Summary
Attached to this memorandum is a letter from Mr. Glenn Fuller of 2224 Windsor Way. The
Fuller property is within the 2009 Pavement Management Project. At its May 12, 2009
Council/Manager meeting, the City Council considered a request from the Fullers to install a
dropped curb on the Markay Ridge frontage of their lot to allow driveway access to the rear of
the house. At this meeting, the Council directed staff to meet with the Fullers to work on
providing access to the rear of the home via the primary driveway to the home.
Staff met with Mr. Fuller and offered to grade the boulevard to the north of the driveway to
allow a relatively level access route. Staff had not heard back from the Fullers until the recent
letter dated June 29, 2009 was received.
Council Member Scanlon has requested that that this item be placed on the July 14, 2009
Council/Manager Meeting agenda.

Re: Request for 12 ft of mountable curb - it is now
"crunch" time!
Dear Mayor Loomis,
My wife, Marlys, and I have tried to go through
the normal route to get approval for our request for
12 ft. of mountable curb on Markay Ridge to permit
convenient access to our back door when dealing
with heavy groceries, luggage, propane tanks,
persons disabled, etc. - as we have had and used for
49 years. I have enclosed a copy of my letter to the
City Engineer and my email to the Director of Public
Works as they outline in more detail why this issue is
so important to us.

6. Our request was agenda item #3 at the
CouncillManager Meeting of 5-12-2009. The
Director of Public Works and City Engineer
prepared an "Executive Summary" for our
request - which drew some totally
unsubstantiated conclusions - please r~ad our
critique of the "Executive Summary" attached.
7. Meeting "on site" with City Councilman
Freiburg - 6-24-09 as he was absent from the
CouncillManager Meeting of 5-12-2009.
8. Called City Councilman Shaffer on 6-25-09 in
an effort to set up an "on site" meeting with
him. At present, this has not taken place.
At the CouncillManager meeting it was evident that
the "Staff' is dead set against our request. However,
alternative ideas were advanced: A. Drive into the
back yard by entering our front yard via the north
side of the driveway and driving up the slope around
into the back yard. This is doable, but it is not a good
idea; it feels like the car is going to tip over; the tires
cut into the sloping grass so we would have tire
marks on our front lawn; a mountable curb is a much
more benign solution as indicated by the two white
milk bottles that represent the 12 ft mountable curb
position on Markay Ridge (see photos #1,#2,#3). B.
The City would allow the mountable curb with the
understanding that when we sell the house that it
would then be removed. This would be a
compromise, but the mountable curb is an amenity to
the property. Any future owner would want the same
ability to access the back door with three steps up or
down rather than the front door with its fourteen steps
up or down. C.Put three or four 2x4's down in the
gutter to form a bridge up onto the lawn from the
street. This would be totally inconvenient - and
possibly dangerous - for either my wife or me to
contend with every time we wish to mount our curb.
Why is the "Staff' vehemently against our simple,
benign request for 12 ft. of mountable curb that
conveniently permits us to function in our home as
we have for fifty years? There is only one possible
reason: During ten years of "managing" the
Pavement Management Program for Golden Valley
they have concluded that the easiest way to handle
citizen requests is to always say "NO". Item 5b. of
the Executive Summary mentions that in the 2005
PMP they allowed a driveway apron where the
property owner did not follow through on his
commitment to pave the driveway. Must we be
denied our request because that homeowner didn't
follow through as he should have! Item 5a. comments
on a 2006 PMP driveway that was put in and served
both the homeowner and the City of Golden Valley
by providing access to a pond for maintenance
purposes. Conclusion: if the "Staff' wants
something they get it; if a citizen of Golden Valley
wants something the answer is "NO". Apparently
this has been going on for ten years. It saves
everyone from having to make a "value judgement"
based on the merits of any request. So after ten years
of this attitude a member of our City Council can
make the statement: "If we do something nice for
you, it may give us a problem in the future"! ! !
In over a year of pursuing this request for a
mountable curb to conveniently permit us to drive up
to our back door we have not heard of one
substantive reason why it is being denied. The
"Staff' says that they are just doing what they have
been instructed to do, and if they let us have our
mountable curb the standards of Golden Valley will
collapse. So they develop an "Executive Summary"
that talks primarily about boulevard parking and
auxiliary driveways; they even say that my request is
for a "secondary driveway" so they can lump it in
with discussions that took place back in the year
2000! This is totally unfair to me and my wife.
Please read our critique of the Executive Summary
attached.
Mayor Loomis, we really need this amenity to our
property. The City Council and the "Staff' should
realize that the citizens of Golden Valley are aging;
we need some consideration for things that make our
life easier here in Golden Valley - not more difficult!
Please let me know what else I can do to convince
the City Council to approve my tiny request for 12 ft.
of mountable curb adjacent our property on Markay
Ridge. There cannot be a simpler, more benign
request than this one. If it is denied, then the citizens
of Golden Valley get the unmistakable message that
it is useless to request anything from the Golden
Valley City Council because: "If we do something
nice for you, it may give us a problem in the future."
A generic "put down" if there ever was one!

. A CRITIQUE
It is admirable for the City Council to support their
"Staff' . However, in this case their position on our
request is not supportable:
Staff frames our request as one for: "Secondary
Driveway" when no communication I have made
has ever mentioned a "Secondary Driveway" . We
do not want a secondary driveway; we do not want
an apron; all we do want is 12 ft of mountable
curb. Staff are the only ones that ever mention
secondary driveways and auxiliary parking spaces
all of which have nothing to do with my request.
Finding #1 - At one time our area - called
Westurban - was interested in having
surmountable curbs throughout. Plowing
considerations apparently were the major detriment
to this idea. Twelve feet of mountable curb does
not pose the same problem.
Finding #2 - No tire tracks - Is "Staff' suggesting
that we really don't drive up on our back yard
enough to consider it a hardship if we can't do it.
Ridiculous! ! We have been doing it for fifty years.
Finding #3 - Yes, we do take heavy things into the
house via the garage when there is snow on the
ground. This is when we realize how important the
mountable curb is during the other eight months of
the year so we don't have to deal with those
fourteen steps.
Finding #4 - There are no handicapped people
living in our house right now. This is true, but I
have artificial knees, my wife has artificial hips,
and we have relatives and friends that can not walk
up or down fourteen steps and must come in or out
via the back door.
Finding #5 - This discussion refers to auxiliary
driveways again and references the March 15,2000
Council/Manager Meeting Minutes that are titled:
Boulevard Parking Areas In Pavement
Management Projects - where the bottom
paragraph says: "The Council consensus is to
allow parking related to existing driveways and
discourage those removed from the driveways,
except in hardship cases where there is limited on-
street parking ....."
These minutes from the March 15, 2000 meeting
are about boulevard parking, they are irrelevant to
our request for 12 feet of mountable curb.
The Summary goes on to conclude: "Based on the
findings of this investigation, staff determined that
there was no hardship present at the Fuller
residence and the request to install localized
surmountable curb for driveway access to the rear
of the home was denied."
IT IS AGREED THAT THERE IS NO
HARDSHIP AT THE FULLER RESIDENCE
NOW! ! ! ! ! ! ! ! ! ! ! !
THE WHOLE POINT OF THE LETTERS AND
MEETINGS IS TO CONVEY TO PEOPLE THAT
THERE WILL BE PLENTY OF HARDSHIP IF

Hello Jeannine Clancy.D Back on March 26th you witnessed the last part of
a conversation I had with Jeff Oliver relative to my written request to him -
dated February 23,2009 - to include twelve feet of mountable curb on the
Markay Ridge portion of our corner lot as part of the area 3 Project
Management Plan that affects our neighborhood of Westurban this
summer.O As you know, I was totally dumbfounded to learn that my request
was being turned down.O A few days after that meeting I left for a month in
Texas where I am right now. 0 I expect to return to Golden Valley on or
about May 1 st. 0 Soon after I will give you a call; I would like to meet with
you so we can discuss this further.
This issue is very important to my wife and me, and I feel that Golden
Valley should agree to our request for the following reasons: 0 1. We have
been good citizens of Golden Valley since 1961; a simple reasonable request
for 12 feet of mountable curb where we want it should be happily honored
by our City of Golden Valley. 0 2. 0 We have had a mountable curb where
we want it for 48 years; we occasionally bring in groceries directly to our
kitchen, and load heavy luggage directly into the car from the house - all
without the need to carry heavy items up or down fourteen steps which is
necessary if we enter or exit the front of the house.D This amenity of this
unique property is important and valuable - result of careful planning when
we had the house built and the yard landscaped.O Certainly this labor saving
feature of the property deserves "grandfathering in". 0 3.0 We have
handicapped friends that cannot traverse fourteen stairs; they will not be able
to enter our house without our mountable curb feature.
I am hoping Ms Clancy that we can meet and keep this "molehill" 0 ofa
request from becoming a "mountain" ofa problem for either one ofus.O

RE: REQUEST For a 12 ft. Mountable Curb on Markay
Ridge on the north side of our comer lot -
At 2224 Windsor Way.
Please be aware that we purchased this vacant lot back in
1960. We landscaped it at considerable expense to have a
back yard at the same elevation as the road at one point to
make it possible to . drive onto the back yard. This was
planned to make it easier to bring groceries, handicapped
people, and anything else into the house via the back
entrance. Both front entries require climbing fourteen steps
- a hardship that was recognized and overcome by
landscaping at the time of building on the property.
For almost fifty years we have enjoyed this element of
thinking ahead. Every time we bring a handicapped friend
or a load of groceries in by virtue of our ability to drive up
to the back door we appreciate our foresight of long ago!
My wife and I respectfully request that the new curbs and
gutters being put in this summer as part of Golden Valley's
Pavement Management Program have in the plan a twelve
foot section of mountable curb centered on the elevation
where the road and our back yard are as close to the same
as possible.
We have lived in Golden Valley for forty-eight years. In
all that time we have never made a special request of
Golden Valley of any kind. But we are very anxious about
this and hope that you will look favorably on this request as
it is very important to us.

Rega residents from Golden Valley, Minneapolis and
other co ften commented on the current state of disrepair
of several ts of h Park. Examples include the condition of the
traifs, street artOctrai: ting, and parkway roads. In addition, drainage
issues affecting t rkway, trails and Glenwood Avenue, which is a
county road, have been an ongoing difficulty. The deteriorated condition of
the parkway was even called out in an article on bicycling in the Twin
Cities in the June 2009 edition of Mpls/St. Paul Magazine.
Another infrastructure issue affects water quality. Bassett Creek, Sweeney
Lake and Wirth Lake are all on the Minnesota Pollution Control Agency's
Impaired Waters list. Furthermore, the water quality of Twin Lake has
recently shown signs of degradation. A concerted effort by interested and
responsible agencies is required to appropriately address the
maintenance issues associated with Basset Creek and lake water quality
issues. Intergovernmental cooperation will be key to obtaining State funds
that are desperately needed to implement water . y projects.
Regarding public safety, the City of Golden lice Department has
received an untold number of complaints gal activities,
including public nudity, at the unauthori~~cjbeach I ted on Twin Lake.
While the Minneapolis Park and Recreation Board (M B) police are
willing to respond on a complaint basis, Golden Valley wOlI...Jike to

Summary
The Center for Energy and Environment provides comprehensive building analysis. The
comprehensive building analysis is a service that identifies and prioritizes rehabilitation
opportunities for property owners within the City. This service is provided through an annual
contract approved by the City Council at a cost of $130 per building analysis. The Center for
Energy and Environment also provides rehabilitation financing programs at no additional cost
to the City. The number of building analyses has continued to increase each of the three
years that it has been available.
In 2007, there were 29 building analyses, 2008 had 34, and for January through June 30,
2009 there have been 64 building analyses. Attached is a map which shows the locations of
2009 properties that were analyzed. The 2009 budget includes $10,000 for comprehensive
building analyses. Expenditures through June 30, 2009 totaled $8,320. At the current level of
participation in the program, the budgeted amount will be expended prior to the end of the
year. The increased participation in 2009 is likely a result of staff increasing public awareness
of the program through CityNews, local cable television and the home remodeling fair.
The 2010 proposed budget includes $7,500 for comprehensive building analysis services.

This is the first year the City of Golden Valley has embarked on a two-year biennial budget.
Many assumptions were made and will have to be reevaluated as time passes, and hard
choices have been made by staff to balance this biennial budget. The first budget discussion
will be held at the July 14 Council/Manager meeting. The 2010 proposed levy, which will be
used for the Truth in Taxation (TNT) notices, will be approved at the City Council Meeting of
September 1. In December the final 2010 levy and budget will be approved for 2010 Property
Tax Statements. This proposed biennial budget includes General Fund expenditures,
General Fund revenues, and the 2010-2011 CIP for Parks, Buildings, and Equipment. All
enterprise, special revenue, and internal service budgets will be distributed in September.
Starting with the direction from the March Council Workshop until the production of this
budget, the following overall factors taken into account are listed below:
The 2009 legislation did not eliminate levy limits for the 2010 and 2011. budget years. The
2010 Implicit Price Deflator (IPD) set by the US Department of Commerce, Bureau of
Economic Analysis (BEA) was at .86 percent as of April 1. This factor is the percentage
the state will allow the increase to the city's operating tax levy. The total increase to 2010
property taxes allowed is $102,095. For 2011 the percentage is unknown, but for budget
purposes the amount of increase is $23,950.
The Department of Revenue does not send out its levy limitation notice until early August.
This notice is City specific and has the adjustments to the levy limit factor for new
households and increases for new construction. The adjustments may increase the total
amount allowed to levy for 2010.
In 2009 the levy limit was 3.9%, although the IPD was at 6.1 percent. The levy limit statute
applies the lesser of the two factors.
Although Golden Valley did not have as many foreclosures as some communities, the
overall taxable market value of all properties were affected by the market. Golden Valley
lost $2,303,222, or 5.2%, in gross tax capacity.
Certain property tax levies are authorized in addition to the overall levy limit. These. are
called special levies, and the State law has approved 20. Such additions for Golden
Valley will be the levy for the Golden Valley Fire Relief Association Pension, Tax
Abatement Debt Levy, Certificates of Indebtedness, and Bonded Indebtedness for the
Pavement Management Program.
The Golden Valley Fire Relief Association invests its pension assets with the Minnesota
State Board of Investments. The City is required by State to levy for the shortfall to meet
the normal cost plus amortizing any existing prior year service costs over a 10-year
period. Because the overall pension assets dropped to 83% of the funded rate, the City is
anticipating a required levy for 2010 and 2011. The estimated levy amount was set at
$200,000, but the actual amount needed is not due to the City until July 31.
The Tax Abatement Levy is to pay for the bonds issued to pay for the improvements to
Trunk Highway 55 and Boone Avenue. These improvements were tied to the General
Mills expansion of its campus. This levy will not increase for 2010 and 2011 budget years
and will end in 2019.
Direction from the workshop in March was to keep equipment certificates level for 2010
and 2011. The amount of bonded debt for certificates in 2010 and 2011 is at $750,000.
Direction from Council was to plan for the 2010 Pavement Management Program. Each
fall the Council will review the scheduled improvements for the geographic area as
previously proposed and the impact on the additional levies for bonded (jebt on the
remaining streets to be improved. The original program would have ended in 2019, but
due to economic impacts, the street improvements may need to be delayed. In 2010, the
bonded debt levy is $2,994,900; in 2011 it is $3,229,823.
Market Value Homestead Credit (MVHC) and Local Government Aid (LGA) was part of
the governor's unallotment plan. Golden Valley lost $185,000 in 2008, $344,471 for 2009,
and a $369,238 loss is planned for 2010 in MVHC. The 2009 and 2010 plan includes this
as a loss of levy aid. If we are to lose this aid again for 2011, the budget will need to be
trimmed at least $369,238. Golden Valley does not receive LGA from the State.
The League of Minnesota Cities has warned cities not to anticipate improvement in the
state's economic condition for awhile. The state budget forecast will likely be facing
another 3 to 4 billion deficit into the 2012-2013 biennium.
An option for cities is to levy this lost MVHC and LGA as a special levy. Golden Valley has
not added this levy to this budget.
Golden Valley is a contributor to the Fiscal disparities program. This is a mandatory
program that compares increases in property values to commercial and industrial values
to the 1971 base year and shares that growth with other jurisdictions. In 2010, it is
estimated we will contribute an additional $209,593 of net tax capacity to the pool. The
same amount was used for the 2011 budget.
Council direction was to not increase salaries and wages for employees in 2010. The goal
was to try to keep the same staffing to meet the needs of the community. The 2010
budget includes no increases in salaries and wages for all employees. In 2011, the salary
contingency is set at 3% and is included in all divisions.
Seasonal and temporary employees have not seen pay increases since 2009. In 2010
and 2011, no increase is budgeted for these positions. If the State approves adding sick
and vacation leave to these positions, it will further impact the budget.
Currently benefit earning employees will see a 15.63% increase in health insurance for
2010. This is the last year of the three year contract for the consortium. In 2011, the
consortium will request bids for health insurance.
Delays on hiring due to retirements or job opportunities have allowed for some savings.
One position will not be filled in 2010 and 2011.
Once again energy prices have impacted the budget. Golden Valley has joined the State
Consortium to take advantage of low fuel prices and has planned for an increase in fuel
prices.
Minnesota Sales Tax has increased from 6.5% to 6.875% on all purchases for the City of
Golden Valley. This is estimated to be an increase of $7,400 for the General Fund only.
Overall expenditures decreased by $494,055, or 3.20%, in 2010. In 2011, the expenditures
increased by 2.25%, or $336,520 from 2010.
MAJOR CHANGES IN EXPENDITURES BY DIVISION:
(001) Council
The School District reduced the staff liaison to a part time person for funding. This shortfall,
along with cuts from the State, means reductions are necessary to our contractual
arrangements with Home Free Shelter, YMCA, and the Historical Society. (1001.6440)

Five Cities Transportation is billed on a per-ride basis by the City of Robbinsdale. We receive
Community Block Grant funds to offset the service.
(004) Transfer Out
Due to the elimination of MVHC, transfers to the Building Improvement Fund were reduced
by $375,000. In 2008, the City transferred $300,000 to the Park Improvement Fund, which
allowed the City to reduce the transfer for 2010 and 2011.
(007) Casualty Insurance
State Statutes have increased minimum limits for uninsured/underinsured motorist coverage.
Property rates have increased due to land use litigation, a string of storm, fire, and other
losses, and replacement value increases. The City received a lower dividend as in previous
years.
(016) Planning
Corridor planning studies were lowered $22,800 for 2010.
(022) Police
The agreement for dispatch services with St Louis Park ends December 2010. The possibility
of entering into an agreement with Hennepin County for dispatch in 2011 is not known at this
time. In 2012, the City will be allowed to join Hennepin County for dispatch services.
(023) Fire/Inspections
The contractual amount with Center for Energy and Environment was lowered by $2,500.
(036) Engineering
One Engineering Technician position will not be filled for 2010 and 2011.
(068) Park and Recreation Programs
Adult Proqrams
Most Adult Programs cover more than their expenditures. The Adults provide 118.68% of the
expenditures in revenue. Concerts in the Park are in the budget for $4,500.
Youth Proqrams
Overall the Youth Programs cover about 76.03% of the expenditures. Summer Park
programs and Rink Supervision are subsidized.
Senior Proqrams
Seniors currently provide about 68.41 % of the expenditures with revenue. Senior Activity is
subsidized.
