MINUTES OF THE GOLDEN VALLEY � PLANNING COMMISSION December 9, 1985 A regular meeting of the Planning Commission was held in the Council Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. Chairman Prazak called the meeting to order at 7:05 P.M. Those present were Commissioners Kapsner, Lewis, McCracken-Hunt and Prazak. Commissioners Leppik, McAleese and Russell were absent. Also present were Mark Grimes, Director of Planning and Development; Alda Peikert, City Planner; and Gloria Anderson, Planning Secretary. I. APPROVAL OF MINUTES - NOVEMBER 25, 1985 It was moved by Commissioner Kapsner, seconded by Commissioner Lewis and carried unanimously to approve the minutes of the November 25, 1985 Planning Commission meeting. II. INFORMAL PUBLIC HEARING - AMENDMENT OF CONDITIONAL USE PERMIT #82-9 APPLICANT: Time Master, Inc. dba Golden Valley Tire LOCATION: 600 Decatur Avenue North � REQUEST: Amendment of Conditional Use Permit for a Tire Service in a Commercial Zoning District Chairman Prazak introduced this agenda item and Alda Peikert, City Planner reviewed the staff report. Mr. Jim Pauly, one of the owners of the Golden Valley Tire Center, was present and stated that their request for an amendment to the original conditional use permit was to allow for an addition to the Golden Valley Tire Center to meet the demand for this type of business in the area. Commissioner Lewis asked Mr. Pauly what the hours of operation af the business were and also what would be stored in the space being converted to storage area. Mr. Pauly stated they presently were open from 7:30 A.M. to 8:00 P.M. in order to accommodate people who work in the area during the day and the people who live in the area. The storage space would be used to store equipment used in the business. Chairman Prazak opened the informal public hearing. Hearing and seeing no one, the informal public hearing was closed. It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Kapsner and carried unanimously to recommend City Council approval of the Amendment to Conditional Use Permit #82-9 to allow expansion of the Golden Valley Tire ! Center located at 600 Decatur Avenue North subject to the following conditions: Planning Commission Minutes December 9, 1985 � Page 2 1. The site shall conform to the Site Plan for an Addition for Golden Valley Tire Center prepared by Pauly and Olsen Associates, Ltd. , dated November 19, 1985. 2. There shall be no parking for the subject operation on the street, and there shall be no vehicle storage on site other than in the service bays or in the 26 outside parking spaces designated on the approved Site Plan prepared by Pauly and Olsen Associates, Ltd. , dated November 19, 1985. 3. Plans for the building addition shall be reviewed by the Building Board of Review prior to issuance of a building permit. 4. Signage shall conform with the City Sign Regulations and approval of the City Building Inspector. 5. There shall be no outside storage of products or materials. 6. Trash and used/unusable tires shall be stored within the building or within an enclosure which meets the specifications of the City Building Inspector. 7. The operation shall conform with all requirements and recommendations � of the City Building Inspector and City Fire Marshal . 8. Failure to comply with one or more of the above conditions of approval shall be grounds for revocation of the Conditional Use Permit. III. INFORMATION SESSION WITH CITY ENGINEER ON HIGHWAY CONSTRUCTION City Engineer Lowell Odland reviewed proposed MnDOT plans for changes near the Highway 55/Highway 100 intersection. It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Kapsner and carried unanimously to recommend City Council approval of the plans prepared by MnDOT with the addition of a connected service road on the east side of Highway 100 over the railroad tracks. Mr. Odland also made a presentation on the I-394 (Highway 12) construction plans. The meeting was adjourned at 9:00 P.M. Grimes, Director of Planning and Development SUBJECT: Set Informal Public Hearing Date for Rezoning and Preliminary Plat Approval for Michael Sharp Addition on Florida Avenue North South of Medicine Lake Road The Planning staff is recommending that the Planning Commission set an Informal Public Hearing date of February 10, 1986 to consider the rezoning of about two acres of property on the east side of Florida Avenue North about 200 feet south of Medicine Lake Road. The proposed rezoning would be from Residential to R-2. The proponent, Michael Sharp, would like to develop the land for three two-family houses. In addition, Mr. Sharp must also plat the property in order to create the three lots on which the buildings are to be constructed. The Planning staff is also recommending that an Informal Public Hearing be set on this matter for the February 10, 1986 meeting. � r � January 8, 1986 s T0: Golden Valley Planning Commission FROM: Alda Peikert, City Planner SUBJECT: Waiver of the Platting Ordinance - 3900 Golden Valley Road The proponent, Mr. Gerald L. Michaelson, requests a waiver of the Platting Ordinance to allow division of the single family residential lot at 3900 Golden Valley Road for transfer of a triangular portion of the rear yard to the adjacent single family residential lot at 3801 Bassett Creek Drive. There are existing single family residences on each of the lots involved in the proposed division and combination. Mr. Michaelson is purchaser on a contract for deed of the residence located on the parcel proposed for division, the property at 3900 Golden Valley Road. Mr. Michaelson also represents Michaelson Farm Partnership, owner of the adjacent parcel at 3801 Bassett Creek Drive. The purpose of the proposed division and combination is transfer to 3801 Bassett Creek Drive an area of rear yard which Mr. Michaelson feels fits more suitably with 3801 Bassett Creek Drive than with 3900 Golden Valley Road due to topography. The triangular piece proposed for transfer includes an area toward the rear lot lines which is on the same level as the rear � yard of 3900 Golden Valley Road. According to Mr. Michaelson, the area is left in weeds due to the fact that it is separated by topography from the back yard of the 3900 Golden Valley Road residence. The resident of 3801 Bassett Creek Drive wishes to landscape the area in order to improve the view from the 3801 Bassett Creek Drive home. Planning staff inspected the site and confirmed the elevation change. Discontinuities due to lack of yard maintenance are not evident at this time of year due to snow coverage. On his application form, Mr. Michaelson states the reason for the request for a waiver of the Platting Ordinance as follows: "This part being transferred is the back yard view from the house at 3801 Bassett Creek and it is the back side and lower level of the lot at 3900 Golden Valley Road. It will enhance the beauty of 3801 and will not detract or devalue 3900. It makes good common sense." The proposed transfer of property is in conformance with provisions of the � Zoning Ordinance. The proposed new property line does not create any nonconformities in lot size or setbacks. Based on conformance with provi- sions of the Zoning Ordinance, staff suggests that the Planning Commission recommend City Council approval of the requested waiver of the Platting Ordinance to allow transfer of a portion of rear yard from the property at 3900 Golden Valley Road to the property at 3801 Bassett Creek Drive. Adams, request a waiver of the Platting Ordinance to allow division of the commercial property at 815 Winnetka Avenue North for transfer of a four foot strip of property to the adjacent property to the south. The property proposed for division is the location of Sally Adams Realty. The property to the south is the location of a multiple tenant commer- cial building owned by Dr. Dennis Johnson. The proposed lot division was initiated at the request of Dr. Johnson, owner of the building at 701-737 Winnetka Avenue North. Dr. Johnson proposes purchase of a four foot strip of property along the north boundary line of his property. The purpose of the additional four feet is to allow widening of a drive at the north end of his building providing access from Winnetka Avenue to parking area to the rear or west of his building. The drive is currently approximately 13 feet wide and utilizes the entire area from the building to the current property line. The additional property would allow widening of the drive to approximately 17 feet between the building and the proposed new property line. The proposed shift in property line is shown on the attached survey as two lines • to the north of the 701-737 Winnetka Avenue North building, both perpendicular to Winnetka Avenue North. The southerly line indicates the current property line and the edge of the current paved driveway. The proposed new property line four feet to the north would become the edge of newly paved drive. The property line shift involves only the easterly portion of the property line between the two properties, the portion of the line perpendicular to Winnetka Avenue North. The 701-737 Winnetka Avenue North property is currently nonconforming in that the drive extends to the northerTy property line without the ten foot landscaped setback required by the Zoning Ordinance. Dr. Johnson proposes to perpetuate the nonconformity by paving to the proposed new property line. A variance is required for setback, and application has been made to the City Board of Zoning Appeals (BZA) . Consideration of the variance request is scheduled for the January 14, 1986 BZA meeting. , Planning staff suggests consideration of acquisition of additional property in order to ensure adequate driveway width and in order to provide landscaped setback from the property line. More than adequate setback from the proposed new property line to the Sally Adams Realty building remains. The required building setback is 20 feet, and the distance from the proposed new property line to the Sally Adams building is approximately 30 feet. Staff suggests that the Planning Commission recommend City Council approval of the requested waiver of the Platting Ordinance for transfer of property from � 815 to 701-737 Winnetka Avenue North conditional upon acquisition of additional property for provision of required setback or BZA approval of a variance.
