Golden Valley Planning Commission
November 9,2009
A regular meeting of the Planning Commission was held at the Golden Valley City Hall,
Council Chambers, 7800 Golden Valley Road, Golden Valley, Minnesota, on Monday,
November 9, 2009. Vice Chair Waldhauser called the meeting to order at 7 pm.
Those present were Planning Commissioners Cera, Eck, Kluchka, McCarty, Schmidgall
and Waldhauser. Also present was Director of Planning and Development Mark Grimes,
City Planner Joe Hogeboom and Administrative Assistant Lisa Wittman. Chair Keysser was
absent.
1. Approval of Minutes
September 29, 2009 Regular Planning Commission Meeting
Eck referred to the first sentence in the last paragraph on page 3 and asked that it be
clarified.
McCarty referred to the second paragraph on page two and noted that a comma was
missing in the first sentence. He also noted that the minutes stated that Waldhauser
chaired the meeting. She didn't, Keysser was in attendance and he chaired the meeting.
MOVED by Eck, seconded by Cera and motion carried unanimously to approve the
September 29,2009 minutes with the above noted corrections.
2. Informal Public Hearing - Zoning Code Amendment - Regarding the Building
Board of Review
Applicant - City of Golden Valley
Purpose - To amend Section 11.35, Subd. 7(A) and Section 11.36, Subd. 7(A)
(Light Industrial and Industrial Chapters of the Zoning Code) to remove language
regarding the Building Board of Review
Grimes explained that staff is recommending that the Building Board of Review be
discontinued because they rarely meet and their duties regarding city ordinances can be
done by staff. He stated that there are a couple of places in the Zoning Code and the
Sign Code where the Building Board of Review is mentioned in regard to reviewing
landscape plans. It is now being suggested that the review of landscape plans is
something that can be reviewed by staff or City Manager designee.
Waldhauser asked if the Building Board of Review was established originally because
some of the reviews were considered more subjective and not straight forward. Grimes
said back in 1988 when the Board was originally established there might have been more
concerns about the aesthetics of buildings, but having aesthetic requirements is difficult if
a building meets the requirements of the building code.

Waldhauser said when there has been discussion in the past about the pros and cons of
having a design review process it has often come back to the fact that the City does have
the Building Board of Review that looks at projects apart from the Planning Commission
and that the Building Board of Review would have some say over the appearance of a
development. She added that she is getting the sense from the information in the Zoning
Code that the Board just reviews landscaping and not other structures. Grimes explained
that the City has a landscaping standards policy in place that is enforced by City staff
which is the same policy currently enforced by the Building Board of Review. He
explained that the Building Board of Review is advisory to the Building Official and it is
not a design review board.
McCarty asked if a design review board could be appointed on an ad hoc, per project
basis. Grimes said a design board ordinance process would have to be developed to do
that. He explained that many of the design issues involved in specific projects are
addressed through the PUD process and the other review processes already in place. He
stated that staff feels there should be standards and requirements in the City Code that
applicants are required to meet rather than having to go through another board.
Cera asked about the possibility of referring the design review process to the Planning
Commission. Grimes reiterated that the Planning Commission, in effect, already does
review the design of many of the projects in the City through the Planned Unit
Development and Conditional Use Permit processes. Cera asked when in the process a
project goes to the Building Board of Review. Grimes explained that it is a discretionary
process by the Building Official as to whether a project goes to the Building Board of
Review or not. He stated that staff would rather "beef up" the standards in the City Code
and have those standards enforceable by city staff.
Kluchka said he is having trouble with this issue because he doesn't see a clear
understanding of the purpose of the Building Board of Review and how its purpose is
translated into new skill sets, new policies or specific staff process that would
accommodate what the intent of the Building Board of Review is supposed to be. He said
he has seen perceptions of decisions being made by the City that weren't necessarily in
everybody's interest, but rather a city staffer making a decision, so he is concerned about
a lack of oversight and perception.
Waldhauser said if there is something warranting review she agrees that it seems odd
that the decision would be left to staff to make the decision whether or not the application
goes to a city board. She said it would make more sense for direction to come from the
Planning Commission.
Grimes clarified that the City Council is considering the decision to discontinue the
Building Board of Review therefore the language in the City Code referring to the Building
Board of Review has to be removed. He also clarified that the Planning Commission isn't
deciding whether or not to discontinue the Building Board of Review; that is done by City
Council resolution. The Planning Commission is only charged with reviewing the Zoning
Code language.

Cera stated that it sounds like there is the desire by the Planning Commission to further
discuss design review standards either through the Commission or some other entity.
Grimes said staff would bring the Planning Commission the language and standards
other communities use in their design review process.
McCarty asked if the City Council is abolishing the Building Board of Review but looking
at how other cities handle design review what the likelihood is of putting a board back in
place. He said it seems premature to him to eliminate the Building Board of Review if the
City is going to have some sort of design review board replacing it. Grimes said he thinks
the design review process can be well addressed through the ordinance process similar
to the language in the Mixed Use zoning district which requires certain design standards
and review processes.
Eck asked if the City Council has already decided to eliminate the Building Board of
Review because the staff report states that it is being recommended that the Building
Board of review be eliminated. Grimes explained that the language in the Zoning Code
needs to come out at the same time the City Council decides to eliminate the Building
Board of Review.
Kluchka said that from an oversight perspective he hasn't seen enough information that
designates what the process is today or what the process will be, which in his role,
seems like he would not be doing his job so he is inclined to say no to this
recommendation. McCarty said he would agree with Commissioner Kluchka if the
Building Board of Review was more consistent and had specific powers, but he doesn't
think the City would lose any control by eliminating the Building Board of Review. He said
he would like to revisit how the City can get a design review process established but he is
not convinced the Building Board of Review is the answer because it seemed too
arbitrary. Kluchka said he would rather have a plan than a hope that something will
replace the Building Board of Review.
Grimes suggested that the Planning Commission review specific policies and design
review guidelines at some point in the future.
MOVED by Cera, seconded by Schmidgall and motion carried 5 to 1 to recommend
approval to amend Section 11.35, Subd. 7(A) and Section 11.36, Subd. 7(A)
(Light Industrial and Industrial Chapters of the Zoning Code) to remove language regarding
the Building Board of Review. Commissioner Kluchka voted no.

a. Planning Commission Meeting Schedule
Grimes explained that over the past several years many Planning Commission meetings
have been cancelled due to the lack of agenda items. He asked the Commission if they

would like to switch the schedule to have only one meeting per month and if so, which
Monday of the month they would prefer.
McCarty said he'd like to meet the fourth Monday of the month if possible. Waldhauser said
she would like to meet the second Monday of the month. Eck said he would like to keep
the schedule the way it is and cancel meetings as necessary so that applicant's schedules
wouldn't be affected.
Grimes said he would keep the meeting schedule the same and make an effort to put items
on one agenda per month if it can be helped. The Commissioners agreed.

approve the minutes of the August 24, 2009 meeting.
3. Presentation by Sean Gosiewski, Alliance for Sustainabilitv
Mr. Gosiewski spoke to the commission about the purpose of the Alliance for
Sustainability and potential ways for communities to save money and become
socially and environmentally responsible.
4. Solid Waste Hauling and Recycling
Tim Goodwin and Associates sent a proposal to the City, at staff's request, to
assist the Commission on the study. The proposal will be brought before the
Council. A copy of the proposal will be provided to the Commission.

Summary
Emerald Ash Borer (EAB) was found in a St. Paul neighborhood on May 14, 2009. The insect
only kills ash trees, but it does so in great numbers. EAB has already killed millions of ash
trees in North America. It is expected to have a huge effect on Minnesota's landscape and
the 937 million ash trees that grow in our cities and forests. Grant money has been made
available from the Minnesota Department of Agriculture for EAB planning and preparedness.
The City of Golden Valley has developed a grant proposal requesting funding for assisting
the City in developing a complete public tree inventory. The inventory will assist the City in
developing an EAB Management Plan and to identify the City's liability once the infestation
begins within our City limits.

WHEREAS, the City of Golden Valley will submit an application to the Minnesota
Department of Agriculture for Planning and Preparation of Emerald Ash Borer (EAB)
Management Plans; and
WHEREAS, the City Council authorizes the Director of Public Works or her designee
to submit the application on behalf of the City of Golden Valley; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley that the City supports the development of an Emerald Ash Borer Management Plan,
for which a planning and preparedness financial grant application was submitted to the
Minnesota Department of Agriculture on November 20,2009, by the City of Golden Valley.

Summary
The 1984 Chevrolet Van (Unit 867) was replaced with the command vehicle from the Fire
Department. This vehicle was used by the SWAT team for emergency response. This vehicle
will be advertised for sale in the League of Minnesota Cities publication. Minnesota Statute
417 requires that the City Council adopt a resolution authorizing the sale of excess
equipment.

Summary
The Police Department held compliance checks on locations that sell tobacco products on
November 7, 2009. Walgreens, 5695 Duluth Street, failed the compliance check by selling a
package of cigarettes to a minor. As this is the third violation in a sixteen month period, the
City Code provides for an administrative penalty of $150. However, since this is also the third
violation in a 16 month period, and Walgreen's has not utilized training on the sale of tobacco
products offered by the City, staff is also recommending that the license to sell should be
revoked or refused to be granted for 2010. It is recommended that the administrative hearing
be held on January 5, 2010, at 6 pm.

Section 6.03: Action on Application, Transfer,
Termination, and Duplicate License
Subdivision 1. No Refunding
No license fee shall be refundable upon revocation or voluntarily ceasing to carryon
the licensed activity.
Subdivision 2. Issuing
If an application is approved, the City Clerk shall forthwith issue a license pursuant
thereto in the form prescribed by the Council, payment of the appropriate license
fee, and approval of the bond or insurance as to form and surety or carrier, if
required. All licenses shall be on a varying fiscal year basis unless otherwise
specified herein as to particular businesses. Except as to licenses which are
specifically Citywide, licenses shall be valid only at one location and on the
premises therein described.
Subdivision 3. Termination
Licenses shall terminate only by expiration or revocation.

Subdivision 4. Refusal and Revocation
The Council may, for any reasonable cause, refuse to grant any application, or
revoke or suspend any license, or where allowed, levy an administrative fine. No
license shall be granted to a person of questionable moral character or business
reputation. Before revocation or suspension of any license or before imposition of
an administrative fee, the Council shall give notice to the licensee and grant such
licensee opportunity to be heard. Notice to be given and the exact time of hearing
shall be stated in the resolution calling for such hearing. The Department of Public
Safety shall provide the Council with a report on compliance and illegal conduct by
the applicant. Grounds for revocation or suspension may be, but are not limited to,
any of the following:
A. That the licensee suffered or permitted illegal acts, or acts prohibited under
Chapter 6 of the City Code, upon the licensed premises;
B. That the licensee had knowledge of such illegal or prohibited acts but failed
to report the same to police;
C. That the licensee failed or refused to cooperate fully with police in
investigating such alleged illegal or prohibited acts; or,

D. That the activities of the licensee created a serious danger to public health,
safety, or welfare.

Subdivision S. Duplicate License
Duplicates of all original licenses may be issued by the City Clerk, without action by
the Council, upon licensee's affidavit that the original has been lost, and upon
payment of a fee as established by resolution of the Council for issuance of the
duplicate. All duplicate licenses shall be clearly marked DUPLICATE.

Section 6.34: Tobacco
Subdivision 1. Definitions
For the purpose of this Section, the following terms have the meaning stated:
A. Self Service Merchandising: means the open display of tobacco products
where the public has access to the products without the intervention of an
adult employee, and shall include the use of a vending machine.
B. Tobacco Products: means cigarettes, cigars, cheroots, stogies, perique,
granulated plug cut, crimp cut, ready rubbed and other smoking tobacco,
snuff, snuff flower, cavendish, plug and twist tobacco, fine cut and other
chewing tobaccos, shorts, refuse scrips, clippings, cutting and sweepings of
tobacco prepared in such manner as to be suitable for chewing, sniffing or
smoking in a pipe, rolling paper or other tobacco related devices, or any
tobacco in any form.
Subdivision 2. License Required
No person shall directly or indirectly, by coin or vending machine, or otherwise,
keep for sale, sell or otherwise dispose of any Tobacco Products at any place in the
City unless they have obtained a license therefore as provided herein.
Subdivision 3. License Facility
Separate licenses shall be required for each place of business selling Tobacco
Products. No license shall be issued for a movable place of business.
Subdivision 4. Display of License
Every license issued under this Section shall be openly displayed in the place of
business to which it has been issued.
Subdivision 5. Prohibited Acts
A. No person shall sell, give away or furnish any Tobacco Product to any person
under the age of 18.
B. No person shall use Self Service Merchandising for Tobacco Products.
Subdivision 6. Actions Required by Licensees
A. Persons licensed under this Section shall be required to train all employees
on the requirements of this Section.
B. Checkout registers using computer scanners shall be programmed to remind
seller to check identification of purchasers of Tobacco Products, unless such a
reminder is not available in said register program.

C. Every licensee under this Section shall be responsible for the conduct of its
employees while on the licensed premises and any violation of this Section by
an employee shall be considered a violation of the licensee for purposes of
imposing an administrative fine, license suspension or revocation.
Subdivision 7. Violations
A. Administrative Civil Penalties: Individuals. Any person who sells, gives away
or furnishes any Tobacco Product to a person under the age of 18 years is
subject to an administrative penalty; and any person under the age of 18
who attempts to purchase a Tobacco Product is subject to an administrative
penalty. The Council shall impose administrative penalties as follows:
First violation. The Council shall impose a civil fine not to exceed fifty dollars
($50).
Second violation within twelve (12) months. The Council shall impose a civil
fine not to exceed one hundred dollars ($100).
Third violation within twelve (12) months. The Council shall impose a civil
fine not to exceed one hundred fifty dollars ($150).
B. Administrative Civil Penalties: Licensee. If a licensee or an employee of a
licensee is found to have sold, given away or furnished Tobacco Product to a
person under the age of eighteen (18) years, the licensee shall be subject to
an administrative penalty as follows:
First violation. The Council shall impose a civil fine not to exceed one
hundred fifty dollars ($150).
Second violation within twelve (12) months. The Council shall impose a civil
fine not to exceed two hundred fifty dollars ($250).
Third violation within twelve (12) months. The Council shall impose a civil
fine not to exceed five hundred dollars ($500).
C. Defense. It is a defense to the charge of selling tobacco to a person under
the age of eighteen (18) years, that the licensee or individual, in making the
sale, reasonably and in good faith relied upon representation of proof of age
described in State Statute Section 340A.503, subdivision 6, paragraph (a).
Subdivision 8. Compliance Monitoring
Periodically the City shall complete compliance checks of all licensees within the
City. At the time of license application, applicant shall be made aware of this
Subdivision. Violators of this Section may be checked more frequently than non-
violators. The Department of Public Safety shall make an annual report to the
Council on the compliance checks.

Every person who violates a section, subdivision, paragraph or provision of this
Section, when such person performs an act thereby prohibited or declared unlawful,

VIOLATION AND POTENTIAL LICENSE REVOCATION - WALGREENS
WHEREAS, as per City Code the city conducts annual compliance monitoring of
establishments that sell tobacco products; and
WHEREAS, during such compliance check held on November 7, 2009 a clerk at
Walgreens, 5695 Duluth Street, sold a package of cigarettes to a minor in violation of City
Code; and
WHEREAS, per City Code an administrative penalty is imposed on the individual
and licensee; and
WHEREAS, the City Code provides for an Administrative Civil Penalty for the first
violation in a twelve month period of $50 for the Individual, and $150 Penalty for the
Licensee and notification of such Penalties have been mailed; and
WHEREAS, due to fact that Walgreens has failed three compliance checks in the
last sixteen months, staff is recommending a revocation of the tobacco license;
WHEREAS, City Code also provides that any licensee be given the opportunity to
be heard by the City Council;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Golden
Valley hereby schedules an administrative hearing on January 5, 2010 at 6 pm.

Summary
At its Council/Manager meeting of October 13, the Council directed staff to notify the current
Cigarettes - Tobacco Products licenses holders of its intent to increase the license fee from
$200 to $275. The fee has not been increased since 1997.
State Statutes requires a general notice of the intent to amend the tobacco ordinance be sent
to license holders and give them a 30-day written notice of the time, place, and subject matter
of the meeting. Letters to license holders were sent on October 30, 2009.
First Consideration of the Amendment to the 2010 Master Fee Schedule for Cigarettes -
Tobacco Products licenses holders will be tonight and second consideration will be
December 15. Staff recommends opening the public hearing and take any testimony who
would like to speak regarding the fee increase.

Summary
The Building Board of Review (BBR) was established in 1988 with the adoption of Resolution
88-61. The purpose of the BBR was to advise the Building Official regarding structure
continuity and aesthetics of buildings presented for building permit approval. The Board
meets only when projects are brought to it by the Building Official. Over the years, approval
processes for those areas in the purview of the BBR have gradually changed, such that now
it is rarely called upon to meet. Staff has worked on new processes that can reasonably
provide for review previously undertaken by the BBR.
Since the BBR was established by the adoption of Resolution 88-61, the appropriate process
to discontinue it would be to adopt a Resolution rescinding the prior resolution. The City
Council has expressed an interest in adopting such a resolution (see attached draft).
However, staff has found three references to the BBR in the City Code, one in Section 4.20
regarding BBR review of signs, and two in Chapter 11, Sections 11.35 and 11.36 in
Subdivision 7, regarding landscaping review. Ordinance No. 427 has been prepared to
remove reference to the BBR in these sections of the City Code. Since changes to Chapter 4
require two considerations, staff is recommending starting with the first consideration of the
ordinance amendments. If the ordinance is adopted on first consideration, staff will place the
proposed resolution on the December 15 Council agenda along with the second
consideration of the ordinance and adoption of the Resolution.

foundations and/or soil tests may be required for freestanding signs.
C. Illumination. Direct rays or glare of light from an illuminated sign shall not be
visible from public rights-of-way or property other than that on which the
illuminated sign is located. Any external source of illumination must be
provided with shields or lenses that concentrate the light onto the sign.
D. Menu Signs. If the name of the business or business logo is included in a
menu sign, the sign area of such name or logo shall be counted as sign area
for determining maximum sign area allowed.
E. Sign Quality. All signs shall incorporate materials and colors which are
compatible with the building upon which the sign is located. Compatible shall
include, but is not limited to, materials that are consistent with the principal
architectural features and colors of the building(s) being identified. All signs
shall be of good quality, and shall be designed to include attractive and
tasteful colors and design elements. The layout of the sign shall give the sign

F. Sign Setbacks. Signs other than residential nameplates and neighborhood
identification signs must be entirely located at least ten (10) feet from all
property lines and ten (10) feet from any driveway on the premises on which
the sign is erected and maintained. The following additional setbacks are
required:
1. Signs must be outside the corner visibility zone, as per the corner
visibility requirements in Chapter 7 of the City Code.
2. Shopping center pylon signs shall have a minimum setback of thirty-five
(35) feet from a street property line.
G. Streets and Easements. No sign other than public signs shall be erected or
placed upon any public street, right-of-way, public easement, public land or
project over public property or public easements.
H. Wall Signs. The following requirements are applicable for all wall signs:
1. Spacing. Signs applied to a building shall be placed as to allow a space
between the end of the sign and the edge of the building or individual
occupancy equal to ten (10) percent of the linear frontage of the building
or individual occupancy.
2. Sign Projection. No sign may project out more than eighteen (18) inches
from the face of the building to which it is attached.

Professional Office, or Institutional Zoning Districts, required side and rear
yard setbacks shall not be less than fifty (50) feet in depth.

B. Storage. All raw materials, supplies, finished or semi-finished products and
equipment shall be stored within a completely enclosed building, or within
the confines of a one hundred percent (100%) opaque wall or fence not less
than six (6) feet in height.
C. Screening. All principal, accessory, and conditional uses, except business
signs, which are situated within fifty (50) feet of a Residential Zoning District
or an R-2 Zoning District shall be screened and buffered from such Zoning
District by a separation of open space which shall have a minimum depth of
thirty (30) feet, and shall include a required fence or vegetative screening of
not less than ninety percent (90%) opacity, and not less than six (6) feet in
height above the level of the said Residential or R-2 Zoning District.

Summary
At its November 3, 2008 meeting, the Golden Valley City Council directed staff to prepare a
feasibility report for the 2010 Pavement Management Program (PMP). The proposed project
includes 2.7 miles of streets in the south central portion of the City north and east of
Glenwood Avenue, south of Trunk Highway 55, and west of the CP Railroad. The streets
included in the 2010 PMP are shown on the attached project location map.
The feasibility report for this project is being prepared by the consulting engineering firm of
Short Elliott Hendrickson, Inc. and will be presented at the public hearing. The feasibility
report outlines a project that reconstructs the subject streets, replaces and repairs portions of
the sanitary sewer and water systems, and includes storm drainage improvements
throughout the project area. The estimated total project cost is approximately $7.4 million and
affects approximately 150 properties. The special assessment for each residential property is
$4,900 per unit.
Consistent with past PMP projects, neighborhood open houses and issue specific
neighborhood meetings have been held throughout 2009 regarding this project.

RESOLUTION PROVIDING FOR PUBLIC HEARING
ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS
PROJECT NO. 10-1
2010 PAVEMENT MANAGEMENT PROGRAM
BE IT RESOLVED by the City Council of the City of Golden Valley, Minnesota, as
follows:
1. In conformity with the provisions of Minnesota Statutes, Chapter 429, this Council
proposes to construct certain proposed public improvements within the City as stated in the
form of notice included in paragraph 4 hereof.
2. The Engineer for the City has reported to the Council advising it in a preliminary way
that the proposed public improvements are feasible and that they should be made as
proposed and not in connection with some other improvements.
3. A public hearing shall be held on the proposed improvements on January 5, 2010, in
the council chambers at city hall at 7 pm.
4. The Clerk is authorized and directed to cause notice of the time, place and purpose
of said meeting to be published for two successive weeks in the NEW HOPE/GOLDEN
VALLEY SUN POST, the official newspaper of the City, the first of said publications to be in
the issue of said paper dated December 10, 2009, and the last of said publications to be in
the issue dated December 17, 2009. Such notice shall be substantially the same as in the
attached form.

Summary
Xcel Energy has applied for a permit to install overhead power lines and underground cables
on Country Club Drive and a portion of Douglas Drive (see attached map showing the project
overview). The application calls for "double-decking the existing pole line," which includes
installing pole extensions on the existing overhead poles and installing an additional set of
overhead power lines on the extensions (see attached photo). The double-decking is
proposed on approximately 2,800 feet of existing overhead facilities on Country Club Drive.
The application also includes installing two new poles and burial of approximately 930 feet of
new cable between existing overhead facilities west of Douglas Drive. A note on the plan
suggests a Hennepin County permit is needed for the proposed work on Douglas Drive.
According to the City's Right-of-Way Management Ordinance, City Code Chapter 7, Section
7.28, Subd. 3, Xcel Energy's proposal is considered a reconstruction of existing facilities,
which must be located and maintained underground. Therefore, the permit application was
denied in May 2009.
Xcel Energy would like to proceed with the design and installation of the project; however,
there is the issue of cost recovery. Xcel has indicated that they can design the project as an
underground installation, but the incremental costs between overhead (standard construction)
and underground construction (nonstandard construction) must be paid for by the City either
by direct payment to Xcel, through the City Requested Facilities Surcharge (CRFS), or
through a franchise fee.
Staff discussed this issue with Council at a Council/Manager meeting on November 10, 2009.
At that meeting, the consensus of Council was that it preferred no additional overhead utilities
be constructed on Country Club Drive or Douglas Drive, and that if there were additional
costs for nonstandard construction, Xcel seek recovery, if any, for the costs through a City
Requested Facilities Surcharge (CRFS) that would need to be approved by the Minnesota
Public Utilities Commission.

Recommended Action
Motion to uphold the Public Works Director's denial of a right-of-way permit to install
additional overhead utilities on Country Club Drive (between Rhode Island and Douglas
Drive) and on a portion of Douglas Drive (between TH 55 and the Olson Memorial Highway
North Frontage Road); and to direct the Public Works Director to prepare a letter advising
Xcel Energy that the proposed improvement project must be designed and constructed so
that overhead utilities for this project are placed underground and that recovery for the
nonstandard construction costs, if any, should be sought through the Minnesota Public
Utilities Commission. Furthermore, staff is directed to oppose any surcharge for the project
presented to the Minnesota Public Utilities Commission.
