A regular meeting of the Planning Commission was held at the Golden Valley City Hall,
Council Chambers, 7800 Golden Valley Road, Golden Valley, Minnesota, on Monday,
November 5,2007. Chair Keysser called the meeting to order at 7 pm.
Those present were Planning Commissioners Cera, Eck, Keysser, Kluch
Schmidgall and Waldhauser. Also present was Director of Planning a

Grimes referred to a site plan of the property and stated that it is located on the corner of
Pennsylvania Ave. and Wayzata Blvd. in the former Suburban Tire building. He explained
that Morrie's Automotive is considering purchasing this property and remodeling it in order
to sell and service automobiles.
Grimes discussed the history of the site and stated that it is located in the Industrial
Zoning District. He explained that prior to the early 1980s the City did not require
Conditional Use Permits for auto repair or auto sales in the Industrial Zoning District so
the former tire store and former gas station operated without Condition" ermits.
When the ordinance was revised to require Conditional Use Permits uses
were considered non-conforming uses. They could continue to op t until

understanding is that they will remain two separate parcels. He stated that combining the
properties would require a PUD. He explained that the use is an existing non-conforming
use and the law allows it to remain so he feels a Conditional Use Permit in this case is
appropriate.

Cera asked if the property will require any variances for the existing setback issues.
Grimes said no because the buildings footprints are not expanding. He explained that
state law says that non-conforming uses can continue to operate and non-conforming
structures can be improved and maintained. However they can not be enlarged or
encroach further into setback areas.

Brad Gunn, Malkerson Gilliland Martin, representing the Applicant, stated that he believes
the changes being discussed will be good for the community. He reiterated that the
exterior of the buildings will be upgraded to improve their appearance, paces will

in those reports are not for the Planning Commission to decide, it should be between the

Waldhauser stated that usually when the Deputy Fire Marshal makes these types of
recommendations it is because of access issues or he may want the building sprinklered
for other reasons.

Keysser said he would be comfortable not having a condition of approval regarding the
building being sprinklered. Kluchka recommended leaving the condition regarding
sprinkering in the approval because it is only a recommendation, not a requirement.
Grimes reiterated that the plans will be reviewed by the Building Official and the Fire
Marshal and the applicant will have to meet the requirements of the building and fire
codes. He said he would ask the Deputy Fire Marshal to write a memo that specifically
addresses the issues discussed before the Conditional Use Permit request goes on to the
City Council.

Keysser clarified that the Commission is recommending that the wording be changed in
condition number 7 regarding the Deputy Fire Marshal's memo and that they are adding a
condition regarding the number of cars allowed to be displayed. The Commissioners
agreed.
Kluchka suggested that the applicant add bicycle racks to the site.
Eck stated that this site as always been automotive in use and he sees this as nothing
more than an enhancement to the appearance.
