Summary
Melrose North Pyrotechnics, Inc. has requested permission to discharge aerial fireworks at
the Golden Valley Fire Relief Association Street Dance on June 21,2008. The Street Dance
will be held at the Chester Bird American Legion, 200 North Lilac Drive.
The location proposed for discharging the fireworks is on the Breck School baseball field.
Breck School has submitted a letter authorizing the use of their property.
The fireworks display company and the Golden Valley Fire Relief Association will be
responsible for cleaning up the debris from the fireworks.
Recommended Action
Motion to approve the fireworks display permit for Melrose North Pyrotechnics, Inc. to
discharge aerial fireworks at the Breck School baseball fields for the Golden Valley Fire Relief
Association Street Dance on June 21,2008.

Golden Valley Planning Commission

A regular meeting of the Planning Commission was held at the Golden Valley City Hall,
Council Chambers, 7800 Golden Valley Road, Golden Valley, Minnesota, on
Wednesday, May 28,2008. Chair Keysser called the meeting to order at 7 pm.
Those present were Planning Commissioners Cera, ECk, Keysser, Kluchka, McCarty
(left at 7:50 pm), Schmidgall and Waldhauser. Also present was Director of Planning
and Development Mark Grimes and Administrative Assistant Lisa Wittman.
1. Approval of Minutes
April 28, 2008 Regular Planning Commission Meeting
McCarty referred to the second paragraph on page one and noted that first "and" needed
to be removed from the first sentence.
MOVED by Eck, seconded by McCarty and motion carried unanimously to approve the
April 28, 2008 minutes with the above noted correction.
2. Informal Public Hearing - Minor Subdivision - Lots 11 &12, Block 3, Glen Urban
Addition - SU09-13
Applicant: Di,Giacomo Homes
Address: Lqts 11 & 12, Block 3, Glen Urban Addition
Purpose: T~e subdivision would create three separate lots to allow for the
cqnstruction of three new homes
Grimes stated that the!applicant is requesting to do a minor subdivision of Lots 11 and 12,
Glen Urban 2nd Addition. The minor subdivision would re-subdivide the existing two lots
into three new lots to allow for the construction of three single-family homes. He stated
that the proposed three lots will each exceed the minimum lot size requirements of 10,000
square feet. Lot "A" will be 13,914 square feet, Lot "B" will be 1 0,260 square feet and Lot
"C" will be 11,569 square feet.
Grimes stated that he has had discussions with the applicant about the recently adopted
single-family zoning code changes regarding infill development so the applicant is aware
of the new requirements.
Grimes referred to his memo dated May 22,2008 and discussed the nine factors for
consideration and approval. He explained that the City Engineer has stated in his staff
report that the owner of the lots will be required to submit a grading and erosion control
plan for each of the lots prior to construction. Grimes added that there, has also been a

suggestion by Public Works staff that a drainage study done for this area in the past be
updated to include these proposed new lots to make sure that there is adequate storm
water capacity.
Keysser stated that he has been told by people in the neighborhood that the area does
flood a couple times a year. Grimes said that it is his understanding that on occasion
water has had to have been pumped out of the area. He stated that staff feels with proper
grading plans there should be enough capacity in the system for these proposed new lots.
Keysser asked about installing rain gardens. Grimes said the developer could address the
issue of rain gardens. He added that rain gardens would probably be considered as a part
of the individual grading and drainage plans for the homes. He noted that there was a
large house removed from Lot 13 that also had a swimming pool so the overall hard
surface area probably won't be significantly changed after these proposed new homes
are built.
Eck referred to proposed Lot "8", the middle lot, and asked if the 12.5 foot setback meets
the requirements. Grimes said that it depends on the height of the house. If the house is
more than 15 feet in height then the side yard setbacks will need to be increased. Eck
said he is concerned about the homes being able to meet the setback requirements.
Grimes explained that the Planning Commission is not approving the homes as a part of
this subdivision proposal. The plans just show the building envelope and the possible size
and scale of the proposed homes. He added that he wants to make it clear that the style
and character of the potential homes could change from those shown on plans submitted
by the developer with the minor subdivision application
Cera asked if the grade of the lots will be set as a part of the subdivision agreement.
Grimes said yes. The grade of the lots will be set in the subdivision agreement approved
by the City Council at the time of final plat approval.
Kluchka asked about the impact the proposed new houses will have on the existing pond.
Grimes stated that based on the information submitted there will not be an adverse effect
on the pond but staff is requiring that the existing drainage study be updated just to be
certain. Kluchka asked if the run-off from these homes will go into the pond or if the
drainage issues are a street issue. Grimes stated that the drainage study will show if
there is enough capacity in the pond.
Rocky DiGiacomo, Applicant, stated that the former home located at 229 Janalyn Circle
straddled the property line between proposed Lot "A" and Lot 13. He explained that the
impervious surface area of the proposed new homes on the three new lots will be fairly
similar in comparison to the former house at 229 Janalyn Circle and the existing home at
4108 Glencrest. He added that the run-off from the new homes will be more evenly
distributed than before and he would like to create a rain garden in the low point on Lot
"A" to help with water in the low area.
Keysser asked if the existing newly built home on Lot 13 just to the east of Lot "A" is sold.
DiGiacomo said yes. Keysser asked the applicant if he has buyers for the proposed three
new homes. DiGiacomo said no. He stated that there is a strong resurgence of people

who want to move back to this area and that these lots will be developed by him or by
someone else. He added that he is working hard not to diminish the quality or character of
the neighborhood.
Keysser asked about the style of the proposed new homes. DiGiacomo said he is most
comfortable building the arts and crafts style of home. Keysser asked the applicant if he
will be the builder of the homes on the three proposed lots. DiGiacomo said yes.
Keysser opened the public hearing.
Jeff Nordstrom, 232 Janalyn Circle, stated that there has been a lot of talk about the pond
being an issue or not and there is clearly an issue of how much more water the pond can
hold. He stated that water comes back through the pipes and backs-up on people's
property and the City has to pump it out. He said the issue needs to be addressed
because it is not getting better.
Marcia Cushmore, 4300 Glencrest Road, read a letter from Mike Schock and Leslie
Baken at 4316 Glencrest Road. The letter stated that they are concerned about Mr.
DiGiacomo's claims that he is committed to ecologically influenced home construction yet
his web page is void of references to the floral ecological footprint created by his
construction. They stated that one of the preeminent ecological elements of North Tyrol is
the healthy and long lived oak forest. They stated that they do not argue with the right of
private developers to create upgraded living space in their neighborhood however they
believe that the evidence strongly suggests that the current developer thinks of ecology
on a single dimension, that of the building he constructs. They attached photos of the
applicant's recent work and noted that is void of any pre existing trees and the
landscaping is young and offers little shade and water uptake. They noted that many of
the trees on or near the property at 301 Janalyn Circle are nearly a century old and any
plan to build multiple new homes on and around the oak forest is na'ive. They stated they
are concerned about destroying many of the adjacent trees and added that the ecological
and economic costs of losing a dozen centenarian oak trees far outweighs the gain from
even the most energy efficient construction possible. They said they understand that the
Planning Commission must be fair to both the developer and neighborhood and urged the
City to require significant guarantees that the developer would build without harming both
the conifer stand and the oak grove surrounding 301 Janalyn Circle.
Gene Hollister, 240 Janalyn Circle, said his main concerns are the pond and the run-off
because there are water problems during heavy rains. He said during a heavy rain his
neighbor's back yard becomes a pond and the water goes onto his driveway and he's had
to put in "speed bumps" at the end of his driveway to help divert the water. He said he
believes there is going to be a lot of trees lost and there is not enough slope on the street
to direct the water to the pond.
Ryan Urness, 308 Janalyn Circle, said the corner of Glencrest Road and Janalyn Circle is
a relatively high point. He said his biggest concern is that he is not sure these proposed
new lots will be saleable given their size and elevation. He added that he does not want a
dirt pile sitting across the street from him waiting for a home to be built.

Judy Stinson, 4308 Glencrest, said her neighborhood is in the "old forest" section of
Golden Valley with dozens of mature oaks, maples, elms and numerous other trees and
shrubs. She said most families in her neighborhood are long-term residents who live there
because of the exceptional beauty and environment. She stated that it is important to
consider that a heavily wooded old forest environment is very different from a typical city
or single home area that has widely spaced trees. She stated that oaks are the most
vulnerable to construction related damage and most of the neighborhood oaks stand 50-
70 feet tall with 20-30 inch diameter trunks. Their canopies typically span 60 to 80 feet
and are all root connected to a distance of 150 to 200 feet. She stated that the proposed
subdivision and construction threatens the health of their oak trees and exposes them to
oak wilt and other insect and disease problems. She referred to a University of Minnesota
publication regarding protecting trees from construction damage and explained that it
describes the prevention of damage to root systems by providing a formula for arriving at
the protected root zone as well as the impact of construction activities. She added that the
guide also states that the occurrence of oak wilt is four times more likely within 160 feet of
a construction site. She referred to Lot "C", the eastern most lot in the subdivision
proposal, and said she is concerned about the proposed new location of the driveway
because within a few feet of that driveway there are six mature oaks, two pine trees and
others. These trees would likely not be able to survive the excavation and soil compaction
associated with new construction and any tree removal would cause extensive damage
and risks to the root systems of the neighboring root-connected trees. She suggested the
proposed new home on this lot be built in the same footprint as the existing home with the
driveway remaining in its current location so that no new excavation would be done. She
referred to Lot "B", the middle lot, and said it has the added complication of being even
more heavily wooded and of being positioned on a steep grade. She stated that
construction on this lot would involve considerable leveling of the site and changes in site
grade increasing the risks associated with soil compaction and changes to water run-off
and sunlight. She said that her comments are not intended as criticism against any
particular developer because it would not be possible for any developer to undertake the
proposed development without cutting into the root systems of the neighborhood's oak
trees. She said she understands that a property owner has the right within certain
guidelines to do what they want with their property but the guidelines for redevelopment of
"virgin forest" land should be very different from those established for development of city
land where deforestation is not an issue. She said she believed that the long-term
interests of the existing homeowners should outweigh the short-term interests of
developers and that developers do not have the right to damage her trees or place them
at risk.
Paul Denecke, 228 Janalyn Circle, stated that up until 5 or 6 years ago the neighborhood
had a constant water problem and after a heavy rain he would have water on his lawn
and the water would back-up on the streets. He said he is concerned about having
enough storm sewers to handle the water.
Bobbie Connor, 244 Janalyn Circle, showed the Commissioners a list of addresses in the
area that have multiple oak trees. She said she counted 85 oak trees in yards of just 12
properties on JanalynCircle so she hopes that there will be a great effort to protect these
trees. She referred to a Penn State study regarding reducing the life of trees and stated

that three poor decisions and misconceptions are: 1) trees are elastic enough to adapt to
abrupt changes, 2) our actions in and around trees do not obviously and immediately
impact the trees and 3) the trees have been there for years so nothing will affect them.
She discussed how changes in grade and soil compaction affect the trees. She added
that the grade for the new home that was recently built by the applicant was changed
considerably and she thinks it is important to measure the grade where the new houses
are being proposed to see how significant the grade change will be.
Rich Baker, 224 Janalyn Circle, commended the applicant's efforts to build "green"
houses. He referred to the drainage issues and stated that the design of the pond is built
to hold water well above the low point in the road. He said the City put a siphon in the
pond in order to hook up a fire truck and pump the water into Wirth Lake. He said there
are significant problems that aren't going to be solved with a rain garden and he is going
to be looking for significant on-site storage if this subdivision is approved. He added that
there are going to be changes in permeability, compaction, erosion and nutrient run-off
with the addition of these proposed houses. He stated that he agrees with the applicant's
desire to preserve architectural style diversity but the three homes the applicant has built
in their neighborhood all look very similar with big roofs that face the road and he does
not want to see four of these same houses in a row. He said he hopes the applicant does
a better job of trash control than he has done with the current home being constructed.
He added that the tree preservation is important and the City's tree preservation
ordinance is inadequate and should be improved upon because it is the large oak trees
that make this neighborhood unique.
Rachel Rosen, 401 Janalyn Circle, stated that the selling point of their house was the
gorgeous trees. She said the thought of losing or damaging the trees is heartbreaking and
asked that the tree issues be taken seriously.
Helga Theilen, 400 Janalyn Circle, said she supports the ideas that have been presented
by her neighbors. She said her concern is not only the loss of trees but the loss of space
by the proposed lot sizes. She stated that the proposed lots only slightly exceed the
minimum lot size requirements and she'd prefer this subdivision not go through because it
will cause significant changes to their neighborhood.
Bridget Burke, 4223 Glencrest, said that one reason she was attracted to this
neighborhood is the character of the homes, the trees and the lot sizes. She said she is
renovating her home and has worked hard to keep the architectural character of the
neighborhood. She supports the concern over the oak trees and said she doesn't agree
that the proposed homes are in character with the Tyrol Hills style of homes.
Mary Adair, 505 Janalyn Circle, said she wonders how the applicant is going to build on
the proposed lots without changing everything. She stated that there is a large red or
white pine on one of the lots that she is concerned about losing. She said she would
support not building on the middle lot but just building on the two end lots.
Ralph Jacobson, 516 Parkview Terrace, said a couple of years ago Dave Allen put up two
houses next to his. Trees were taken down and he was assured new trees would be put

in and of course they weren't. He said he is concerned that the developer for this project
won't be sensitive to the tree issues.
Hazel Belvo, 4300 Glencrest, said aesthetics are her main concern. She said they are a
neighborhood of distinctly different homes and designs which gives a distinct character.
She said the new house recently built at 4108 Glencrest is out of character and out of
scale for the neighborhood. She referred to the applicant's brochure and noted that it
shows a image of a very warm home but what was actually built is nothing like the image
in the brochure.
Marcia Cushmore, 4300 Glencrest, said that the neighborhood is a wonderful place to
raise kids and the Planning Commission has heard how much they love their trees. She
said when she saw the new house being built at 4108 Glencrest she was in a state of
shock and sick. She said she thinks it's cold, unaesthetic and doesn't respect the
neighbors or the surroundings. She said she is concerned about vacant lots being in the
neighborhood for long periods of time. She said that the builder may be a "green" builder
but "green" builders build around existing trees. She noted that the applicant has stated
that he doesn't want to diminish their neighborhood but he has and she hopes the City
understands how deeply she cares about the ecology of the world today.
Seeing and hearing no one else wishing to comment, Keysser closed the public hearing.
DiGiacomo said he respects the fact that so many people have come forward and care
about their neighborhood. He reiterated that the total hard cover of the proposed new lots
is not that dissimilar to what was previously there and a drainage plan for every lot will
probably help the existing drainage issues. He addressed the concerns about the trees
and noted that there are four oak trees on Lot "C" and none of them will be impacted. He
explained that the proposed new home on Lot "C" will sit roughly in the same place as the
home sitting there currently. He said the existing home is non-conforming because it is
too close to the front yard property line and the home he is proposing will meet the
setback requirements.
Keysser asked the applicant if it would work for him to build the new home on Lot "C" in
the exact same location as the existing home. DiGiacomo said he would prefer to build
the new home in the same location as the existing house but he would require a variance
to do so. Grimes stated that the location of the homes is not dealt with as a part of the
subdivision proposal. The applicant would have to go to the Board of Zoning Appeals if he
needed a variance and he is not sure what the hardship would be.
DiGiacomo explained that Lot "B" is the most heavily wooded lot. It has two large elm
trees which will survive, but it is mostly buckthorn and boxelder that should be removed.
He added that no large trees on Lot "A" will be impacted.
Grimes reiterated that each lot will be required to have a tree preservation plan and the
City's Environmental Coordinator will suggest protection measures for the trees at the
time of construction.

Cera asked about the repercussions if the trees are removed before the lots are sold.
Grimes said it would be a violation of City Code. He explained that once an applicant has
gone through the subdivision process only a certain percentage of the trees can be
removed without there being a large penalty. He added that most developers are
interested in preserving good trees because they are valuable to the lots.
Keysser asked if there is an escrow account required in case the tree preservations plans
are not followed through. Grimes stated that there is an inventory done and reiterated that
only a certain percentage of the trees can be removed.
DiGiacomo stated that there is an escrow account required. He said that he appreciates
the oak trees as much as anybody and they are valuable.
Eck questioned one of the neighbors comments regarding a large red or white pine
located on one of the lots. DiGiacomo said he thinks the tree referred to is located on Lot
"A" and stated that the larger pines will remain.
Cera asked if the City owns the pond on Janalyn Circle. Grimes said yes and explained
that the updated drainage study will hopefully show that there is enough capacity in the
pond.
Keysser asked if the Planning Commission can recommend that additional storm water
capacity be required if needed. Grimes said yes and reiterated that the City Engineer
thinks there will be enough capacity for these new homes because the amount of hard
surface area will not be substantially increased. He added that staff believes that the
proposed development can occur with no negative impacts to adjoining properties.
Waldhauser said she gets the sense that some mitigation has been done by the City
regarding drainage and that the drainage issues in this area are pre-existing and not
being caused by these proposed new homes; the neighbors just want the City to fix the
problems. Keysser said he thinks there might be a minor exacerbation in the drainage
issues as a result of this proposed subdivision. He suggested they install a pond on Lot
"A". Waldhauser said they can't expect this development to solve the existing drainage
problems.
Schmidgall questioned an earlier comment about there being four homes where there are
currently two. Grimes explained that this subdivision proposal takes two existing lots and
divides it into three but there is an adjacent property that the applicant has also built a
home on so there will be four new homes in the immediate area.
Cera said he likes the idea of requiring a pond or rain garden on Lot "A".
Grimes said the Planning Commission could add a recommendation about maintaining
the oak trees and making sure the roots aren't damaged.
Keysser clarified the possible conditions of approval they've discussed as follows: 1)
requiring an update of the existing drainage study, 2) requiring a drainage pond or rain
garden, 3) requiring special effort to maintain the oak trees and if possible move the

location of the proposed new house on Lot "C" to be in the same location of the existing
house on Lot "C".
Grimes stated that the Planning Commission could also suggest that the Board of Zoning
Appeals consider the trees as a hardship in this case in order to keep the location of the
proposed new house in the same spot on Lot "C".
Kluchka said that part of the value of the trees is the fact that they are probably already
acting as a rain garden and that removing the existing trees will have an impact on the
drainage as well. He said he is concerned enough to deny the application because he
feels there is not adequate capacity and drainage as the subdivision regulations require.
Grimes suggested submitting the tree preservation plans to the engineer that will be
updating the drainage study to determine if the removal of the trees will impact the
drainage.
Kluchka asked if the City would be able to address the capacity issue in the pond. Grimes
stated that if the study indicates that the storm water capacity in the pond needs to be
increased it would likely be done through a City project. He explained that the City's
systems are built to certain standards but they can not be built to accommodate 100 year
flood events. Kluchka said he doesn't have reason to believe that a rain garden will help
with the capacity issues.
Schmidgall asked how often water is pumped out of the area. Grimes guessed a couple
times per year. Rich Baker, 224 Janayn Circle, stated that in the 10 years he's lived in this
neighborhood the City has had to pump water out twice.
Veryle Logan, 301 Janalyn Circle, stated that the City's Environmental Coordinator has
told her that the buckthorn and boxelder should be removed from these lots.
Eck said he is disappointed that the Planning Commission doesn't have a report from the
Environmental Coordinator regarding the trees in the area. Keysser suggested tabling this
subdivision request in order to review the updated drainage study and to also get a report
from the Environmental Coordinator. Kluchka stated that the Planning Commission's
guidelines are to look at the subdivision and the drainage. He questioned if the trees are
something the Planning Commission can consider as part of a subdivision request. Eck
said he thinks the trees are a significant enough matter that they should be addressed by
the Environmental Coordinator.
Keysser suggested again that they table this request in order to get an update on the
drainage report and a report from the Environmental Coordinator regarding the trees.
MOVED by Kluchka, seconded by Eck and motion carried unanimously to table this
subdivision request to the June 9, 2008 Planning Commission meeting in order to get an
updated drainage study and tree preservation report.

3. Reports on Meetings of the Housing and Redevelopment Authority, City
Council, Board of Zoning Appeals and other Meetings
Kluchka reported on the May 20,2008 City Council meeting where they approved the
1-394 Corridor zoning district ordinance with minor changes.
Keysser said he would like AI Lundstrom, Environmental Coordinator, to come to a
Planning Commission meeting and discuss the City's tree preservation requirements.
Grimes said he would ask Mr. Lundstrom to come to the June 9,2008 Planning
Commission meeting.
4. Other Business
MNPASS 1-394 Phase II Planning Study - Comprehensive Plan Addition
Grimes stated that staff is recommending that the MNPASS Study done by the Center
for changing Landscapes at the University of Minnesota be added as a link to the City's
updated Comprehensive Plan. The Commissioners agreed that a link to the U of M
study would be fine and that the study does not need to be a chapter in the City's
Comprehensive Plan.
Kluchka asked for an update on the homes partially constructed on Medicine Lake and
Douglas Drive. Grimes said that the City recently did some more securing of the houses
and has been in contact with the bank that owns the property about being a hazardous
building.
Eck asked about the former restaurant site at TH 55 and Douglas. Grimes said the City
has also been talking to the owner of that property regarding it being declared a
hazardous building.

COMMITTEE REPORTS
SCHOOL EDUCATION
Ninety one essays were received and have been judged. Awards will be given to the
winning 6th grade Sandburg students during the first or second week of May. Awards will
be given for 1S\ 2nd and 3rd place as well as some "Honorable Mentions." Fourteen essays
have been received so far for the state league contest. Awards for the state league essay
contest will be presented at the Crystal Community Center on May 17th.
The Community Collaborative Council distributed surveys to students in grades 4-12 to
determine what the student experience has been in District #281. Survey results were
distributed to commissioners and a brief overview was given.
HOUSING
Chief Altonen advised Golden Valley does not have a financial assistance package for
homeowners, but all utilities are kept on during the foreclosure process to help provide
some relief to homeowners.
Commissioner Dykstra inquired about a meeting of staff from Crystal, Golden Valley and
Plymouth concerning group home density/spacing in neighborhoods. Commissioner
Dykstra requested an update from Mayor Loomis or Council Member Scanlon at the next
meeting.
LEAGUE OF MINNESOTA HUMAN RIGHTS COMMISSIONS
Commissioner Helland distributed the flier for the annual conference, which will be held
October 4th in Rochester.
Commissioner Dykstra advised the league extended an invitation to the Genocide
Intervention Network to send a representative to speak about divesture of city resources to
ensure none are used in any way to support the genocide in Darfur. Commissioner Helland
distributed a letter with information regarding a planning meeting to raise awareness about
the Darfur genocides. The meeting is scheduled for April 24th at the Minnesota Council of
Churches.
SHARE THE DREAM
The Share the Dream event did not take place in March. Further discussion about
circulating informational brochures at Juneteenth will take place at the May 15th meeting.
DISCRIMINATION
Chair Brandon inquired about the appeal proceedings in the Hixon case. Chief Altonen
advised the case has been settled.
OLD BUSINESS
BIAS/HATE CRIME RESPONSE AND PREVENTION PLAN
Commissioner Jorgenson proposed a couple revisions to the draft policy:
1) Page #1, Sentence #1: "The purpose of this policy is to establish guidelines and
responsibilities for the reporting of and response to violations..."
2) Page #5, Section 1: St. Louis Park should be added to the list of neighboring cities
Commissioner Dykstra proposed one revision:
1) Page #1, Paragraph #1: change "sex" to "gender"
Commissioner Jorgenson moved to approve the revised draft policy; seconded by
Commissioner Helland. Motion carried.
HOBBS AWARD
Commissioner Helland advised one nomination was received, but the nominee does not
live or work in Golden Valley. Commissioner Helland will follow-up with the person who
submitted the nomination to get more information pertaining to the nominee.
DIVERSITY TRAINING
Commissioner Dykstra requested this item be added to next meeting's agenda.
NEW BUSINESS
STATUS OF MEMBERSHIP
Commissioner Dykstra suggested devising a strategy for recruiting new members.
Commissioners Jorgenson and Dykstra will work on drafting a strategy and will present the
draft at the next meeting for discussion. Chair Brandon and Commissioner Helland would
like to participate in the draft via e-mail.
PUBLIC HEARING FOR STATE VOCATIONAL REHAB COUNCIL
Commissioner Dykstra advised the council will conduct hearings on June 25th from 9am to
8pm for persons with disabilities regarding how services are being rendered.
Commissioner Helland motioned to request that the Golden Valley Human Rights
Commission host the public hearings for the State Vocational Rehabilitation Council on
June 25th from 9am to 8pm, and the rehabilitation council be permitted to use the Council
Chambers and Council Conference Room for the extended evening hours; seconded by
Chair Brandon. Motion carried.

Golden Valley Human Services Foundation (GVHSF) Meeting Minutes
May 12, 2008
Present: Daniel Blumb, Hilmer Erickson, Bob Hoyt, Chris Monroe, Diane Nimmer, Connie
Sandler, Steve Schumacher and Toots Vodovoz. Also present Jeanne Fackler, Staff
Liaison.
Not Present: Shannon Breimhurst, Elissa Heilicher, Teri Holgate, and Gloria Johnson.
Call to Order: Chairperson Schumacher called the meeting to order at 6:35 p.m.
February 11 minutes: Erickson moved and Vodovoz seconded the motion to approve the
minutes of February 11. The motion passed unanimously.
Run the Valley: The net for Run the Valley is $14,348. Suggestions for next year's event
include:
Order medals for first place only, but increase the number of age categories.
Plan for 550 people
Contact Pilgrim Cleaners for safety pin donation
Increase the number of volunteers on the course
New Business:
Sponsorship packet/brochure: Breimhurst and Nimmer will work on a sponsorship
brochure for the 2009 events to present to area businesses.
Golf Tournament: The 2007 golf brochure was updated. A line for e-mail address will be
added. It was suggested to increase the foursome fee to $300 before September 2 or $350
after September 2. A new category to encourage multiple foursomes from a company or
friends will be $500 for 2 foursomes before September 2 or $550 after September 2.
Fackler will check with Kris Tovson to make sure the new fees are in line with other
tournament groups.
Spohsor contribution levels: Members recommended changing corporate sponsorship to
incl~de the company name will appear at all holes and all advertising if received by
dea~line date.

Taste of Golden Valley: Monroe, Sandler and Vodovoz will chair the event. "Save the
dat~" cards were printed. Members will ask if they can appear at other commission
me~tings to encourage attendance at the event.

Other Business:
Schumacher reported that the Rotary Club of Golden Valley donated $1,100 to the
Foundation with $100 designated to Run the Valley and $1,000 to the Golf Classic.
Schumacher accepted the check at the Rotary's May 6 meeting. Fackler reported that the
Golden Valley Federated Women's Club donated $300 to the Foundation. Thank you's
have been sent.
Fackler reported that a request has come from Go Health Chiropractic to offer chair
massages after the golf tournament. Members felt this would be a nice service. Fackler will
contact and meet with staff of Go Health.
By-laws review: Discussion centered on attendance. Hoyt moved and Monroe seconded
that the wording in Article II, Section 3 be changed to "Attendance is required at all
meetings. Unexcused absence from three meetings per calendar year could result in
removal from the Foundation." Second reading and vote will be at the June meeting.
Adjournment: Erickson moved to adjourn the meeting, Monroe seconded the motion. The
meeting was adjourned at 7:45 p.m.

Summary
The 2008-2012 Capital Improvement Program includes $50,000 (S-011, p. 96) for rating the
pavements on all city streets in 2008. Staff has received a proposal from Stantec, Inc. for
collecting surface distresses such as cracking, heaving, settlements, etc. and pavement
roughness or ride condition. It is important for staff to have a "snapshot" of the current
condition of all streets, new or old, to help determine the appropriate maintenance strategy
and timing of that strategy for any given street. The rating system also provides historical
data to more accurately predict pavement performance.
Stantec has been the provider of previous pavement ratings in the City. Their firm provided
the City with its current Pavement Management Software (PMS) and are familiar with the way
the data must be structured to be compatible with the software. In addition, they have
demonstrated their capability of performing the data transfer effectively.
Stantec, Inc. propOses to provide the data for a cost of $42,800 (a copy of the agreement is
attached for Council consideration). The proposal includes street ratings, software upgrades
(no additional cost), training, software maintenance and support.

PROJECT NAME (the "PROJECT'):
Pavement Condition Rating and Associated Pavement Management Services
DESCAfP110N OF WORK: STANTEC shall render the services described in Attachment "A" (hereinafter called the "SERVICES")
in accordance with this AGREEMENT. STANTEC may, at its discretion and at any stage, engage subconsultants to perform all or
any part of the SERVICES. The CLIENT and STANTEC by written amendment to this AGREEMENT may from time to time make
changes to the SERVICES. All changed work shall be carried out under this AGREEMENT. The time for completion of the
SERVICES shall be adjusted accordingly.
COMPENSATION: Charges for the SERVICES rendered will be made in accordance with the CONTRACT PRICE indicated in
Attachment "A", or, if no CONTRACT PRICE is indicated, in accordance with STANTEC's Schedule of Fees and Disbursements in
effect from time to time as the SERVICES are rendered.
Invoices shall be paid by the CLIENT in the currency of the jurisdiction in which the SERVICES are provided without deduction or
setoff upon receipt. Failure to make payment within 30 days of receipt of invoice for work prepared in accordance with the
Distress Rating Acceptance (Services: Task 3) is a material breach of this Agreement and will entitle STANTEC, at its option, to
suspend or terminate this Agreement and the provision of the SERVICES. Interest will accrue on accounts overdue by 30 days at
the lesser of 1.5 percent per month (18 percent per annum) or the maximum legal rate of interest.
REPRESENTATIVES: Each party shall designate in the space provided above a representative who is authorized to act on behalf
of that party and receive notices under this AGREEMENT. Such representatives have complete authority to act on behalf of their
principals in respect to all matters arising under this AGREEMENT.
NOTICES: All notices, consents, and approvals required to be given hereunder shall be in writing and shall be given to the
representatives of each party. All notices required by this AGREEMENT to be given by either party shall be deemed to be properly
given and received within two (2) business days if made in writing to the other party by certified mail, telegram, email, facsimile or
telex, addressed to the regular business address of such party as Identified above.
CLIENTS RESPONSIBlLmES: The CLIENT shall provide to STANTEC in writing, the CLIENT's total requirements in connection
with the PROJECT, including the PROJECT budget and time constraints. The CLIENT shall make available to STANTEC all
relevant information or data pertinent to the PROJECT which is required by STANTEC to perform the SERVICES. STANTEC shall
be entitled to rely upon the accuracy and completeness of all information and data furnished by the CLIENT, including information
and data originating with other consultants employed by the CLIENT whether such consultants are engaged at the request of
STANTEC or otherwise. Where such information or data originates either with the CLIENT or its consultants then STANTEC shall
not be responsible to the CLIENT for the consequences of any error or omission contained therein.
When required by STANTEC, the CLIENT shall engage specialist consultants directly to perform items of work necessary to
enable STANTEC to carry out the SERVICES. Whether arranged by the CLIENT or STANTEC, these services shall be deemed to
be provided under direct contracts to the CLIENT unless expressly provided otherwise.
The CLIENT shall give prompt consideration to all documentati<?n related to the PROJECT prepared by ST ANTEC. and whenever
prompt action is necessary shall inform STANTEC of CLIENT's decisions in such reasonable time so as not to delay the scheduie
for providing the SERVICES.
When applicable, the CLIENT shall arrange and make provision for STANTEC's entry to the PROJECT site as well as other public
and private property as necessary for STANTEC to perform the SERVICES. The CLIENT shall obtain any required approvals,
licenses and permits from governmental or other authorities having jurisdiction over the PROJECT so as not to delay STANTEC in
the performance of the SERVICES.

STANTEC'S RESPONSIBILITIES: STANTEC shall fumish the necessary qualified personnel to provide the SERVICES.
ST ANTEC represents that It has access to the experience and capability nece$sary to and agrees to perform the SERVICES with
the reasonable skill and diligence required by customarily accepted professional practices and procedures normally provided in the
performance of the SERVICES at the time when and the location in which the SERVICES were performed. This undertaking does
not imply or guarantee a perfect PROJECT and in the event of failure or partial failure of the product of the SERVICES, ST ANTEC
will be liable only for its failure to exercise diligence, reasonable care and professional skill. This standard of care is the sole and
exclusive standard of care that will be applied to measure STANTEC's performance. There are no other representations or
warranties expressed or implied made by STANTEC. In particular, but not by way of limitation, no implied warranty of
merchantability or fitness for a particular purpose shall apply to the SERVICES provided by STANTEC nor shall STANTEC warrant
or guarantee economic, market or financial conditions, proforma projections, schedules for public agency approvals, or other
factors beyond STANTEC's reasonable control. STANTEC does not warrant the SERVICES to any third party and the CLIENT
shall indemnify and hold harmless STANTEC from any demands, claims, suits or actions of third parties arising out of STANTEC's
performance of the SERVICES.
In performing the SERViCES under this AGREEMENT, STANTEC shall operate as and have the status of an independent
contractor and shall not act as, or be an employee of the CLIENT.
The SERVICES performed by STANTEC shall be subject to the inspection and the review of the CLIENT at all times but such
inspection and review shall not relieve STANTEC from its responsibility for the proper performance of the SERVICES.
TERMINATION: Either party may terminate this AGREEMENT without cause upon thirty (30) days' notice in writing. If either party
breaches this AGREEMENT, the non-defaulting party may terminate this AGREEMENT after giving seven (7) days' notice to
remedy the breach. On termination of this AGREEMENT, the CLIENT shall forthwith pay STANTEC for the SERVICES performed
to the date of termination. Non-payment by the CLIENT of STANTEC's invoices within 30 days of STANTEC rendering same is
agreed to constitute a material breach of this AGREEMENT and, upon written notice as prescribed above, the duties, obligations
and responsibilities of STANTEC are terminated.
SUSPENSION OF SERVICES: If the project is suspended for more than thirty (30) calendar days in the aggregate, STANTEC
shall be compensated for services performed and charges incurred prior to receipt of notice to suspend and, upon resumption, an
equitable adjustment in fees to accommodate the resulting demobilization and remobilization costs. In addition, there shall be an
equitable adjustment in the project schedule based on the delay caused by the suspension. If the PROJECT is suspended for
more than ninety (90) days, STANTEC may, at its option, terminate this agreement upon giving notice in writing to the CLIENT.
ENVIRONMENTAL: Except as specifically described in this AGREEMENT, STANTEC's field investigation, laboratory testing and
engineering recommendations will not address or evaluate pollution of soli or pollution of groundwater.
BUILDING CODES, BYLAWS AND OTHER PUBUC REGULATIONS: STANTEC shall, to the best of its ability, interpret building
codes, by-laws and other public regulations as they apply to the PROJECT and as they are published at the time SERVICES
commence. Furthermore, STANTEC shall observe and comply with all applicable laws, ordinances, codes and regulations of
govemment agencies, Including federal, state, provincial, municipal and local goveming bodies having jurisdiction over the conduct
of the SERVICES ("LAWS"). However, it is expressly acknowledged and agreed by the CLIENT that as the PROJECT progresses
such building codes, by-laws, other publiC regulations and LAWS may change or the interpretation of any publiC authority may
differ from the interpretation of STANTEC, through no fault of STANTEC, and any extra costs necessary to conform to such
changes or interpretations during or after execution of the SERVICES will be paid by the CLIENT.
STANTEC shall continue to provide equal employment opportunity to all qualified persons and to recruit, hire, train, promote and
compensate persons In all jobs without regard to race, color, religion, sex, age, disability or national origin or any other basis
prohibited by applicable laws.
COST AND SCHEDULE OF CONSTRUCTION WORK: In providing opinions of probable cost and project schedule, it is
recognized that neither the CLIENT nor STANTEC has control over the costs of labor, equipment or materials, or over the
Contractor's methods of determining prices or time. The opinions of probable cost or project duration are based on STANTEC's
reasonable professional Judgment and experience and do not constitute a warranty, express or implied, that the Contractors' bids,
project schedules, or the negotiated price of the Work or schedule will not vary from the CLIENT's budget or schedule or from any
opinion of probable cost or project schedule prepared by STANTEC. Exact costs and times will be dete.rmlned only when bids
have been received for the PROJECT and when the construction work has been performed and payments finalized.
UMITATlON OF UABlLITY: The CLIENT releases STANTEC from any liability and agrees to defend, Indemnify and hold
STANTEC harmless from any and all claims, damages, losses, and/or expenses, direct and indirect, or consequential damages,
including but not limited to attomey's fees and charges and court and arbitration costs, arising out of, or claimed to arise out of, the
performance of the SERVICES, excepting liability arising from tile negligence or willful misconduct of STANTEC.
DOCUMENTS: All documents prepared by ST ANTEC or on behalf of ST ANTEC in connection with the PROJECT are
instruments of service for the execution of the PROJECT. STANTEC retains the property and copyright in these documents,
whether the PROJECT is executed or not. Payment to STANTEC of the compensation prescribed In this AGREEMENT shall be a
condition precedent to the CLIENT's right to use documentation prepared by STANTEC. These documents may not be used for
any other purpose without the prior written agreement of STANTEC. The CLIENT shall have a permanent non-exclusive, royalty-
free license to use any concept, product or process which is patentable or capable of trademark, produced by or resulting from the
SERVICES rendered by STANTEC in connection with the PROJECT, for the life of the PROJECT. The CLIENT shall not use,
infringe upon or appropriate such concepts, products or processes without the express written agreement of STANTEC. In the

event ST ANTEC's documents are subsequently reused or modified in any material respect without the prior consent of ST ANTEC,
the CLIENT agrees to indemnify STANTEC from any claims advanced on account of said reuse or modification.
STANTEC cannot guarantee the authenticity, integrity or completeness of data files supplied in electronic format ("Electronic
Files"). CLIENT shall release, indemnify and hold ST ANTEC, its officers, employees, consultants and agents harmless from any
claims or damages arising from the use of Electronic Files. Electronic files will not contain stamps or seals, remain the property of
STANTEC, are not to be used for any purpose other than that for which they were transmitted, and are not to be retransmitted to a
third party without ST ANTEC's written consent.
FORCE MAJEURE: Any default in the performance of this AGREEMENT caused by any of the following events and without fault
or negligence on the part of the defaulting party shall not constitute a breach of contract: labor strikes, riots, war, acts of
governmental authorities, unusually severe weather conditions or other natural catastrophe, or any other cause beyond the
reasonable control or contemplation of either party.
GOVERNING LAW: This AGREEMENT shall be governed, construed and enforced in accordance with the laws of Minnesota.
DISPUTE RESOLUTION: If requested in writing by either the CLIENT or STANTEC, the CLIENT and STANTEC shall attempt to
resolve any dispute between them arising out of or in connection with this AGREEMENT by entering into structured non-binding
negotiations with the assistance of a mediator on a without prejudice basis. The mediator shall be appointed by agreement of the
parties. If a dispute cannot be settled within a period of thirty (30) calendar days with the mediator, if mutually agreed, the dispute
shall be referred to arbitration pursuant to laws of the jurisdiction in which the majority of the SERVICES are performed or
elsewhere by mutual agreement.
AlTORNEYS FEES: In the event of a dispute hereunder, the prevailing party is entitled to recover from the other party all costs
incurred by the prevailing party in enforcing this AGREEMENT and prosecuting the dispute, including reasonable attorney's and
expert's fees, whether incurred through formal legal proceedings or otherwise.
ASSIGNMENT AND SUCCESSORS: Neither the CLIENT nor STANTEC shall, without the prior written consent of the other party,
assign the benefit or in any way transfer the obligations of this AGREEMENT or any part hereof. This AGREEMENT shall inure to
the benefit of and be binding upon the parties hereto, and except as otherwise provided herein, upon their executors,
administrators, successors, and assigns.
PROTECllON OF PRIVACY LAWS: STANTEC will comply with its statutory obligations respecting the collection, use, disclosure,
access to, correction, protection, accuracy, retention and disposition of personal Information that may be collected or created
under this AGREEMENT. STANTEC will refer any request for access to or correction of personal information that is made under
statute to the CLIENT and will comply with any directions from the CLIENT respecting the access request, or respecting correction
and annotation of personal information. ST ANTEC will, at reasonable times and on reasonable notice, allow the CLIENT to enter
its premises and inspect any personal information of the CLIENT's that is in the custody of STANTEC or any of STANTEC's
policies or practices relevant to the management of personal information subject to this AGREEMENT.
ENTIRE AGREEMENT: This AGREEMENT constitutes the sole and entire agreement between the CLIENT and STANTEC
relating to the PROJECT and supersedes all prior agreements between them, whether written or oral respecting the subject matter
hereof and no other terms, conditions or warranties, whether express or implied, shall form a part hereof. This AGREEMENT may
be amended only by written instrument signed by both the CLIENT and STANTEC. All attachments referred to in this
AGREEMENT are incorporated herein by this reference; however, in the event of any conflict between attachments and the terms
and conditions of this AGREEMENT, the terms and conditions of this AGREEMENT shall take precedence.
SEVERABILITY: If any term, condition or covenant of this AGREEMENT is held by a court of competent Jurisdiction to be invalid,
void, or unenforceable, the remaining provisions of this AGREEMENT shall be binding on the CLIENT and STANTEC.
THE PARTIES EXPRESSLY ACKNOWLEDGE THAT THIS AGREEMENT CONTAINS L1MITAnON OF LIABILITY
PROVISIONS RESTRICllNG RIGHTS FOR THE RECOVERY OF DAMAGES.

This task involves discussions with City staff and the transfer of project-related information, to finalize

electronic GIS SCL file, with attribute information and (4) receipt of a city street map with street name
index.

conjunction with the City-provided maps highlighting any new streets to be surveyed or streets that are
not to be included in the survey. This task includes the necessary preparation of routing maps and
sectioning, by Stantec staff, for our field survey crew.
Task 2 - Roughness and Distress S!-,rvey
This task involves the collection of pavement roughness and surface distress data, for City identified
streets, using a Stantec RT3000 mobile data acquisition van and experienced field crew. Our standard
survey will be modified to incorporate the local rating criteria for 13 distress types. The Stantec PMA
software allows the roughness and distress observations to be summarized at 100ft-intervals.
Two-lane streets and street sections with partial medians will be surveyed in one direction only. Full-
length four-lane divided street sections will be surveyed In both directions, in the two outside lanes,
where they tend to carry the majority of truck and bus traffic. The 120 test miles of City pavements will
be surveyed according to the aforementioned criteria.
This task will Include having the Stantec field crew perform a walk through with designated City staff, to
ensure an understanding of the local rating standards to be used, prior to the start of the data
collection.
Task 3 - Distress Rating Acceptance
The City has divided its street network into four (4) project areas. This task involves the review, analysis
and summary of the collected distress data, for comparison to control sections in each of the project
areas. Each area will be surveyed in its entirety with acceptance of the control section Surface Distress
Indices approved by the City before the Stantec field crew can start the survey on the next project area.
The City will take no longer than one (1) day to determine acceptance of any project area data set
provided by Stantec.
If the acceptance criteria cannot be met upon completing the survey of a project area, the collected
field data for the control sections will be field checked by the Stantec field crew and compared to the
City-generated data. Then, if necessary, Stantec will make a correction to the rating procedure, as it
relates to distress interpretation, and.. re-survey of the failed project area. The re-survey will again be
subjected to the control section acceptance procedure.
Each project area will include the identification (by the City), of approximately 11 control sections (full
pavement database sections), covering a total length of approximately 1.25 miles. The average
difference between the Stantec SOl scores and the City's control SOl scores will be calculated by
dividing the sum of the differences (+ and -), by the number of control sections (ex: +0.3, +0.3, -0.6, -
0.5 = -0.5/4.0 = -0.1 rounded to the nearest 10th). This average difference must be no greater than +
0.5 points. If this criterion is met, then the average difference will be applied to each of the Stantec SOl

Task 4 - Review, Analyze & Configure Data for Upload Into the PMA Database then upgraded to a
RoadMatrix database
All data accepted in Task 3 will be reviewed, analyzed and configured by Stantec. This data will be
subjected to a series of quality assurance checks and then analyzed to detennine RCI, SOl and POI
perfonnance indicators.
The updated data will then be converted from the PMA database into a RoadMatrix database. Once
completed, the database and installation files will be forwarded to the City on a CD or placed on an FTP
site from which the City can download and install on their network. The database will contain the
updated sectional perfonnance Indicators and detailed station-by-station data. Prior to delivering the
. updated data, the Present Status Analysis component of the software will be run and the results
reviewed by the Stantec Project Manager (PM) as part of a final quality control check.
Task 5 - User Knowledge
City staff will gain further insight into the functionality and capabilities of the Road Matrix pavement
software and will substantially increase their comfort level in assessing and updating data, and in
viewing and evaluating system-generated results.
Task 6 - Annual Software Maintenance Agreement (ASMA)
It is recommended that the City subscribe to an Annual Software Maintenance Agreement (ASMA)
fonnerly ECS. Subject to the tenns of the Agreement, Stantec will provide software upgrades, related
documentation updates, telephone and email support. Software upgrades will encompass new
capabilitieslfeatures that serve to improve software perfonnance.

Where the SERVICES or services conditions change, STANTEC shall submit to the CLIENT in a timely
manner, documentation of the revisions to Attachment "A" adjusting the Contract Services Time and
Price as required.
Unless otherwise specified, charges for SERVICES are based on STANTEC'S hourly billing rate table
("Rate Table"), attached hereto. The Rate Table is subject to escalation from time to time.

Summary
Calvary Lutheran Church, located at 7520 Golden Valley Road, has requested a minor
amendment to their existing Planned Unit Development (PUD) permit. This amendment
would allow for the construction of an outdoor columbarium and memorial prayer garden with
walk. In addition, Calvary would like to convert one of the rooms inside the church for a
columbarium. Both the inside and outside columbarium are indicated on the attached plans.
In a letter to me from Pastor Steve Dornbusch, the columbariums are described along with
the reason for their construction.
The minor amendment to the current PUD permit for the church is necessary because one of
the conditions specifically states that the use of any of the church property for a columbarium
would require an amendment to the PUD. When the PUD permit was last amended in 2004,
there was some discussion about a columbarium at the church. It was my understanding that
the City Council wanted more information prior to approving a columbarium on church
property and more research needed to be looked at regarding laws regulating columbariums.
Since 2004, staff has checked with the State of Minnesota about columbariums. The state
has no restrictions about locating them on church property. The church and family members
would enter into agreements about the long term care and maintenance of the remains in the
columbarium.
Staff is recommending that this amendment to permit both an indoor and outdoor
columbarium consistent with the plans submitted be considered as a minor PUD amendment.
In order to qualify as a minor PUD amendment, the proposed amendment may not:
1. Eliminate, diminish or be disruptive to the preservation and protection of sensitive site
features.
2. Eliminate, diminish or compromise the high quality of site planning, design,
landscaping or building materials.
3. Alter significantly the location of buildings, parking areas or roads.
4. Increase or decrease the number of residential dwelling units by more than 5%.
5. Increase the gross floor area of non-residential buildings by more than 3% or alter it in
such a way as to change its original design or intended function or use.
6. Decrease the amount of open space by more than 3% or alter it in such a way as to
change its original design or intended function or use.
7. Create non-compliance with any special conditions attached to the approval of the
Final PUD Plan.
The indoor columbarium will go into a small room near the Golden Valley Road entrance to
the church. It will not have any impact on the building or its design.
The outdoor columbarium and memorial garden and walk will be located in the oak grove
north of the outdoor worship area. It is the intent of the church to provide a paved walkway
connecting up to six pods. Each pod would have up to three columbarium structures as
shown on the attached plans. At the current time, the plan is to build only one of the pods. If
there is future demand, other pods would be constructed. The memorial walk and gardens
would not have an impact on the existing worship area. The plan is to place the pods so that
there would be minimal or no tree loss. Each of the columbarium structures would be about
six feet high and nine feet long and have 72 niches for remains. With the fence along the
north property line adjacent to the Three Rivers trail and landscaping, these pods should not
noticeable to the properties north of the railroad tracks.
Staff believes that the indoor and outdoor columbarium meets the test for them to be
considered as a minor PUD amendment. In particular, the outdoor columbarium and
memorial garden will not have a negative impact on the overall site planning or significantly
reduce the open space on the site. It will be done in a way to minimize or have no tree loss.
The memorial walk will provide for better access to the oak grove at the north of the site by
providing a paved walkway that is accessible to those in wheelchairs or needing assistance.
Staff recommends that the permit for PUD No. 46, Amendment No.5, Calvary Lutheran
Church, be amended to allow for an indoor columbarium in the Luther Room or other room as
chosen by the Church. Also, the permit is amended to allow for the construction of an outdoor
columbarium with memorial prayer garden and walk as shown on the attached site plans and
drawings of the outdoor columbarium. It is understood that the final design of the outdoor
columbariums and specific location of the walk and memorial gardens may differ from the
concept drawings and site plan. The columbarium structures shall not exceed 7 feet in height
and be no closer than 10 feet from the property line.

except as follows:
a. Outdoor services using amplified voice and music will be permitted
on a trial basis during the year 2004. During this year, up to three
services may be conducted each week between the hours of 10 am
and 9 pm. Additional outdoor events or services during 2004 may
be permitted with notification given to the City at least 72 hours
prior to the event with assurances from the Church that noise levels
would be consistent with other outdoor services in 2004. Such
services are permitted for the purpose of determining whether it is
possible to develop such reasonable, objective and measurable
noise standards as are needed to protect nearby residential uses
from the adverse effects of amplified sound that have been
experienced in the past. The Church will also notify all property
owners located north of the railroad tracks between Pennsylvania
Avenue North and Sumter Avenue North up to and including
Phoenix Street.
b. Upon development of such proposed objective and measurable
noise standards, the applicant may submit proposed standards to
the City Council for administrative approval. If the City Council
determines that such proposed standards, or any modifications to
such proposed standards deemed appropriate by the City Council,
are adequate to protect nearby residential uses from the adverse
effects of amplified sound, the Council may administratively amend
this condition to allow the use of amplification for voice or music on
such conditions as the Council determines are reasonable and
necessary. During the testing the consultant will involve the
residents, Church and City in the process.

Summary
The City of Golden Valley is included in a group of communities with population greater than
10,000 that are federally required to obtain a Municipal Separate Storm Sewer System (MS4)
Permit for managing nonpoint source storm water. Nonpoint source storm water is generally
the overland flow of storm water that does not originate from a single pipe.
The Phase II National Pollution and Discharge Elimination System (NPDES) permitting
process required cities such as Golden Valley to file a Phase II NPDES permit with the
Minnesota Pollution Control Agency (MPCA) by March 10, 2003. The permit application
addressed how the City regulates and improves storm water discharges, and includes a
Storm Water Pollution Prevention Plan (SWPPP) addressing all the requirements of the
permit. The current permit is scheduled to expire in 2011.
Golden Valley's SWPPP addresses the six minimum control measures outlined in the permit
requirements. Many of the Best Management Practices, required in the NPDES permit, have
already been developed in accordance with the City's Surface Water Management Plan. The
six minimum control measures of the permit are:
1. Public Outreach and Education,
2. Public Involvement and Participation,
3. Illicit Discharge, Detection and Elimination,
4. Construction Site Runoff Control,
5. Post Construction Runoff Control, and
6. Pollution Prevention and Good Housekeeping.
An annual public meeting and preparation of a report is a requirement of the NPDES permit.
The meeting has been advertised for June 17, 2008 at 7 p.m. Cities must create a record of
the public comments received, either written or oral. The public input must be considered and
a record of decision must be added to the annual report.

RESOLUTION ISSUING A NEGATIVE DECLARATION OF NEED
FOR REVISIONS TO THE STORM WATER POLLUTION PREVENTION PLAN
WHEREAS, the City prepared and submitted to the Minnesota Pollution Control
Agency (MPCA) its permit application for operation of the City's Municipal Separate Storm
Sewer (MS4) on March 10,2003; and,
WHEREAS, the permit required that the City develop a plan for regulating and
improving storm water discharge commonly referred to as the Storm Water Pollution
Prevention Plan (SWPPP); and,
WHEREAS, staff has been working to meet the objectives set forth in the SWPPP
and is required to report to the MPCA on the status of the plan's implementation on an
annual basis; and,
WHEREAS, the City has placed notification of a public hearing in the City's official
newspaper and has held a public hearing to report on progress made in implementation of
the SWPPP and to take public testimony; and,
WHEREAS, comments made during the public hearing will be incorporated into the
City Council record.
NOW, THEREFORE, BE IT RESOLVED, the City of Golden Valley has determined
that no revisions to the Storm Water Pollution Prevention Plan (SWPPP) are required and
staff is hereby directed to file the annual report with the Minnesota Pollution Control
Agency.

Summary
The City Council approved the proposed revisions to City Code, Sections 3.30 and 3.31,
Rules and Regulations Relating to Sanitary Sewer Service ordinance on its first consideration
on June 3, 2008. However, Council requested that some modifications be made to the
ordinance prior to its second consideration. After discussion with the City Attorney, staff
believes that it is in the best interest of the City to review the proposed revisions with the City
Council at a future Council/Manager meeting prior to consideration at a regular City Council
meeting.
Recommended Action
Motion to direct staff to place Proposed Revisions to City Code, Sections 3.30 and 3.31,
Rules and Regulations Relating to Sanitary Sewer Service on a future Council/Manager

Summary
The commercial building located at 6200 Olson Memorial Highway is abandoned and in
disrepair. Minnesota Statute 463.15 subdivision 3 states that a "hazardous building or
property, which because of inadequate maintenance, dilapidation, physical damage,
unsanitary conditions or abandonment, constitutes a fire hazard or a hazard to public safety
or health." The building meets the criteria of a hazardous building. Upon Council approval the
property owners will be served this order and enforcement of this order will be made to the
District Court of Hennepin County unless corrective action is taken.
All costs of this proceeding and the removal of the hazardous condition will be charged to the
owners or assessed against the real estate pursuant to Minnesota Statute 463.21.

You and each of you are hereby ordered pursuant to the provisions of Minnesota Statutes
sections 463.16 to 463.261, inclusive, to take the following action with respect to the above-
described property, upon which the City Council of the City of Golden Valley has determined
there exists a hazardous building within the meaning of the aforesaid Minnesota Statutes.
REMOVAL OF HAZARDOUS BUILDING
By this Order, pursuant to Minnesota Statutes section 463.151, the City orders the owner
of the property to correct or remove the hazardous condition of the building and property.
1. Remove the building/structure now located on the above-described premises.
2. Seal the sanitary sewer line, water line, and other utilities leading from the premises.
3. Fill to grade and cover any excavation remaining after the removal hereinabove ordered.
FINDINGS OF FACT
The foregoing Order is based upon the finding by the City Council of the City of Golden
Valley that the property is a hazardous building defined by Minnesota Statutes section 463.15
due to its "inadequate maintenance, dilapidation, physical damage, unsanitary condition, or
abandonment" and the following findings of fact based on the report of the City's Building
Inspector.
A. Inadequate Maintenance and Physical Damage:
Roof: joist and decking is severely rotten, falling down and collapsing into the southeast
comer of the building.
Soffit/Fascia: The paint is severely cracked, peeling, blistering and falling off the
perimeter of the structure. Rotten and water soaked fascia boards are falling off the building.
B. Dilapidation:
The following damage is evidence of the property's fall into ruin or decay by neglect.
Roof: joist and decking is severely rotten, falling down and collapsing into the southeast
comer of the building.
Soffit/Fascia: The paint is severely cracked, peeling, blistering and falling off the
perimeter of the structure. Rotten and water soaked fascia boards are falling off the building.
Interior:
Components have been removed from the property. Interior walls are ripped apart. The
ceiling is falling down.
C. Unsanitary Conditions:
The domestic water meter was removed on September 18,2006. There has been no
water or fire suppression since September 18, 2006. The electrical panels are removed. The
parking lot is being used as an indiscriminant dumping site.

D. Abandonment:
The property has been abandoned since September 18, 2006. Records show that on
February 16, 2007, a new property owner, Hempel Properties, was issued a certificate of
compliance permit (GV033963) for inspection of the sanitary sewer service of the property. As
of May 13,2008, there was no response to either of two correction letters sent to Hempel
Properties. The permit has now expired.
E. Fire Hazard/Public Hazard:
The Building Inspector of Golden Valley has concluded that the property is indeed a fire
and public hazard as it is unsecured and completely accessible by anyone in the general public.
The property is a hazard to fire fighters because of physical damage to the building, unsafe roof
conditions and a lack of fire suppression on the property. In addition, the property has potential
methane gas issues.
IT IS FURTHER ORDERED by the City Council of the City of Golden Valley that you
have thirty (30) days from the service ofthis order upon you within which to comply with the
terms of this order. You are hereby notified that a motion for summary enforcement of this order
will be made to the District Court of Hennepin County, State of Minnesota, unless corrective
action is taken by the aforesaid compliance date, or unless an answer to this Order is served upon
the City of Golden Valley within twenty (20) days from the date of the service of this Order upon
you, in the manner for service of such Answer as is provided in Minnesota Statutes section
463.18.
IT IS FURTHER ORDERED that all costs of this proceeding and the removal of the
hazardous condition be charged to the owners or assessed against the real estate pursuant to
Minn. Stat. 9 463.21.
