MCES Sanitary Sewer Project Update: 1-GV-461 Reliever Project Prepared By Jeannine Clancy, Director of Public Works Jeff Oliver, PE, City Engineer Mitchell Hoeft, EIT, Engineer Summary The Metropolitan Council Environmental Services (MCES) staff would like to update the City Council on the status of the 1-GV-461 Reliever Project. This project includes the installation of an 18-inch sanitary sewer forcemain that accommodates sanitary sewer discharges from the cities of Golden Valley and St. Louis Park. The installation of this sanitary sewer will decrease existing capacity issues along the MCES 1-GV-461 interceptor sewer and will provide relief for existing sewer capacity issues in the sewer system servicing the I-394 corridor. Over the last couple of months, MCES has been working on selecting the most economically responsible route to complete this installation. Two routes were considered, including the Xenia Avenue/Turners Crossroad corridor that runs from I-394 to TH 55, and along Theodore Wirth Parkway. Maps of these proposed routes are attached to this memorandum for reference. Following an extensive analysis, MCES has determined that the Xenia Avenue/Turners Crossroad route is the most cost-efFective selection. Due to poor subgrade conditions and high water tables, construction of a new forcemain along Theodore Wirth Parkway is estimated to be $9 million more than the Xenia/Turners Crossroad route. A memo and cost estimate provided by MCES documenting this is attached. Completion of this project includes the construction of a lift station on a MnDOT-owned parcel located north of Douglas Avenue, east of TH 100, and south of I-394 as shown on the location map. Installation of the sanitary sewer reliever includes directional boring a new line under TH 100 and I-394. Installation of this forcemain also includes trenching and burial ofi pipe along Circle Down as well as the Xenia Avenue/Turners Crossroad corridors. MCES will be drafting an agreement with the City for the design and construction of the Circle Down segment as a component of the 2012 Pavement Management Program (PMP). MCES cost participation for the 2012 PMP will be addressed in future amendments to this agreement. During this Council/Manager meeting, MCES will review the route selection process and project schedule with Council. These deposits are unsuitable for pipe and road bedding and trench backfill. Significant soil correction and pile installation would be required to install the pipe on this route. • The majority of swamp deposits present on the Xenia route have been corrected during previous utility installations. Little soil correction and pile installation would be required on this route. Groundwater Conditions • Groundwater is present in the pipe zone for a large portion of the Parkway route. Surface water and wetlands are also present. Significant dewatering would be requir�i on this route. • The majority of groundwater present on the Xenia route is below the pipe zone or perched in small lenses of permeable soils. Little dewatering would be required on this route. Tunneling Conditions • Soils in the vicinity of the I-394 tunnel on the Parkway route consist of sand, gravelly sand, cobbly gravel and boulders. The presence of cobbly gravel and boulders significantly increase the risk of tunneling • Soils in the vicinity of the I-394 tunnel on the Xenia route consist of sand, gravelly sand and gravel which are more conducive to tunneling. North Wirth Business Center Prepared By Jeanne Andre, Assistant City Clerk Summary The owners of the North Wirth Business Center have not kept current on property taxes for a number of years. Under the GVEC Properties, LLC Private Development Agreement as Amended, this is a default, and the Note issued by the Housing and Redevelopment Authority allows it to terminate the note if the default is not cured within 60 days. Notice of default was sent February 23, 2010. Also, if taxes are not paid in full this year, the property will be subject to tax forfeiture. If the Note is cancelled there is no reason to retain the North Wirth Parkway Tax Increment District Number 3. Consideration of decertifying the District would be a Council action. All changes to TIF Districts need to be reported to Hennepin County by June 30. If action is taken prior to June 30, the collection of increment for this district would cease effective January 1, 2012 and any residual increment would be distributed to the appropriate taxing districts. If the Council would like to initiate this process, staff will call a special meeting of the Golden Valley HRA at 6 pm on May 17 to consider cancelling the TIF Note. If the HRA takes this action, the staff will place a resolution to decertify the North Wirth Parkway Tax Increment District Number 3 on the June 7 Council Agenda. It is a defense to the charge of selling tobacco or tobacco-related devices to a person under the age of eighteen (18) years, that the licensee or individual, in making the sale, reasonably and in good faith relied upon representation of proof of age described in Minnesota Statutes section 340A.503, .,. F Exceptions. An Indian may furnish tobacco to an Indian under the age of eighteen (18) years if the tobacco is furnished as part of a traditional Indian spiritual or cultural ceremony. For purposes of this paragraph an Indian is a person who is a member of an Indian tribe as deflned in Minnesota Statutes section 260.755, subd. 12. Zoning Code Variance Process and Board of Zoning Appeals Status Prepared By Joe Hogeboom, City Planner Summary In the summer of 2010, the Minnesota Supreme Court issued a decision that changed the way in which municipalities could consider variance requests. The Krummenacher v. City of Minnetonka case resulted in a much stricter standard for granting variances. As a result of the case, cities are not to consider whether the proposed variance is reasonable, but rather whether there is reasonable use of the property as a whole in the absence of the variance. As a result of this ruling, there have been no variance applications in Golden Valley since August, 2010. Most other cities in Minnesota have also not considered variances since that time. New legislation passed in early May is being enacted that will again broaden the ability for cities to issue zoning variances. The City Attorney is currently reviewing the legislation and drafting a proposed amendment to City Code that corresponds with the new law. The City will be required to make those changes in order to be in compliance with state statute. Staff anticipates seeking approval of the language by the Planning Commission and City Council in the near future so that variances may again be considered. Concurrently with the change to City Code language, staff is considering eliminating the Board of Zoning Appeals (BZA) and charging the Planning Commission with the duty of considering variance requests. This is permitted by state statute. With the resignation of a longstanding BZA member and the transfer of another member to the Planning Commission, the BZA is left with only two members. Additionally, enabling the Planning Commission to grant variances would allow property owners the opportunity ta appear at two meetings per month (the 67�1 meets only once per month). Eliminating the BZA would work to streamline city services and would provide greater scheduling flexibility to those seeking variances. If the BZA were to be eliminated, staff recommends appointing the finro remaining BZA members as alternates on the Planning Commission. Human Rights Commission Status Prepared By Thomas Burt, City Manager Summary Currently there are only three Human Rights Commission members, one of which has expressed an interest in serving on a different Commission. The City Code allows the Commission to have eleven members. Over the past couple years there have been very few applicants who have applied to serve on the Human Rights Commission. Staff is requesting direction on how the Council would like to proceed with this Commission.
