March 22, 2005
A regular meeting of the Golden Valley Board of Zoning Appeals was held on Tuesday,
March 22,2005 in the Council Chambers, 7800 Golden Valley Road, Golden Valley,
Minnesota. Sell called the meeting to order at 7 pm.
Those present were Members Duff, Hughes, McCarty and Sell and Plan
Commission Representative Waldhauser. Also present were Plannin
Gonzalez and Administrative Assistant Lisa Wittman.
I. Approval of Minutes - February 22, 2005
McCarty stated that he was listed as present, but was actual

Duff referred to the application and stated that the noted hardship is the corner lot
setback requirements. He said he views the hardship more as the slope of the lot.

MOVED by Waldhauser, seconded by McCarty and motion carried unanimously to
approve the request for 1.5 ft. off the required 12.5 ft. to a distance of 11 ft. at its closest
point to the side yard property line for a kitchen, bedroom, study addition.
III. Other Business
Sell stated that David Cera has been appointed to the Planning Commission and will
not longer serve on the Board of Zoning Appeals. He agreed to chair the meetings until
the election of officers in April.

Brian and Patricia Peuschold own the house and property at 4501 Avondale Road. The
applicants are requesting one variance from Section 11.21, Subd. 10 (A)(3)(a), Side Yard
Setbacks, in order to allow for construction of an addition to the rear of the existing home and
garage. The proposed addition would turn the current kitchen space into a kitchen/great room
area, and add a second % bathroom and additional workspace. The survey indicates that the
existing setback (the garage portion of the home) is 13.8 ft. from the side property line. The
proposed addition would have a setback of 13.3 feet therefore extend 1.7 feet into the side yard
setback. The requested variance will allow for the construction of the addition.
The applicant states that the primary hardship is the irregular shaped lot.
The project requires the following variance from City Code:
· Section 11.21, Subd. 10 (A)(3)(a) City Code states the required side
yard setback for lots of 100 feet or greater in width shall be 15 feet. The
requested variance is for 1.7 feet off the required 15 feet to a distance of
13.3 feet at its closest point to the side (east) property line.
A review of the City file indicates that the house was built in 1951 and that no other
additions have been made to the house since that time.

Our house, built in 1926, does not haye a garage. Additionally, our lot and the house
placement are irregular. Our house sits sideways and at the very back of our lot (see
attached photos and lot survey) i.e. our front door faces east where the street is south..
The house placement on the lot severely restricts possible building sites forthe garage,
and leaves just one option. The hardships of no garage in Minnesota are obvious due to
weather. As well, we have no place to store garbage cans, recycling bins, rakes, shovels,
etc.

We have worked closely with our architect to make certain that the design and placement
of our proposed garage addition enhances the historic aesthetic and integrity ~f our 1926
home in combination with the modem convenience / necessity of an attached garage in
Minnesota. As well, we know that this garage addition will be pleasant, positive
improvement for our neighbors, who will no longer have to see our cars parked in the
driveway and our miscellaneous lawn/snow equipment and garbage at the backside of our
home.

George Wessin is the property owner ofWessin Transport at8125 Lewis Road. Wessin
Transport specializes in contracted airfreight and express trucking services and provides delivery
and other related transportation services to its customers. The property at this address is a
25,280 square foot warehouse. The owner is requesting three variances from the Light Industrial
zoning code (Section 11.35) and one variance from the Shoreland Management (Section 11.65)
in order to reconstruct the parking lot. The reconstruction of the parking lot would include lowering
the land behind the existing building to accommodate dock-height loading and unloading of
trucks. The property is zoned office warehouse and light industrial use but current conditions of
the parking lot make vacant warehouse space difficult to rent due to the lack of dock level loading
and unloading.
The project requires the following variances from City Code.
· Section 11.35, Subd. 7(C)(3) Side Yard Setbacks. City Code states that for
Industrial Zoning Districts the side setbacks shall be 20 feet. The requested
variance is for 15 feet off the required 20 feet to a distance of 5 feet at it
closest point to the (west) side yard property line for the existing building.
· Section 11.35, Subd. 7(C)(4) Yard Requirements. City Code states that for
Industrial Zoning Districts adjoining an Industrial Zoning District, one half (1/2)
of the required side setbacks shall be landscaped. planted. and maintained as
a buffer zone. The requested variance is for 5 feet off the required 10 feet to a
distance of 5 feet at its closest point to the side yard (west) property line for the
parking lot.
· Section 11.35, Subd. 7(C)(4) Yard Requirements. City Code states that for
Industrial Zoning Districts adjoining an Industrial Zoning District, one half (1/2)

a buffer zone. The requested variance is for 10 feet off the required 10 feet to

requires that all structures adjacent to Bassett Creek shall be set back 50 ft. from the
top of the bank. The variance request is for 36 feet off the required 50 feet to a
distance of 14 feet at its closest point to the top of the bank of Bassett Creek.
A review of the City file indicates that the building was erected in 1960 and that no
other variances have been requested.

With this letter and enclosures I am making application for variances in parking and
parking lot setback from Basset Creek and from the easterly property line for the property
at 8125 Lewis Road in Golden Valley. Enclosed with this letter are the following:
1. Application form (items 3 and 4 are addressed in this letter);
2. A check in the amount of $225 to cover the application fee;
3. A site plan for the project; and
4. Signatures of surrounding property owners verifying notification by applicant
concerning the proposed project.

The project involves lowering the land behind the existing 25,280 square foot
building to accommodate dock-height loading and unloading of trucks to meet
needs for its intended office-warehouse-light industrial use and reconstructing,
expanding and improving the parking lot to define the boundary for vehicular
access on the site and to capture water that currently runs off of the parking lot
and site directly into Bassett Creek and redirect it through a treatment system that
will both reduce the rate and improve the quality of the runoff into the Creek.

granting ofthis(these) variance(s).
Vacant warehouse space m the bUlldmghas been dlttICUlt to rent due to the lack
of dock level loading and unloading, a basic requirement in the current
warehouse/light industrial market. Without this project, a change in use of the
building would likely be required, presenting a hardship in that adequate land to
provide parking for office, the most logical alternative use to warehouse or light
industrial allowed in the light industrial zoning district within which the property
islQcated, does not exist on the site.

The regrading of the area behind the building and the further encroachment on the
required 50-foot Bassett Creek setback (existing setback is 16 feet at closest point
and average of 26 feet; proposed setback is 14 feet at closest point and average of
18) are necessary in order to provide dock level.access to the building. This
additional encroachment on the required Creek setback is, in large part,
ameliorated by the fact that vehicle circulation will now be defined with curbing
that will also serve to channel water running off the parking area and site through
a treatment system. This improvement to the parking lot along with installation of
the treatment system will improve the quality of water running into Bassett Creek
from the site and reduce the rate of runoff into the Creek.
While the improved parking lot will also encroach on the required ten-foot side
setback from its east property line, it represents an improvement over the existing
situation where the parking lot continues onto the adjacent property with no
consideration for location of the lot line. The curb along the easterly property line
of the subject parcel is proposed to be located one foot from the property line in
the reconstruction and improvement of the parking lot.
Even though no expansion of the building is proposed, a parking variance is
required because of the fact that the building, which does not meet minimum
parking requirements, is being altered. The nonconformity in parking will not
increase as a result of the project, however. Allowing the requested variances in
parking lot setback facilitates the installation of truck docks, thereby increasing
the likelihood that the vacant space will be leased for warehouse or light industrial
and reducing parking needs as compared to use of the vacant space for office.
Without the variances the property owner cannot make reasonable use of the
property in that part of the building would need to be demolished or left vacant.
The property for which the variances are being requested was purchased by the
current property owner in its current condition, unique to the property and not
created by the current owner. The variances, if granted, will not alter the essential
character of the locality. As indicated above the variances will, in fact, facilitate
changes to the site that will improve the area and be in keeping with the spirit and
intent of the Zoning Ordinance.
We respectfully request that the Board of Zoning Appeal approve the requests on the
basis that they meet the hardship criteria for granting variances. I will be present at the

Robert Kolasa & Lois Lenarz own the house and property at 117 Paisley Lane. The applicants
are requesting a variance from Section 11.72, Subd. 3 (A)(1 ),Front Yard Fence Height
Regulations in order to construct a fence along the east and north side of their property. The
applicants intend to build a fence 40 inches high with integral posts 8 feet high that are 18
incl1es wide. The fence would stretch 58 feet along the front yard (east) property line. The
applicants were not required to obtain a survey as there was an accurate survey on file with
the City.
The applicant's stated hardship is the irregular lot conditions. The applicants' front yard
borders the neighbor's back yard which would allow for a 6 foot fence.

In addition to the fence the applicant intends to build a Pergola, which is an arbor with an open
roof of rafters supported by posts (see attached photos). The structure would be 12 feet wide
and 1 0 feet deep along the north property line. The applicant has been informed that the
structure needs to be set back 5 feet from the property line.
The project requires a variance from the following Section of City Code:
· Section 11.72, Subd. 3 (A)(1), Height Limitations. City Code states that no fence in
the front yard of any residential property shall be. higher than 4 feet. The requested
variance is for 4 feet greater than the maximum 4 feet, to a height of 8 feet.
A review of the City file indicates that the house was built in 1960. A conforming porch was
built in 1963.
