A regular meeting of the Planning Commission was held at the Golden Valley City
Hall, Council Chamber, 7800 Golden Valley Road, Golden Valley, Minnesota. The
meeting was called to order Chair McAleese at 7:00 PM.
Those present were Commi ssi oners Groger, Johnson, Kapsner, Lewi s, McAleese,
Pentel and Prazak. Also present were Mark Grimes, Director of Planning and
Development; Beth Knoblauch, City Planner; and Mary Dold, Secretary.
I. Approval of Minutes - June 28, 1993
MOVED by Johnson, seconded by Groger and motion carried unanimously to approve
the June 28, 1993 minutes as submitted.
Mark Grimes updated the Commission on the Ahlberg Minor Subdivision.
II. Informal Public Hearing - Planned Unit Development (No. 63)

Mark Grimes reviewed his memo dated August 18, 1993 to the Planning Commission
commenting on each of the four lots involved (Saturn Dealership, Infiniti Deal-
ershi p, New/Used Car Sal es and Recondi ti oni ng Servi ce). Mr. Grimes commented
that the above uses would be permitted on the site with a Conditi.onal Use Permit
but to maximize the use of the site, the applicant is applying for a P.U.D.
Mr. Grimes talked about some concerns he had if, in the future, the Saturn and
Infiniti Dealerships added on the service area which would eliminate 10 parking
spaces from each dealerships parking area. Lupient representatives prepared a
parking calculation for each of the buildings on the site and found that the
Saturn and Infiniti Dealerships meet or exceed the required parking. If the 10
parking spaces were removed from either dealership, the display area would be
reduced by ten cars.
Mr. Grimes commented that at the rear and si de of the bui 1 di ng on the Londo
Reconditioning Center there would be a six foot wood fence. Also, there would
be significant landscaping on the north edge but there would be no berm as
stated in the staff report. Londo-Lupient would like to get this project under-
way before the first of the year.
Mr. Grimes reviewed eight issues with the Commission. Commissioners Groger and
Pentel and Chair McAleese question the 20 foot setback along Market Street and
felt strongly that this was not enough of a setback. They all agreed that this
setback should be the required 35 feet.
Staff could not recommend the Hardscape Vehicle Display areas. Lupient agreed
to remove them from the request. Lupi ent will need to bri ng in updated site
plans Showing the removal of the display areas in the setbacks.

Signs and lighting are under the direction of the Zoning Director. Lupient's
representative commented that there would be a need for security lighting during
the night time hours; staff is proposing that the main lights to on no earlier
than 7 AM and be turned off by 11 PM.

Commissioner Lewis asked if each lot could be sold separately and Mr. Grimes
commented that they could but would have to maintain conditions set in the
P.U.D. Permit. These conditions include cross parking and access easements.
Commissioner Kapsner asked when the upgrade of Laurel is scheduled. Mr. Grimes
stated that the reconstructi on of Laurel Avenue is in the C1P for 1994. The
street will be improved from Florida to Pennsylvania. Commissioner Kapsner com-
mented on the traffic in the general area that many people feared with the com-
pletion of 1-394 never materialized. He feels this project would not generate
that much more traffic.
Chair McAleese suggested that all owners of the P.U.D. would need to be in
agreement before they brought in an amendment to the P.U.D. Staff stated that
this should be a condition to the permit.
Doug Sailor, Mi dwest Management and representati ve for Lupi ent, commented on
staff's thorough staff report. He stated that thi s project is a "State of the
Art Dealership" and he proceeded to show renderings of the proposed site. Mr.
Sailor commented on the security lighting and said there would need to be secur-
ity lighting from 11 PM to 7 AM. There is extensive landscaping planned to the
north to screen the lighting from the residential area to the north.
Chair McAleese opened the informal pUblic hearing; seeing and hearing no one he
closed the informal public hearing.
Commissioner Pentel asked if there was a condition with regards to the land-
scaping plan. Mr. Grimes commented that staff would add a condition that the
building and landscape plan would be reviewed by the Board of Building Review.
Commissioners Groger and Pentel reiterated their concern about the small setback
on Market Street the precedent that would be set if left and would like to see
something approaching the 30 foot mark.
Mr. Grimes asked the Commission what an acceptable setback would be. Chair
McAleese commented that the applicant should maintain the required setback of 35
feet. However, he said that Lupient could go before the City Council with their
current desi gn pl an of 20 feet and argue for the reduced area to the City
Counci 1 .
Commi ssi oner Kapsner commented that businesses have to go through many tough
things and feels that the City should be accommodating when a good development
proposal is presented.
Chair McAleese asked which Commissioners would vote for the requested 20 foot
setback. Commissioners Johnson, Kapsner, Lewis, and Prazak favored the 20 foot
setback.
Chair McAleese and Commissioners Groger and Pentel wanted the minutes to relate
that they were strongly against the proposed 20 feet and feel the required 35
foot setback woul d serve the area better. However, they di d not want to vote
against the project solely due to the 20 foot setback on Market Street.

Beth Knoblauch reviewed the request for a Minor Subdivision and Conditional Use
Permit (CUP) concurrently.
Ms. Knoblauch asked the applicant for clarification on what the name of the sub-
division would be (the application said "Cooperman Addition" and the plat said
"Wendy's of Golden Valley"). The representative from Wendy.s stated the name
would be "Cooperman Addition".
Ms. Knoblauch also commented that the plat showed 5 ft. of easement right-of-way
and code states that it needs to be 6 ft. A revised plat showing the correction
will need to be prepared before the City Council meeting of September 21st.
Commissioner Pentel asked about the width of the remaining lot to the west. Ms.
Knoblauch commented that the width of the lot to the west is approximately 179
feet which is large enough for another development.
Ms. Knoblauch commented that the CUP was for the easterly part of the proposed
subdivision.

Commi ssi oner Pentel asked about the speaker menu board and how far the sound
woul d carry. Mark Grimes commented that the speaker menu board woul d only be
operating until 10 PM and that during the summer the apartment residents would
hear the speaker. Ms. Knoblauch also commented that the speaker board is tilted
away from the apartments according to the design plan.
Chair McAleese commented that he felt it would be wise to add a condition to the
permit stating that the restaurant must close at 11 PM but Wendy's can come in
with an amendment request to be open longer if no problems arise.

Ms. Knoblauch stated that the preferred site plan for Wendy.s does not meet full
parking requirements, but the overall site plan shows where additional parking
can be located if necessary. Staff refers to this as uproof of parkingU, and
other conditional use permits have been issued with conditions allowing the
reduced parking as long as no problems occur. If a parking problem develops,
full parking must be provided. Director of Zoning and Community Services, Lloyd
Becker, feels that the applicant should also' submit a letter of understanding
regarding these terms, before the permit is issued.
Ms. Knoblauch reviewed all pertinent factors with the commission.
Juri Ozga, Construction Engineer for Wendy's, commented on the noise issue
stating that there would be two buffer zones, drive-thru cars would be parked in
front of the speaker and the speaker can be turned down. Mr. Ozga showed staff
and the commission drawings of the parking lot lighting plan and pictures of
other Wendy's interiors and exteriors. He commented that Wendy's would like to
begin construction as soon as possible.
Chair McAleese opened the informal public hearing, seeing and hearing no one he
closed the informal public hearing.
MOVED by Pentel, seconded by Johnson and motion carried unanimously to recommend
to the City Council approval of the Minor Subdivision for Wendy's International
Inc.
MOVED by Pentel, seconded by Lewis and motion carried unanimously to recommend
to the City Council approval of the Conditional Use Permit subject to the con-
ditions and with an added condition limiting use of the speaker. The specific
recommendati on of the Pl anni ng Commi ssi on was that the speaker cannot be used
before 7 AM or after 10 PM on any day.

clients should be treated, wherever possible, with the minimum amount
of disruption to their daily lives, in accordance with their
indi vidual needs, and in the least restrictive environment. To
support this philosophy, West Metro Recovery Services has established

out-patient treatment program for adults, age 18 and older, to
assist clients in establishing and maintaining a quality,
sober/chemically free lifestyle.

Following evaluation, a 63-hour program is designed to provide
treatment while allowing the client to live at home and continue
to work. The proqram is designed to suit the individual needs,
family obligations and lifestyle of each client. The program
also provides 63 hours of treatment for family members and/ or
significant other concerned persons. The proqram includes:

24 hours of aftercare
One-to-one counseling
Group therapy
Lectures, video presentations, audio tapes
Introduction to and application of the principles of A.A.
Family/concerned person involvement in qroup therapy
Aftercare planning to establish goals and objectives for
maintaining a clean/sober lifestyle
Described below are two options for participating in the primary
Outpatient Treatment Program:
1. Evenina Treatment GrouD: This group is a mixed group (men
and women) and meets Monday, Wednesday and Friday evenings
from 6:00 p.m. to 9:00 p.m.
2. Daytime Treatment GrouD: _This group is a mixed group (men
and women) meets Monday, Wednesday and Friday from 10: 00
a.m. to 1:00 p.m. and is designed to provide a needed
alternative for clients whose schedules conflict with
evening hours.

III. Goal: Upon completion of this program, the client shall have
support, knowledge and the tools necessary to maintain and enjoy
personal freedom from chemical dependency.

EDUCATIONAL AND ASSESSMEN'1' SERVICES
GENESIS I - EDUCATION
Purpose: To provide education about alcohol and other mood-altering
chemical misuse and abuse.
Program: The program will present clients with lectures, video
presentations, speakers and group discussions. Program is
held in one or two sessions totalling six hours in length.
Times are arranged around client's schedule.
Goal: To assist participants in making more informed decisions to
avoid further consequences from using alcohol or chemicals.
GENESIS II - ASSESSMEN'1'
Purpose: To provide education, evaluate and assess any possible
problems with alcohol or chemical use for the client who
needs more than only education.
program: The program includes lectures, video presentations and group
discussions. The client will also participate in testing _
and a one-to-one session with staff to discuss test results ~
and staff recommendations. Two sessions held on the second
and third Saturdays of each month from 9:00 a.m. to 4:00
p.m.
Goal:
To educate and assess clients on the harmful effects of
continued abuse of alcohol or chemicals. Assist clients
with appropriate referrals for problem solution.
GENESIS III - EXTENDED ASSESSMEN'1'
purpose: To provide a substantial period of time to assess client's
problematic abuse of alcohol/chemicals in a supportive,
chemical-free setting.
Program: Twenty hours of assessment are provided over six sessions
held on Mondays, Wednesdays and Fridays concurrent with the
primary treatment groups, with family members and/or
significant others included in Friday sessions. The program
includes lectures, video presentations, group discussions,
testing and specific assignments designed to assist both the
client and the staff in identifying dependency.
Goal:
To provide appropriate recommendations for problem resolu-
tion and assist client in achieving improved quality of

Purpose: West Metro Recovery Services offers a comprehensive relapse
program designed to assist clients in establishing and
maintaining sobriety. The Genesis IV program is designed to
assist clients who are either having difficulty maintaining
sobriety or have not been able to maintain sobriety after
previous attempts.
Program: The Genesis IV program consists of a treatment phase of one
session per week for 12 weeks, plus an aftercare phase of
one session per week for 12 weeks. The treatment phase
provides clients with assessment of relapse, stabilization,
prevention planning and maintenance planning through weekly
assignments, lectures, video presentations, and group
discussions. Abstinence and 12-Step support group
attendance is expected.
To assist clients in achieving abstinence from alcohol/
chemicals through an individual recovery process and to
assist clients in developing coping skills and making
responsible decisions.

FUILY/CONCERNED PERSONS PROGRAM
The standard-length treatment for the Family/Concerned Persons program
consists of:
8 sessions of Family/Concerned Person Group
7 sessions of Family/Concerned Person and Treatment Groups
combined.
As a component of both the Primary Treatment Program and the Genesis
IV Relapse Program, family members and/or other individuals personally
involved with the client are both invited and encouraged to attend
this program at no additional charge.
The Family/concerned Person Treatment Program is also offered to
individuals independently of the Primary and Relapse Treatment
programs for a fee. These clients attend 8 sessions of the
Family/Concerned Persons Treatment Group, but do not attend the
combined Family/Concerned Persons and Treatment client groups.
Family members/concerned persons of Relapse Treatment Program clients
do not have to attend this group.

As a OWl defense attorney, I have come to value the assistance of
West Metro Recovery Services. I have been referring my clients
to this chemical dependency facility for the past two and one-
half years, and have always received prompt and reliable
services. Director and CD Counselor, Patrick Mus, headquarters
this facility in Shorewood, Minnesota.
After my initial contacts with alcohol-related offenders, I refer
them to Pat for an evaluation. There are numerous benefits to a
prompt CD evaluation followed by completion of any program
recommended after such evaluation. Cost is one such factor.
West Metro charges a very reasonable fee of $90 for the
evaluation. The court assessment for evaluations done through
the probation office is now $125.00. In all cases where my
clients have completed an evaluation privately, the Court has
always agreed to waive the court imposed CD assessment. Further,
for first time offenders who have completed an evaluation and any
programs recommended through the evaluation can receive
reinstatement of their driver's license 30 days early. I have
also found that judges and prosecutors often times are more
lenient with defendants who have taken the responsibility to
address their own alcohol issues prior to coming to court.
I heartily recommend that you check out West Metro Recovery
services for your clients. Now, in addition to the Shorewood
facility, Pat has opened a downtown Minneapolis branch in the
Barristers Trust Building at 247 Third Avenue South. West Metro
Recovery Services is certified and approved by the State of
Minnesota. They are able to work with most insurance companies
that cover our clients, and payment plans are available.

ZONING VARIANCES:

The Church of St. Margaret Mary is asking the City of Golden Valley to g-ant a
zoning variance for the bUilding known as the rectory. This building is currently in non-
compliance with zoning requirements with regards to set backs from the property lines
as well as the set backs for the parking lot from the property lines. All buildings,
including the rectory building, are existing buildings which have been occupied by the
church for more than 25 years. Currently the rectory building is being used as the
church offices. The convent building, located behind the rectory and next to the
school, is currently vacant and the church offices will be moved tot he first floor of that
building.
The rectory building would be leased by the church to West Metro Recovery
Services. West Metro Recovery Services is a fully licensed and currently has a facility
in Shorewood, MN. With the closing of the Golden Valley Health Center sees a need
for quality outpatient treatment for chemically dependent adults in this area. A
description of their prog-am is enclosed with this P.U.D. application. Treatment is in
the evening from 6:00 - 9:00pm and 1 0:00am -1 :OOpm during the day. None of the
clients would be reside on the premises. West Metro Recovery Services also provides
educational and assessment services.
The Church of St. Margaret Mary will retain ownership of the property and will
pay property taxes on the property no longer used for church activities according to
State and local tax laws.
I ask, on behalf of the Church of St. Margaret Mary, the City of Golden Valley to
grant the zoning variance to the Church of St. Margaret Mary so that the church may
continue to serve the needs of the citizens of Golden Valley as it has done since 1946.

NOTICE IS HEREBY GIVEN that the Golden Valley Planning Commission will con-
duct an Informal Public Hearing on Monday, October 11, 1993, 7 PM, Golden Valley
City Hall, Council Chamber, 7800 Golden Valley Road, Golden Valley, Minnesota.
The purpose of this informal public hearing is to consider a request by the
Church of St. Margaret Mary, applicant, for approval of a Preliminary Design
Plan for a Planned Unit Development to allow for the use of the rectory building
as an outpatient treatment clinic for chemically dependent adults along with the
existing school and church facilities. The property is located at 2323 Zenith
Avenue North and 2305 Zenith Avenue North, Golden Valley, Minnesota.
City Code requires notification of owners of property lying within 500 feet
of any site for which a Planned Unit Development application has been filed. If
your property is occupied wholly or in part by renters, it is up to you to
decide whether to pass this notice on to them.
All interested parties may appear in person or by counsel and be heard. If
