• October 12, 1992
A regular meeting of the Planning Commission was held at the Golden Valley City
Hall , Council Chamber, 7800 Golden Valley Road, Golden Valley, Minnesota. The
meeting was called to order by Chair McAleese at 7:00 PM.
Those present were Commissioners Groger, Johnson, Kapsner, Lewis, McAleese,
Pentel and Prazak. Also present were Mark Grimes, Director of Planning and
Development; Beth Knoblauch, City Planner and Mary Dold, Secretary.
I. Approval of Minutes - September 28, 1992
MOVED by Kapsner, seconded by Lewis, and motion carried unanimously to approve
the September 28, 1992 minutes with the following change: Item IV.
Commissioner Prazak reported on the City Council meeting of September 1, 1992.
II. Informal Public Hearing - Minor Subdivision
Applicant: Boustead Electric & Mfg. Co. , Inc.
Address: 7135 Madison Avenue West
Request: Minor Subdivision to re-subdivide Lot 2 into two single
industrial parcels.
• Mark Grimes gave a brief summary of his report to the Commissioners commenting
that Boustead Electric is selling off the west half of Lot 2 to Mueller Sales
Corp. and retaining the east half to consolidate with their Lot 3 which pre-
sently houses their business. Mueller Sales will construct a new building on
the site they are buying and has a buyer for their present building at 2420
Nevada Avenue which is located on the same block. Mr. Grimes stated that there
is a market for small lots in Industrial areas.
Commissioner Lewis asked about the 57 feet at the south end of Lot 2. Mr.
Grimes stated that sometime ago there was an administrative lot division that
permitted the south 57 feet of Lot 2 to be sold to the neighbor to the east.
Mr. Steve Svendsen, owner of Boustead Electric, had no comments and asked if the
Commissioners had any questions for him.
Commissioner Kapsner asked if Boustead had anticipated using Lot 2. Mr.
Svendsen commented that the original thought was to use Lot 2 for expansion but
now only needs the east half of Lot 2 for expansion.
Mr. Guy Mueller, buyer of the west half of Lot 2 and from Mueller Sales, intro-
duced himself and asked if the Commission had any quest�ions of him.
Commissioner Groger asked if there would be any changes in the business with
this move and Mr. Mueller commented that the move was for expansion purposes
. only.

Chair McAleese opened the informal public hearing; hearing and seeing no one he
closed the informal public hearing.
Commissioner Lewis commented that she felt this proposal makes good use of the
proposed property.
MOVED by Lewis, seconded by Prazak and motion carried unanimously to recommend
to the City Council approval for the Minor Subdivision requested by Boustead
Electric & Mfg. Co. , Inc. to re-subdivide Lot 2 into two single industrial
parcels.
III . Reappointment to Sidewalk Committee
Mark Grimes asked if any Commissioners would be interested in serving on the
Sidewalk Committee -- Rick Groger and Paula Pentel offered their services.

No reports were given.
• V. Other Business
Mark Grimes told the Commission that the Flood Plain Ordinance would be on the
agenda for the next Planning Commission Meeting for review and that sometime in
the future the zoning map would need to be reviewed and updated.

SUBJECT: MINOR SUBDIVISION TO CONSOLIDATE TWO LOTS INTO ONE -- LOT 3 and 4,
BLOCK 4, TYROL HILLS (1420 ALPINE PASS IN SOUTH TYROL) , KENNETH AND
DONNA HUBER, APPLICANTS
Kenneth and Donna Huber have applied for a minor subdivision to consolidate the
two lots they own in the South Tyrol area. They have requested the consolida-
tion in order that they may expand their existing home to the south. r�y under-
standing is that the planned expansion includes a deck and carport.
The consolidation is necessary in order to eliminate the lot line dividing the
Huber property. Without the consolidation, an addition to the home may be built
• only if it would meet the 15 ft. sideyard setback requirement from the lot line
between Lots 3 and 4. The City Code specifies that an owner of two contiguous
lots cannot expand over the joint property line, or build closer to the property
line than setback requirements would allow, without a lot consolidation. The
proposed addition would go up to the property line with virtually no setback.
Without the requirement for consolidation, a property owner could build right up
to the property line on one of the lots he or she owns and at a later date
request a building permit on the other lot. If this would happen, the two
structures would be separated by much less space than required by the Zoning
Code.
Recommendation
Staff recommends approval of the minor subdivision to consolidate Lots 3 and 4,
Block 4, Tyrol Hills into one lot. The consolidation will allow the Hubers to
add their proposed carport and deck on to the south side of their home.
