Minutes of a Regular Meeting of the Golden Valley Board of Zoning Appeals November 27, 2007 A regular meeting of the Golden Valley Board of Zoning Appeals was held on Tuesday, November 27,2007 at City Hall, 7800 Golden Valley Road, Golden Valley, Minnesota. Chair Boudreau-Landis called the meeting to order at 7 pm. Those present were Members, Boudreau-Landis, Morrissey, Nederveld Commission Representative McCarty. Also present were Director of PI Development Mark Grimes and Administrative Assistant Lisa Witt I. Approval of Minutes - October 23,2007 MOVED by Sell, seconded by Boudreau-Landis and molign car approve to October 23, 2007 minutes as submitted. II. The Petitions are: .:. Purpose: endtB!3 variance that was approved at the August 28, 2007 9 Appeals meeting to allow for the construction of a ocr closet addition plicant, Sandra Gunderson, appeared before the Board of 8 to request variances to expand her home. Part of that an existing main floor closet to be enlarged. He stated that the ,:~termined, after speaking with contractors, that a larger closet than d would be desirable. Nederveld ed that the new plans for the closet show a lesser encroachment (about 5 inches) into the side yard setback area than what was approved in August. Grimes agreed, but stated that the proposed larger closet still requires a variance. Sandra Gunderson, Applicant, stated that when her builders looked at her original plans they said that it would make the closet more functional if it were 45 inches wide and 5 feet . deep so that is why she is asking for an amendment to the original variance request. Boudreau-Landis opened the public hearing. Seeing and hearing no one wishing to comment Boudreau-Landis closed the public hearing. . <. . Gunderson said construction on her house starts in January and she is not considering any other changes to the plans that have been approved. MOVED by Morrissey, seconded by Sell and motion carried unanimously to amend the variance granted August 28, 2007 to allow for a larger (45 inches wide by 5 feet deep) main floor closet addition. Mr. and Mrs. Patterson are proposing to construct a deck onto the front of their home. The proposed deck would encroach into the front yard setback'i>f the property. The Pattersons did begin the construction without a building permit and the work was stopped by one of the building inspectors. When Mrs. Patterson came in to the City about the work being stopped, it as discovered that the deck location did not meet setback requirements in addition to building code requirements. The variance requests are to allow for the completion of the deck and to bring the existing garage and screened porch into conformity with City Code requirements. I have viewed this property and have attached photos of the site. As detailed in the Patterson's Zoning Code Variance Application, the hardship with this property is that the front door to the house is four feet off of the ground, making a deck-type entrance necessary. Also, the previous deck was in disrepair and a new structure would enhance the appearance and safety of the home. The existing garage (built by previous owners) is in violation of City Code due to its proximity to the principal structure. In addition, an attached screened porch (also built by previous owners) is in violation of side yard setback requirements. This porch was built without a building permit. Variances are needed to bring these two structures into conformity with the City's Zoning Code. The proposed project requires variances from the following section of City Code: Section 11.21, Subd. 10(A)(1) Front Yard Setback Requirements. The City's Zoning Code states that front yard setbacks in the R-1 Zoning District shall be at least 35 feet from any front property line along a street right-of-way line. The proposed deck requires a variance of 8 feet off the required 35 feet to a distance of 27 feet at its closest point to the front yard (south) property line. Section 11.21, Subd. 10(A)(3)(a) Side Yard Setback Requirements. The City's Zoning Code states that side yard setbacks in the R-1 Zoning District, in the case of lots having a width of 100 feet or greater, shall be 15 feet from the property line. The existing screened porch requires a variance of 8 feet off the required 15 feet to a distance of 7 feet at its closest point to the side yard (east) property line. . . . Section 11.21, Subd. 11 (A)(1) Front Detached Accessory Structure Location. The City's Zoning Code states that a detached accessory structure shall be located completely to the rear of the principal structure, unless it is built with frost footings. The existing garage requires a variance to bring the structure into conformity with City Code. No prior variances have been obtained for this property.
