Council/Manager Meeting Minutes
June 10, 2008
Present: Mayor Loomis and Council Members Freiberg, Pentel, Scanlon and Shaffer.
City Manager Tom Burt, Public Works Director Jeannine Clancy, Director of Planning
and Development Mark Grimes, and Administrative Assistant Christine Columbus.
The meeting began at 6:30 pm in the Council Conference Room.
Confirmation of Conditional Use Permit Requirement - 1405 Lilac Drive North
Mark Grimes reported that he has been mediating with an adjacent property owner,
John Giese (5545 Golden Valley Road) on the appropriate screening to be established
to the rear of 1405 Lilac Drive North to satisfy the conditional use permit. Possible
options include a six foot cedar fence, an eight foot cedar fence or the planting of two or
three trees to create a natural screen.
The consensus was to check with Allen Barnard about whether the motion must come
back to the Council to be amended. John Giese will be notified that the Council will re-
visit requiring a fence after discovering the installation of the fence would require the
removal of trees. The owner of the property will also be notified and given additional
time to meet the conditions of the CUP.
Request for Ban on Pit Bulls
Residents, Stan and Alice Pearson, Maria T. Wetherall and Leo Aufdermauer mailed
letters to the Mayor requesting the City Code be amended to ban Pit Bulls.
Tom Burt supplied copies of the 2007 Minnesota Statutes which prohibits cities placing
bans on specific breeds of dogs. A discussion ensued about the current city dog
ordinance being weak. The Council would like the ordinance to be re-written to include a
stipulation that owners of dangerous dogs would be required to have a rider on their
homeowner's insurance and to provide proof of insurance yearly.
The consensus was that staff will research and draft an ordinance that assures the
ordinance will be defendable in a court of law. The staff will bring the draft ordinance to
the Council for discussion at a future Council/Manager meeting.
Utility Markings on Sidewalks
Council Member Scanlon voiced her concerns that the utility markings on new
sidewalks and curbing are excessive and the markings last longer than a season.
Jeannine Clancy offered to remind the utility companies who are registrants with the
City of Golden Valley that they should only use paint that is water-based and lasts only
a season.

Clarification Regarding Set Backs Established in Ordinance Number 382 (added
Agenda Item)
Mark Grimes asked for Council direction on the intent of the setback provisions of
Ordinance No. 382 regarding Infill Housing. The Council concluded that the ordinance
was written with the intention of applying to only those walls where the height exceeded
15 feet. Mark Grimes will re-write the ordinance for clarity regarding set-back and wall
height pertaining to only those walls in excess of 15 feet.
Proposed 2009 Operating Budget for Bassett Creek Watershed (added Agenda
Item)
Mayor Loomis asked that this item be placed on the agenda and distributed the Bassett
Creek Watershed Budget. She asked the Council to review the Bassett Creek
Watershed Operating Budget and Project Updates. The Mayor would like the Council
consensus as to whether the proposed budgeted amount of $35,000 for an
Administrator on line 17 is acceptable.
