2001, in the Council Chambers, 7800 Golden Valley Road, Golden Valley, Minnesota. Chair
McCracken-Hunt called the meeting to order at 7:00 pm.

Olson referred to his memo dated May 16, 2001 and stated the applicants want to construct
a porch on the east side of their home. He stated that when a survey was submitted for the
property it was discovered that the existing home does not meet the side yard setback
requirements, therefore, the applicants are requesting the variances listed above.

Shaffer asked why the setbacks are ranged. Olson stated that is done because the lot is
irregularly shaped and the rear of the lot is not as wide as the front, so the setback varies.
Shaffer asked if this setback was figured differently than they normally are. Olson stated he
worked out the setback ranges with the building inspector. Grimes stated that this property
was a little unusual because it's a pie shaped piece of property.

Eric Flam, applicant, stated that there was an existing porch that they had to remove
because it had rotted out the rim joist and caused major erosion problems and now they
would like to replace it with a new porch.

Shaffer asked if the proposal is for a screened porch. Flom stated that is what they are
proposing. McCracken-Hunt asked if it was previously a deck. Flom stated yes. Cera
asked if the new porch would be in the same spot. Flom stated it was the same on the
side, but it would go further back than the deck did.

to the foundation and construct a new home on this foundation. However, during the
construction planning process, a survey was submitted for the property and it was
discovered that the existing home foundation does not meet the front and south side yard
setbacks.
Olson stated that a portion of the property lies within the flood zone and the City Engineer is e
recommending that two conditions be made part of any variance approval. Thefirst

permanent structure in the flood zone area. Olson referred to the shed indicated on the
survey and stated that the applicants have indicated they will be removing it.
Grimes suggested that it should be required that the shed be removed before a certificate
of occupancy is issued.

maintenance of the wall. Grimes stated that this property isn't along a wall so MnDOT
probably wouldn't require an easement.

A. Clarification of February 27,2001 Meeting Minutes - Variance for 2155 Kelly Drive
Olson stated that the Building Official, Gary Johnson, wanted the minutes to be corrected for the
variance at 2155 Kelly Drive. The board voted to allow an accessory building to be constructed in
front of the existing home, but the minutes didn't reflect the distance tha' ould be from the
home. The minutes have been corrected to show that the accessory an be constructed
no closer than 28 feet to the front yard property line.

Susan Getts, with property located at 1315 Tyrol Trail, is requesting variances from the
Residential zoning code (Section 11.21). The applicant has approached the City to remodel
the existing home. During the construction planning process, a survey was submitted for the
property and it was discovered that the existing home does not meet setback requirements.
City Staff has allowed the applicants to sign off on a "Hold Harmless" form in order to receive
a building permit for the remodeling project. This was done only after the applicant had
submitted the required survey and application materials. The Hold Harmless form is
attached. Ms. Getts will soon begin construction of the remodeling project.
· The first requested variance is from Section 11.21, Subd. 7(A) Front Yard Setback.
City Code states that the front yard setback shall be 35 feet from the front yard property
line. The variance request for the home is for 1.8 feet off the required 35 feet to a distance
of 33.2 feet at its closet point to the front property line along Tyrol Trail.
· The second requested variance is from Section 11.21, Subd. 7(C)(1) Side Yard
Setbacks. City Code states that the distance between any part of a dwelling or structure
and the side lot lines shall be governed by the following requirements: In the case of lots
having a width between 70 and 1 00 feet, the side yard setback shall be 15% of the lot
width. The requested variance is for 1 foot off the required 12.6 feet to a distance of 11.6
feet at it closest point to the east side yard property line for the existing home.
The City's file on this property does not contain the original building permit for the home, but
Hennepin County's property record system states that the home was constructed in 1936.
No other pertinent information was found in the file.

Susan Getts, with property located at 1315 Tyrol Trail, has petitioned the
Golden Valley Board of Zoning Appeals for four variances from the
Residential zoning district. The applicant is proposing to construct a
addition onto the existing home. Also, as a result of this construction, it
was discovered that the existing home does not meet current setback
requirements. This construction project requires variances from the
following sections of City Code.
. Section 11.21, Subd. 7(A) Front Yard Setback. City Code
states that the front yard setback shall be 35 feet from the front
yard property line. The variance request for the home is for 1.8
feet off the required 35 feet to a distance of 33.2 feet at its closet
point to the front property line along Tyrol Trail.
· Section 11.21, Subd. 7(C)(1) Side Yard Setbacks. City Code
states that the distance between any part of a dwelling or
structure and the side lot lines shall be governed by the following
requirements: In the case of lots having a width between 70 and
100 feet, the side yard setback shall be 15% of the lot width. The
requested variance is for 1 foot off the required 12.6 feet to a
distance of 11.6 feet at it closest point to the east side yard
property line for the existing home and for 8.5 feet off the required
12.6 feet to a distance of 4.1 feet at it closest point to the east
side yard property line for the proposed garage addition.
· Section 11.21, Subd. 7(B) Rear Yard Setback. City Code states
the required rear setback shall be 20 percent of the lot depth.
Staff has determined that the rear setback to be 25.3 feet from the
property line to a structure. The requested variance is for 14.6
feet off the required 25.3 feet to a distance of 10.7 feet at its
closest point to the rear yard property line for the proposed
garage addition.
This petition will be heard at a regular meeting to be held Tuesday,
June 26,2001, beginning at 7:00 P.M. in the Council Chambers,
7800 Golden Valley Road, Golden Valley, Minnesota. If you have

requesting a variance for an a detached garage to be constructed 4 feet from the south
yard property line and for the shed to be constructed 2 feet from the detached garage.
The City's file on this property reveals that a permit was pulled in November of 1953 for the
construction of the existing house. No other pertinent information was found in the file.

I am requesting a Variance and Waiver to build a deck on the front of my home
located at 1540 Ottawa Ave. So., Golden Valley. I'm not able to attach one on the rear as
there is no access to it. Also, my air-condition unit, furnace air intake and exhaust are
located at the rear of the home.
My wife is handicapped and is at the state of using a wheel chair. As the back
door is on the side from the driveway, it is impossible to use that door with a wheel chair.
There is not enough room inside the side door to make a turn for the wheel chair. I can
only use the front door. My wife also has terminal cancer. It is her hope and desire,
along with mine, that she be able to spend some time out on a deck as long as she is able.
We have a deck on our winter mobile home down in Texas and use it just about every
day. I plan to have a ramp build over the steps on the south end of the deck.
I have discussed this with many of my neighbors and have received no objection
from any of them. In most cases they encouraged me to put a deck on as it would
improve the font of the house.

The height of the front steps is only sixteen inches high. My intentions are to add
only two and a half inches needed for construction and decking.
I ask that you give serious consideration of my request.

from that meeting are attached for your review. At that time, the applicant received a
variance to build the room addition up to 7.4 feet to the rear yard property line. The
requirement is for the building to be setback 25.4 feet from the property line. After receiving
the variance, the homeowner did not build the addition.
· The first requested variance is from Section 11.21, Subd. 7(C)(1) Side Yard Setbacks.

Variance Request: Physical description:
We propose to build an addition 20'x34' on the west side and
southwest corner of our house. This will be one large interior room
20'x28' with a cathedral ceiling reaching a maximum height of 16'
(approximately). There will be a clerestory with north facing
windows at the peak. A lower shed roof will extend from below the
clerestory to the north. This roof will cover six feet of the interior
space and a six foot wide porch.
The addition will attach to the west elevation of our house and
project past the southwest corner of the house and join up with an
existing deck (which will be rebuilt as necessary). This extension
allows us to put a separate entry from the deck into the new
structure thereby qualifying the space as an at home office. This
projection will come within seven feet of the lot line. Our neighbor
(Wendy Louise) on this side has built her garage to within seven feet
of the property line. The space between us is rough, unused and
unusable space except as a muddy walkway.
Esthetically this addition will create a visual balance and
harmony to the existing structure which will be an asset for the e
whole block. By building south we will have the most positive affect
on the neighborhood.
If we build to the north we will intrude on the Nelmarks living
space and view. Which we feel would be unacceptable.
Our house faces east. If we build east, externally it would be
esthetically inappropriate and internally it would make the house
traffic pattern unacceptable. By building off the front of the house
we would lose our best garden and flower bed area and view of
Wirth parkway.
In order to best utilize our lot we will build this addition on
posts over the existing driveway creating a carport underneath.
Thus we will keep our existing two car garage which we will loose if
we build at ground level. Because of the minimum excavation
(auguring holes large enough and deep enough for cement pads and
columns below the frost level) required for building on posts will
minimize the physical impact on the existing house footings, our lot
and the neighborhood in general. Building on posts will keep the
new space on the same level as the existing living area allowing
future owners to adapt the space to their needs.

Variance Request: Reason for variance:

Bernice is a full time Professor of visual art at the University of
Wisconsin-River Falls, WI. Jon is an adjunct professor at the College
of Visual Arts in St Paul. To maintain our professional status, keep
our jobs and insure advancement within the academic community
we are annually evaluated on our professional activity. We must be
actively engaged in producing research in drawing, graphics and
photography. This requires we have a fine art studio. This would be
a research and work space, not open to the general public.
For the last 20 years we have rented studio space in
Minneapolis. However, this is becoming prohibitively expensive. We
are anticipating our future retirement and realize that we must
control this important fiscal responsibility by stabilizing our
expenses while simultaneously creating equity which we are now
loosing by paying rent.
By having immediate access to our studio we will be more
productive and utilize our time better. Instead of spending a half
hour driving each way to and from a studio we will be able to
creatively use the odd hour that may suddenly present itself. Less
driving is better for the environment and the community.
We enjoy being actively involved in our two sons schools and
interests. A studio at home will give us more time with our children
and allow us to fulfill our professional research responsibilities.

It was explained that the street is not developed to full width and in all
probabl1ity considering the topography, it wi 11 not be widened in the future.
Mr. Perssons stated that with the front of the house built to within 15 feet
of the front lot line it would still be 40 feet back from the existing street.
The longer the driveway on this site, the more difficult it is to construct.
Mr. and Mrs. Kastor participated in the plan review and discussions.
Mike Sell moved to adjust the waiver request to 15 feet off the required 35
feet setback, to a distance of 20 feet from the front lot line and to approve
the required rear yard waiver for a rear yard of 19 feet from the lot line to
the proposed home. Second by Mahlon Swedberg. Discussion on the motion called.
During further discussion, Mr. Perssons described the proposed home as 60 feet
in depth, plus approximately 21 feet deep for the garage portion. The house in
effect running from front to back on the property with maximum trees and existing
growth maintained. The vote was called on the motion and it carried unanimously.

Mr. Moody was present, the petition was in order, consent had been obtained from
all adjacent properties.
Mr. Moody explained in his petition that they were previous owners of a home at
630 Sunnyridge Lane which was acquired and removed in the HRA area. The previous
home was on three lots and had a three-car garage.
They purchased this smaller home to stay in the area.
Mahlon Swedberg noted the proposed addition puts this home generally in line
with adjacent properties, proposes no significant impact on the area, and also
noted the placement of the existing home which requires setback waiver to provide

Jon and Bernice Swenson, with property located at 401 France Avenue
North, have petitioned the Golden Valley Board of Zoning Appeals for
four variances from the Residential zoning district. The applicant is
proposing to construct a room addition onto the rear of the existing
home. The construction of this room addition would reduce the rear yard
setback requirement. Also, as a result of this construction, it was
discovered that the existing home and deck do not meet current setback
requirements. This construction project requires variances from the
following sections of City Code.
· Section 11.21, Subd. 7(C)(1) Side Yard Setbacks. City Code
states that the distance between any part of a dwelling or
structure and the side lot lines shall be governed by the following
requirement: In the case of lots having a width between 70 and e
100 feet, the side yard setback shall be 15% of the lot width. The
requested variances are for 1.5 feet off the required 10.5 feet to a
distance of 9 feet on the north side for the existing home; for 8.5
feet off the required 10.5 feet to a distance of 2 feet on the south
side for the existing deck; and for 3.5 feet off the required 10.5
feet to a distance of 7 feet on the south side for the proposed
addition.
· Section 11.21, Subd.7(B) Rear Yard Setback. City Code states
the required rear setback shall be 20 percent of the lot depth.
Staff has determined that the rear setback to be 25.4 feet from the
property line. to a structure. The requested variance is for 9.6 feet
off the required 25.4 feet to a distance of 15.8 feet for a proposed
room addition to the rear yard property line.
This petition will be heard at a regular meeting to be held Tuesday, June
26,2001, beginning at 7:00 P.M. in the Council Chambers, 7800 Golden

requesting variances from the Residential zoning code (Section 11.21). The applicants have
approached the City to construct a deck onto the existing home. The construction of the deck
requires variances from the Residential zoning district building requirements.
Previously, this property received two variances.
· In June of 1993, a variance was approved for this property to construct a 7.5
foot high fence. Fences over 6 feet in height require variances. The minutes
from that meeting are attached for your review.
· In August of 1996, a variance was approved for this property to construct a
deck onto the existing home. The minutes from that meeting are attached for
your review. At that time, the applicant received a variance to build the deck
addition up to 12 feet to the rear yard property line. The requirement is for the
deck to be setback 19 feet from the property line. After receiving the variance,
the homeowner did not build the deck.
The requested variance is from Section 11.21, Subd. 7(8) Rear Yard Setback. City Code
states the required rear setback shall be 20 percent of the lot depth. Staff has determined
that the rear setback to be 19 feet from the property line to a structure. The requested
variance is for 5.4 feet off the required 19 feet to a distance of 13.6 feet for a proposed deck
to the rear year property line.
The City's file on this property reveals that a permit was pulled in December of 1978 for the
construction of the existing house. No other pertinent information was found in the file.

GOLDEN VALLEY BOARD OF ZONING APPEALS
June 8, 1993
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, June 8, 1993, at 7:30 P.M. in the City Council Chambers, City Hall,
7800 Golden Valley Road, Golden Valley, Minnesota.

The following Board members were present:

The first order of business was approval of the minutes of a regular meeting
held Tuesday, May 11, 1993, copies of which had previously been distributed
to the Board.
Herb Polachek moved to approve the minutes

90 feet in length along the northwest lot line.
The petition was in order, consent obtained from adjacent properties.
Leonid Mayzel was present. No others were in attendance for this petition.
11.21Subd. 7 C
Secretary, Lloyd Becker, explained that the Building Code identifies any
fence/wall over 6 feet in height as being a structure. The proposed board-
on-board fence is 7i feet high and as such is considered a structure on the
lot line.
Mr. Mayzel described the type of fence and said because of the noise of
1-394 he needs a fence and also for privacy. Mr. Mayzel said the home is
about 10 years old and he purchased the home approximately a year ago.
Mahlon Swedberg questioned why 7i feet. Mr. Mayzel said he is over 6
feet tall and wants the fence high enough to reduce sound and have privacy
for the back yard. The fence is only along the side toward 1-394 and ends
at the rear of the house. It does not run front to rear of the lot. .
MahlonSwedberg saidhes's not sure a 7i foot. high fence will solve any
noise problems but there may be a perception it does so. Swedberg moved to
approve the fence at H feet high along the northwest lot line. Second by
Mike Sell and upon vote carried.

Request:
Waiver of Section 11.21, Subd. 7 (B) Rear Yard Setback -- 12 feet off the
required 19 feet to a distance of 7 feet for the proposed deck; and
Waiver of Section 11.21, Subd. 7(C)(2) Side Yard Setback - 2 feet off the
required 11.25 feet to a distance of 9.25 feet for the proposed deck.
Purpose:
To allow for the construction of a nonconforming deck onto the southeast
side of the house (rear and side).
Staff Liaison Mark Grimes explained that this is an irregular shaped lot. He said that a variance
granted on this lot, in 1978, allowed the house to be built with smaller setbacks. The applicant is
proposing to construct an irregular shaped deck onto the rear and side (northeast corner) of the
house. Staff has heard from the neighbor to the south who is concerned with how close the deck
will come to the property line and the materials the applicant will be using in the construction of
e the deck.
The Board discussed the petition thoroughly and addressed a number of questions to Mr. Mayzel
who was in attendance. Mr. Mayzel responded that he would remove the existing deck; the deck
wraps around the corner to take advantage of the quietest side of the house, farthest from 1-394.
There is access from the kitchen from the rear of the house. He also commented that he
designed a larger deck to accommodate a three-season porch, to be constructed sometime in the
future.
The Board stated that it usually grants variances only when there is no chance to build within
compliance. They believed that if the deck were smaller, it would not need a variance. Mr.
Mayzel answered that he wants a large deck and he is paying for it. Members of the Board
explored other options for which the deck might comply with City Code but the applicant was not
in agreement with any options. The Board discussed and agreed to eliminate the request for a
side yard setback variance.
MOVED by Sell, seconded by Pentel and motion carried unanimously to grant a waiver of Section
11.21, Subd. 7(B) Rear Yard Setback for 12 feet off the required 19 feet to a distance. of 7 feet for
the proposed deck; and to deny the waiver of Section 11.21, Subd. 7(C)(2) Side Yard Setback.

Lenard and Lilya Mayzel, with property located at 1015 Wisconsin
Avenue South, have petitioned the Golden Valley Board of Zoning
Appeals for a variance from the Residential zoning district. The
applicants are proposing to construct a deck addition onto the side and
rear of the existing home. This construction project requires variances
from the following sections of City Code.
. Section 11.21, Subd. 7(B) Rear Yard Setback. City Code states
the required rear setback shall be 20 percent of the lot depth.
Staff has determined that the rear setback to be 19 feet from the
property line to a structure. The requested variance is for 5.4 feet
off the required 19 feet to a distance of 13.6 feet for a proposed
deck to the rear year property line. e

Daryl and Linda Wanttie, with property located at 4205 Olson Memorial Highway, are
requesting variances from the Residential zoning code (Section 11.21). The applicants have
approached the City to construct a room addition and attached garage onto the existing
home. The construction of the room addition and garage requires variances from the
Residential zoning district building requirements. Also, during the construction planning
process, a survey was submitted for the property and it was discovered that the existing
home also does not meet setback requirements.
· The requested variance is from Section 11.21, Subd. 7(A) Front Yard Setback. City
Code states the front setback shall be 35 feet from the front yard property line. The
variance request for the home is for 13 foot off the required 35 feet to a distance of 22 .feet
to the front property line along Indiana Avenue North and for 5 feet off the required 35 feet
to a distance of 30 feet to the front property line along Olson Memorial Highway.
The City's file on this property reveals that a permit was pulled in April of 194 t for the
construction of the existing house. No other pertinent information was found in the file.

HEARING NOTICE
Board of Zoning Appeals
4205 Olson Memorial Highway
Daryl and Linda Wanttie
Daryl and Linda Wanttie, with property located at 4205 Olson Memorial
Highway, have petitioned the Golden Valley Board of Zoning Appeals for
two variances from the Residential zoning district. The applicants are
proposing to construct a room addition and attached garage onto the
existing home. As a result of this construction, it was discovered that the
existing home does not meet current setback requirements. This
construction project requires variances from the following sections of City
Code.
· Section 11.21, Subd. 7(A) Front Yard Setback. City Code e
states the front setback shall be 35 feet from the front yard
property line. The variance request for the home is for 13 foot off
the required 35 feet to a distance of 22 feet to the front property
line along Indiana Avenue North and for 5 feet off the required 35
feet to a distance of 30 feet to the front property line along Olson
Memorial Highway.
This petition will be heard at a regular meeting to be held Tuesday,
June 26, 2001, beginning at 7:00 P.M. in the Council Chambers,
7800 Golden Valley Road, Golden Valley, Minnesota. If you have
