Jerry Kassanchuk, with property located at 235 Paisley Lane, is requesting variances from
the Residential zoning code (Section 11.21). The applicant has approached the City to build
a garage and room addition to the east side of the existing home. This addition requires
variances from building setback requirements. Below is the requested variance request:
· The first requested variance is from Section 11.21, Subd. 7(A) Front Yard Setback.
City Code states that the front yard setback shall be 35 feet from the front yard property
line. The variance requested is for 9.9 feet off the required 35 feet to a distance of 25.1
feet at its closest point to the front property line along Ski Hill Road for the proposed room
and garage addition.
· The second requested variance is from Section 11.21, Subd. 7(C)(1) Side Yard
Setbacks. City Code states that the distance between any part of a dwelling or structure
and the side lot lines shall be governed by the following requirements: In the case of lots
having a width over 100 feet, the side yard setback shall be 15 feet. The requested
variance is for 7 feet off the required 15 feet to a distance of 8 feet at it closest point to the
north side yard property line for the proposed room and garage addition.
Previously, this property received a variance. In July of 2002, a variance was granted for this
property for a proposed room and garage addition. The minutes from the July 23, 2002 BZA
meeting are attached for your review. Now, the applicant has revised his building plans by
moving the location of addition, which requires further additional variance requests.
According to the applicant, the building plans call for 836 square feet of proposed garage
space. The applicant already has 370 square feet of garage space. Therefore, after the
addition is built the applicant would have 1, 206 square feet of garage space. The City has a
policy of limiting a property to 1,000 square feet of garage and accessory building space.
The applicant has indicated that he will convert some of the existing garage space to a music
studio.

If the Board of Zoning Appeals approves this variance, staff suggests that the Board add the
following condition of approval:
1. After the addition is built, the applicant have no more than 1,000 square feet of
garage space.
The City's file on this property reveals that a permit was pulled in July of 1950 for the
construction of the home. No other pertinent information was found in the file.

Olson stated that the applicant is proposing to build a garage and 3-story addition on
the east side of his home, which would require a variance from the front yard setback
requirements.
Jerry Kassanchuk, applicant stated that because of the way the house is sitting on the
lot it is hard to add any additions except to the east. He stated there are only two
neighbors that this addition would affect and that the east side of the lot is very heavily
wooded.
Shaffer stated that this proposal seemed logical and the addition wouldn't affect any of
the surrounding neighbors. He added that it is going to be hard to even see the new
addition because of all the trees on the lot.
Cera asked if there is also a north side yard setback issue. Olson stated that the
applicant has redesigned his plans and that the north side yard setback requirement of
15 feet would be met.
MOVED by Shaffer, seconded by Smith and motion carried unanimously to approve the
request for 10.4 feet off the required 35 feet to a distance of 24.6 feet for the proposed .~

Brant and Debra Pallazza, with property located at 4101 Glencrest Road, are requesting
variances from the Residential zoning code (Section 11.21). The applicants have
approached the City to build a room, deck and front entryway addition to the existing home.
Only the front entryway addition requires a variance from the building setback requirements.
Also, a survey was submitted for the property and it was discovered that the existing home
does not meet building setback requirements. The following are the requested variances:
· The first requested variance is from Section 11.21, Subd. 7(A) Front Yard Setback.
City Code states that the front yard setback shall be 35 feet from the front yard
property line. The requested variance is for 1.6 feet off the required 35 feet to a

HEARING NOTICE
Board of Zonina Appeals

Brant and Debra Pallazza, Applicants
Brant and Debra Pallazza, with property at 4101 Glencrest Road, have
petitioned the Golden Valley Board of Zoning Appeals for variances from
the Residential zoning district. The applicants are proposing to construct
a room, deck and front entryway addition to the existing home. The front
entryway addition does not meet building setback requirements. Also,
during the construction planning process, a survey was submitted and it
was discovered that the existing home does not meet setback
requirements. This construction project requires variances from the
following sections of City Code.
· Section 11.21, Subd. 7(A) Front Yard Setback. City Code
states that the front yard setback shall be 35 feet from the front
yard property line. The requested variance is for 1.6 feet off the
required 35 feet to a distance of 33.4 feet for the existing home at
its closest point to the front property line along Glencrest Road;
and for 5.6 feet off the required 35 feet to a distance of 29.4 feet
for the proposedentryway addition at its closest point to the front
property line along Glencrest Road.
. Section 11.21, Subd. 7(B) Rear Yard Setback. City Code states
the required rear setback shall be 20 percent of the lot depth.
Staff has determined the rear setback requirement to be 29.9 feet
for any structure to the rear year property line. The requested
variance is for 4.3 feet off the required 29.9 feet to a distance of
25.6 feet at its closest point to the rear yard property line for the
existing home.
This petition will be heard at a regular meeting to be held Monday,
December 16, 2002, beginning at 7:00 P.M. in the Council Chambers,
7800 Golden Valley Road, Golden Valley, Minnesota. If you have any

Shaun Graham, with property located at 6620 Olympia Street, is requesting variances from
the Residential zoning code (Section 11.21). The applicant has approached the City to build
a 2-story room and garage addition onto the existing home. This project requires variances

· The first requested variance is from Section 11.21, Subd. 7(A) Front Yard Setback.
City Code states that the front yard setback shall be 35 feet from the front yard
property line. The variance request is for 18.6 feet off the required 35 feet to a distance
of 16.4 feet at it closest point to the front yard property line along Hampshire Avenue
North for the proposed 2-story room and garage addition.
· The second requested variance is from Section 11.21, Subd. 7(8) Rear Yard
Setback. City Code states the required rear setback shall be 20 percent of the lot
depth. Staff has determined that the rear setback to be 28.7 feet from the property line
to a structure. The requested variance is for 4.7 feet off the required 28.7 feet to a
distance of 24 feet at its closest point to the rear yard property line for the proposed 2-
story room and garage addition.
Previously, this property received several variances. In July of 2002, variances were granted
for this property for the existing home and decks on the property. The minutes from the May
29 and July 23, 2002 BZA meetings are attached for your review. The applicant had
originally approached the City in May, 2002 to build basically the same addition as is now
proposed. The BZA asked the applicant at that time to revise his plans and provide
elevations for the proposed addition. The applicant is now providing that information.
The City's file on this property reveals that a permit was pulled in March of 1946 for the
. construction of the home. No other pertinent information was found in the file.

Olson reviewed the applicant's request to build a two-story room addition and garage
addition to his existing home. He stated that the proposed additions as well as the
existing house require variances from the setback requirements.
McCracken.Hunt noted that part of the hardship in this case is that it is a corner lot.
Cera stated that the elevation change on the lot is also unique.
Shaun Graham, applicant stated he wants to take care of these variance requests
before he goes any further with the proposed additions. He stated he is in a business
which requires the materials be kept warm and that he is currently parking three cars on
the street. He stated that he wants to add a second story to his home because it only
has 900 square feet.

McCracken-Hunt noted that the existing garage is 20 feet x 24 feet. Cera stated that
size garage is actually a large single stall garage. Graham stated that there is a 7-foot
wide door on the existing garage and that he can't get a car into it. He showed the
Board a sketch of an elevation for the proposal and stated he would eventually like to
turn the breezeway into a dining room.
Cera asked the applicant if he had any detailed drawings of the proposal. Graham
stated that Staff told him he didn't need to have detailed plans but that he had done a
lot of planning before he came to the City with these variance requests.
Shaffer asked the applicant if he is planning to keep the existing garage. Graham
stated no he was not.
McCracken-Hunt stated that the variance request for the existing deck concerns her
and asked if the deck could be moved to the other side of the house instead of being in
front of the house. Cera stated that there is already a deck on the side of the house.
Sell stated that the deck in front is really an entryway.

Shaffer asked the applicant if the new addition could be moved back four feet. Graham
stated that then it wouldn't line up with the existing house. Shaffer stated that the new
addition might look better and not so massive if it were pushed back a little bit.
Cera stated he was having difficulty picturing how this proposal would work. Graham
stated that he thought the concern was the distance from the property line, not the flow
of the house.
Sell asked about the distance to the property line of the proposed addition along the
north side. McCracken-Hunt stated it would be approximately 16 feet, -but if the addition
were pushed back 4 feet then the distance would be 20 feet in the front.
Shaffer stated that this proposal makes him nervous because there is a good chance
that this applicant would be back with more variance requests in the future. He stated
that if the addition were moved back it would be more in line with the homes already in
the neighborhood. He stated that he is hesitant about approving these variance
requests without seeing more detailed plans and suggested that the applicant hire a
designer to help with the plans for this addition. He stated that he thinks this request
should be tabled.
McCracken-Hunt stated that she would also like to table this request and have the
applicant explore the possibilities of moving the Hampshire side of the proposed
addition back four feet.
MOVED by Shaffer, seconded by Cera and motion carried unanimously to table the

existing home. Olson stated that he recommends approval for the existing home
variance requests and denial forthe proposed addition requests because the applicant
is planning on changing his plans for the addition.
Sell stated that if the Board denies the requests for the proposed addition then the
applicant could not Gome back with further variance requests for a year. Olson stated
that variance approvals are valid for one year but that an applicant doesn't have to wait
a year to reapply for a variance request that has been denied. Smith stated he thought
that an applicant couldn't make a request for an identical variance waiver for a year, but
if the request were changed they could.
Shaffer stated the applicant should submit something in writing to withdraw his variance
requests for the proposed addition. Olson had the applicant write a note requesting
withdrawal of the variance requests dealing with the proposed addition.

McCracken-Hunt suggested voting on the variance requests dealing with the existing
homes and not voting on the requests dealing with the proposed addition. She asked
the applicant if he was willing to withdraw his variance requests for the proposed
addition. Shaun Graham, applicant stated yes, he wanted to withdraw the variance
requests for the proposed addition.

petitioned the Golden Valley Board of Zoning Appeals for variances from
the Residential zoning district. The applicant is proposing to construct a
2-story room and garage addition to the existing home. This addition
requires variances from the following building setback requirements:
. Section 11.21, Subd. 7(A) Front Yard Setback. City Code
states that the front yard setback shall be 35 feet from the front
yard property line. The variance request is for 18.6 feet off the
required 35 feet to a distance of 16.4 feet at it closest point to the
front yard property line along Hampshire Avenue North for the
proposed 2-story room and garage addition.
. Section 11.21, Subd. 7(B) Rear Yard Setback. City Code states
the required rear setback shall be 20 percent of the lot depth.
Staff has determined that the rear setback to be 28.7 feet from
the property line to a structure. The requested variance is for 4.7
feet off the required 28.7 feet to a distance of 24 feet at its closest
point to the rear yard property line for the proposed 2-story room
and garage addition.
This petition will be heard at a regular meeting to be held Monday,
December 16, 2002, beginning at 7:00 P.M. in the Council Chambers,

Richard Korab, with property located at 4940 Markay Ridge, is a requesting variance from the
Residential zoning code (Section 11.21). The applicant has approached the City to build a
porch addition to the rear of the existing home. This addition meets building setback
requirements. However, a survey was submitted for the property and it was discovered that
the existing home does not meet building setback requirements. City Staff has allowed the
applicant to sign off on a "Hold Harmless" form in order to receive a building permit for the
remodeling project. This was done only after the applicant had submitted the required survey
and application materials. The Hold Harmless form is attached. The following are the
requested variances:
· The requested variance is from Section 11.21, Subd. 7(A) Front Yard Setback.
City Code states that the front yard setback shall be 35 feet from the front yard
property line. The requested variance is for 8 feet off the required 35 feet to a
distance of 27 feet for the existing home at its closest point to the front property line
along Markay Ridge.
The City's file on this property reveals that a permit was pulled in March of 1955 for the
construction of the existing house. No other pertinent information was found in the file.
