Section 5.30:
Non-intoxicating Malt Liquor License Required
It is unlawful for any person, directly or indirectly, on any pretense or by any
device, to sell, barter, keep for sale, or otherwise dispose of non-intoxicating malt
liquor, as part of a commercial transaction, without a license therefore from the
City. This Section shall not apply to sales by manufacturers to wholesalers or to
sales by wholesalers to persons holding the appropriate non-intoxicating malt liquor
license from the City. Annual on-sale non-intoxicating malt liquor licenses may be
issued only to drug stores, restaurants, hotels, bowling centers, clubs, and
establishments used exclusively for the sale of non-intoxicating malt liquor with the
incidental sale of tobacco and soft drinks. Any person licensed to sell liquor on-sale
shall not be required to obtain an on-sale non-intoxicating malt liquor license, and
may sell non-intoxicating malt liquor on-sale without an additional license. Any
person licensed to sell liquor off-sale shall not be required to obtain an off-sale beer
or non-intoxicating malt liquor license, and may sell beer or non-intoxicating malt
liquor off-sale without an additional license.
