OTHER BUSIIS�SS � MINUTES OF THE GOLDEN VALLEY � PLANNING COMMISSION July 24, 1989 A regular meeting of the Planning Commission was held in the meeting room of the Golden Valley Fire Station #3, 3700 Golden Valley Road, Golden Valley, Minnesota. The meeting was called to order by Vice Chair McAleese at 7:05 P.M. Those present were Commissioners Kapsner, Leppik, McCracken-Hunt and McAleese. Commissioners Lewis, Prazak, and Russeil were absent. Also present were Mark Grimes, Director of Planning and Development, and Beth Knoblauch, City Planner. I. . APPROVAL OF MINUTES - July 10, 1989 It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Kapsner and carried unanimously to approve the minutes of the regular July 10, 1989, Planning Commission Meeting. II. INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT APPLICANT: Pizza Hut of America, Inc. LOCATION: 723 Winnetka Avenue North • REQUEST: Approval of a Conditional Use Permit to Operate a Delivery/Carry-Out Pizza Facility Vice Chair McAleese introduced this agenda item and asked City Planner Knoblauch for an overview of this request. City Planner Knoblauch stated that Pizza Hut would like to open a delivery/carry-out facility; there would be no on-site dining. Two (2) parking spaces would be available in front for customers. All delivery vehicles would use the rear 'parking lot. City Planner Knoblauch covered the ten (10) findings. Staff recommended appro- val of a conditional use permit for the proposed Pizza Hut delivery/carry-out facility at 723 Winnetka Avenue North with the following conditions: I. This permit shal� cover only the currently proposed address and use; any expansion into adjacent space or addition of services s�ch as on- site dining shall require a new permit. 2. The business shall not remain open after midnight on Sunday through Thursday nights or after 1:00 A.M. on Friday or Saturday nights. 3. The two dedicated patron parking spaces shall be clearly marked with the appropriate restrictions, and patrons shall not be allowed to "double-park" in the aisle of the front parking lot; if such a problem becomes noticeable, employees shall advise patrons that they must use the rear parking lot in order to be served. � Minutes of the Golden Valley Planning Commission July 24, 1989 � Page 2 4. Delivery vehicles shall be restricted to the rear parking lot during the main hours of center operation. With the approval of center management, delivery vehicles may use the front parking lot after 8 P.M. 5. The business shall conform to all other City and State requirements. 6. Failure to comple with any of the terms of this permit shall be grounds for its revocation. The final two conditions have become standard for all conditional use permits, but had accidentally been omitted from the staff report. City Planner Knoblauch added them during her presentation. Vice Chair McAleese asked to hear from the proponent. Mr. Allan Broholm, repre- sentative from Pizza Hut, stated that he had submitted a letter that covered basically everything. He stated that all the operations were company owned and run. He also stated that the average age of their drivers is 26 years old. Commissioner McCracken-Hunt asked what percent was carry-out versus delivery. � Mr. Broholm stated that approximately 10% was carry-out. Commissioner McCracken-Hunt stated her concern about traffic at that location. Mr. Broholm stated that this location was not the ideal choice, but they could not locate another facility in Golden Valley. He stated that despite the drawbacks, they felt they would go ahead with the project. Commissioner Kapsner asked the proponent if Pizza Hut had a corporate policy regarding the safety of the drivers. Mr. Broholm stated that their drivers had to view a two hour video and they were rewarded for safe driving records. Also, Pizza Hut does not guarantee delivery time. Mr. Broholm stated that Friday and Saturday were their peak days. Their peak times do not coincide with rush hour. Vice Chair McAleese opened the informal public hearing. Deanna Hanson, 2020 Pennsylvania, stated she was concerned as to how the vehicles would get out onto Winnetka without a stop sign. The informal public hearing was closed. � Minutes of the Golden Valley Planning Commission July 24, 1989 � Page 3 Director Grimes stated that traffic should not be a problem as the peak hours on Winnetka are A.M. rush hour and 4:30-5:00 P.M. Pizza Hut's peak hours are usually after 8:00 P.M. Further discussion was held on traffic on Winnetka. It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Kapsner and motion carried unanimously to recommend to the City Council approval of a Conditional Use Permit to Operate a Delivery/Carry-Out Pizza Facility at 723 Winnetka Avenue subject to the six (6) conditions as amended. III. INFORMAL PUBLIC HEARING - PRELIMINARY DESIGN PLAN FOR AMENDMENT #2 TO PUD #46, CALVARY LUTHERAN CHURCH APPLICANT: Calvary Lutheran Church LOCATION: 7520 Golden Valley Rd. REQUEST: Approval of the Preliminary Design Plan for an Amendment to PUD #46 to Allow Operation of a Child Care Center in House at 855 Pennsylvania Avenue. • Vice Chair McAleese introduced this agenda item and asked Director Grimes for an overview. Director Grimes stated that the church now has one child care faci- lity at 831 Pennsylvania and would like to expand their child care facility to 855 Pennsylvania. The new facility would be licensed for 30 children ages 2 & 3 years old. The 3-5 year olds would be housed at 831 Pennsylvania Avenue. Director Grimes stated that significant improvements would have to be made to bring the house up to State Day Care Code. He felt that the church has made a real commitment to day care. This day care facility is not just to serve Calvary members, but the entire area. Director Grimes also stated that the church would like to add a parking lot in front of the two houses that would be used for dropping off and picking up children. This would probably be added in the next year or two. Director Grimes felt that this facility has been a good addition to Golden Valley and recommended approval . Vice Chair McAleese asked to hear from the proponent. Mr. Tom Boyce, President of Calvary Congregation, stated that when the counseling center vacated 855 Pennsylvania, the church saw it as an opportunity to expand their day care faci- lity which has always had a waiting list. � Minutes of the Golden Valley Planning Commission July 24, 1989 � Page 4 Deanna Hanson, director of the day care facility, stated that the new facility would be filled, with only four spaces left, by siblings of present day care children without even advertising. She stated that there would be five (5) toddlers to one (1) adult. Calvary is committed to providing a home like atmosphere with highly trained staff and small groups. Vice Chair McAleese opened the informal public hearing. Ruth Heaner, 1009 Pennsylvania, stated that she feels Pennsylvania is a narrow street and is concerned about letting children off in front. She also is con- cerned about the appearance of the paved area in front of the house; she won- dered if the driveway could run to the back of the house. Mr, Boyce stated that the new parking area would provide a loop so that people would not be backing out on to Pennsylvania. Director Grimes stated that the driveway would be 45-50 feet from street. This is well over the normal setback requirement. Vice Chair McAleese closed the informal public hearing. � Commissioner Leppik stated that perhaps the area could be softened by some landscaping. Commissioner McAleese stated that he had no opposition, but felt the parking lot could be hidden in some fashion. He hoped the church would consider this before talking to the Council . It was moved by Commissioner Kapsner, seconded by Commissioner McCracken-Hunt and motion carried unanimously to recommend approval of the Preliminary Design Plan for an Amendment to PUD #46 to allow operation of a child care center in the house at 855 Pennsylvania Avenue. IV. DISCUSSION OF "HOT SPOTS" REPORT Director Grimes went over a memo covering the "Hot Spots" to send on to the Council . The Council will look over the memo and then let the Planning Commission know which areas they consider most pressing. Director Grimes suggested that the Planning Commission cancel their August 14, 1989 meeting. The meeting was adjourned at 8:25 P.M. s
