting as a private citizen and
that commissioners have to state that they are acting as a private citizen. He asked
about attending neighborhood meetings as a private citizen when speaking at City
Council or other City meetings. Shaffer stated that that would be receiving extra
information that is not public and planning commission members are not suppose to be
looking at individual neighborhoods but rather the whole community.

Rasmussen asked which sections of the guidelines were revised. Mayor Anderson said
the biggest change was the mandatory loss of position if absent so many times.

III. Planning Commission Approval- Amendment to Golden Hills Tax Increment
Financing Plan
Finance Director Don Taylor referred to his memo dated March 19,2001, regarding
expenditures for the "Northwest Project" in the Central Area (Olym' rinting Site) and
the "East Area Project". He stated since the HRA is currently in . ns for the

Qwest Wireless, Applicant
Date: April 4, 2001
This Conditional Use Permit (CUP) application is the first of two on tonight's agenda from Qwest
Wireless. Both applications are proposals to build cellular phone antenna monopoles on privately-
owned property. This first application is to construct a monopole on the property located at 6731
Golden Valley Road, which is owned by the Golden Valley Historical Society.
The Site Location. Attached for your use is a location map that shows the location of the property
Qwest is proposing to lease for their monopole. The subject property is zoned Institutional (1-1). The
Golden Valley Zoning Code does not specifically allow this type of use as either a Permitted or as a
Conditional Use. However, Section 11.46, Subd. 4 (H) states that" such other uses which, in the
opinion of the Council, are reasonably compatible with the uses specifically described in Subdivision
3, above, may be permitted as a Conditional Use in any ofthe four Institutional Zoning Sub-Districts
set forth above". The applicant would like to use this provision to apply for a CUP for this antenna
monopole for this Institutionally-zoned property.
City Staffhas hired a professional engineer, at the expense of the applicant, who is familiar with
monopole design to review this application to see if there is any other location where Qwest could
build a monopole. His report, which recommends approval of this antenna tower location, is attached
for your review. This engineer, Garrett Lysiak, PE, from Owl Engineering, will be present at the
Planning Commission meeting to discuss his findings.
The Antenna Monopole. The Golden Valley Zoning defines these cellular phone antenna monopoles
as "Essential Services - Class II". This definition states:
"Public utility facilities completely enclosed within buildings not to exceed 12 feet in height or
600 square feet in gross floor area; or cellular telephone, radio, or television signal transmission
towers not to exceed 120 feet in height as measured from the ground level to the highest point
of the structures (including antenna), and including necessary equipment completely enclosed
within buildings not to exceed 12 feet in height or 600 square feet in gross floor area".
This definition is basically the only requirement in the City's Zoning Code for cellular phone
monopoles. The applicant has submitted a site plan showing the proposed 85-foot high monopole, .
which will be installed in the rear of the property. The base station accompanying the monopole will
occupy an area of approximately 225 square feet.
Setback/Code Issues. The subject property is zoned Institutional (1-1) and is surrounded on the east
and west by properties zoned Multiple Dwelling (M-I), on the north by property zoned for single-
family residential and Seeman Park, and on the south by the Golden Valley Country Club. To the
southeast is property zoned Industrial. The monopole meets all applicable setbacks, with the exception
of the 50 foot rear yard requirement. According to the site plan, the monopole is only 36 feet from the
rear yard property line. The applicant will be appearing before the Board of Zoning Appeals (BZA)
on April 24th to request a variance for this setback requirement. The monopole meets the height
requirements as defined in the Zoning Code.
Environmental Issues. According to the attached memorandum from the City Engineer, the
applicant would be required to complete and submit a Grading, Drainage and Erosion Control
application prior to the construction of the monopole. In addition, the applicant has submitted a letter
from a landscape architect dated 8/23/00 in which the architect describes the planting design screening
for the monopole.
Factors for Consideration
In approving or denying any CUP, City Code requires that findings be made on ten specified factors. .
Staff evaluation of those factors as they relate to the current proposal are as follows. As you may
suspect, many of these criteria are not applicable to cellular phone monopoles.
1. Demonstrated Need for the Use: The City's standard basis for determining need is that an
applicant has identified a market of the proposed good or service. That criterion has been met in
this case.
2. Consistency with the Comprehensive Plan: The plan identifies the proposed site for long-term
Public Facilities use. Cellular phone monopoles, by conditional use, can be considered for that
land use classification.
3. Effect on Property Values in the Area: Since there are similar property uses in the area,
approval of the CUP will not substantially alter the extent or nature of on-site development or
activity .
4. Effect of any Anticipated Traffic Generation Upon Current Traffic Flow and Con2estion in
the Area: The applicant is not proposing any parking spaces for this monopole.
5. Effect on any Increase in Population: This criteria is not applicable to this application.
6. Increase in Noise Level: At this time, staffhave no reason to expect that noise impacts will
extend outside of the monopole.
7. Any Odor, Dust, Smoke, Gas, or Vibration Caused by the Use: The City Inspection staff has
reviewed the issues concerning this use, and have been satisfied that this use will not cause issues
in these areas. .
8. Any Increase in Flies, Rats, or other Vermin on the Area Caused by the Use: There should be
no increases in these pests, because the proposed monopole is not the sort to attract them.

9. Visual Appearance of the Proposed Structure or Use: The applicant has stated that the
shrubbery and tree screening on the property will hide any negative visual effects.
10. Other Concerns Re~ardin~ the Use: The applicant has attached a letter dated 2/19/01 in which
they state that the monopole will not interfere with any other communication systems.
Recommended Action
Staff recommends that the following conditions be made part of any approval of a Conditional Use
Permit for a cellular phone monopole at 6731 Golden Valley Road. An approved site plan becomes a
part of the CUP approval.

1. The applicant shall provide for co-location of future antennas whenever possible.
2. The use of any portion of a tower for signs other than warning or equipment information signs
is prohibited.
J. If the monopole is abandoned or unused, it, along with any associated facilities, shall be
removed within twelve (12) months of the cessation of operations at the site unless a time
extension is approved by the City Council.
4. The monopole shall not be illuminated by artificial means and shall not display strobe lights
unless such lighting is specifically required by the Federal Aviation Administration or other
Federal or State authority.
The recommendations of City Engineer Jeff Oliver as found in his memo dated March 26,2001
become a part of this approval.
The site plan submitted by the applicant and dated 8/24/00 shall be made a part of this
approved permit.
All other applicable local, state, and federal requirements shall be met.
Failure to comply with one or more ofthe above conditions shall be grounds for revocation of
the conditional use permit.

Per your request, the following is a description of the planting design
screening of Qwest Wireless equipment to be located at 6731 Golden
Valley Rd. in Golden Valley, MN. Please refer to the Zoning Drawings
for MIN-349, revision 1.
The equipment sits under a well shaded canopy of middle aged Boxelder
trees which range in size from approximately 11 to 15 inches diameter at
breast height (dbh). The understory is composed of small Buckthorn
trees, Virginia Creeper vine, and herbaceous weeds. Per the landowners
request, all plant materials added to this site will be broad leafed
shrubs.
A meandering line of varied height shrubs have been positioned to fully
screen the equipment in this natural setting. All plant materials being
added to the site are shade tolerant, broad leafed, and native to
Minnesota.
In reviewing the site, Mike Goodwin and myself felt it would be
necessary to remove a m~n~mum of two severely leaning Boxelder trees
(approximately 12 and 15 inch dbh) to protect the equipment and
monopole.

To alleviate the lack of coverage in both of these areas, Qwest Wireless has located and
entered into option and lease agreements with the following property owners:

With the change to the existing ordinance that would allow for Essential Services, class II
in I-I Institutional Zoning districts and 1-3 Institutional Zoning districts, QwestWireless
would request the approval for the placement of the following equipment:
CHESTER BIRD AMERICAN LEGION
This project consists of a replacement of an existing 35' wood pole parking light with a
70' tapered metal pole. The existing parking light will be replaced at the same height on-
the new pole. The base station will be located adjacent to the existing shed, behind a
berm. The total square footage of the equipment space will be approximately 225 square
feet. There will be no parking spaces taken. Trees to the south and east, and the building
to the north will screen the equipment. Highway 100 borders on the west. The
replacement pole will be approximately 160 feet set back from the nearest property line.
The closest residential structures are approximately 1100 feet to the east, and 1100 feet to
the southwest.

The site is currently zoned 1-3.
We looked at the following sites in searching for the most f~asible location:
1. Breck School - Zoned Institutional.
2. Boy Scout Office Building - RF rejected due to terrain
3. Small Office Building - Zoned Business and Professional. Rejected due to proximity
to residential use.
GOLDEN V ALLEY HISTORICAL SOCIETY
This project consists of an 85' communicator pole installed in a wooded area at the rear
of the parcel. The base station will be located adjacent to the communicator pole and will
occupy an area of approximately 225 square feet. There will be no parking spaces taken.
Existing trees with an average height of 60 feet will screen the equipment to the south
and east. The communicator pole will be set back from the south and east property lines
by approximately 40 feet and from the westerly property line by approximately 100 feet.
The closest residential structures are to the west, approximately 120' (multiple dwelling
zoned M-I) and to the east, approximately 350 feet (multiple dwelling zoned M-l).

We looked at the following sites in searching for the most feasible location:

1. NSP power poles to the south - Turned down due to c.onstruction and OSHA issues.
2. Golden Valley Country Club - Rejected our use.
3. United Health Care - Rejected our use. They have plans for a parking ramp.
4. Tenant Company - Rejected our use. They have plans for expansion of their
property.
5. Minnegasco Property - Rejected by RF as it is too far east.
6. Golden Valley Business Center - Rejected by RF as it is too far east.
I have attached two coverage maps that show the existing coverage and coverage after
these sites are constructed. The maps show that the gaps in existing coverage will be
cured with the inclusion of these two sites.

Qwest Wireless operates a Personal Communications System (PCS) in the Minneapolis~St. Paul
greater metropolitan area. When choosing an appropriate location for a cell site, we try to meet both
the coverage and capacity objectives we want to achieve in that particular service area. For cell sites
located in highly residential and commercial areas, our objective as a PCS provider is to provide
good in-building service and wireless data service to as many businesses and homes as possible.
During this process, the RF design engineer must balance signal level requirements of the area with
capacity.limitations of the system while incorporating his knowledge of the terrain and the density of
surrounding clutters.
In order to meet the requirements of continuous coverage and fill in our footprint in the west of the
Minneapolis-St. Paul greater metropolitan area, particularly near the vicinity of the Golf course on
Golden Valley Rd, we are proposing to build a cell site at 6731 Golden Valley Rd. in Golden
Valley, MN. The main objective of this site is to increase the quality of our coverage in the
residential area near the golf course and also to create additional capacity for our users by relieving
capacity on surrounding sites. See coverage maps attached. The coverage area for this cell site will
be' approximately 2 square miles bounded approximately by Hwy 100 to Winnetka Ave Nand Hwy
55 to Duluth Street. This particular location has been selected because it fulfilled our capacity needs,
and to meet our coverage objective, the site has been designed with 3 antennae mounted on a 85-ft
pole at the Golden Valley Historical Society.
During our search for a location for the proposed cell site, we also evaluated other locations in the
area, but unfortunately they did not work out.

The Golden Valley Country Club was our preferred candidate. Unfortunately we were not .
successful in negotiating a lease.
The NSP High _ voltage transmission line poles were reviewed as a possible site but for safety
reasons we do not have a workable solution with NSP to accommodate collocating our antennas
on that type of transmission line tower.
The AM towers located west of the site were rejected mainly because they do not allow PCSor
cellular carriers to collocate, and also because they are too far from where we need to be.
The industrial property near Golden Valley rd and Douglas dr. was also review but those
properties are again to far to the west of our original preferred location at the Golf course.

Per your request, the following is a description of the planting design
screening of Qwest Wireless equipment to be located at 6731 Golden
Valley Rd. in Golden Valley, MN. Please refer to the Zoning Drawings
for MIN-349, revision 1.
The equipment sits under a well shaded canopy of middle aged Boxelder
trees which range in size from approximately 11 to 15 inches diameter at
breast height (dbh). The understory is composed of small Buckthorn
trees, Virginia Creeper vine, and herbaceous weeds. Per the landowners
request, all plant materials added to this site will be broad leafed
shrubs.
A meandering line of varied height shrubs have been positioned to fully
screen the equipment in this natural setting. All plant materials being
added to the site are shade tolerant, broad leafed, and native to
Minnesota.
In reviewing the site, Mike Goodwin and myself felt it would be
necessary to remove a m~n~mum of two severely leaning Boxelder trees
(approximately 12 and 15 inch dbh) to protect the equipment and
monopole.

entered into option and lease agreements with the following property owners:

With the change to the existing ordinance that would allow for Essential Services, class II
in I-I Institutional Zoning districts and 1-3 Institutional Zoning districts, Qwest Wireless
would request the approval for the placement of the following equipment:
CHESTER BIRD AMERICAN LEGION
This project consists of a replacement of an existing 35' wood pole parking light with a
70' tapered metal pole. The existing parking light will be replaced at the same height on-
the new pole. The base station will be located adjacent to the existing shed, behind a
berm. The total square footage of the equipment space will be approximately 225 square
feet. There will be no parking spaces taken. Trees to the south and east, and the building
to the north will screen the equipment. Highway 100 borders on the west. The
replacement pole will be approximately 160 feet set back from the nearest property line.
The closest residential structures are approximately 1100 feet to the east, and 1100 feet to
the southwest.

The site is currently zoned 1-3.
We looked at the following sites in searching for the most feasible location:

2. Boy Scout Office Building - RF rejected due to terrain
3. Small Office Building - Zoned Business and Professional. Rejected due to proximity
to residential use.
GOLDEN VALLEY HISTORICAL SOCIETY
This project consists of an 85' communicator pole installed in a wooded area at the rear
ofthe parcel. The base station will be located adjacent to the communicator pole and will
occupy an area of approximately 225 square feet. There will be no parking spaces taken.
Existing trees with an average height of 60 feet will screen the equipment to the south
and east. The communicator pole will be set back from the south and east property lines
by approximately 40 feet and from the westerly property line by approximately 100 feet.
The closest residential structures are to the west, approximately 120' (multiple dwelling
zoned M-l) and to the east, approximately 350 feet (multiple dwelling zoned M-l).

. The site is currently zoned 1-4.
We looked at the following sites in searching for the most feasible location:

1. NSP power poles to the south - Turned down due to construction and OSHA issues.
2. Golden Valley Country Club - Rejected our use.
3. United Health Care - Rejected our use. They have plans for a parking ramp.
4. Tenant Company - Rejected our use. They have plans for expansion of their
property.
5. Minnegasco Property - Rejected by RF as it is too far east.
6. Golden Valley Business Center - Rejected by RF as it is too far east.
1 have attached two coverage maps that show the existing coverage and coverage after
these sites are constructed. The maps show that the gaps in existing coverage will be
cured with the inclusion of these two sites.

Reference: Qwest Tower Proposal Site MIN349
Dear Mr. Olson:

The documents submitted by Qwest for the proposed tower at 6731 Golden Valley Road
(Golden Valley Historical Society) were reviewed. The first step in the process was to evaluate
the present Qwest system coverage to determine if the proposed tower is needed to provide the
required system coverage levels or if any other existing structures in the immediate area might
provide the needed coverage.
In reviewing the submitted data it was determined that additional information for nearby
Qwest telecommunications sites was needed in order for me to make a signal coverage
determination. The requested information was provided to me and the data was analyzed. Figure
1 shows the results of the analysis. Using this figure it is clear to see that a coverage gap does
exist in the area around the proposed site (MIN349). This is indicated by a lack of "green" color
(in-building) coverage and the small area of "blue" color (on-street) that is available with the
present communications system.
I then repeated my analysis including the proposed site (MIN349) in the coverage study.

Figure 2 shows the results with the proposed tower and as can be seen in this figure the signal
. levels between the connecting Qwest sites (MIN062 and MIN057) has been increased to provide

adequate linking coverage. In addition I included Figure 3 which shows the combined coverage
with the other Qwest proposed tower in the city.
The next step in the process was to review other potential existing structures that could be
used instead of constructing a new tower in the area. The sites that were considered were: NSP
transmission line poles, AM radio towers used by KDIZ, Industrial property near Golden Valley
Road and Douglas Drive and the city water tower.

The submitted material indicated that the NSP transmission line poles could not be used
due to safety problems. I did confer with NSP engineering staff and they did have concern with
the Qwest proposal. Presently NSP does have working agreements with Qwest and several other
communications providers for co-locating on their power line poles. However, the type of poles
in the immediate area could not be used due to the configuration of the present electrical system
and NSP had problems in servicing the power lines with any non-power system equipment
installed on the poles.

There are presently three radio towers located approximately 0.65 miles from the
proposed location. These towers are used by radio station KDIZ for their night operation. These
towers form a directional antenna pattern and are difficult to use since RF energy is present on
the towers. In order for Qwest to use these tower they would have to isolate their
communications system from the AM stations operation. This is not impossible but it is difficult
and the radio station must be willing to modify their towers. It is my understanding that the radio
station was not willing to allow Qwest to locate on their facility due to several technical issues
and the potential of pattern distortion and increased maintenance concerns. It has been my
experience that this type of co-location is avoided due to the complexity and potential continuing
maintainance problems posed by this type of installation.

Regardless of where the proposed tower will be placed Qwest will have to perform
measurements on the KDIZ antenna pattern prior to any construction and again after the tower is
constructed. These requirements are due to FCC Rules that require such a procedure whenever
communications towers are located within two (2) miles of any AM radio stations utilizing a
directional antenna system in order to demonstrate that the new communications facilities do not
distort the AM radio station directional antenna pattern.

The industrial park area was analyzed and it was determined that it was too far from the
desired area to provide the required system coverage. This was also confirmed with data supplied
to me by Qwest.

The city water tower was analyzed as a potential site and was located too far from the
proposed site location to provide the desired signal coverage.
In reviewing the boundary survey submitted by Qwest for the proposed site it was noted
that the tower would be located only 40 feet from the southern property line. In discussions with
your office it was determined that the present city ordinances require a minimum of a 50-foot
setback. This proposal does not appear to meet this requirement.
A search was performed using the FCC frequency database to determine the frequency
and location of any city or county public safety facilities within one-mile from the proposed
tower location. Using all the identified frequencies either utilized by the city or county an
intermodulation (interference) study was performed to determine if any predicted interference
. products would be generated by the proposed Qwest facility. The results of the study indicate

that no interference products are predicted to be generated that would cause interference to any
of the identified protected frequencies.

My review of the proposed Qwest tower (MIN349) indicates that it would provide the required
system coverage to eliminate the present existing poor coverage area in the Golden Valley area.
Several other potential site locations that were examined did not prove to be acceptable for both
technical and availability reasons. The site is not predicted to cause any interference products to
any protected frequency in the area. The one problem that I did find in the proposal is that the
proposed tower location is only 40 feet from the southern property line and the present
ordinances require a 50-foot minimum set back.

Qwest Wireless, Applicant

This Conditional Use Permit (CUP) application is the second of two on tonight's agenda from Qwest
Wireless. Both applications are proposals to build cellular phone antenna monopoles on privately-
owned property. This second application is to construct a monopole on the property located at 200
Lilac Drive North, which is owned by the Chester Bird American Legion Post 523.
The Site Location. Attached for your use is a location map that shows the location of the property
Qwest is proposing to lease for their monopole. The subject property is zoned Institutional (1-3). The
Golden Valley Zoning Code does not specifically allow this type of use as either a Permitted or as a
Conditional Use. However, Section 11.46, Subd. 4 (H) states that" such other uses which, in the
opinion of the Council, are reasonably compatible with the uses specifically described in Subdivision
3, above, may be permitted as a Conditional Use in any of the four Institutional Zoning Sub-Districts
set forth above", The applicant would like to use this provision to apply for a CUP for this antenna
monopole for this Institutionally-zoned property.
City Staff has hired a professional engineer, at the expense of the applicant, who is familiar with
monopole design to review this application to see if there is any other location where Qwest could
build a monopole. His report, which recommends approval of this antenna tower location, is
attached for your review. This engineer, Garrett Lysiak, PE, from Owl Engineering, will be present
at the Planning Commission meeting to discuss his findings.
The Antenna Monopole. The Golden Valley Zoning defines these cellular phone antenna monopoles
as "Essential Services - Class II". This definition states:
"Public utility facilities completely enclosed within buildings not to exceed 12 feet in height or
600 square feet in gross floor area; or cellular telephone, radio, or television signal transmission
towers not to exceed 120 feet in height as measured from the ground level to the highest point
of the structures (including antenna), and including necessary equipment completely enclosed
within buildings not to exceed 12 feet in height or 600 square feet in gross floor area".
This definition is basically the only requirement in the City's Zoning Code for cellular phone
monopoles. The applicant has submitted a site plan showing the proposed 70-foot high monopole,
which will be installed in the rear of the property. The base station accompanying the monopole will
occupy an area of approximately 225 square feet.
Setback/Code Issues. The subject property is zoned Institutional (1-3) and is surrounded on the east
and north by properties zoned for the Breck School Planned Unit Development (PUD), and on the west .
and south by State Highway 100. The monopole meets all applicable setback and height requirements
as defined in the Zoning Code.
Environmental Issues. According to the attached memorandum from the City Engineer, the
applicant would be required to complete and submit a Grading, Drainage and Erosion Control
application prior to the construction of the monopole.
Factors for Consideration
In approving or denying any CUP, City Code requires that findings be made on ten specified factors.
Staff evaluation of those factors as they relate to the current proposal are as follows. As you may
suspect, many of these criteria are not applicable to cellular phone monopoles.
1. Demonstrated Need for the Use: The City's standard basis for determining need is that an
applicant has identified a market of the proposed good or service. That criterion has been met in
this case.
2. Consistency with the Comprehensive Plan: The plan identifies the proposed site for long-term
Public Facilities use. Cellular phone monopoles, by conditional use, can be considered for that
land use classification.
3. Effect on Property Values in the Area: Since there are similar property uses in the area, .
approval of the CUP will not substantially alter the extent or nature of on-site development or
activity.
4. Effect of any Anticipated Traffic Generation Upon Current Traffic Flow and Congestion in
the Area: The applicant is not proposing any parking spaces for this monopole.
5. Effect on any Increase in Population: This criteria is not applicable to this application.
6. Increase in Noise Level: At this time, staff have no reason to expect that noise impacts will
extend outside of the monopole.
7. Any Odor, Dust, Smoke, Gas, or Vibration Caused by the Use: The City Inspection staffhas
reviewed the issues concerning this use, and have been satisfied that this use will not cause issues
in these areas.
8. Any Increase in Flies, Rats, or other Vermin on the Area Caused by the Use: There should be
no increases in these pests, because the proposed monopole is not the sort to attract them.
9. Visual Appearance of the Proposed Structure or Use: The applicant has stated that the
shrubbery and tree screening on the property will hide any negative visual effects.
10. Other Concerns Regarding the Use: The applicant has attached a letter dated 2/19/01 in which
they state that the monopole will not interfere with any other communication systems.

Recommended Action
Staff recommends that the following conditions be made part of any approval of a Conditional Use
Permit for a cellular phone monopole at 200 Lilac Drive North. An approved site plan becomes a part
of the CUP approval.
1. The applicant shall provide for co-location of future antennas whenever possible.
2. The use of any portion of a tower for signs other than warning or equipment information signs
is prohibited.
3. If the monopole is abandoned or unused, it, along with any associated facilities, shall be
removed within twelve (12) months of the cessation of operations at the site unless a time
extension is approved by the City Council.
4. The monopole shall not be illuminated by artificial means and shall not display strobe lights
unless such lighting is specifically required by the Federal Aviation Administration or other
Federal or State authority.
5. The recommendations of City Engineer Jeff Oliver as found in his memo dated March 26,2001
become a part of this approval..
6. The site plan submitted by the applicant and dated 3/31/00 shall be made a part ofthis
approved permit.
7. All other applicable local, state, and federal requirements shall be met.
8. Failure to comply with one or more ofthe above conditions shall be grounds for revocation of
the conditional use permit.

The documents submitted by Qwest for the proposed tower at 200 North Lilac Drive
(Chester Bird American Legion) were reviewed. The first step in the process was to evaluate the
present Qwest system coverage to determine if the proposed tower is needed to provide the
required system coverage levels or if any other existing structures in the immediate area might
provide the needed coverage.
In reviewing the submitted data it was determined that additional information for nearby
Qwest telecommunications sites was needed in order for me to make a signal coverage
determination. The requested information was provided to me and the data was analyzed. Figure
1 shows the results of the analysis. Using this figure it is clear to see that a coverage gap does
exist in the area around the proposed site (MIN452). This is indicated by a lack of "green" color
(in-building) coverage and the small area of "blue" color (on-street) that is available with the
present communications system.

I then repeated my analysis including the proposed site (MIN452) in the coverage study.
Figure 2 shows the results with the proposed tower and as can be seen in this figure the signal
levels between the connecting Qwest sites (MIN062 and MIN217) has been increased to provide
adequate linking coverage. In addition I included Figure 3 which shows the combined coverage
with the other Qwest proposed tower in the city.

The next step in the process was to review other potential existing structures that could be
used instead of constructing a new tower in the area. The sites that were considered were: Boy
Scouts building, Breck School, AM radio towers used by KDIZ and WWTC, office building near
the proposed site and the city water tower.
An analysis was performed using the Boy Scouts building and initially my computer
model did not show the terrain blockage that Qwest stated in their documents. Since terrain such
as trees and brush are not included in my computer model I went to the site and determined that
there was indeed a potential blockage caused by the trees located on the ridge on the side of the
building. This condition would cause severe attenuation of the Qwest communications signal at
the proposed height. This condition could be eliminated or greatly reduced if the tower were
increased in height. However, if the height were increased to a sufficient value it would be
. required to be over 200 feet tall which would be objectionable.
The Breck schools and the nearby office building were not interested in providing a lease
and were therefore rejected.

There are presently two radio station facilities that are potential location sites for the
Qwest communications facility. KDIZ uses three radio towers located approximately 0.75 miles
and WWTC, which uses four towers located approximately 1.3 miles away from the proposed
location. These towers are used by radio stations for their night operation. These towers form a
directional antenna pattern and are difficult to use since RF energy is present on the towers. In
order for Qwest to use these tower they would have to isolate their communications system from
the AM stations operation. This is not impossible but it is difficult and the radio station must be
willing to modify their towers. It is my understanding that the radio station KDIZ was not willing
to allow Qwest to locate on their facility due to several technical issues and the potential of
pattern distortion and increased maintenance concerns. It has been my experience that this type

of co-location is avoided due to the complexity and potential continuing maintenance problems
posed by this type of installation. The WWTC facility is located too far from the proposed tower
location to provide the desired system signal coverage.
Regardless of where the proposed tower will be placed Qwest will have to perform
measurements on the KDIZ and WWTC antenna patterns prior to any construction and again
after the tower is constructed. These requirements are due to FCC Rules that require such a
procedure whenever communications towers are located within two (2) miles of any AM radio
stations utilizing a directional antenna system in order to demonstrate that the new
communications facilities do not distort the AM radio station directional antenna pattern.

The city water tower was analyzed as a potential site and was located too far from the
proposed site location to provide the desired signal coverage.
In reviewing the boundary survey submitted by Qwest for the proposed site it was noted
that the tower would be located more than the required 50- foot setback requirement.
A search was performed using the FCC frequency database to determine the frequency
and location of any city or county public safety facilities within one-mile from the proposed
tower location. Using all the identified frequencies either utilized by the city or county an
intermodulation (interference) study was performed to determine if any predicted interference
products would be generated by the proposed Qwest facility. The results of the study indicate
that no interference products are predicted to be generated that would cause interference to any
ofthe identified protected frequencies.

My review of the proposed Qwest tower (MIN452) indicates that it would provide the required
system coverage to eliminate the present existing poor coverage area in the Golden Valley area.
Several other potential site locations that were examined did not prove to be acceptable for both
technical and availability reasons. The site is not predicted to cause any interference products to
any protected frequency in the area.

Qwest Wireless operates a Personal Communications System (PCS) in the Minneapolis-St. Paul
greater metropolitan area. When choosing an appropriate location for a cell site, we try to meet both
the coverage and capacity objectives we want to achieve in that particular service area. For cell sites
located in highly residential and commercial areas, our objective as a PCS provider is to provide
good in-building service and wireless data service to as many businesses and homes as possible.
During this process, the RF design engineer must balance signal level requirements of the area with
capacity limitations of the system while incorporating his knowledge of the terrain and the density of
surrounding clutters.

In order to meet the requirements of continuous coverage and fill in our footprint in the west of the
Minneapolis-St. Paul greater metropolitan area, particularly around Hwy 100 & Glenwood Avenue,
we are proposing to build a cell site at 200 North Lilac Drive in Golden Valley, MN. The main
objective of this site is to increase the quality of our coverage around that intersection and also to
create additional capacity for our users by relieving capacity on surrounding sites. See coverage maps
attached. The coverage area for this cell site will be approximately 1 square mile around the around
Hwy 100 & Glenwood Avenue, between Hwy 55 and Hwy 394. This particular location has been
selected because it fulfilled our capacity needs, and to meet our coverage objective, the site has been
designed with 3 antennae mounted on a 70-ft pole behind the American Legion building.
During our search for a location for the proposed cell site, we also evaluated other locations in the
area, but unfortunately they did not work out.

The Boy Scouts of America building was rejected because the terrain configuration around it was
not suitable for our proposed facility. One side of the building is totally blocked by a ridge with a
lot of trees on top of it.
We also approached the Breck School and offered them to attach our antennas to one of their ball
field's light poles. They were not interested.
The AM towers located northwest of the site were rejected mainly because they do not allow
pes or cellular carriers to collocate, and also because they are too far from where we want to be.
The office building located south' of the American Legion site was also contacted, but they were
not interested in leasing space to us.

Informal Public Hearing on Subdivision of the Lot at 7001 Harold Avenue

Background
Lions Park Development is requesting that the 56, 313 square foot (1.29 acres) site be
subdivided into 5 lots. They are planning to develop these lots into 5 single family homes.
Along with this subdivision, the applicant is applying for a General Land Use Plan Map
amendment and for a rezoning of the property from Institutional (1-1) to Residential (see
attached memo in your agenda packet).
Design Features of the Subdivision
Since this subdivision is located on an existing platted street with access to utilities, the
application is pretty straight forward. The property does not lie within a floodplain. The
actual size of the parcel is 61,269 square feet in size (1.4 acres), but the City is taking 10 feet
to increase the right of way along Louisiana Avenue. The comments of the City Engineer,
Jeff Oliver, PE on the site plans are attached for your review. The site plans submitted by
the applicant have all of the required information as stated in City Code Section 12.11, except
for the proposed zoning on the preliminary plat. It is Staff's opinion that the review of this
subdivision can proceed without this information.
Qualification Governing Approval as a Subdivision
According to Section 12.12 of the City's Subdivision Regulations, the following are the
regulations governing approval of subdivisions:
1. The Council may require such changes or revisions as it deems necessary for the
health, safety, general welfare and convenience of the City.
2. The approval of a preliminary plat is tentative only, involving merely the general
acceptability of the layout as submitted.
3. Prior to approval of the preliminary plat by the Council, approval by the City
Engineer and other public officials having jurisdiction will be required of the
,
engineering proposals pertaining to water supply, storm drainage, sewerage and
sewage disposal, roadway widths and the surfacing of streets. .
4. No plat will be approved for subdivision which covers an area subject to periodic
flooding or which contains extremely poor drainage facilities and which would make
adequate drainage of the streets and lots difficult or impossible, unless the subdivider
agrees to make improvements which will, in the opinion of the City Engineer, make the
area complete safe for occupancy, and provide adequate street and lot drainage.
5. No plat will be approved for subdivision that does not meet the requirements
specified in Section 12.20, Minimum Subdivision Design Standards, and Section
12.30, Public Sites and Open Spaces.
The City Code requires that the Planning Commission make a recommendation to the City
Council on this subdivision. The City Council would then hold a public hearing on the plan for
the subdivision. If the City Council approves the plan, the applicant will then prepare the final
plat. The final plat is then brought back to the City Council for approval.
Staff Findings
The staff has reviewed the request for the subdivision and found it to be acceptable. The
proposed subdivision would create five new lots for single family homes. These lots meet all
requirements for lots in the Residential zoning district.

Recommended Action
The staff recommends approval of the proposed lot subdivision the following condition:
1. The recommendations of City Engineer Jeff Oliver as found in his memo dated April 2,
2001 become a part of this approval. . \61.

Preliminary Review for Lions U~dition

Public Works staff has reviewed the plans submitted for a proposed subdivision to be called lions
Park Addition. The proposed development, located east of Louisiana Avenue North, north of
Kentucky Avenue North and south of Harold Avenue, was previously submitted as a Planned Unit
Development consisting of six single-family lots. The most recent submittal dated March 19, 2001 is a
subdivision consisting of five single-family lots.
Preliminary Plat:
.
The preliminary plat shows an additional ten feet of right-of-way dedication on the east side of
Louisiana Avenue with a twenty foot drainage and utility easement directly to the east of that. These
dedications will provide for a total of thirty additional feet on the east side of the roadway for future
street and utility needs.
As discussed in a previous memo, the developer shall also post a $14,400 escrow for street
reconstruction, which is tentatively planned for 2003 as part of the Pavement Management Program.
Grading and Utility Plan:
This proposed development is located within the Sweeney Lake subdistrict of the Bassett Creek
Watershed and is subject to the Water Quality Policy. According to the policy, a residential
development larger than 2.0 acres is required to provide water quality ponding. This proposed project
is 1.41 acres in size, so the developer does not need to provide water quality ponding. However, the
developer is required to prepare an erosion and sediment control plan and implement best
management practices as needed for this project. The plan included with this submittal meets the
standards established in the Water Quality Policy.
This development is subject to the City of Golden Valley Grading, Drainage and Erosion Control
Ordinance. As outlined in the ordinance, a permit is required for mass grading of the site and
individual permits will be required during construction of the homes. No grading or earth disturbing
activities are to occur on site until the appropriate permit has been obtained from the Public Works
Department.
This proposed development will not require the installation of sanitary sewer or watermain extensions
to provide service. Each home will be required to install new sewer and water services as shown on
the plans. This work will require sewer and water permits, and a right-of-way permit prior to
installation. The utility work must be performed according to City standards.

The developer will also need to obtain a demolition permit from the Inspections Department at the City
of Golden Valley before demolition of the existing church building is to begin.
Tree Preservation:
This development is subject to the City of Golden Valley Tree Preservation Ordinance. Therefore, the
developer must submitted a tree preservation plan prepared to City standards as part of the General
Plan submittal for the development. The tree preservation plan is acceptable as submitted.
Summary and Recommendations:
Public Works staff recommends approval of the preliminary design plan for the Lions Park Addition

Brief History of Property
As you recall, this applicant originally applied for a Planned Unit Development (PUD) for this site to build 6
single family homes. At the March 5, 2001 Planning Commission meeting, 6 members of the Commission (one
member was absent from the meeting) recommended the denial of this PUD to the City C'ouncil. After that
action, the applicant chose to withdraw his PUD application before the City Council reviewed it, and instead
apply to the City for a simple subdivision of the parcel into 5 lots. The attached site plans show that these 5
lots meet the requirements in the Residential zoning district for lot area and building setbacks.
Recommended Action
The staff recommends that the zoning map be amended to Residential for this site that is now zoned
Institutional (1-1). The rezoning will be compatible with the single family zoning that is found in this
neighborhood. Staff also recommends revising the General Land Use Plan Map from Schools and Religious
Facilities to Low Density Residential.
