Brian and Karen Zais, with property located at 1501 Zealand Avenue North, are requesting
variances from the Residential zoning code (Section 11.21). 'The applicants have
approached the City to build a 2nd story room addition over the existing garage. This addition
does not meet building setback requirements. In addition, a survey was submitted for the
property and it was discovered that the existing home and garage also do not meet building
setback requirements. This project requires variances from the following sections of City
Code.
· The requested variances are from Section 11.21, Subd. 7(A) Front Yard Setback. City
Code states that the front yard setback shall ,be 35 feet from the front yard property line.
The variances requested are for 18.6 feet off the required ,35 feet to a distance of 16.4
feet at its closest point to the front property line along Winsdale Street North for the
existing home and for 13.9 feet off the required 35 feet to a distance of 21.1 feet at its
closest point to the front property line along Winsdale Street North for the existing garage
and proposed 2nd story addition.
The City's file on this property reveals that a permit was pulled in November of 1950 for the
construction of the home. No other pertinent information was found in the file.

We have been residents of our home in Golden Valley for. 5 years. We enjoy living in Golden
Valley, and we support our local community and merchants. We would like to be long-term,
contributing members of the city, and have already performed several projects to improve the
utility and yalue of our property and our older home.
In November 2001, we were blessed with twin daughters. Over the past 14 months it has
become apparent to us that our current home will quickly become inadequate to support our
enlarged family. In addition, both sets of grandparents are from out of state, and our house is not
well equipped to host guests for more than a night or two. We really enjoy our home and where
we live, so we chose to pursue expansion rather than being forced to move.
Our existing house, built in 1953, does not meet the current setback requirements of our comer
lot. It is conforming in the setbacks from 3 of the 4 property lines, however it is too close to the
property line along Winsdale Ave; to meet current ordinance.
Our proposed addition consists of a single-story expansion behind the garage and breezeway plus
the addition of a second story to the garage. The only portion of the entire expansion that does
not conform to current setback requirements is. a vertical extension of existing walls-it would
not encroach further on the setback than the existing structure.
We feel that the revised house would look balanced in design and aesthetics, and would still
blend with the style and character of the other houses in the neighborhood. It would not be the
"odd duck" with respect to setback: of the 8 houses on our 2-block spur of Wins dale Ave., 5 do
not meet the current setback requirements, and some have had variances granted to expand
further into the setback. Our house very closely matches the setback of the other 4 non-
conforming houses.
We request that a waiver of the setback requirement be granted so that we can continue to live in
our home in Golden Valley.

North, have petitioned the Golden Valley Board of Zoning Appeals for
variances from the Residential zoning district. The applicants are
proposing to build a room and breezeway addition to the rear of the
existing home. These additions meet building setback requirements.
However, the applicants are also proposing to build a 2nd story room
addition above the existing garage. This proposed addition, as well as
the existing garage and existing home, do not meet building setback
requirements. Below are the requested variances:
. Section 11.21, Subd. 7 (A) Front Yard Setback. City Code
states that the front yard setback shall be 35 feet from the front
yard property line. The variances requested are for 18.6 feet off
the required 35 feet to a distance of 16.4 feet at its closest point
to the front property line along Winsdale Street North for the
existing home and for 13.9 feet off the required 35 feet to a
distance of 21.1 feet at its closest point to the front property line
along Winsdale Street North for the existing garage and proposed

This petition will be heard at a regular meeting to be held Tuesday,
February 25, 2003, beginning at 7:00 P.M. in the Council Chambers,

Robert Newtson, with property located at 407 Turners Crossroads North, is requesting a
variance from the Residential zoning code (Section 11.21). The applicant has approached
the City to build a room addition to the existing home. This addition meets building setback
requirements. However, a survey was submitted for the property and it was discovered that
the existing garage does not meet building setback requirements. City Staff has allowed the
applicant to sign off on a "Hold Harmless" form in order to receive a building permit for the
remodeling project. This was done only after the applicant had submitted the required survey
and application materials. The Hold Harmless form is attached. This project requires a
variance from the following section of City Code.

Robert Newtson, with property located at 407 Turner's Crossroad North,
has petitioned the Golden Valley Board of Zoning Appeals for a variance
from the Residential zoning district. The applicant is proposing to build a
room addition onto the existing home. This proposed addition meets
building setback requirements. However, during the construction
planning process, a survey was submitted for the property and it was
discovered that the existing garage does not meet building setback
requirements. Below is the requested variance:
. Section 11.21, Subd. 7(A) Front Yard Setback. City Code
states that the front yard setback shall be 35 feet from the front
yard property line. The variance requested is for 27.5 feet off the
required 35 feet to a distance of 7.5 feet at its closest point to the

Team Properties, Inc., with property located at 211 Paisley Lane, is requesting a variance from the
Residential zoning code (Section 11.21). The applicant has approached the City to build a two-story
room and garage addition to the existing home. These proposed additions meet building setback
requirements. However, a survey was submitted for the property and it was discovered that the existing
home does not meet building setback requirements. City Staff has allowed the applicant to sign off on a
"Hold Harmless" form in order to receive a building permit for the remodeling project. This was done only
after the applicant had submitted the required survey and application materials. The Hold Harmless form
is attached. This project requires a variance from the following section of City Code.
· The requested variance is from Section 11.21, Subd. 7(A) Front Yard Setback. City Code states
that the front yard setback shall be 35 feet from the front yard property line. The variance requested is
for 4.1 feet off the required 35 feet to a distance of 30.9 feet at its closest point to the front property line
along Paisley Lane for the existing home.
Previously, an owner of this property received variances for this property for the existing home and for a
shed on the property. The variance for the existing home was for it to remain to a distance of 33.5 feet to
the property line along Paisley Lane. When a property survey was submitted for the recent construction
project, the survey showed the existing home as being 31.9 feet from the property line. Therefore, a new
variance for the existing home is required. A copy of the November 26, 1996 BZA meeting minutes is
attached for your review.
As can be seen from a visit to the site, a. shed exists just south of the existing home. This shed is owned
by the applicant and is appears to be in a different location than when a variance was approved for a shed
in 1996. After speaking with the applicant, David Kaplan of Team Properties, he has agreed to either
move the shed to conform to accessory building requirements or remove the shed from the property. As
a condition of approval of the above variance requests, staff requests the foll.owing:
1. Before a final building inspection is completed, the shed either be moved to conform to the City's
requirements for accessory buildings or be moved from the property.
The City's file on this property reveals that a permit was pUlled in September of 1976 for the construction
of the home. No other pertinent information was found in the file.

Purpose:
To make the house and shed legally nonconforming.
Staff Liaison Mark Grimes explained to the Board th~t the Solems wanted to begin
construction of a proposed underground addition before the November 26 meeting date.
Staff reviewed their proposal and told the Solem's builder that the applicant would need a
variance forthe proposed underground room addition and for an existing cantilever on the
east side of the house. The builder talked with his client and reported to staff that the
applicant has agreed to move the underground room addition so it would not infringe on
the side yard setback area. Staff Liaison Grimes commented that staff agreed to accept a
"Hold Harmless" letter with the understanding that the applicant would have the west lot
line surveyed so staff would know how far the addition was from the lot line; the shed
would be moved five feet from the property line and the three~season porch would be
removed from the west side ofthe house. The Solems would need to apply for a variance
for the nonconforming cantilever facing Paisley Lane.
Staff Liaison Grimes said that the applicant, in his request for a front setback variance is
also requesting a variance from Subd. 12 for accessory buildings. He would like the shed
to remain where it now stands.
It was noted that the applicant was not present at the meeting. The Board believed that
the issues at h::md were minor and instead of continuing this item to the next meeting
discussed the minor issues and granted the variances.
MOVED by Sell, seconded by Swedberg and motion carried unanimously to approve a
waiver of Section 11.21, Subd. 7(A) Front Yard Setback for 1.5 feet off the required 35
feet to a distance of 33.5 feet for the existing structure facing Paisley Lane; and a waiver
of Section 11.21, Subd. 12 Accessory Buildings for 3.5 feet off the required 5 feet to a
distance of 1.5 feet for the existing shed on the west property line.
