The Gommission holds informal public hearings on land use proposals to enable you to learn, first-hand, what such propasals are, and to permit you to ask questions and offer cc�ments. Your questions and ccamnents become part of the record and'will be used by the Council, along with the Commission's recommendation, in reaching its decision. To aid in your understanding and to facilitate your canments and questions, the Comnission wi11 utilize the fotlawing procedure: ' i. MINUTES OF THE GOLDEN VALLEY PLANNING COMMISSION � April 25, 1988 A regular meeting of the Planning Commission was held in the Council Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The meeting was called to order by Vice Chair McAleese at 7:08 P.M. Those present were Commissioners Lewis, McAleese, McCracken-Hunt and Russell . Cormnissioners Kapsner, Leppik and Prazak were absent. Also present were Mark Grimes, Director of Pianning and Development, Alda Wilkinson, City Planner, and Gloria Anderson, Planning Secretary. � I. APPROVAL OF MINUTES - APRIL 11, 1988 It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Lewis, and carried unanimously to approve the minutes of the April 11, 1988 Planning Commission meeting. II. SET DATE FOR INFORMAL PUBLIC HEARING - REZONING APPLICANT: Teacher Federations Credit Union LOCATION: Vacant Lot East of and Adjacent to 6500 Olson Memorial Highway REQUEST: Rezoning from Open to the Business and Professional � Offices Zoning District This agenda item was introduced by Vice Chair McAleese and reviewed by Director of Planning and Development Mark Grimes. It was moved by Commissioner Russell , seconded by Commissioner McCracken-Hunt � and carried unanimously to set an informal hearing date of May 9, 1988 to consider the request for rezoning of the above described property by the Teacher Federations Credit Union. III . INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT APPLICANT: Mui Li Wan, Inc. LOCATION: 2300 Nevada Avenue North REQt1EST: Conditional Use Permit to Allow Food Processing That Involves "cooking, heating, smoking, soaking or marinating" in an Industrial Zoning District Vice Chair McAleese introduced the above item and asked for a review of the staff report. City Planner Alda Wilkinson reviewed the staff report noting that the site now has a number of non-conformities and the proposed use of the property would offer an opportunity to improve the property. She stated that some of the City Staff had visited their present site and that it did not have � any negative effect on the surrounding properties. Ms. Wilkinson stated that the site plans meet the requirements of the Zoning Code except along the front of the property and the applicant would be going to the BZA for a variance on Minutes of the Golden Valley Planning Commission April 25, 1988 Page 2 � this frontyard setback. Staff recommended approval of this use as it is an improvement and would make use of a now vacant building. Commissioner Russell asked how many persons would be employed. Staff stated approximately 20 to 25 persons would be employed there. Commissioner Lewis had questions regarding loading docks on two sides of the building, inside storage of wastes and signage for the property. City Planner Wilkinson stated that the proponent could later answer the question on loading docks. She said that all wastes would have to be stored inside the building until removed from premises and that the existing signage, though non-conforming, could remain if only the name was changed on the sign. If there were any alterations or a complete new sign, it would have to meet the City's sign regulations. Commissioner Russell asked who was responsible for overseeing removal of the underground fuel tanks. City Planner Wilkinson stated it was regulated by the State and PCA and would be overseen by the City Fire Marshal . Vice Chair McAleese asked if there was a reason that staff suggested the tanks be removed no later than September 30, 1988. City Planner Wilkinson stated that the tanks should be removed immediately as they had been abandoned for more than the allowable period of time. � The proponents, Mr. Ducharme, and Marian Ducharme, President of Mui Li Wan, Inc. , were present. Mr. Ducharme stated that reading the staff report was the first he was aware that the underground tanks would have to be removed by a certain date. Mr. Ducharme also noted that the reason for the two locations for loading docks is that one was where trucks could be loaded directly from the freezers. Vice Chair McAleese stated for the record that he was not surprised that the underground tanks had to be removed but that sueh a long time period was given for this removal . Vice Chair McAleese opened the Informal Public Hearing. Mr. Ivar Sorenson, President of Jacobson Machine Works, 2445 Nevada Avenue, stated his only concern was with cooking odors but that his questions had been answered. Mr. Jeff Bartlett, representing R. L. Johnson Company, 7125 Sandburg Road, had a question on parking which was answered. The Tnformal Public Hearing was closed. Vice Chair McAleese reviewed with the Planning Commission and for the audience the ten specific points to be cansidered when reviewing an application for a � Conditional Use Permit. He noted that staff had prepared a response to each of these items and found that there would be no ill effects on surrounding properties. Minutes of the Golden Valley Planning Commission April 25, 1988 Page 3 � It was moved by Commissioner Russell , seconded by Commissioner McCracken-Hunt and motion carried unanimously to recommend City Council approval of the Conditional Use Permit requested by Mui Li Wan, Inc. , 2300 Nevada Avenue North, subject to the following conditions: 1. The site shall conform to the Site Plan, Sheet L1, prepared by Damon Farber Associates, dated April 7, 1988, and revised April 8, 1988 and April 18, 1988. 2. All green areas adjacent to parking and drive shall be protected by concrete curb as required by the City Zoning Code. 3. Landscaped front yard along Nevada Avenue North shall meet the 35 foot landscaped setback required by the City Zoning Code unless a variance is granted by the City Board of Zoning Appeals (BZA) . 4. Abandoned underground fuel storage tanks shall be removed in accordance with llniform Fire Code Section 79.133 and in accordance with direction from the City Fire Marshal . 5. Site improvements indicated on the approved Site Plan, Sheet Ll, prepared by � Damon Farber Associates, dated April 7, 1988, and revised April 8 and April 18, 1988, shall be completed no later than November l, 1989. 6. One or more financial guarantees in amounts or a total amount approved by � the City Engineer and City Building Official shall be provided to guarantee removal of the underground fuel storage tanks and installation of all site improvements, including asphalt paving, concrete curb and landscaping. A financial guarantee in an amount to cover the landscaping shall run for two (2) full growing seasons after installation of landscaping materials and until released by the Golden Valley Inspection Department. The financial guarantee(s) shall be delivered to the City o�' Golden Valley Inspection Department prior to issuance of any permits. 7. All waste generated by the occupancy shaTl be store internally until removed from the premises. 8. The site shall meet all requirements and recommendations of the City Fire Marshal , City Engineer, City Sanitarian, and City Building Official . 9. Any failure to comply with one or more of the conditions of approval shall be grounds for revocation of the conditional use permit. IV. INFORMAL PUBLIC HEARING - PLAT OF VALLEY SQUARE THIRQ ADDITION APPLICANT: City of Golden Valley LOCATION: Golden Va11ey Road Between Winnetka Avenue North and Wiseonsin Avenue North REQUEST: Approval of the Preliminary Plat of Va11ey Square � 3rd Addition Minutes of the Golden Valley Planning Commission April 25, 1988 Page 4 � The above item was introduced by Uice Chair McAleese and reviewed by Director Grimes. He explained that the City had purchased property for the new Golden Valley Road and also made some exchanges with the Super Valu and Bank. The results were a number of small parcels which have now been replatted to make a simple legal description. Vice Chair McAleese opened in the Informal Public Hearing. Hearing and seeing now one, the Informal Public Hearing was closed. It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Russell , and carried unanimously to recommend City Council approval of the Preliminary Plat of Valley Square 3rd Addition. Um INFORMAL PUBLIC HEARING - PLAT OF GOLDEN VALLEY CIVIC CENTER APPLICANT: City of Golden Valley LOCATION: 7800 Golden Valley Road REQUEST: Approval of the Preliminary Plat of Golden Valley Civic Center The above item was introduced by Vice Chair McAleese and reviewed by Director Grimes. Director Grimes stated that the purpose of this plat was to combine the � City owned property in the Civic Center block area into one parcel to simplify the legal description. Vice Chair McAleese opened in the Informal Public Hearing. Hearing and seeing now one, the Informal Public Hearing was closed. It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Russell , and carried unanimously to recommend City Council approval of the Preliminary Plat of Golden Valley Civic Center. VI. REPORT ON HRA, BZA AND CITY COUNCIL MEETINGS Vice Chair McAleese provided a report on the April 12, 1988 meeting of the Board of Zoning Appeals. Commissioner McCracken-Hunt stated she did not attend the April 12, 1988 HRA meeting. Commissioner Kapsner represented the Planning Commission at the April 19, 1988 City Council meeting but was not present to provide a report. The meeting was adjourned at 8:30 P.M. . May 4, i9ss � T0: Golden Valley Planning Commission FROM: Alda Wilkinson, City Planner SUBJECT: Informal Public Hearing - Rezoning from Open Development to Business and Professional Offices - Vacant Triangular Parcel at Highway 55 and Country Club Drive East of 6500 Olson Memorial Highway The Teacher Federations Credit Union, located at 6500 Olson Memorial Highway, requests rezoning of a triangular parcel of land to the east of their site to allow construction of additional parking, The subject parcel is State of Minnesota highway right-of-way located between Highway 55 and Country Club Drive. Current zoning is Open Development, which does not allow parking use. The request is for rezoning to Business and Profess�onal Offices, which is the same zoning classification as the Teacher Federations Credit Union property and would provide for parking use. The Teacher Federations Credit Union proposes to lease the property from the State. An attached letter from the Minnesota Department of Transportation consents to the requested rezoning. Teacher Federations Credit Union parking needs exceed City Zoning Code require- ments. The existing Teacher Federations Credit Union site provides more parking than required by Ordinance. As noted on the attached reduction of the site plan � for the existing site, actual number of parking spaces provided is 66 compared to 53 required by Ordinance. The proponent gives three reasons for the need for additional parking: l. Growth in Credit Unian Membership Existing parking is based on plans and improvements completed in 1984 when the Teacher Federations Credit Union constructed a building addition and drive-up banking facility. At that time, the Credit Union did not anticipate substantial further growth. However, the Teacher Federations Credit Union has experienced growth in its own membership and, in addition, has merged with several other credit unions. 2. Staff Size According to the proponent, services most in demand are human services requiring tellers and other staff people. The Teacher Federations Credit Union has added five new employees each year. At peak business times on Monday and Friday the Teacher Federations Credit Union has 55 staff people on site at any one time. Tuesday, Wednesday and Thursday there are 50 staff peop]e on site at any one time. 3. Insufficient Use of Electronic Means According to the proponent, the proportion of transactions utilizing electronic � banking faciiities at remote locations has remained low. A high proportion of transactions involves customers coming to the site and requires staff services at the site. Golden Valley Planning Commission May 4, 1988 � Page 2 The Teaeher Federations Credit Union is currently operating with an interim solution to its parking space problem. The Teacher Federations Credit Union leases 25 to 30 spaces from the Surgical Center adjacent to the west. The leased spaces are to the rear of the Surgical Center along Highway 55. The Surgical Center parking spaces are used exclusively for Credit Union employee parking. The Credit Union is not satisfied with this arrangement as a long-term solution. Dissatisfaction is both due to inconvenience and due to a safety concern. The leased Surgical Center parking spaces are removed from the 7eacher Federations Credit Union building, and lighting is felt to be inadequate to provide a sense of security for employees utilizing the spaces during later working hours. The proposed new parking lot to the east of the Credit Union building would replace the leased Surgical Center parking. The main entrance to the Credit Union is on the west side of the building, and the main west parking lot would remain customer parking. Proposed parking on the State right-of-way would be staff parking. The Teacher Federations Credit Union proposes construction of 23 additional parking spaces. As shown on the plan submitted with the rezoning application, the new parking spaces would be constructed over the easterly property line of the current 7eacher Federations site partially on the State right-of-way and partially in the east setback area of the current site. � Utilization of this narrow triangular area between Highway 55 and Country Club Drive is not feasible without setback variances. The City of Golden Valley Zoning Code requires a landscaped 35 foot setback from any street right-of-way line. Landscaping of 35 feet back from both Highway 55 and Country Club Drive would leave virtually no development area. The applicant understands that development in accordance with the proposed site plan is conditional upon the granting of variances by the Board of Zoning Appeals (BZA) . The BZA previously granted variances from both the Highway 55 and Country Club Drive right-of-way lines on the currently existing Teacher Federations Credit Union site. The existing bui]ding is a distance of 20 feet from the Highway 55 right-of-way line, and parking is within approximately 17 feet of the Highway 55 right-of-way line. The canopy for the drive-up facility extends to within 20 feet of the Country Club Drive right-of-way line. The requested variances for the proposed new parking construction include setback of 20 feet from the Highway 55 right-of- way line and setback of 10 feet from the Country Club Drive right-of-way line. Planning staff recommends approval of the requested rezoning based on availabil- ity of the adjacent land, based on existing need for additionai parking, and based on understanding that utilization of the site as proposed is conditional on granting of setback variances by the BZA. At the same time, staff feels it is appropriate to convey to the proponent concern for overutilization of the site. Concern for overdevelopment of the site was expressed at the time of approval of the conditional use permit for the drive-up facility in 1984. This concern is reflected in a condition attached to the conditional use permit prohibiting � future construction of additional bGilding or parking on the site. A copy of the conditional use permit is attached. The Teacher Federations Credit Union Golden Valley Planning Commission May 4, 1988 Page 3 � assured the City that site development proposed at that time would meet future needs. Staff feels that consideration of additional parking construction is allowable in this case where additional land is acquired. However, it is noted that the proposal for new parking again involves setback variances indicating overutilization of available land area. Staff again questions adequacy of the site to accommodate future Teacher Federations Credit Union needs. In conclusion, Planning staff suggests that the Planning Commission recommend City Council approval of the rezoning of the triangular parcel to the east of 6500 Olson Memorial Highway from Open Development to Business and Professional Offices based on the understanding that utilization for Teacher Federations Credit Union parking as proposed is conditional upon granting of waivers by the BZA.
