09-01-09 CC Minutes Regular Meeting of the City Council September 1, 2009 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on September 1, 2009 at 6:30 p.m. The following members were present: Freiberg, Loomis, Pentel, Scanlon and Shaffer. Also present were: Thomas Burt, City Manager, Allen Barnard, City Attorney; and Judy Nally, Administrative Assistant. Board/Commission Oath of Office and Presentation of Certificate of Appointment Mayor Loomis administered the oath of office and presented a Certificate of Appointment, mug and city pin to: Ben Peterson, Civil Service Commission and Dan Steinberg, Open Space an~ Recreation Commission. Approval of Aaenda MOVED by Pentel, seconded by Freiberg and motion carried unanimously to approve the agenda of September 1, 2009 as amended: Certification of Proposed 2010 Property Tax Levy and 2010-2011 Proposed Budget, staff distributed amended executive summary. Approval of Consent Aaenda MOVED by Shaffer, seconded by Scanlon and motion carried unanimously to approve the agenda of September 1, 2009 as amended: removal of Approval of Six Month Extension for Filing of Plat and Submitting Final PUD Plan Application - PUD #107 - The Towers at West End - Southwest Quadrant of 1-394 and Highway 100 - Duke Realty, Applicant. * Approval of Minutes - City Council Meetina - Auaust 5. 2009 MOVED by Shaffer, seconded by Scanlon and motion carried unanimously to approve the City Council Meeting minutes of August 5,2009 as submitted. *Bills and Claims MOVED by Shaffer, seconded by Scanlon and motion carried unanimously to authorize the payment of the City and Housing and Redevelopment Authority bills as submitted. *General Business Licenses MOVED by Shaffer, seconded by Scanlon and motion carried unanimously to authorize the issuance of licenses as recommended by staff. Regular Meeting of the City Council September 1, 2009 Page 2 *Solicitor's License - Naral Pro-Choice Minnesota MOVED by Shaffer, seconded by Scanlon and motion carried unanimously to approve the solicitor's license for Naral Pro-Choice Minnesota. *Gamblina License Exemption and Waiver of Notice Reauirement - St. Therese Foundation. Inc. MOVED by Shaffer, seconded by Scanlon_and motion carried unanimously to receive and file the gambling license exemption and approve the waiver of notice requirement for S1. Therese Foundation, Inc. *Minutes of Boards and Commissions MOVED by Shaffer, seconded by Scanlon and motion carried unanimously to receive and file the minutes as follows: Human Rights Commission - July 9, 2009 Environmental Commission - July 27, 2009 Envision Connection Board of Directors - July 16, 2009 Bassett Creek Watershed Management Commission - July 16, 2009 *Receipt of Julv 2009 General Fund Budaet Report MOVED by Shaffer, seconded by Scanlon and motion carried unanimously to receive and file the July 2009 General Fund Budget Report. Approval of Six Month Extension for Filina of Plat and Submittina Final PUD Plan Application - PUD #107 - The Towers at West End - Southwest Quadrant of 1-394 and Hiahwav 100 - Duke Realty. Applicant Council Member Pentel had questions regarding the traffic issues in the area and requested staff review traffic mitigation when the item comes back to the Council. Thomas Burt and Allen Barnard answered question from the Council. MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve an extension for submittal of the Final PUD Plan application and the Final Plat for The Towers at West End, PUD NO.1 07 until February 28, 2010. *Call for Public Hearina - Special Assessments - Delinauent Utility Bills and Miscellaneous Charaes - 10/6/09 MOVED by Shaffer, seconded by Freiberg and motion carried unanimously to call a public hearing for special assessments for delinquent utility bills and miscellaneous charges for October 6,2009 at 7 pm. Regular Meeting of the City Council September 1, 2009 Page 3 Certification of Proposed 2010 Property Tax Levy and 2010-2011 Proposed Budaet Sue Virnig, Finance Director, introduced the agenda item and answered questions from the Council. Thomas Burt answered question from the Council. MOVED by Pentel, seconded by Shaffer and motion carried unanimously to certify the City's Proposed 2010 property tax levy in the amount of $16,327,725 and 2010-2011 Proposed Budget. Set Date for Public Hearinas - 2010-2011 Budaet and 2010 Property Tax Levy Sue Virnig, Finance Director, introduced the agenda item and answered questions from the Council. Thomas Burt answered question from the Council. MOVED by Pentel, seconded by Freiberg and motion carried unanimously to set the date of the informal public hearing for Tuesday, December 8 at 6:30 pm and the formal public hearing for Tuesday, December 15 at 7 pm for the 2010-2011 Budget and 2010 Property Tax Levy. Announcements of Meetinas The City Offices will be closed on September 7,2009 in observance of Labor Day. Some Council Members may attend the Douglas Drive Corridor Study Committee meeting on September 8, 2009 at 7:30 am. The next Council/Manager meeting will be held on September 8 at 6:30 pm. The next Golden Valley Historical Society Meeting will be September 10, 2009 at 7 pm at the Historic Church. Some Council Members may attend the Golden Valley League of Women Voters Anniversary on September 12, 2009 at 1 :30 pm at the Brookview Community Center. The next City Council meeting will be held on September 15,2009 at 6:30 pm. Mayor and Council Communications No action and/or discussion took place.
