06-02-09 CC Minutes Regular Meeting of the City Council June 2, 2009 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on June 2, 2009 at 6:30 p.m. The following members were present: Freiberg, Loomis, Pentel, Scanlon and Shaffer. Also present were: Thomas Burt, City Manager, City Manager; Allen Barnard, City Attorney; and Judy Nally, Administrative Assistant. Approval of Agenda MOVED by Pentel, seconded by Freiberg and motion carried unanimously to approve the agenda of June 2,2009 as submitted. Approval of Consent As;lenda MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve the agenda of June 2, 2009 as amended: Removal of Fireworks Permit- Melrose North Pyrotechnics, Inc. for Golden Valley Fire Relief Association Street Dance and Acceptance of Donation - Golden Valley Federated Women's Club for Concerts in the Park Series. Fireworks Permit - Melrose North Pyrotechnics, Inc. for Golden Valley Fire Relief Association Street Dance Council Member Pentel highlighted the Fire Relief Association street dance, fireworks and the "Three Words Firefighter Recruitment Campaign" Award received by the City. MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve the fireworks display permit for Melrose North Pyrotechnics, Inc. to discharge aerial fireworks at the Breck School baseball fields for the Golden Valley Fire Relief Association Street Dance on June 20, 2009. MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve the solicitor's license for Brown Brother's Remodeling Inc. *Solicitor's License - Phillips Construction MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve the solicitor's license for Phillips Construction. *Minutes of Boards and Commissions MOVED by Pentel, seconded by Shaffer and motion carried unanimously to receive and file the minutes as follows: Board of Zoning Appeals - March 24, 2009 Environmental Commission - April 27, 2009 Envision Connection Project Board of Directors - April 23, 2009 Bassett Creek Watershed Management Commission - March 19, 2009 Joint Environmental Commission and Planning Commission - April 27, 2009 *Authorization to Extend Fire Relief Association Street Dance Hours MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve the extension of hours for the Golden Valley Fire Relief Association Street Dance to midnight on Saturday, June 20, 2009. *Acceptance of Donation of Memorial Bench - General Mills Headquarters Nature Preserve for Meredith Weimer Bender from Friends at General Mills Member Pentel introduced the following resolution and moved its adoption: RESOLUTION 09-29 RESOLUTION ACCEPTING DONATION FOR MEMORIAL BENCH FOR MEREDITH WEIMER BENDER FROM FRIENDS AT GENERAL MILLS FOR GENERAL MILLS HEADQUARTERS NATURE PRESERVE The motion for the adoption of the foregoing resolution was seconded by Member Shaffer and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Loomis, Pentel, Scanlon and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Regular Meeting of the City Council June 2, 2009 Page 3 Acceptance of Donation - Golden Vallev Federated Women's Club for Concerts in the Park Series Council Member Scanlon highlighted the Women's Club and stated they are currently looking for members. Member Scanlon introduced the following resolution and moved its adoption: RESOLUTION 09-30 RESOLUTION ACCEPTING DONATION FROM GOLDEN VALLEY FEDERATED WOMEN'S CLUB FOR CONCERTS IN THE PARK SERIES The motion for the adoption of the foregoing resolution was seconded by Member Freiberg and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Loomis, Pentel, Scanlon and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. *Approval of Reauests for Beer and/or Wine at Brookview Park MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve the requests for beer and/or wine at Brookview Park as recommended by staff. Public Hearing - Issuance of Revenue Note - WorkAbilities, Inc. Sue Virnig, Finance Director, introduced the agenda item and answered questions from the Council. Steve Fenlon, MHC, reviewed the project and answered questions from the Council. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one, the Mayor closed the public hearing. Member Freiberg introduced the following resolution and moved its adoption: RESOLUTION 09-31 RESOLUTION GIVING PRELIMINARY APPROVAL TO A PROJECT UNDER MINNESOTA STATUTES, SECTIONS 469.152 THROUGH 469.165 AND REFERRING THE PROPOSAL TO THE MINNESOTA DEPARTMENT OF EMPLOYMENT AND ECONOMIC DEVELOPMENT FOR APPROVAL - WORKABILlTIES, INC. Regular Meeting of the City Council June 2, 2009 Page 4 Public Hearing - Issuance of Revenue Note - WorkAbilities, Inc. - Continued The motion for the adoption of the foregoing resolution was seconded by Member Pentel and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Loomis, Pentel, Scanlon and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Member Freiberg introduced the following resolution and moved its adoption: RESOLUTION 09-32 RESOLUTION APPROVING THE ISSUANCE AND SALE OF A REVENUE NOTE, SERIES 2009 (WORKABILlTIES, INC. PROJECT) IN THE AGGREGATE AMOUNTOF NOT TO EXCEED $1,500,000 AND AUTHORIZING THE EXECUTION OF DOCUMENTS RELATING THERETO The motion for the adoption of the foregoing resolution was seconded by Member Pentel and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Loomis, Pentel, Scanlon and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Authorizing Issuance, Awarding Sale, Prescribing the Form and Details and Providing for the Payment of $5,665,000 General Obligation Improvement Refunding Bonds, Series 20090 Sue Virnig, Finance Director, stated the bond market rallied and bonds were not able to be refinanced at this time. Staff is requesting consideration of a resolution which allows the City Manager to authorize approval to refinance when the bond interest saving rate is 3.1 % or over. The Council did not consider Resolution 09-33, Resolution Authorizing Issuance, Awarding Sale, Prescribing the Form and Details and Providing for the Payment of $5,665,000 General Obligation Improvement Refunding Bonds, Series 20090. Member Pentel introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING ISSUANCE AND SALE OF $5,665,000 GENERAL OBLIGATION IMPROVEMENT REFUNDING BONDS, SERIES 20090 The motion for the adoption of the foregoing resolution was seconded by Member Shaffer and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Loomis, Pentel, Scanlon and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. The Council will conduct a Board/Commission interview on June 9,2009 at 6 pm. The next Council/Manager Meting is June 9, 2009 at 6:30 pm. Some Council Members may attend the Bassett Creek Watershed Commission Tour on June 11, 2009 at 8:30 am. Some Council Members may attend the Bridge Builders Informational Meeting on June 13, 2009 at 10 am at the Animal Humane Society. A Concert in the Park featuring Golden Valley Orchestra will be held on June 15, 2009 at 7 pm at Brookview Park. The next City Council meeting is June 16, 2009 at 6:30 pm. The Fire and Police Open House is June 17, 2009 from 6 to 8 pm at all Police/Fire buildings. Some Council Members may attend the Board/Commission Recognition Dinner on June 17,2009 at 6:30 pm at the Brookview Community Center. A Bassett Creek Watershed Management Commission meeting will be held on June 18, 2009 at 11 :30 am. A Concert in the Park featuring Robbinsdale City Band will be held on June 18, 2009 at 7 pm at Brookview Park. The Golden Valley Historical Society Antique Road Show will be held on June 20,2009 at 1: 15 pm at The Heathers. The Fire Department Street Dance is June 20,2009 at the American Legion. A Concert in the Park featuring Jeff Brooks will be held on June 22,2009 at 7 pm at Brookview Park. A Concert in the Park featuring Stomping Dixie will be held on June 29,2009 at 7 pm at Brookview Park.
