• PLANNING COMMISSION GUIDELINES FOR PUBLIC INPUT
The Planning Co�nission is an advisory body, created to advise the City Council on land use. The Commission
will recommend Council approval or denial of a land use pro�osal based upon the Commission's determination of
whether the proposed use is permitted under the Zoning Code and the Comprehensive Plan, and whether the pro-
posed use will, or will not, adversely affect the surroundin9 neighborhood.
The Cort�nission holds informal public hearings on land use proposals to enable you to learn, first-hand, what
such proposals are, and to permit you to ask questions and offer comments. Your questions and comments become
part of the record and will be used by the Council, along with the Commission's recommendation, in reaching
its decision.
To aid in your understanding and to facilitate your comments and questions, tihe Co�nission will u�ilize the
following procedure:
1. The Comnission Chair will introduce the proposal and the recommendation from staff. Comnission
members may ask questions of staff.
2. The proponent will describe the proposal and answer any questions from the Commission.
3. The Chair will open the public hearing, asking first for those who wish to speak to so indicate
by raising their hands. The Chair may set a time limit for individual questions/comments if a
large number of persons have indicated a desire to speak. Spokespersons for groups will have a
longer period of time for questions/coaanents.
4. Please give your full name and address clearly when recognized by the Chair. Remember, your
questions/co►�nents are for the record.
5. Direct your questions/cormnents to the Chair. The Chair will deuermine who will answer your
questions.
� 6. No one will be given the opportunity to speak a second time until everyone has had the opportunity
to speak initially. Please limit your second presentation to new information, not rebuttal.
7. At the close of the public hearing, the Cortenission will discuss the proposal and take appropriate

MINUTES OF THE GOLDEN VALLEY
- PLANNING COMMISSION
� December 8, 1986
A regular meeting of the Planning Commission was held in the Manager's
Conference Room of the Civic Center, 7800 Golden Valley Road, Golden Valley,
Minnesota. Chairman Prazak called the meeting to order at 7:00 P.M.
Those present were Commissioners Kapsner, Leppik, McAleese, McCracken-Hunt,
Prazak and Russell . Commissioner Lewis was absent. Also present were Mark
Grimes, Director of Planning and Development, and Alda Wilkinson, City Planner.
I. APPROVAL OF MINUTES - NOVEMBER 24, 1986
It was moved by Commissioner Russell , seconded by Commissioner Kapsner and
carried unanimously to approve the minutes of the November 24, 1986 meeting.

� Planning and Development Director Mark Grimes reviewed the status of the Midway
Rent-All operation. Chairman Prazak, with the consensus of the Planning
Commission, set an informal public hearing date of January 12, 1987 to consider
revocation of the Conditional Use Permit for operation of an outdoor rental
business at 9010 Olson Memorial Highway.
III. STUDY SESSION
Chairman Prazak initiated the work session with a suggestion for a summary report
on Planning Commission actions for the year, including numbers and types of
agenda items heard before the Planning Commission, subsequent City Council
actions, reversals of Planning Commission recommendations, and numbers of pro-
posals withdrawn or never implemented. Commissioner McAleese suggested that an
annual report of this type could be expanded to include an audit of annual progress
toward meeting objectives in the adopted City of Golden Valley Comprehensive
Plan. It was the consensus of the Planning Commission that an annual report on
Planning Commission actions and on Comprehensive Planning progress shall be
reviewed at one of the January Planning Commission meetings each year.
Commissioner McAleese reported to the Planning Commission on the December 4,
1986 meeting of the Centennial Town Meeting Committee. Commissioner McAleese
informed Planning Commissioners that the City Council plans to discuss procedure
for handling Centennial Town Meeting citizen input at the December 9, 1986 City
Council meeting and at a City Council retreat scheduled for January 24, 1987.
It is the expectation of the Centennial Town Meeting Committee that the Planning
• Commission and other City commissions will receive assignments or direction
from the City Council following the January 24, 1987 retreat date.

� The Planning Commission discussed procedure for continuation of the Year 201Q
planning program. Based on review of preliminary data received from the Town
Meeting, the Planning Commission listed the following three items for priority
treatment as part of the Year 2010 planning program:
1. Review of the Valley Square Redevelopment Plan
Planning Commissioners noted that a substantial proportion of the comment
received at the Centennial Town Meeting related to Valley Square, including the
issues of traffic congestion on Winnetka Avenue and of pedestrian circulation
throughout the Golden Valley "downtown".
2. Recycling
3. Reuse of the Golden Va11ey Lutheran College site
Commissioner Russell suggested that as part of the Year 2010 planning process
the Planning Commission hear from City program directors, such as the Senior
Program Director, concerning needs. Commissioner Kapsner further suggested
joint meetings with other City commissions several times a year.
In response to an inquiry from Planning and Development Director Mark Grimes
concerning use of the strategic planning facilitator provided for in the 1987
Planning Commission budget, the Planning Commission requested that staff select
� two candidates to be interviewed by the Commission early in 1987.

SUBJECT: Revocation of Conditional Use Permit No. 85-22, Midway Rent-All ,
9010 Olson Memorial Highway
At the December 8, 1986 Planning Commission meeting, the Commission called an
informal public hearing to discuss the possible revocation of the Conditional
Use Permit issued to William Friede on May 21, 1985. The Conditional Use
Permit was issued to operate a Midway Rent-All . The Midway Rent-All was closed
sometime in late Fall 1986. However, the Conditional Use Permit remains valid
if another similar rental operation would want to rent the store.
The staff has had problems with the existing Conditional Use Permit almost from
the start. There was a misunderstanding between the owner, Mort Liss, and Mr.
Friede about who would pay for the improvements required by the Conditional Use
Permit. Mr. Liss said that he was not aware of the requirements of the
Conditional Use Permit and did not say he would pay for the improvements. Mr.
Friede had a different story.
The requirements of the Conditional Use Permit were never met fully. The
landscaping, fencing, paving and lighting were never completed. The business
never looked fully operational . I spoke and wrote letters to Mr. Friede and
� Mr. Liss on numerous occasions. For instance, the landscaping, paving and
fencing were supposed to have been completed by June 15, 1986.
I believe that the City has been more than fair in the administration of the
Conditional Use Permit. The staff has tried to be very understanding with the
problems in starting a new business.
Now that Midway Rent-All is out, I am recommending that the Conditional Use
Permit be revoked for reasons of noncompliance as stated on Conditional Use
Permit No. 85-22. If another rental operation would want to use the Liss
property, they would have to obtain a new permit. The next time I would
suggest tougher conditions and approval of both the owner, Mr. Liss, and the
future renter.
The action I am requesting from the Planning Commission is to recommend to the
City Council that Conditional Use Permit No. 85-22 be revoked for noncompliance
with the conditions stated in the permit. The City Council would then hold a
public hearing to consider the revocation.

CONDITIONS OF APPROVAL:
1. The site plan dated March 31, 1985 shall become a part of this Conditional
Use Permit.
2. The site plan be submitted to the BZA to address the non-conforming aspects
of the plan.
3. The amount of outside storage be limited to 15 trucks (pickups, vans and
• trucks up to 22 feet in length), 20 trailers, and other miscellaneous
equipment. All equipment must be in the designated display and storage
areas shown on the plan in order to allow for circulation.
4. At least 15 parking spaces be designated on the site.
5. As shown on the site ptan, areas along Golden Valley Road and Highway 55
should be landscaped as per plan. The final landscape plan should be
approved by the Director of Planning and Development. The landscaping
shall be completed by October 1, 1985.
6. Any plan for lighting of the lot shall be reviewed and approved by the
Director of Inspections.
7. The operation shall comply with all requirements and recommendations of the
City Building Inspector and Fire Marshal .
Failure to comply with one or more of the conditions of approval shall be
grounds for revocation of the Conditional Use Permit.

Dear Mr. Friede:
Last Fall several members of the City staff inet with you and Mr. Liss
to discuss the required improvements for your rental business at 9010
Olson Memorial Highway. We agreed to allow the paving to be delayed
until June 15, 1986. That date is now fast approaching and I wanted
to remind you of the deadline. In addition, the landscaping and
fencing that you said would be done has also not been completed as you
• said it would be last Fall . Now that Spring is here, the necessary
landscaping and fencing should be completed as soon as possible.
I understand the problems in starting a new business and the costs
involved. I believe that the City has been more than fair in meeting
your deadlines. However, the Conditional Use Permit you signed said
that you would make certain improvements. The improvements that you
promised to make are very much needed to improve the appearance of
your business. As I have said before, the staff has received numerous
complaints about the appearance of your business.
I thank you for your cooperation in advance. I would appreciate a call
or letter confirming that the paving, landscaping and fencing will be
completed by June 15, 1986.

Dear Mr. Friede:
On October 24, 1985 I wrote you regarding the completion of
landscaping and fencing on the Midway Rent-All site. It was my
understanding that these improvements were to be installed by
October 31, 1985. The paving of the parking lot would be delayed
until 1986 as approved by staff on September 18.
• Unfortunately, the landscaping can no longer be done in 1985 and
will have to be delayed until 1986. However, I would think it
would still be possible to complete the fencing along Golden
Valley Road. In order to clear up this situation and to get a
firm commitment from you on site improvements, I would like to
schedule a meeting with you and Mr. Liss. Would you please get
in contact with Mr. Liss and find a time that is mutually agree-
able to meet with City staff. I would suggest meeting sometime
the week of December 9 or December 16, 1985.
I will be looking forward to hearing from you on the meeting
date.

Dear Mr. Friede:
On September 22, 1985 we received a letter signed by both you and
Mr. Liss regarding the postponement of blacktop improvements until
next year. However, it was my understanding, after speaking with
both you and Mr. Liss, that the landscaping and fencing would be
completed this fall . I believe we discussed the date of October 15,
1985 for completion which was 15 days later than stipulated in the
• Conditional Use Permit that was issued to you.
The landscaping and fencing should be completed as soon as possible.
I know that it is still feasible to plant shrubs and lay sod even
at this late date. I have received numerous complaints about your
business' appearance from other business people and customers of the
area. I have told these people that improvements would be made
shortly.
I believe that the City staff has been more than fair with you regard-
ing the timing of improvements at the site. However, I believe that
you must also be fair by completing the improvements that you said
would be made. If the agreed upon landscape improvements and fencing
are not completed in the very near future, I will have to take
appropriate action.
I would appreciate a response from you on this matter. If you have
any questions, please give me a call .

Dear Mr. Liss:
Thank you for your letter of September 12 regarding the paving of the
Midway Rent-All lot. I can understand your situation. However,
after speaking with several other staff inembers, we believe that the
paving should be completed by October 1, 1985 as previously agreed
upon by Mr. Friede. The City has received complaints from property
owners in the area regarding the condition of the site. The City
staff believes that the blacktop and landscaping promised in the
• Conditional Use Permit will make the site acceptable.
Mr. Friede did not indicate to us that the improvements were
conditional upon getting a loan from you. He agreed to each of the
conditions and said they would be done. I also believe that he is a
sincere and honest man that wants to make a good business in Golden
Valley. However, a commitment to the City was made and I cannot see
why it should not be completed.
I would be happy to meet with you to discuss this matter. Please
give me a call and we can set up an appointment.

Dear Mr. Grimes:
I am the owner of the property at 9010 Olson Highway, which I have rented to
Mr. Wm. Friede, doing business as Midway Rent-All.
Mr. Friede informed me the other day, that he had received a letter from your
department, requesting that he black top the parking lot at the above mentioned
location by October 1, 1985. I was completely unaware that he had obligated
himself to take on this improvement.
Is it at all possible for your committee to postpone this until the spring of
1986. I am requesting this because Mr. Friede does not have the capital at
this time to pay for this black top,which will cost approximately $17,000.
In starting up his business at this location, he has had to invest in a huge
inventory as needed in a business of this type. I cannot afford to advance
this money as I have already obligated myself to meet the required changes in
the sprinkling system.
I am very concerned that his obligations will be such that he may have diffi-
culty in meeting his responsibilities. I am convinced that he is a very
sincere and honest man who will be successful and provide a need in Golden
Valley for services that are much needed.
I would greatly appreciate meeting with you or any members of the committee
in charge, at your convenience. I sincerely hope that you can help me solve
th3s problem so that he can remain my tenant. It would be most difficult to
find a new tenant during the winter, and the income loss would be a great hard-
ship on me.

Dear Mr. Friede:
On May 21, 1985, the Golden Valley City Council issued you a Conditional
Use Permit to operate a rental store at 9010 Olson Memorial Highway.
One of the conditions of the Conditional Use Permit is to conform to
the site plan that was submitted to the City as part of the Conditional
• Use Permit. The plan calls for fencing around the perimeter of the
property and includes two gates into your lot.
I strongly suggest that you begin work on the site as soon as possible.
I have received numerous complaints about the condition of the property.
Part of the understanding regarding your permit was that you would keep
the site in good condition similar to your St. Paul store. I confirmed
to both the Planning Commission and the City Council that your St. Paul
store is well kept and that I anticipated your store in Golden Valley
would be similarly managed and maintained.
Please give me a call regarding your timetable for site plan comple-
tion. (I do realize that you have until October 1, 1985 to complete
landscaping. ) I would like to see the plans completed by September 1,
1985.

� Mr. Bob Papousek, 1929 Glenwood Parkway, had concerns regarding the traffic
problems a day care center would cause.
The Whelans explained that it should not create a traffic problem as some of
the parents already drop older children at the school and would probably drop
the younger children at the day care center and also that in many cases one car
would probably be dropping off more than one child.
�Chairman Prazak closed the public hearing.
Commissioner Kapsner felt it would create some additional traffic but that it
would probably be only 20 to 25 additional cars and that he would support the
proposal .
Commissioners Russell and Leppik both felt there was a need for day care and
"latchkey" programs and that the positive aspects outweighed the negative
aspects of additional traffic.
It was moved by Commissioner Kapsner, seconded by Commissioner McCracken-Hunt
and carried unanimously to recommend that the City Council approve a
Conditional Use Permit to operate a day care center in the convent building
at 2225 Zenith Avenue North subject to the following conditions:
1. The building meet all applicable standards and codes required by the
City, State and County. This includes, but is not limited to, the
� Uniform Building Code, Uniform Fire Code, Plumbing Code and Handicap
Access Requirements.
2. The State of Minnesota has issued a license for the operation of the
day care facility for 70 children.
V. INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT
APPLICANT: William 0. Friede dba Midway Rent-All

REQUEST: Approval of a Conditional Use Permit to Allow
Outdoor Sales and Storage
Chairman Prazak introduced this agenda item and asked staff for their review of
the Conditional Use Permit request.
Director Grimes gave a review of the request and the staff recommendations.
The Planning Commissioners had a number of questions regarding parking, snow
removal , repair of equipment, etc.
Mr. William 0. Friede of Midway Rent-All , the proponent, was present to answer
questions. He explained that there would be space for seven cars plus the fact
� that some customers, when renting a truck, would park their vehicles in the
truck spot in the storage area. Mr. Friede also explained the entrance and

• exit plan which should alleviate any traffic backup. Mr. Friede informed the
Commissioners that they had they own snow removal equipment and that if there
was a large amount of snowfall , it would be hauled from the site. He also
stated that they would only do small repair jobs at the site and that most of
the repairs would be done at their St. Paul location.
Questions were raised regarding the storage of fuels on the premises and
Director Grimes stated that if the building were sprinklered, up to 50 gallons
could be stored there. He also stated it was recommended by the City Fire
Marshal that the building be sprinklered.
Chairman Prazak opened the meeting for public input.
Mr. Ralph Lange, owner of Hannon Security at 9100 Olson Memorial Highway,
expressed his concerns regarding the parking problem, snow removal , and asked
what Midway Rent-All 's hours of operation would be. He also stated that the
trucks parked in the storage area and the fencing would block out their signage
along Olson Memorial Highway.
Mr. Friede said they plan on being open from 8:00 A.M. to 6:00 P.M. for a year
or so and then extend their hours, and that they would be open seven days a
week. He felt that with the trucks parked at an angle along the east side,
there would not be a visibility problem for Hannon Security's signage. Mr.
Friede stated that there should not be more than five cars parked there at any
� given time. He further stated that the property will be landscaped and
resurfaced and that the property's appearance and the parking will be improved
over what it is now.
Chairman Prazak closed the public hearing.
Commissioner Leppik feels that the Midway Rent-All business would be an
improvement in terms of traffic and parking and that the landscaping will help
to improve the appearance of the area.
Chairman Prazak asked questions of the staff regarding the fence.
Director Grimes said that the matter of the fence would have to be addressed by
the Board of Zoning Appeals (BZA) .
Commissioner Russell felt an effort should be made to include the neighbors in
discussion of the parking and fence problems, and City Planner Alda Peikert
informed the Commissioners that adjoining neighbors would be notified when
Midway Rent-All went to the BZA.
It was moved by Commissioner Russell , seconded by Commissioner McCracken-Hunt
and carried unanimously to recommend City Council approval of the Conditional
Use Permit for Midway Rent-All at 9010 Olson Highway based on findings in staff
report dated April 3, 1985, subject to the following conditions:
1. The site plan dated March 31, 1985 shall become a part of this Conditional
� Use Permit.

� 2. The site plan be submitted to the BZA to address the non-conforming access
of the plan.
3. The amount of outside storage be limited to 15 trucks (pickups, vans and
trucks up to 22 feet in length) , 20 trailers, and other miscellaneous
equipment. All equipment must be in the designated display and storage
areas shown on the plan in order to allow for circulation.
4. At least 15 parking spaces be designated on the site.
5. As shown on the site plan, areas along Golden Valley Road and Highway 55
should be landscaped as per plan. The final landscape plan should be
approved by the Director of Planning and Development. The landscaping
shall be completed by October 1, 1985.
6. Any plan for lighting of the lot shall be reviewed and approved by the
Director of Inspections.
7. The operation shall comply with all requirements and recommendations of
the City Building Inspector and Fire Marshal .

VI. INFORMAL PUBLIC HEARING - REZONING
� APPLICANT: Foxboro Corporation
LOCATION: 1245, 1315, 1335 and 1411 North Lilac Drive
REQUEST: Approval of Rezoning from Residential to Business
and Professional Offices Zoning District
Chairman Prazak requested an update of this rezoning request from the staff.
Director Grimes gave a review of the request and stated that neighbors had been
re-notified of the rezoning request.
Chairman Prazak suggested that the proponent make their presentation at this
time.
Mr. Dennis Marhula of Westwood Engineering was present to represent the
proponent, Foxboro Incorporated. Mr. Marhula gave his presentation of the
drainage plan for this property whereby they had worked out the problems that
had previously existed. He also explained the sight line of the property from
nearby homes.
Mr. Lynn Sloat of Sloat Logan Associates gave a presentation on the building
concept. He stated that they had reduced the size of the building from 36,700
square feet to 32,500 square feet. Mr. Sloat stated that reducing the size of
the building did not change it's appearance but it did reduce the numbers of
. parking spaces which would indicate less cars. The number of parking spaces
now required is 130 and they have provided 132 parking spaces.

Commercial District at 9010 Olson Highway (Current National
Camera Location) William Friede (dba Midway Rent-All of
St. Paul ) , Applicant
Introduction
William Friede, owner of Midway Rent-All on University Avenue near Lexing-
ton Avenue in St. Paul , has requested a Conditional Use Permit to allow the
operation of a rental store with outside storage at 9010 Olson Highway.
The property is currently occupied by the National Camera Exchange. The
Camera Exchange is going to be relocated about 1/4 mile to the west in May
or June.
The proposed rental store will occupy the entire National Camera site which
is about 36,700 square feet in size. The store will rent equipment such as
tools, party goods (tables, chairs, china, tableware, etc.) , yard equip-
� ment, trailers, trucks, vans and construction equipment. The Conditional
Use Permit is required because the rental store will be storing the vehi-
cles (e.g. trucks, bobcats and trailers) and some larger construction •
equipment (e.g. cement mixers) outside. Within the Commercial Zoning
District, outdoor sales and equipment rental require a Conditional Use
Permit.
Description of Site Plan
Mr. Friede has submitted a site plan for the rental store. I have attached
two plans for your reference. The first plan was submitted earlier by Mr.
Friede and was updated by the second plan. The first plan does show the
relationship of the business to Golden Valley Road and Highway 55. The
second plan, dated March 31, 1985, which is the updated site plan, gives
more detail to the site. It shows the parking areas, display areas and how
the circulation will work on the property.
The following are items that should be considered when discussing the
Conditional Use Permit:
A. Amount of Equipment to be Stored Outside: The site will generally have
ten trucks parked on the lot. The majority will be parked along the
east property line. The maximum number of trucks would be 15 on the
lot any any time. The trucks range in size from pickup trucks to 22
foot moving trucks. Mr. Friede's experience at the Midway store is
that many of the trucks are rented at most times and often times there
� are no trucks at the site. If he would get too many trucks, he would
call Ryder Rental and ask them to take trucks back or find space off
the site to store the trucks.

There would also be about 15 trailers on the lot ranging in size from
5'x8' to 5'x12' . He also rents "Bobcat" loaders. There would be
about four of them on the site. These would be stored in the display
and storage area or along the south property line.
Other equipme�t to be stored outside would include larger construction
equipment lik� cement mixers that are on trailers. Most equipment
will be store� inside. The ramp going to the basement will be used to
wheel equipme t up from the basement.
The plan indicates a trailer pick-up area. Cars would pull up in this
area to pick up or drop off a trailer or temporarily park to pick up
other pieces of equipment.
B. Parking: There are 15 designated spaces shown on the plan. Seven
spaces will be in the front as they are now used by National Camera.
The other eight spaces will be along the building. The Zoning Code
requires one space for each 150 square feet of retail floor area. The
amount of retail space in the store will be less than one-half the
space on the first floor. (The first floor is about 4,500 square feet
in area. ) I calculate that 15 spaces are needed to meet the code.
� Due to the nature of the business, the 15 spaces should be adequate.
Many of the customers will not park but drive up to the trailer
pick-up area. Also, some customers will be dropped off to pick up a
truck. Parking would be short term with a high turnover.
There will be a maximum of four employees. These employees are to
park at the rear of the building in the designated employee parking
area.
C. Circulation: The site will have a one-way traffic pattern with entry
from the east access. Rental trucks would then back into the spaces
along the east property line. The one-way traffic pattern will allow
for less confusion in the lot.
D. Fencing: There will be a six-foot chain link fence on the east and
west side of the site. The plan along the front property line is to
provide a wrought iron fence and gates at the access drives. Mr.
Friede wants to use the iron fence to provide a decorative tauch.
There will be no fence along the south property line since there is a
Highway Department fence at that location.
The fences will hopefully provide some security for the site.
E. Landscaping: The first plan better indicates the landscaping that is
planned. Along Golden Valley Road, the landscaping proposed in the
� first site plan will be provided along with the provision of grass in
the areas indicated green space. Landscaping will also be provided in
an 8 foot wide strip along Highway 55.

One of the major differences between the first and second plan is the
provision of a 35 foot wide green space between the property line and
the fence. This 35 foot green space is in the required setback area.
The first plan indicated a small green area with parking in the
setback area.
It should be noted that there will be no screening provided other than
by the landscaping proposed. Screening is not a requirement of the
Zoning Code in a Commercial District. I do not believe that screening
would be beneficial or necessary in this area due to the surrounding
land uses and Highway 55.
F. Variances: This plan will have to be submitted to the Board of Zoning
Appeals (BZA) to address the non-conforming areas of the plan. The
non-conforming areas include the continuation of the zero setback of
the building, the continuation of the existing setback of the parking
areas from the lot lines on the south and east and the continuation of
the existing parking area in front of the building on Golden Valley
Road. The plan will go to the BZA in May.
I believe that the proposed site plan makes a good effort to minimize
• the existing non-conformities of the site. There will be no struc-
tures in the front yard setback east of the building where there is
currently parking. The only area where parking will continue is the
seven spaces in front of the building. There is adequate space,
however, to pull out of these spaces without getting into the driving
surface of Golden Valley Road. The required rear yard setback along
Highway 55 is 35 feet where an eight �foot setback is shown. However,
this 35 foot setback appears unreasonable due to the existing green
area long Highway 55. In addition, if this 35 foot setback were
enforced, the site would almost become unusable due to lack of space.
Ten Factors to be Considered as Part of Conditional Use Process
Section 20.03 of the Zoning Code requires that the Commission make findings
and recommendations on ten factors. The following are my recommendations
on the ten factors:
1. Demonstrated Need: To my knowledge, there is no general rental
business in Golden Valley. This type of business is needed for both
the business community and the general population.
2. Consistency With the Comprehensive Plan: The Plan designates the
area for Commercial development which is consistent with the rental
business.
� 3. - Effect on Property Values in Area: The surrounding properties are
used for commercial uses including a gas station to the east. I do
not believe the rental store would depreciate values in the area.

4. Effect on Traffic Flow in the Area: I do not anticipate that the
business would substantially effect traffic flows in the area. The
amount of traffic generated from this use shall not be substantially
greater than the traffic from the camera store.
5. Effect on Increase in Population or Density: The increased population
and density of the rental store should not have an effect on the
surrounding area. The rental store will have fewer employees. The
use of the property may be somewhat more intense because of the
outside storage but this should not cause a problem because of the
location with other commercial uses.
fi. Increased Noise Levels: I do not anticipate a substantial increase in
noise levels. Any increases in noises would be caused by operation of
vehicles. The traffic on Highway 55 causes a greater amount of noise.
7. Dust, Odors, Vibration or Gas Caused by Use: The proposed use should
not cause any of the above mentioned problems.
8. Increase in Flies, Rats or Other Vermin: The rental store should not
cause an increase in the 'above mentioned problems.
• 9. Visual Appearance of Any Proposed Structure or Use: The rental
business will have outside storage which will not be screened.
However, the business is in a commercial area along Highway 55 where
the business will have less of a visual impact. Also, Mr. Friede's
business in St. Paul is neat and well kept. I have been to the Midway
site several times. Mr. Friede has won several awards from Ryder
Rental regarding display of products.
10. Any Other Effect on the General Health, Safety or Welfare of the Area:
The proposed use should not have a negative effect on the health,
safety or welfare of the community.
Recommendation �
I recommend approval of the Conditional Use Permit to operate an outdoor
rental business at 9010 Olson Highway with the following conditions:
1. The site plan dated March 31, 1985 shall become a part of this Condi-
tional Use Permit.
2. ThP site plan be submitted to the BZA to address the non-conforming
aspects of the plan.
3. The amount of outside storage be limited to 15 trucks (pickups, vans •
and trucks up to 22 feet in length) , 20 trailers, and other miscellan-
