5.h Wirth_Enforcement_AgreementThis Memorandum of Understanding is between the Minneapolis Police Department, the Golden Valley Public Safety Department, the Minneapolis Fire Department, and the Minneapolis Park and Recreation Board Police Department. The purpose of this memorandum is to delineate the policy and procedures to be used by the above named agencies when responding to and managing public safety emergencies occurring in Wirth Regional Park. The policy and procedures are based on the followin g information: 1. Wirth Regional Park is located within the municipal boundaries of both the cities of Minneapolis and Golden Valley. The entire park is the property of the Minneapolis Park and Recreation Board which is responsible for the management of t he park lands and establishing ordinances governing those who use the park and parkways. The boundaries of the park and the municipal boundaries are shown on the attached map (Attachment 1). 2. The Minneapolis Park and Recreation Board has police authorit y in Wirth Regional Park based on: first, State Laws 440.37, 440.38, 440.40, 448.54, and 448.56; and second, the Charter of the city of Minneapolis Chapter 16, Section 14. 3. For events occurring in Wirth Park, whether inside or outside the city limits of Minneapolis, the Minneapolis Police Department has jurisdictional authority to the same extent it has on Park Board property located within the Minneapolis city limits. 4. The Golden Valley Police Department has jurisdictional authority in that part of W irth Regional Park located within the Golden Valley city limits to the same extent it has on any property located in Golden Valley. The Golden Valley Police Department has no more responsibility for serving that part of Wirth Regional Park that lies outsid e of Golden Valley city limits that it does for any other non -Golden Valley property. The parties agree as follows: SECTION ONE: LAW ENFORCEMENT POLICE SERVICE RESPONSIBILITY The Golden Valley Police Department and the Minneapolis Park and Recreation Board Police Department are responsible for responding to all calls for police service occurring in Wirth Park that are located within the corporate limits of Golden Valley. The M inneapolis Police Department and the Minneapolis Park and Recreation Board Police Department are responsible for responding to all calls for police service occurring in Wirth Park that are located within the corporate limits of Minneapolis. If ne cessary, the police department of Golden Valley, Minneapolis, or the Minneapolis Park Board can request the assistance of one of the other departments to help respond to a police incident occurring in Wirth Park. If for any reason a police department canno t respond to a call to Wirth Park with enough resources as quickly as may be needed, one of the other departments should be notified and dispatched immediately . JURISDICTION DETERMINATION At an appropriate juncture following the initial response to an in cident located in or near Wirth Park, the responding agency should determine if the incident is located in the municipal jurisdiction of Minneapolis or Golden Valley. This effort should in no way interfere with the need to follow regular police procedures or take immediate police action. If the location of the incident or crime scene is found not to be in the area of responsibility of the responding agency, the appropriate agency should be notified as soon as possible. In determining the appropriate munici pal responsibility for an incident, agencies may use maps, aerial photos, and surveyors depending on the lack of landmarks, the need for precision, the need for follow -up, and the relative importance of the incident. INVESTIGATIONS Control of crime scene s located in the Golden Valley section of Wirth Park and related investigations will be the responsibility of the Golden Valley Police Department and the Minneapolis Park Police . Control of crime scenes located in the Minneapolis section of Wirth Park and related investigations will be the responsibility of the Minneapolis Police Department and the Minneapolis Park Police. Exception: If a crime scene located on Wirth Park property is believed to be a continuation of a crime or related to another crime ini tially committed in either Golden Valley or in Minneapolis, the jurisdiction where the crime originated may, after consultation, control the Wirth Park investigation and complete the necessary reports. The jurisdiction not investigating the case would be k ept informed about the status and progress of the investigation. REPORTING/INFORMATION MANAGEMENT Crime reports for incidents in Wirth Park and responded to by the Golden Valley Police Department are the responsibility of Golden Valley. A copy of these o ffense/incident reports or an appropriate summary should be forwarded to the Minneapolis Park Police. The Minneapolis Park Police will provide similar information to the Golden Valley Police Department on incidents in Wirth Park that they respond to. PATR OL Minneapolis Park Police will provide periodic patrol of Wirth Park during their regular patrol hours. Golden Valley will also patrol the park as part of their regular operations. ORDINANCE ENFORCEMENT Minneapolis Park Police Officers, Minneapolis Polic e Department Officers, and Golden Valley Police Officers have police power authority in the Golden Valley part of Wirth Park including the incidents occurring in Wirth Park that are located within the corporate limits of Golden Valley. The Minneapolis Fire Department should be dispatched to all fire, rescue, and hazardous material incidents occurring in Wirth Park that are located within the corporate limits of Minneapolis. If necessary, the fire department of either Golden Valley or Mi nneapolis can request the assistance of the other to help respond to a fire, rescue, or hazardous material incident occurring in Wirth Park. JURISDICTION DETERMINATION At an appropriate juncture following the initial response to an incident located in or near Wirth Park, the responding agency should determine if the incident is located in the municipal jurisdiction of Minneapolis or Golden Valley. FIRE INVESTIGATIONS Origin and cause investigations will be conducted by the fire department in whose jurisdiction the fire has occurred. That fire dep artment will also request arson investigations as needed. BUILDING AND FIRE CODE COMPLIANCE INSPECTIONS Page 72
The city of Golden Valley will have the responsibility to enforce state and municipal fire and building codes in that part of Wirth Park that lies within the corporate limits of Golden Valley. Notification of hazardous materials stored or used in Wirth Park should be directed to both the Minneapolis and Golden Valley Fire Departments . SECTION FOUR: GENERAL SAFETY PLANNING AND OVERSIGHT INTER AGENCY SAFETY ASSESSMENTS The public safety agencies of Minneapolis, Golden Valley, and the Minneapolis Park and Recreation Board will meet as necessary to review and discuss safety issues in Wirth Park. The agencies will review the nature of the demand f or safety services in Wirth Park and cover such issues as the patrol and response operations, enforcement of ordinances, and other needed changes to improve the level of safety. PROPOSALS FOR IMPROVEMENTS The interagency safety assessment meetings should include development of specific proposals to change policies and ordinances and make physical improvements to Wirth Park. These recommendations should be forwarded to the appropriate governing authority for review and implementation. SECTION FIVE: 911 AN D DISPATCH OPERATIONS TELEPHONES A 911 call from any telephone located in the Golden Valley part of Wirth Park should be directed to the St. Louis Park PSAP for dispatching of Golden Valley public safety agencies. A 911 call from any telephone located in the Minneapolis part of Wirth Park should be directed to the Minneapolis PSAP for dispatching of Minneapolis public safety agencies. DISPATCH POLICY Wirth Park should be considered Golden Valley response territory for all calls for police, EMS, fire, an d rescue services. Therefore, all calls for public safety response to Wirth Park should be forwarded to St. Louis Park PSAP for dispatch of Golden Valley public safety agencies with the following two exceptions: Exception Number 1: Eloise Butler Calls fo r service originating from the Eloise Butler Building should result in a dispatch of Minneapolis Police and Fire Departments, North Ambulance, and Minneapolis Park Police as appropriate. Exception Number 2: Emergency Police Service All calls for police service in Wirth Park for situations where the personal safety of an individual is at immediate or imminent risk should result in a dual dispatch of both Golden Valley Police and Minneapolis Park Police. Upon receipt of an emergency police call from any lo cation in Wirth Park, St. Louis Park PSAP should dispatch Golden Valley Police and then request the Minneapolis PSAP to dispatch Minneapolis Park Police. Similarly, calls received by Minneapolis PSAP for any Page 73
Wirth Park destination should result i n a dispatch of the Minneapolis Park Police and then a request to the St. Louis Park PSAP to dispatch Golden Valley Police. In all cases where the Minneapolis Park Police is unavailable for an immediate response, Minneapolis Police should be dispatched. Additions or modifications to this memorandum may be made with the approval of all parties. The agreement is in effect as of the date of signing by all parties and will continue in effect until further notice.

SECTION TWO: EMERGENCY MEDICAL SERVICE MEDICAL SERVICE RESPONSIBILITY Golden Valley Police Department will provide First Responder emergency medical service to the Golden Valley part of Wirth Park. Minneapolis Fire Department will provide First Responder emergency medical service to the Minneapolis part of Wirth Park. North Memorial Ambulance is the primary provider of ambulance service for all of Wirth Park. SECTION THREE: FIRE/RESCUE/HAZARDOUS MATERIALS FIRE SERVICE RESPONSIBILITY The Golden Valley Fire Department should be dispatched to all fire, rescue, and hazardous material
