Regular Meeting of the Golden Valley Planning Commission March 22, 2004 A regular meeting of the Planning Commission was held at the Golden Valley City Hall Council Chambers, 7800 Golden Valley Road, Golden Valley, Minnesota, on Monday March 22, 2004. Chair Pentel called the meeting to order at 7 PM. Those present were Chair Pentel, Commissioners Eck, Groger, Keysser Rasmussen. Also present were Director of Planning and Developme and Administrative Assistant, Lisa Wittman. Address: I. He said that there is a cross parking agreement between the two properties that make up the Spring Gate Shopping Center. He added that if this site were developed today it probably would have been a PUD because there are two buildings on one property. . Grimes referred to the site plans and showed a front elevation of the proposed restaurant. He stated that the restaurant would have 157 seats and that they would be adding a small, about 500 square feet, walk-in freezer/storage room addition on to the back of the building which will meet setback requirements. . . . Minutes of the Golden Valley Planning Commission March 22, 2004 Page 2 Grimes said Staff's biggest concerns were the parking lot and access to the site. He said the City has been working with Applebee's, Byerly's and Spring Gate Partners to come to an agreement to make improvements to the parking lot that will enhance the safety in the area and also increase the number of parking spaces. Grimes said the shopping center is short on parking spaces and if Byerly's and Spring Gate Shopping Center were looked at separately, 713 parking spaces would be required according to the City Code. He said at the current time there are 462 parking spaces on the property. Grimes said that in order to allow a more intense user of 0 go in at this shopping center the City hired Traffic Engineer, Glen Van Worm 0 a ffic study. He added that the owner of the Sinclair station located on the site has said he wants to stay where he is located. He added that Byerly's is planning on doing some interior upgrades this fall. He asked if Glen Van Wormer was considering the times when both Applebee's and Byerly's would be at their peak use such as on a Friday before a holiday. Grimes stated that GlenVan Wormer has said that you can't design a parking lot for the peak shopping day like the day after Thanksgiving at Ridgedale. He said there may be times when the parking is tight, but that Byerly's won't need 100% of their parking spaces on an average day. . Grimes said yes. Rasmussen asked Grimes if he has any data regarding the number of people who use the exit closest to Byerly's and how many people go to the intersection with the signal. She referred to the exit onto Duluth Street and asked Grimes if he thinks that is a safe exit. Grimes explained that Duluth Street is a County road and that they haven't felt the need for a traffic signal at that location. He said he thinks having a single exit all the way over on the other end of the parking lot is going to be asking for a lot of problems and it will increase the amount of traffic trying to exit by the driveway in front Byerly's which will make that situation a whole lot worse. He added that he is not at all pleased with the proposed plan and that he thinks it could be much better. He referred to the freezer/storage addition being proposed and said that right now that area is used as an access road for trucks. He stated that the addition would make that drive aisle awfully tight and asked Grimes if ttraffic was taken into consideration. Pentel said she was at the Applebee's located on 42nd Avenue in New Hope and that she had to leave because the air was too smokey. She asked what kind of smoke extractors would be used at this location. Canada said he doesn't knowwhy there was a . Minutes of the Golden Valley Planning Commission March 22, 2004 Page 6 problem at that restaurant because all of their restaurants have a separate smoke extraction .system designed to pull out the smoke located above the smoking section. Pentel asked where the customer "pick-up" area would be located on the site.. Canada referred to the site plan and said the "to-go" spaces would be on the east side of the building. Rasmussen asked what percentage of the restaurant allows for smoking. Canada said smoking is only permitted in the bar area which is 38 seats and that th ystem is designed to pull the smoke out of the restaurant. . P s the park and ride is critical and that it is unfortunate that the ride situation is located on a private commercial lot. Grimes said that he IdenValley's Metro Transit representative and that they are willing to relocate t ark and ride location but that MnDOT hasn't been willing to have it at their location. Rasmussen said she thinks it is critical to move the park and ride out of this parking lot before Applebee's goes in because therewill be no time when someone can draw the line and say now it is time to move it. Grimes agreed and said obviously Spring Gate has been a good citizen by allowing it and providing for it up until thi.s time. Groger asked if there is a sidewalk going to the MnDOTparking lot. Grimes said that one would have to be built and the City would have to be sure there is a crosswalk, or the bus could make a detour to go into the MnDOT parking lot. Pentel opened the public hearing. . Marilyn Clayten, 5725 Westbrook Road, said she uses this the week and has used the park and ride program for 10 yea than 40 spaces designated for the park and ride. Groger asked Rosell if he sees any problems with the property regarding the traffic flow and having just the two proposed exits. Rosell said he is not an expert on traffic issues, that Glen Van Wormer is an expert and has put this plan together. He said they trust Mr. Van Wormer and Mark Grimes in what they are propsing. . Pentel asked Rosell if he followed Grimes approach when he was di installation of a contiguous sidewall. He explained that staff also looked at the sidewalks and that there is a wholly developed sidewalk system on both sides of Duluth Street butthere is a hole in the City's pedestrian system in a high pedestrian use area. He stated that people from the Courage Center to east use this shopping center frequently and that there are no amenities to make it safe and no accommodations for wheelchairs. . . . Minutes of the Golden Valley Planning Commission March 22, 2004 Page 8 Oliver explained that an entrance at the top of the curve on the frontage road was not put in the plan because it resulted in a loss of parking and there are visibility concerns cmd continuing concern for operations and conflicts in this location. Also, for people who don't know the area, they think they are in the parking lot when they're on the frontage road. He said that by placing the driveway where it is proposed, adequate site lines are maintained through the curve and it lines up straight into the parking lot. He said there is still access off Duluth Street with a left turn lane for west bound traffic and a right turn lane in, so there is immediate access to the Byerly's site, a gain of parking spaces, and a dramatic decrease in the potential conflict points particularly for pedes . d hopefully a great reduction in the number of accidents. Groger said because there is a shared parking arrangement, and because the ingress and egress to Byerly's is changing they have to look at it as one proposal and not separate them. . . . He said the City has concerns about that intersection and whenthetime comes with Byerly's the City will take to opportunity to make improvements to the parking lot and the intersection on the west side. Oliver said the current situation will be maintained and all of the aisles will have adequate width for backing out and for two-way traffic. Grimes, Director of Planning and Development Subject: Zoning Map Amendment for Property at 3370 Lilac Dr. N. from Single-Family Residential (R-1) to Two-Family Residential (R-2)- Tasks Unlimited Lodges, Applicant T asks Unlimited Lodges is the owner of the existing two-family dwelling at 3370 Lilac DL N. (The property is located at the intersection of Lilac DL N. and Scott Ave. adjacent to TH 100 in the northeast portion of Golden Valley.) The property is zoned Single-Family Residential (R-1). Within that zoning district, the only type of residential development that is permitted is single-family homes. The two-family home that now exists on the property was legally constructed in 1960. At that time, the zoning code permitted two-family dwellings in the Residential zoning district. Around 1980, the City of Golden Valley changed its zoning code and eliminated two-family dwellings as a permitted use in the Residential zoning district. At that time, the Two-Family (R-2) zoning district was created that permitted only two-family homes. However, the 3370 Lilac Dr. property was not rezoned to R-2 at that time. Because the 3370 Lilac DL N. two-family hom~ was constructed to meet the requirement of the Residential zoning code at the time it was built, the existing two-family home is now considered a non-conforming use. In other words, it currently does not conform to the requirements of the current Single-Family (R-1 ) zoning district. The two-family home can continue to be used as a two-family home but it cannot be expanded, enlarged, extended or altered in scope, character or in physical dimension. It is the intent of Tasks Unlimited Lodges to expand the existing two-family home by adding a new grade-level single story addition to the rear or east side of the building. This new space would be used to expand the living space in each of the two side-by-side units. In addition, lower level garages that are located along the west side of the building will be converted to living space. The existing detached, two-car garage at the rear of the lot would remain for the shared use of the occupants of the two-family home. The zoning code calls for one-garage space for each unit. Tasks Unlimited will be atthe Planning Commission meeting to answer any questions about the requested zoning map amendment and Tasks Unlimited. In discussions with Gary Nielson, representative of Tasks Unlimited, the two-family home will continue to be occupied 1 , . . . by persons receiving services from Tasks Mental Health Services. Tasks Unlimited has owned the two-family home since 1997. At the current time, there are only three or four persons sharing each unit in the two;.family home. The additional space will allow for up to fivejndividuals to live in each unit as permitted by the zoning code. (The zoning code defines a family as up to five unrelated individuals sharing a common household.) This property is designated on the General Land Use Plan Map for Low Density uses (0-5 units per acre). The size of the property at 3370 Lilac Dr. N. is 27,283 sq. ft. With two units on the property, the density is 3.2 units per acre which fits with the Low Density category on the Plan Map. The R-2 zoning district requires that lots be a minimum of 12,500 sq. ft. for a two- family home. In this case, the lot is more than twice the minimum lot area required. Also, the two-family home (with proposed addition) meets all setback requirements for the R-2 zoning district. Since this property has been used as a two-family home for the past 44 years, this zoning change should not. have any significant change on the neighborhood. The number of vehicle trips to and from the site will remain the same. (At the current time, the trips from the two- family dwelling are minimal because most of the residents do notdrive. Transportation for most of the residents is provided by Tasks Unlimited.) There is a group of bikes that are located near the house. It is my understanding that one of the residents fixes bikes and either sells them or gives them away. If the bikes are being sold on the premises, this is not a legal home occupation because home occupations are not permitted in the R-2 district. Mr. Nielson said that he will be prepared to answer questions on this matter. Recommended Action Staff recommends amending the zoning map from Single-Family Residential (R-1) to Two- Family Residential (R-2) for the property at 3370 Lilac Dr. N. he property is currently a non- conforming two-family home that was constructed legally as a two-family home in 1960. If the zoning map amendment was done, the character of the neighborhood would remain low density in character and consistent with the General Land Use Plan Map designation of Low Density. The proposed expansion would have minimum impact on the area and upgrade its appearance. The application for rezoning, which you requested, is enclosed with this letter. I know you are aware that the tenants at this property are persons who also receive services from Tasks Mental Health Services. While I have shared that general information with you as we discussed the project, specific information about residents mental health is protected by privacy laws. This is not a licensed home and the occupancy as a duplex is consistent with the Golden Valley ordinance, which permits up to 5 unrelated adults to reside in each unit. The rezoning request should not necessitate the sharing of any information of a private nature about our tenants. Our request is to improve the property and your criteria for non-conforming dwellings in an R-l district require this application. In an earlier conversation I asked about your interest in broadening the rezoning area, since several properties close to our site are of the same construction. It seems you could avoid the potential for future hearings in the event others wanted to expand if you would include those properties at this time. Just food for thought.
