ADJOURNMENT � MINUTES OF THE GOLDEN VALLEY PLANNING COMMISSION � January 13, 1992 A regular meeting of the Planning Commission was held at the Golden Valley City Hall , Council Chamber, 7800 Golden Valley Road, Golden Valley, Minnesota. The meeting was called to order by Chair McAleese at 7:05P.M. Those present were: Groger, Johnson, Kapsner, McAleese and Prazak; absent were Lewis and McCracken-Hunt. Also present were Mark Grimes, Director of Planning and Development; Beth Knoblauch, City Planner and Mary Dold, Secretary. I. Approval of Minutes - November 25, 1991 MOVED by Groger, seconded Johnson and motion carried unanimously to approve the minutes for November 25, 1991 as submitted. II. Informal Public Hearing - Conditional Use Permit Applicant: Wilkins Pontiac Address: 8925 Wayzata Blvd. , Golden Valley, Minnesota Request: Consider a request for a conditional use permit to allow � for auto retail sales and service in an Industrial District Chair McAleese asked staff for a surnmary of the Wilkins request. Beth Knoblauch, City Planner reviewed her staff report commenting that this request fits the area although there are setback problems which will be addressed at a Board of Zoning Appeals meeting in February. She also noted to the Planning Commission that the enclosed site and floor plans are preliminary and a new set would need to be provided before the City Council hears this request. Lloyd Becker submitted a memo to Mark Grimes regarding the extensive variances needed which is unusual for new construction. Mr. Becker's memo indicates that it is unlikely that all variances requested would be granted. Ms. Knoblauch said she had talked with the interim City Engineer, Scott Brink, whose recommendation is that the applicant will have to prepare and submit a drainage plan for the City Engineer to approve and that would happen during the construction process. Ms. Knoblauch reviewed the ten factors of consideration and staff's approval with the following recommendations as revised by the Planning Commission. 1. Before proceeding to the City Council for final consideration, the applicant shall obtain all necessary variance approvals from the Board of Zoning Appeals (aZA). Amended site and floor plans incorporating any alterations arising from the action o� the BZA shall be prepared by the � applicant for City Council consideration, and shall then be made a part of the approved conditional use permit. Data necessary for calculating parking requirements shall be clearly indicated on the site plan. Minutes of the Golden Valley Planning Commission January 13, 1992 Page Two • 2. As part of the construction process, a drainage plan shall be prepared by the applicant and approved by the City Engineer. 3. The ground floor of the structure may be used for automobile sales, ser- vicing, leasing, additional parts storage, and may include miscellaneous employee areas not identified on the site plan. The upper floor of the structure may be used for parts storage and for such offi ces or other employee ar�as as are incidental to the automobile sales and service business, which may include leasing. 4. There shall be a maximum of fifty employees on-site. 5. The uses and the site itself shall meet all applicable City, State and Federal regulations. 6. Failure to comply with any of the terms of this permit may be cause for its revocation. Marlc Wilkins, representative for Wilkins, commented because of the soil reports, cost prohibitives and talking �vith civil engineers it is not reasonable to put the lower level in. The approximate square footage of the total building would be 25,000. He also commented that the area is tight for their use and is hoping the BZA will give them some leeway in variances so this project could work. • Commissioners Johnson and Kapsner asked the applicant about landscaping and set- backs. Mr. Wilkins commented the setback to the north of the building would be the same as the plan for Carousel Autos at 89�9 Wayzata Blvd. The east and west setback areas would be extended 2-1/2 to 3 feet to make about six feet oi� grassy area with an underground sprinkling system. Beth Knoblauch asked Mr. Wilkins if the outline of the building would change without the lower level . Mr. Wilkins commented there would be a minor change to the outline of the building; the building would be more squared off. Commissioner Groger asked about parking for customers. Mr. Wilkins stated that signage would be posted for customers and does not anticipate this being a problem. Chair McAleese opened the informal public hearing. Seeing and hearing no one Chair McAleese closed the informal public hearing. The Commissioners agreed that this request was appropriate for the location. Concerns of the Commissioners were tightness of space, parking, and lack of space for landscaping. MOVED by Prazak, seconded by Kapsner and motion carried unanimously to recommend to the City Council approval for the request of a conditional use permit at 8925 Wayzata Blvd. to allow for auto retail sales and service in an Industrial District and acknowledge staff's recommendations to be made part of the Condi- • tional Use Permit (No. 55) . Informal Public Hearing - Text Amendment to the Zoning Code (Part I) IV. n orma Pu c ear ng - on it ona se ermit o. art Applicant: Richard Huffman, Interkey Properties Address: 830 Boone Avenue North, Golden Valley, Minnesota Request: To allow Medical Clinics in the Light Industrial District Chair McAleese asked staff for a brief summary of the request. Mark Grimes, Director of Planning and Development, reviewed his staff report and noting that the zoning code text at this time does not allow medical clinics by right or C.U.P. in a Light Industrial District. The request by Interkey Properties is to amend the zoning code in order to permit medical clinics with a conditional use permit in the Light Industrial District. Medical clinics are allowed in the Commercial , Business and Professional Office and I-3 Institutional Zoning Districts. If inedical clinics are permitted in the Light Industrial District, some control is needed and this would be done through a conditional use permit. He also commented that parking requirements would need to be amended to establish a parking standard for clinics in the Light Industrial District. The 830 Boone Avenue building would remain the same and the only change would be to the signage. The applicant, Interkey Properties, likes this site because there is a market for this kind of clinic and the site has adequate ingress and egress for • patients and materials. There is a need for 400 ampere electrical service and about 20 gallons of water per minutes during operating hours and the industrial area best provides these services. Mr. Grimes reviewed the ten factors of consideration. Staff's recommendations are to approve the text amendment to the zoning code and the recommendations listed below to be included as part of the Conditional Use Permit (No. 56). 1. The site plan dated November 27, 1991 and signed by James Rydeen becomes a part of this permit. This site plan indicates a total of 115 parking spaces. 2. There shall be 115 spaces on the site prior to occupancy of the clinic. 3. The clinic shall obtain all necessary licenses and permits from the City, County and State. 4. All waste sha11 be disposed of in a method approved by the proper regu- latory agency. 5. Failure to comply with any of the terms of this permit may be cause for its revocation. Richard Huffman, applicant commented he feels this use is a good fit for the • building and community. Minutes of the Golden Valley Planning Commission January 13, 1992 Page Four • Commissioner Kapsner asked where the next nearest clinic of this type is located. Mr. Mogdans, administrator for the clinic, stated that there are no clinics in the northwest quadrant of this type. At the present time, patients on this side of the Twin Cities seek treatment at Methodist Hospital , Hennepin County Hospital or Abbot tiorthwestern. He also commented that parking should not be a problem on the proposed sight because less than half of the patients would be driving to the facility. Public vans or relatives would be dropping many patients off and returning to pick them up when dialysis is completed. Com►nissioner Johnson asked about types and amounts of was�e generated. Mr. Mogdans stated that the kidney dialysis procedure causes no pollution, needles are disposed of in a manner regulated by the Dept. of Health and liquid waste materials are disposed of through the sewer system. Chair McAleese opened the informal public hearing. Bruce Bermel , consultant with Interkey Properties, commented he thought the pro- posed use for the building is an excellent and good for the community. Parking is adequate and patient delivery can be to the door. Hearing and seeing no one else, Chair McAleese closed the informal public hearing. Chair McAleese asked the applicant for Airborne's comments. Mr. Huffman stated • he had talked with his tenant, Airborne, and they are in favor of this proposed use. All commissioners agreed that this proposed use would be a good fit and appropriate use for the area. MOVED by Kapsner, seconded by Prazak and motion carried unanimously to recommend to the Ci ty Counci 1 approval for a text amendment to the zoni ng code to al l ow Medical Clinics in the Light Industrial District and acknowledge staff's recom- mendation. MOVED by Kapsner, seconded by Johnson and motion carried unanimously to recommend to the City Council approval for a conditional use permit to allow medical clinics in the Light Industrial District and acknowledgment of staff's recommend- ations to be made part of the Conditional Use Permit (No. 56). Reports on_ Meetings of the Housing and Redevelopment Authority, City Council_ and Boar o Zon ng Appea s Commissioner Groger gave a brief summary of the City Council meeting of the 7th of January at which time the Smith application for a minor subdivision was on the agenda. Mark Grimes briefed the Planning Commission on the City Council meeting of Decmeber 10th where the discussion was on the Ewald site. Grimes, Director of Planning and Development SUBJECT: PRESENTATION AND APPROVAL OF THE 1992-1996 CAPITAL IMPROVEMENT PROGRAM (CIP) I have asked Finance Director, Don Taylor and the City's newest employee, Public Works Director, Fred Salsbury to pres�nt the 1992-1996 CIP (enclosed). According to State Statute, the CIP is a planning document. Therefore, the CIP must be reviewed by the Planning Commission and a recommendation by the Planning Commission must be sent to the o City Council prior to the City Council approval . Since Golden Valley is a developed, first-ring suburb, the items in the CIP have less of an impact on development than in a developing com►nunity. However, many of the items are related to maintaining the existing infrastructures in the City. The overall maintenance of the com- munity is vital to the strength of Golden Valley as a place to live and work. I am enclosing a copy of the latest City newsletter that welcomes Fred Salsbury to the City. I am sure you will enjoy meeting with him. We on the staff are looking forward to working with him and gaining from his years of experience in municipal government. MWG:mkd � � MEMORANDUM DATE: February 6, 1992 T0: Golden Valley Planning Commission FROM: Mary Dold, Planning Secretary SUBJECT: 1992 APA NATIONAL PLANNING CONFERENCE, MAY 9 - 13, WASHINGTON DC Enclosed you will find a preliminary program for the upcoming national APA conference in Washington, DC. This year's budget allows for only one commissioner to attend. In reviewing the past conferences and who attended, it appears that Kevin McAleese is top on the list to attend and then Gary Prazak. All other commissioners are then eligible. You may want to spend � some time at Monday night's meeting discussing who will attend if Kevin or Gary cannot attend. I have been told that there are three colleges in Washington, DC who will be graduating seniors the weekend the conference begins and hotel space will disappear quickly. Therefore, whoever is attending should make a hotel reservation by the middle of February and plane reservations by the end of February; I can help with a11 of this paperwork. The City will reimburse for room, meals, airfare and mobile workshops/tours. Both Beth and Mark are attend- ing the conference, so check with them on where they are staying and what they are planning to attend while in DC.
