The meeting was called to order by Chair Prazak at 7:05 P.M. Those present were Commissioners Kapsner, Leppik, Lewis, McAleese, McCracken-Hunt, Prazak and Russell . Also present were Mark Grimes, Director of Planning and Development, and Gloria Anderson, Planning Secretary. �. APPROVAL OF MINUTES - JUNE 13, 1988 It was moved by Commissioner Kapsner, seconded by Commissioner Leppik, and carried unanimously to approve the minutes of the June 13, 1988 Planning Commission meeting. II . SET DATE FOR INFORMAL PUBLIC HEARIN� - PLAT PETITION APPLICANT: City of Golden Valley LOCATION: Between Sunset Ridge and Ravine Trail REQUEST: Approval of the Preliminary Plat of North � Tyrol Park Th�� item was intraduced by Chair Praiak and reviewed by Director Grimes. The Planning Commission set a date of July 11, 1988 for an Informal Public Hearing to consider the preliminary plat of North Tyrol Park. III. SET DATE FOR INFORMAL PUBLIC HEARING - PLAT PETITION APPLICANT: Dean Franssell LOCATION: 1510 Kelly Drive REQUEST: Approval of the Preliminary Plat of Franssell Addition Which Divides the Property at 1510 Kelly Drive Into Two Single-Family Residential Lots Director Grimes added this request for a preliminary plat approval which proposes to divide the property at 1510 Kelly Drive into two single-family residential lots. The Planning Commission set an informal public hearing date of July 11, 1988 for consideration of this conditional use permit request by Avis Rent A Car System, Inc. V. INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT APPLICANT: Valley Community Presbyterian Church LOCATION: 3100 North Lilac Drive � REQUEST: Conditional Use Permit to Allow Day Care in an Institutional Zoning District Chair Prazak introduced the above item. Director Grimes reviewed the staff report on the request by the Ualley Community Presbyterian Church for a Conditional Use Permit to allow day care in their church building in an Institutional Zoning District. Director Grimes noted they would be licensed by the State to care for 60 children, infants to preschool age. The hours of operation would be 6:30 a.m. to 6:30 p.m. five days a week. He noted there would be an increase in traffic during the peak drop off hours in the morning and again when the children are picked up in the evening but that it would not have a negative effect on the area. Director Grimes indicated that the City encourages additional day care as there is a need for it in Golden Valley. Mr. Norman Baer was present to represent the proponent. He stated he was the Chair of the Board set up by the church to organize and operate the day care. Also present was Ann Johnson, hired as Director of the day care center. Commissioners asked if there was an outdoor play area. Mr. Baer said there would be a fenced in play area at the southeast corner of the church building. Commissioner Leppik asked if the day care would be open to the public or church only and if it would be self-supporting. � , Minutes of the Golden Va11ey PTanning Commission June 27, 1988 � Page 3 Mr. Baer said the day care center was open to the general public. He also stated that hopefully the day care center would be self-supporting in time but presently it is being subsidized by the church. Chair Prazak opened the informal public hearing. Jeanne Lies, 5320 Triton Drive, stated she was glad to see a day care center but had concerns about the maintenance of the grounds, traffic and noise from children playing outside. M�. Baer explained that the majority of the children would be infants and toddlers and would not be outside. He stated he would take her concerns regarding maintenance of the grounds back to the proper persons at the church. The informal public hearing was closed. Chair Prazak said �he proposal seemed reasonable to him. Commissioner Lewis said she felt there certainly is a need for additional day care in Golden Valley. Commissioner Kapsner stated he felt church buildings were generally under utilized and that day care would be a good use. � It was moved b Commissioner Russell , seconded by Commissioner McCracken-Hunt Y and motion carried unanimously to recommend City Council approval of the request by Valley Community Presbyterian Church for a conditional use permit to operate a day care center in their building at 3100 North Lilac Drive subject to the foilowing conditions: 1. The site and building plans submitted with the application be made a part of the conditional use permit. 2., The operation receives all other necessary permits from the State and Golden Valley before operation begins. 3. The day care center shall be limited to 60 children. 4. Any failure to comply with one or more of the conditions of approval shall be grounds for revocation of the conditional use permit. VI. AMENDMENT TO THE ZQNING CODE Director Grimes introduced a request by Greg Malik for an amendment to the Zoning Cade which would allow marine engine repair as a conditional use in a Commercial Zoning District. � Minutes of the Golden Valley Planning Commission June 27, 1988 � Page 4 After discussion, the consensus of the Commissioners was that marine engine repair should be included as a conditional use in the Commercial Zaning District. Commissioner McAleese stated he felt tMe City should not change the code as the City has more discretion denying this zoning change than it would denying a conditional use permit. Other Commissioners felt that any conditional use would still have to meet the criteria of a conditional use permit and all setbacks and other City regulations. It wa� �n�ved by Commissioner McCracken-Hunt, seconded by Commissioner Russell and �rotion carried on a vote of 6 - 1 to recommend City Council approval of an amendment to the Zoning Code to allow for marine engine repair as a conditional use in the Commercial Zoning District. VII . REPORT ON HRA, BZA AND CITY COUNCIL MEETINGS Cammissioners provided reparts on HRA, BZA and City Council meetings which they had attended over the past month. Grimes, Director of Planning and Development SUBJECT: Informal Public Hearing - Conditional Use Permit to Allow Operation of Outdoor Used Car Sales Lot in a Commercial Zoning District - Avis Rent A Car System, Inc. , Applicant Av�s Rent A Car System would like to purchase the former National Camera property to use for the sale of cars. In a Commercial Zoning District, auto sales is permitted only with a Conditional Use Permit (CUP). Auis will use this site to sell cars that have been rented by Avis. The cars ta be sold wi�7 be late model cars (generally current year or one year old) with low mileage. Avis currently operates a car sales operation at the airport and on Highway 61 in White Bear Lake. No repairs or maintenance is dane on the site. As indicated in the letter to me from James McCarron dated June 21, 1988, their plan is to have 60-70 cars in inventory at any one time at this site. They � plan to have 4-8 employees on site and operate during the hours of 8:00 a.m. to 8:00 p.m. Monday through Friday, 8:30 a.m. to 5:00 p.m. on Saturday, and no Sunday hours. They would expect to sell 50-60 cars per month. Avis plans to significantly improve the site. They will be providing landscap- ing around the entire site as required by the City's landscape standards. A financial guarantee wiTi have to be submitted by Avis to assure that the materials planted will last two growing seasons. in addition, Avis will pave the entire parking area and provide curb and gutter around the perimeter. In order to assure that the paving and curb and gutter work is done, a financial guarantee will have to be submitted to the City. As stated in the June 21 letter, Avis will not be doing additional fencing to the site beyond what now exists along the east, west and south sides of the site. The building will remain with na additions. However, significant improvements will be made to the exterior and interior. The proposed exterior is shown on the attached plan. This plan shows the north side of the building. It is my understanding that they will have some cars displayed inside. They plan to paint the exterior block on the remainder of the building. The plan is to provide 70 parking spaces on the site. Seven of those spaces are in front of the building on Golden Valley Road. These spaces are non- conforming and will have to be addressed by the Board of Zoning Appeals (BZA). However, I would recommend that they be allowed to stay to provide convenient customer parking. The previous users (National Camera and the rental store) both used this parking with no problems. There is adequate room so that cars � do not have to back into the traffic lanes on Golden Valley Road to exit these parking spaces in front. Go1den Valley Planning Commission July 7, 1988 Page 2 � There are 63 other parking places indicated on the plan to accommodate employees and display cars. The June 21 letter stated they wanted to display 60-70 cars on the site and have up to 8 employees. There is simply not enough room shown on the site plan for 70 display cars and 8 employee cars. I would suggest that the CUP limit the amount of display cars to designated parking only and that eight parking spaces be designated for employees and that ten spaces be desig- nated for customers. With the current plan, the lot couTd then hold 52 display cars (not including those kept inside) . There is a possibility that 5-7 more spaces could be designated along the south and east side of the building. If they would like to designate more parking in this area, this should be shown on �n e�pdated site plan that would be submitted to the City Council . � 6�ave spoken with the Twin Cities manager of Avis and he said that the Avis �nventory at this time is 30 cars at the airport and White Bear Lake. Ne would r��t anticipate more at Golden Valley. Also, all employees drive Avis cars that ��� f�r sale to and from work. I�npr�ved lighting is also proposed for the site. Good lighting is a must at any car dealership. The lighting plan should be evaluated in order to determine its effects on surrounding properties. Fortunately, the closest single-family residential area is over 250 feet away across Highway 55. There are apartments on the north side of Golden Valley Road "kitty corner" from the site. However, the Avis building will block some of the view of the parking lot from these � apartments. Lighting would be on only during business hours. Only a couple security lights would be on all night. Avi� will have to submit this site plan to the BZA before the Planning Commis- sion recommendation goes to the City Council . The BZA will have to address the existing non-conformities on the property including the setback along T.H. 55 (20 feet instead of required 35 feet) , setback on the east and west (0 feet to 5 feet instead of 10 feet) and setback of parking along Golden Valley Road (0 feet instead of 35 feet) . The Planning Commission must make findings on ten •factors when reviewing a CUP application. They are as follows with staff comment: A� �emonstrated need of the use. �ivis has shown a desire to sell cars at this location due to its visibility fr°om heaviiy travelled 7.N. 55. The City's policy has been if a user determines there is a need demonstrated that that is adequate evidence of demonstrated n�ed for the use. 2. Consistency with the Comprehensive Plan. The Comprehensive Plan designates this area for commercial development. The selling of cars is consistent with this commercial designation. � Golden Valley Planning Commission July 7, 1988 � Page 3 3. Effect on property values in the area. The staff believes that property values will not fall in the area. Avis has proven in other locations to do a good job of upkeep of its properties. 4. Traffic generation from use. The traffic proposed from this use will be adequately handled by Golden Valley Road. I would not anticipate more than 200 trips generated to and from this use during a business day. i. ��f��t of any increases in density or population on the area. The �se �vill nat increase population or density since it is a commercial use. 6. Increase .in noise created by use. There should not be an increase in noise in the area from this use other than �he �oise from �autos coming to the site. 7. Any dust, odor, or vibration caused by use. The car sales will not cause any of the above. � 8. An,� increase in animal pests caused by the use. The car sales will not increase animal pests. 9. Visual appearance of proposed use. Avis plans significant improvements to the site including landscaping, paving and building improvements. There will be additional lighting of the site. I will suggest that the lighting plan be approved by the Director of Zoning and Community Services to insure minimal effect on surrounding properties. 10. Other effects of the use. I can find no other negative effects. Recommendation I recommend approval of the Avis car sales with the conditions listed below. Avis plans to spend a lot of money to get this unsightly site into shape to meet their standards. I do not believe that a car sales in this location will cause a problem in the area due to its good access from T.H. 55 and its loca- tion away from housing. � � f Golden Valley Planning Commission July 7, 1988 Page 4 � The #ollowing conditions are suggested: 1. The site plan dated June 1988 be made a part of the Conditianal Use Permit. 2. Of the parking spaces indicated on the site plan, 10 of these spaces shall be designated for customers and 8 for emplayees. Display cars may be parked only in designated spaces as shown on the site plan. 3e The entire parking area shall be paved. Curb and gutter shall also be placed around the parking area. The work shall be completed by October 31, 1988. Avis shall submit a financial guarantee to the City based on the value of the work as determined by the City Engineer. 4. The property shall be landscaped as per City landscape standards. The landscaping shall be guaranteed for two growing seasons. 5. Avis shall receive variances from the Board of Zoning Appeals for non- conformities in setbacks on all sides. 6� The outdoor lighting plan shall be reviewed and approved by the Director of Zoning and Community Services. Outdoor lighting shall be turned off during non-business hours. � 7� Na repair or maintenance work will be done on site other than car washing. 8. Any failure to comply with one or more of the conditions of approval shall be grounds for revocation of the conditional use permit. Attachments: 1. Grimes, Director of Planning and DeveTopment SUBJECT: Informal Public Hearing - P1at of Franssell Addition - Dean Franssell , Applicant Dean Franssell has proposed a minor subdivision of the Franssell Addition. This property was owned by his parents and Mr. Franssell is now handling this por�ion of the Franssell estate. The proposed subdivision creates an additional lot where there is now one lot. The Franssell house and out buildings are located on the west two-thirds of the existing lot. The proposal is to split off the east one-third for another single-family house site. �oth of the proposed lots will meet or exceed minimum zoning requirements. Lot 1 (where the existing house is located) will be 20,200 square feet in area. The zoning code requires a minimum of 10,000 square feet. The existing build- ings on Lot l all exceed the minimum setback requirements except for the small 4.8'x 6.6' building at the east end of Lot 1. This building will have to be � ��ved in order to meet the minimum five-foot setback for accessory buildings. Lot 2 is proposed to be 10,000 square feet in area (100'x100"). This lot meets the minimum size requirement for lots in the Residential Zoning District. A house equivalent in size to others in the neighborhood may be built on this lot that will meet all minimum setback requirements. The attached area map indicates that the lot directly to the east is also 100'x100' . Lots in the immediate area are in the 12,000 to 15,000 square feet in area range. This lot wi]l be served by City water and sewer lines from Olympia Street as indicated on the survey. These services were put in years ago in anticipation of another house being built east of the Franssell house. Drainage from the lot will be directed to Olympia Street. The lot is ideal for a home with a tuck under garage due to the topography of the lot. The lot rises quickly from Olympia Street to allow a home site significantly above the street. Recommendation The staff recommends approval of the minor subdivision of the Franssell Addition with the condition that the small outbuilding at the east end of Lot 1 be removed or moved to meet setback requirements before final plat approval . The proposed subdivision will create an additional building site in a desirable neighborhood in Golden Valley where there are few, if any, lots left. I believe � that Lot 2 will be a very desirable home site. Golden Valley Planning Commission July 6, 1988 Page 2 � As with all subdivision of property, this subdivision is subject to a park dedication fee of $400. This fee must be paid before the final approval of the subdivision. Note on the Minor Subdivision Procedure As part of the revised Subdivision Code, there is now a provision for a minor subdivision. The Franssell Addition qualifies as a minor subdivision. This procedure allows the applicant to provide a sketch or survey of the property to be subdivided into four lots or less rather than a full preliminary plat. The Planning Commission holds an informal public hearing and reviews the sketch of �he proposed subdivision. R recommendation is then made to the City Council. The City Council then considers the minor subdivisian. If approved by the City Councilg the applicant then has to prepare a final plat in conformance with the sketch.
