PLANNING COMMISSION GUIDELINES FOR PUBLIC INPUT
The Planning Commission is an advisory body, created to advise the City Council on land use. The Commission
will recomnend Council approval or denial of a land use proposal based upon the Comnission's determination of
whether the proposed use is permitted under the Zoning Code and the Comprehensive Plan, and whether the pro-
posed use will, or will not, adversely affect the surrounding neighborhood.
The ComniSSion holds informal public hearings on land use proposals to enable you to learn, first-hand, what
such proposals are, and to permit you to ask questions and offer cortenents. Your quest�ons and corrments become
part of the record and will be used by the Council, along with the Commission's recommendation, in reaching
its decision.
To aid in your understandiog and to facilitate your comnents and questions, the Commission will utilize the
following procedure:
1. The Camnission Chair wi11 introduce the proposal and the recoumendation from staff. Commission
members may ask questions of staff.
2. The proponent will describe the proposal and answer any questions from the Commission.
3. The Chair Wilt open the public hearing. ask9ng first for those who wish to speak to so indicate
by raising their hands. The Chair may set a time limit for individual questions/comnents if a
large number of persons have indicated a desire to speak. Spokespersons for groups will have a
, longer perlod of time for questions/comnents.
4. Please give your full name and address clearly when recognized by the Chair. Remember. your
questions/comments are for the record. •

MINUTES OF THE GOLDEN VALLEY
� PLANNING COMMISSION
August 10, 1987
A regular meeting of the Planning Commission was held in the City Council
Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota.
Chairman Prazak called the meeting to order at 7:04 P.M.
Those present were Commissioners McAleese, Leppik, McCracken-Hunt and Prazak.
Commissioners Kapsner and Lewis were not present. Commissioner Russell was not
present at the beginning of the meeting. Also present were Mark Grimes, Director
of Planning and Development, Alda Wilkinson, City Planner, and Gloria Anderson,
Secretary.
I. APPROVAL OF MINUTES - JULY 27, 1987
It was moved by Commissioner Leppik, seconded by Commissioner McCracken-Hunt
and carried unanimously to approve the minutes of the July 27, 1987 meeting.
II. SET DATE FOR INFORMAL PUBLIC HEARING - REVISED PRELIMINARY PLAT
APPLICANT: Stanley Kugler

Chairman Prazak introduced this agenda item. City Planner Alda Wilkinson
reviewed the request for a change in the preliminary plat of Gruskin Gardens
Second Addition and suggested an informal public hearing date of August 24,
1987.
It was moved by Commissioner McCracken-Hunt, seconded by Commissioner McAleese
and carried unanimously to set an informal public hearing date of August 24,
1987 for consideration of the revised preliminary plat of Gruskin Gardens
Second Addition.
III. INFORMAL PUBLIC HEARING - PRELIMINARY PLAT OF GUERRE
APPLICANT: ITS-1987-XI Limited Partnership
LOCATION: 1200 Mendelssohn Avenue North
REQUEST: Approval of the Preliminary Plat of Guerre to Allow
Division of Five-Acre Site of Existing Office Warehouse
Building to Create an Additional Building Site
Chairman Prazak introduced this item and asked City Planner Wilkinson for a
� brief review of the staff report. She explained that the owners of the present
five-acre site would divide off approximately 1 1/2 acres for a new office
warehouse building on the eastern portion of the property which is presently
undeveloped. She stated the primary concern of staff was the existing building

� and the number of nonconformities in terms of setbacks of parking from the
property line and after conferring with the City Engineer and Director of Zoning,
some compromises were made for upgrading this site. City Planner Wilkinson
also indicated that i.t was the feeling of staff that this is an opportunity to
improve the property but it would not be economically feasible to require all �
the existing blacktopped parking to be removed and everything brought into
conformance. She stated that the applicant would have to apply to the Board of
Zoning Appeals to legalize some of the nonconformities on the site.
Commissioner Russell arrived during the s�aff review.
Commissioner Leppik questioned the parking spaces shown on the site plan. City
Planner Wilkinson stated that the site plan showed the number of parking spaces
that could be constructed to meet the City requirements but that they would not
all be constructed at this time, only in the future if they were needed. There
are no parking problems now.
Mr. Michael Beatty, a partner with ITS-1987-XI Limited Partnership, was present.
He stated his partnership would retain ownership of the existing building and
that he has a buyer for the newly created lot. He indicated that his company
and the previous owner of the property had been making a joint effort to
improve the site.
Chairman Prazak opened the informal public hearing. Hearing and seeing no one,
the informal public hearing was closed.
� After a short discussion by the Planning Commissioners it was moved by Commis-
sioner Leppik, seconded by Commissioner McCracken-Hunt and carried unanimously
to recommend City Council approval of the Preliminary Plat of Guerre subject to
the following conditions:
1. Board of Zoning Appeals (BZA) granting of waivers for all nonconforming
setbacks of parking area prior to City Council approval of the Preliminary
Plat.
2. Installation of curb separation of landscaping from paved parking and drive
areas except where waivers are granted by the BZA.
3. Construction of parking required by the Zoning Code unless a waiver is
granted by the BZA.
4. Provision of a drainage plan which meets the approval of the City Engineer
prior to City Council approval of the Preliminary Plat.
5. Documentation of any required State or Federal approval for any impact on
the wetland area in the southeastern portion of the site prior to approval
of the Final Plat.
6. Provision of a financial guarantee for curb installation and landscaping
improvements on the existing building site prior to approval of the Final
Plat.

� IV. REVIEW OF DRAFT OF PROPOSED SUBDIVISION REGULATIONS
The Planning Commission reviewed the proposed Subdivision Regulations and made
changes to the draft. It was agreed that the draft of the proposed Subdivision
Regulations will be referred_ to the City Attorney for review and therr referred
, back to the Planning Commission for action on a recommendation to the City
Council .
V. REPORT ON AUGUST 4, 1987 CITY COUNCIL MEETING
Commissioner McCracken-Hunt stated she did not attend the August 4, 1987 City
Council meeting as there were no Planning Commission items on the agenda.
VI. INTERIM STATUS REPORT ON CTVIC CENTER TASK FORCE
Commissioner McCracken-Hunt, who represents the Planning Commission on the
Civic Center Task Force, gave an update on the progress of the Task Force.
VII. YEAR 2010 PLANNING PROGRAM
Planning Commissioners discussed the third of ten priority Ye�r 2010 planning
items and provided staff with ideas for the Year 2010 narrative.
VIII. DULUTH/DOUGLAS LAND USE STUDY
� The Planning Commission decided to give the Duluth/Douglas Land Use Study
priority on the next Planning Commission meeting agenda and to postpone
continuation of the Year 2010 Planning Program to allow time for discussion of
the Duluth/Douglas Study.
IX. WORK PROGRAM FOR NORTH WIRTH AREA
The Planning Commission reviewed the proposed work program for preparation of
land use recommendations for an expanded North Wirth Redevelopment Project
Area. Planning and Development Director Mark Grimes suggested that the
Planning Commission set work session times separate from regular Planning
Corrmiission meeting times for subcommittee work on the North Wirth Land Use
Study. The Planning Commission scheduled the first subcommittee meeting for
Thursday, August 20, 1987, from 7:00 A.M. to 8:30 A.M. The subcommittee will
be comprised of all Planning Commissioners who choose to participate and attend
the meetings.
The meeting was adjourned at 9:00 P.M.

SUBJECT: Informal Public Hearing - Revised Preliminary Plat of Gruskin
Gardens Second Addition
The Golden Valley Planning Commission on Ju7y 13, 1987 unanimously recommended
City Council approval of the Preliminary Plat of Gruskin Gardens Second Addition,
which proposed replatting of the properties owned by Mr. Stanley Kugler at 4240
Glenwood Avenue and by Dr. Herbert Polesky and Ms. Susan Lentz at 4270 Glenwood
Avenue. The proposed plat expanded the lot for the Polesky/Lentz residence at
' 4270 Glenwood Avenue to include an area which the owners wished to reserve as
undeveloped open space and retained but moved the location of a vacant single
family residential lot owned by Mr. Kugler.
Mr. Kugler subsequently submitted a revised Preliminary Plat for his property
without the Polesky/Lentz property, which proposed two vacant single family
residential lots fronting on Glenwood Avenue in place of the one lot currently
existing. It was the understanding of Planning staff that Mr. Kugler withdrew
from the previous platting proposal because the neighbors involved were unable to
reach an agreement for transfer of property from Mr. Kugler's ownership to Polesky/-
• Lentz ownership. The Planning Commission set an August 24, 1987 informal public
hearing date for consideration of the revised Preliminary Plat.
The version of the Preliminary Plat now under consideration is a further revision,
submitted August 19, 1987, again including both the Kugler and Polesky/Lentz
properties. The two parties reached an agreement which transfers a 25 foot strip
of Mr. Kugler's property to the Polesky/Lentz lot and creates two vacant single
family residential lots fronting on Glenwood Avenue. A reduction of a sketch of
the new configuration is attached. The proponents are in the process of having
the surveyor prepare a revised plat.
The primary change from the first version of the Preliminary Plat is the creation
of an additional single family residential lot resulting in the availability of
two residential building sites fronting on Glenwood Avenue between the access to
the Kugler residence at 4240 Glenwood Avenue and the Polesky/Lentz residence at
4270 Glenwood Avenue. The proposed plat is essentially as d�scribed in a notice
to surrounding property owners for the informal public hearing on the revised
Preliminary Plat. The notice of the second hearing explained that the revised
Preliminary Plat proposed creation of an additional lot for two vacant single
family residential lots.
The two lots created both meet al] requirements of the Zoning Code for a single
family residential lot. Both are 85 feet wide, which is over the 80 foot minimum
lot width requirement. Both are 200 feet deep for an area of 17,000 square feet,
which is considerably over the minimum lot�area requirement of 10,000 square feet.

The westerly of the two vacant lots has low area back from Glenwood Avenue, but
there is adequate building area to the front of the lot. The City Engineer has
reviewed the plat and feels that any problems of elevation and drainage may be
addressed at the time building plans are submitted for a building permit.
The Planning Commission previously considered building constraints imposed by
driveway and by water and sanitary sewer connections for the existing Kugler house
crossing the newly created lots in front of the Kugler residence. Staff suggests
that the Planning Commission again recommend the same conditions of approval
concerning easements for the drive and utilities.
Staff suggests that the Planning Commission recommend City Council approval of the
revised Preliminary Plat of Gruskin Gardens Second Addition, which proposes transfer
of property to the adjacent lot and creation of two single family residential lots,
subject to the following conditions:
l. Reconstruction of the access drive for the residence at 4240 Glenwood
Avenue entirely on the same lot as the existing residence and removal of
the drive from the easterly of the two proposed vacant lots,� or documen-
tation prior to Final Plat approval of an easement by separate instrument
across the easterly vacant lot for the access drive to the residence at
4240 Glenwood Avenue.
� 2. Documentation prior to Final Plat approva] of easements by separate
instrument for water and sanitary sewer connections to the residence at
4240 Glenwood Avenue over the two proposed vacant lots.
3. Provision of standard drainage and utility easements ten feet in width
along street right-of-way lines and six feet in width along all other
property lines.

III. INFORMAL PUBLIC NEARING - PRELIMINARY PLAT
APPLICANT: Stanley Kugler
LOCATION: 4240 and 4270 Glenwood Avenue
REQUEST: Approval of the Preliminary Plat of Gruskin Gardens
Second Addition Which Adjusts the Lot Lines of Residences
at 4240 and 4270 Glenwood Avenue and the Vacant Lot
Located Between the Two Houses
Chairman Prazak introduced this agenda item, and City Planner Alda Wilkinson
reviewed the staff report and stated that staff recommended approval of this
request.
Proponent requested that, until the new lot was sold, he be allowed to maintain
the present driveway along proposed Lots 2 and 3 because of the expense
involved in constructing a new driveway and in order to preserve the trees.
When the lots are sold he would either construct a new driveway on Lot 1 or
obtain an easement over Lot 3 for his present driveway.
� Commissioners had concerns over location of the access drive to the existing
Kugler house on an easement over the proposed vacant single family residential
lot. Staff stated the opinion that reconstruction of the drive on the same lot
as the house is not necessary at this time provided space is reserved for the
possibility of relocation in the future. The modified lot for the Kugler
residence retains street frontage adequate for relocation of the drive entirely
on the Kugler lot. Therefore, staff recommended allowing the proponent the
option of either relocating the drive or seeking a shared drive arrangement
with the buyer of the vacant lot.
There were also concerns over the water and sanitary sewer lines and easements
through Lots 2 and 3. Staff agreed that the utility easements appear to restrict
the type and size of house that could be built on the new proposed Lot 3. Ms.
Lisa Kugler, daughter of the proponent, was present to answer questions. She
indicated that the sanitary sewer line could be rerouted toward Leber Lane in
the future if an easement could be obtained to the north. The Planning
Commission concluded that the easements are a private matter between property
owners.
Chairman Prazak opened the informal public hearing. Hearing and seeing no one,
the informal public hearing was closed.
It was moved by Commissioner Kapsner, seconded by Commissioner Lewis and
carried unanimously to recommend City Council approval of the Preliminary Plat
� of Gruskin Gardens Second Addition subject to the following conditions:

1. Reconstruction of the access drive for the residence at 4240
Glenwood Avenue entirely on proposed Lot 1 and removal of the
drive from proposed Lot 3, or documentation prior to Final Plat
- approval of an easement by separate instrument across Lot 3 for
the access drive to the residence at 4240 Glenwood Avenue.
2. Qocumentation prior to Final Plat approval of easements by
separate instrument for water and sanitary sewer connections to
the residence on proposed lot 1 over proposed Lots 2 and 3.
3. Provision of standard dra�nage and utility easements ten feet in
width along street right-of-way lines and six feet in width along
all other property lines.
IV. REPORT ON CITY COUNCIL MEETING
Commissioner Kapsner stated that he did not attend the City Council meeting of
July 7, 1987 as there were no Planning Commission items on the Agenda.
Mayor Anderson and Council Member Thompson joined the meeting.
� 1�. RESPONSE TO METROPOLITAN COUNCIL STRATEGIC PLANNING LETTER
Chairman Prazak called on Commissioner McAleese, who suggested Planning
Commission discussion of the Metropolitan Council invitation for input into
their regional planning program. Commissioner McAleese noted that many of the
regional planning issues identified by Metropolitan Council are the same as
community issues raised at the City of Golden Valley Centennial Town meeting
and items listed in the Planning Commission Year 2010 Planning Program.
Commissioner McAleese suggested that a response to Metropolitan Council to
inform them of 1oca1 interest in these same issues may be appropriate unless a
City response has already been made. Mayor Anderson informed the Planning
Commission that the City Council provided comment on the Metropolitan Council
list of regional planning issues and met with Metropolitan Council Representative
Dottie Rietow to discuss City comment on regional planning issues. The Planning
Commission concluded that further response is not necessary at this time and
expressed interest in receiving any future communications on the Metropolitan
planning program.
VI. VISIT OF CITY COUNCIL LIAISON COMMITTEE TO PLANNING COMMISSION
Mayor Anderson and Council Member Thompson explained that they were visiting
the Planning Commission for the purpose of providing liaison between the two
bodies. Discussion topics included the Planning Commission Comprehensive
Planning and Year 2010 Planning Programs, procedure for Planning Coirunission
� input into Housing and Redevelopment Authority (HRA� planning and project
approval processes, potential upcoming referrals to the Planning Commission, �
and scheduling of another town meeting.
