YEAR 2010 PLANNING WORKSHOP � MINUTES OF THE GOLDEN VALLEY PLANNING COMMISSION � November 10, 1986 A regular meeting of the Planning Commission was held in the Council Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. Chairman Prazak called the meeting to order at 6:40 P.M. Those present were Commissioners Leppik, McAleese, and Prazak. Also present were Mark Grimes, Director of Planning and Development, Alda Wilkinson, City ' Planner, and Gloria Anderson, Secretary. Commissioners Lewis and Russell were absent. I. REPORT FROM CHAIRMAN OF RECREATION AND OPEN SPACE COMMISSION ON POOL PLANS Mr. Chuck Burmeister of the Recreation and Open Space Commission gave a review and answered question regarding the proposed swimming pool and recreation center. Commissioners Kapsner and McCracken-Hunt arrived during this presentation. II. INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT APPLICANT: Animal Humane Society of Hennepin County • LOCATION: 845 Meadow Lane North REQUEST: Approval of a Conditional Use Permit to Allow for Expansion of the Animal Humane Society Building Chairman Prazak introduced this agenda item and requested a summary of the staff report. Director Mark Grimes gave a brief review of the staff report and staff's recommendation of approval . Mr. Alan Stensrud, Executive Director of the Animal Humane Society, and Mr. A1 Mjorud, partner in charge, and Ms. Ann Mazzarella, project designer and manager, of Carlson Mjorud Architecture, Ltd. , were present to make a presentation and answer questions from the Commissioners. Mr. Mjorud reviewed the plans for expansion of the Animal Humane Society build- ing. He stated they needed the additional space to provide better service and to expand their educational programs. Mr. Mjorud indicated that with fewer than the required parking spaces, many of the existing trees could be saved and parking would still be adequate. He described how the parking could be increased if it were necessary. Mr. Stensrud described the operation of the Animal Humane Society and answered questions from the Commissioners regarding their educational programs. i � Golden Valley Planning Commission Minutes November 10, 1986 • Page 2 Chairman Prazak opened the Informal Public Hearing. Hearing and seeing no one, the Informal Public Hearing was closed. Consensus of the staff and Commissioners was that the Animal Humane Society's plans for improvement would be an asset to the area and fit in well with the North Wirth Redevelopment plans. It was moved by Commissioner Leppik, seconded by Commissioner Kapsner and carried unanimously to recommend City Council approval of a Conditional Use Permit to allow the Animal Humane Society of Hennepin County to operate and expand their facility by 21,800 square feet at 845 Meadow Lane North in a Light Industrial Zoning District subject to the following conditions: 1. The site plans dated August 8, 1986 and November 10, 1986 become a part of the permit. 2. The Animal Humane Society shall be permitted to provide only 80 spaces as shown on the plan dated August 8, 1986 (Needed Parking). However, if it is determined by the Director of Inspecti�ns that additional parking is needed, the Director shall bring this to the attention of the City Council who may order up to an additional 40 spaces be built as shown on the plan dated November 10, 1986 (Maximum Parking). • 3. The Landscape Plan shall become a part of the permit. The plan shall be completed as per the direction of the Director of Inspections. 4. Any drainage or utility plans shall be approved by the City Engineer. III. APPROVAL OF MINUTES - OCTOBER 27, 1986 • It was moved by Commissioner Leppik, seconded by Commissioner Kapsner and carried unanimously to approve the minutes of the October 27, 1986 meeting. IV. SET DATE FOR INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT APPLICANT: KARE TV LOCATION: 8811 Olson Memorial Highway REQUEST: Approval of a Conditional Use Permit to Allow for a Heliport in a Business and Professional Offices Zoning District Chairman Prazak introduced this agenda item and noted staff's recommendation of an Informal Public Hearing date of November 24, 1986 to consideration a request by KARE TV to operate a heliport at 8811 Olson Memorial Highway. With the consensus of the Commissioners, Chairman Prazak set the date for the Informal Public Hearing for November 24, 1986. • ` Golden Valley Planning Commission Minutes November 10, 1986 Page 3 � V. REPORT ON NOVEMBER 5, 1986 CITY COUNCIL MEETING Director Grimes provided a report on the November 5, 1986 City Council meeting. VI. UPDATE ON TOWN MEETING Commissioner McAleese provided an update on plans for the upcoming Centennial Town Meeting to be held November 20, 1986. VII. YEAR 2010 PLANNING WORKSHOP: DISCUSSION OF CITY DOCUMENT READABILITY AND CITY PLANNING PROCESS Following discussion of the need for simplification of English language used in City ordinances, it was agreed that Commissioner McAleese wauld draft a recommendation to the City Council for Planning Commission consideration. Following discussion of the City planning and evaluation process, it was suggested by Commissioner Leppik and agreed by Planning Commissioners to first review planning input received at the upcoming Centennial Town Meeting and then to set direction for the planning process. Grimes, Director of Planning and Development SUBJECT: Set Date for Informal Public Hearing on Conditional Use Permit for Operation of Rental Business at 1200 Mendelssohn Avenue (Forman-ford Paint Building) The owner of the Forman-Ford Paint Building, 1200 Mendelssohn Avenue Limited Partnership, has requested a Conditional Use Permit in order to allow the building to be used by U-Haul Company of Minnesota, Inc. The plan is to use a portion of the buiiding for over-the-counter rental of equipment (tools, supplies, trucks, trailers, etc.). However, the majority of the building would be used for the distribution of U-Haul equipment to other U-Haul operators in their marketing area. This would include the inside and outside storage and repair of rental items. Repair and maintenance would include work on trucks, trailers and motor homes. Office space would also be provided in the building. A Conditional Use Permit is necessary for this operation in an Industrial Zoning District. This operation qualifies for a Conditional Use Permit under three categories found in Section 7.03. They are: • 1. Drive-in retail establishment (retail rental operation) 2. Outdoor sales including motor vehicle and equipment rental 3. Auto and truck repair The staff suggests an informal public hearing be held on December 8, 1986. � November 19, 1986 � T0: Golden Valley Planning Commission FROM: Alda Wilkinson, City Planner SUBJECT: Informal Public Hearing - Conditional Use Permit - Heliport in a Business and Professional Offices Zoning District - KARE TV 11 - 8811 Olson Memorial Highway Background On May 22, 1984 the City of Golden Valley received from KARE TV 11, known at that time as WTCN TV 11, a request for an amendment to the City of Golden Valley Zoning Code to make provision for heliports in the Business and Professional Offices Zoning District. At that time, K,4RE had recently purchased a helicopter and was already operating the helicopter from a landing site located on General Mills property directly to the south of the KARE TV site at 8811 Olson Memorial Highway. In response to the request from KARE, the Golden Valley City Council on November 20, 1984 adopted an amendment to the Zoning Code providing for heliports as a conditional use in the Commercial , Business and Professional Offices, Light Industrial , Industrial and Institutional Zoning Districts. � During the interim two-year period from the time of passage of the Zoning Code amendment providing for heliports to the present, KARE TV 11 has continued to utilize the General Mills property adjacent to the KARE location as a heliport site. KARE use of the General Mills property was based on an informal arrange- ment which allowed landing of the helicopter on General Mills property for the present, but did not guarantee availability of the property for a specific time period into the future and did not allow installation of improvements on the property. As a result of pressure from the City to make application for the required Conditional Use Permit, KARE reviewed possibilities for placement of the heliport on KARE property. Alternative locations on the KARE site had the disadvantages of either locating the heliport closer to the single-family residential develop- ment to the west or displacing needed parking space. Therefore, KARE approached General Mills to obtain formal permission for utilization of the General Mills location. Attached is a copy of a license agreement recently concluded between General Mills and KARE TV which provides for KARE use of a 50-foot strip of General Mills property adjacent to the KARE site and further provides for KARE installation of paving and fencing. The agreement perpetuates for at least three years into the future KARE use of the helicopter landing location already in use for the last two and a half�years. There will be no change from the current location of the helicopter landing site. Subsequent to General Mills granting of the license for use of the General Mills � property, KARE submitted an application for a Conditional Use Permit for a heli- port. Both the KARE property and the General Mills property are zoned Business and Professional Offices. A heliport is allowed as a conditional use in the Business and Professional Offices Zoning District under the November 1984 amend- ment to the Zoning Code. ' Golden Valley Planning Commission November 19, 1986 Page 2 � At the time of ado tion of the Zonin Code amendment for heli orts the Cit P 9 P • Y Council directed that a list of additional guidelines for review of heliport proposals be included in the City Zoning Code Administrative Manual. This action was in accordance with a recommendation from the Planning Commission for addi- tional guidelines for heliport review. Therefore, a Conditional Use Permit application for a heliport is subject not only to review in reference to the ten findings listed in the Conditional Use Section of the Zoning Code, but also to review under the additional guidelines for conditional use permits for heliports listed in the Administrative Manual . Guidelines for Heliports The list of additional guidelines for review of Conditional Use Permit applica- tions for heliports, which is included in the Zoning Code Administrative Manual , is attached. Also attached is a letter from KARE TV 11 which addresses each of the eleven guidelines. Following is a review of the KARE heliport proposal with reference to each item listed in the guidelines: 1. Documentation of approvals required by other agencies including but not limited to the Federal Aviation Administration, Minnesota Depart- ment of Transportation and Metropolitan Airports Commission. Attached are copies of required reviews and approvals submitted with the KARE Conditional Use Permit application. Approvals include a license issued by the � State of Minnesota Department of Transportation and a November 6, 1986 letter from the Metropolitan Airports Commission (MAC) stating that MAC has no objection to the heliport location. A June 7, 1985 review letter from the Federal Aviation Administration (FAA) specifies conditions for heliport operation which are incor- porated into the proposed heliport design. The proposed site plan indicates installation of a bituminous paved landing pad in accordance with FAA design standards and installation of a fence to satisfy FAA requirement of "a non- obstructing safety barrier". Required FAA improvements and adjustments not shown on the site plan submitted with the CUP application include installation of a wind indicator, incorporation of fire protection as required, and removal of two light standards. The FAA review specifies removal of two trees and two light standards. The trees have been removed, but removal of the two southerly light standards in the KARE parking lot has not been accomplished. 2. Documentation of liability insurance secured by the applicant for the heliport. Attached with the letter from KARE is a certificate of liability insurance for the heliport directed to the City of Golden Ualley. As a certificate holder, the City of Golden Valley would be notified of any reduction or termination of insurance coverage. 3. Provision of a safety barrier around helicopter operational areas. The barrier may take the form of a fence, wall , or a hedge. Any barrier used should be high enough to present a positive deterrent to � persons inadvertently entering an operational area and yet low enough to be nonhazardous to helicopter operations. � " Golden Valley Planning Commission November 19, 1986 Page 3 � The proposed site plan for the heliport indicates installation of a 30 inch fence around the heliport site. The height is minimal in order to avoid hazard to the helicopter on approach and take off. On the other hand, the fence serves to define the heliport site and is of sufficient height to act as a deterrent to persons entering the heliport area. 4. Fire protection, dependent upon the size and number of helicopters to be accommodated, the number of occupants, and the fuel load of the helicopter. The letter from KARE identifies the type of fire extinguisher required and provided at the heliport site. 5. Height restrictions: Minimum altitude of 300 feet to be maintained above ground at the heliport site except for take off and landing. The letter from KARE states that the helicopter will not fly under 300 feet except for take off and landing. 6. Landing and take off patterns, frequency and hours of operation. The application from KARE indicates landing and take off directly to and from the east over the Brookview Golf Course. This take off and landing pattern is noted both on the site plan and on a marked aerial photograph which will be available on display at the November 24, 1986 Planning Commission meeting. This proposed . pattern is within the broader approach/departure route limitations specified in the FAA review letter, which allows approach and departure to �he east and south. The letter from KARE stipulates that take off and landing will occur only during daylight hours and not prior to 8:00 A.M. This stipulation is in conformance with the FAA prohibition, stated in the FAA review letter, against night operations without installation of required lighting and beacon. Limitation to daylight hours after 8:00 A.M. further serves to eliminate any possibility of nighttime noise disturbance of residential neighborhoods. 7. Inclusion of maintenance facilities or fuel 5torage at the heliport site. The KARE letter stipulates that there will be no maintenance or fuel storage facilities at the proposed heliport site. 8. Limitations on number of users and on number of helicopters stored at the heliport site. The KARE letter stipulates that the heliport will be used by only one helicopter. Planning staff feels that additional limitation on users is not necessary in this case. 9. Proximity to residential areas. The KARE and General Mills properties abut single-family residential development on the west. The distance from the helicopter landing site to the nearest resi- � dence is over 300 feet. Visibility of the heliport from the neighboring single- family residences is minimized by intervening tree cover and berming. Golden Valley Planning Commission November 19, 1986 Page 4 . 10. Type of equipment and documentation of noise levels generated by equipment. The KARE letter accompanying the Conditional Use Permit application documents noise levels in terms of decibels at specified distances from the helicopter. The type and size of the helicopter owned by KARE are such that noise generation is at the low end of the range among helicopters. Noise, as well as visibility, is min�mized for adjacent residential development by intervening berming and trees. 11. Placement of a time limit on the Conditional Use Permit providing an opportunity for review of the operation and revision of conditions at the time of renewal after a specified trial period of time. Planning staff does not feel that a trial period is necessary in the case of this heliport due to the fact that the helicopter has already been operating at the proposed site for a period of two and a half years. Planning staff further feels that it is unnecessary to limit the Conditional Use Permit to the three-year period of the license agreement granted by General Mills for the property. Any alteration of the approved site plan cited in the permit automatically requires an amendment to the Conditional Use Permit and reconsideration by the Planning Commission and City Council. Findings for Conditional Use Permits � Section 20.03 of the City Zoning Ordinance provides that in considering a Condi- tional Use Permit application, the Planning Commission shall make findings and recommendations to the City Council on ten items, which need not be given equal weight in the consideration. Examination of the proposed KARE heliport in view of each of the ten items follows: 1. Demonstrated need for the proposed use. Planning staff concurs with the contention of KARE representatives that helicopter availability is essential to competitive television news coverage. 2. Consistency with the Comprehensive Plan of the City. The Comprehensive Land Use Map in the adopted City of Golden Valley Comprehensive Plan designates long-term land use as Business and Professional Offices for the entire area west of General Mills Boulevard between Highway 55 and Betty Crocker Drive. Heliport usage is a conditional use compatible with office use and is consistent with the City Comprehensive Plan. 3. Effect upon property values in the neighboring area. Surrounding land uses include the Brookview Golf Course to the east, vacant General Mills property zoned Business and Professional Offices to the south, and single- family residential development to the west. The heliport site is on General Mills property, which gives General Mills control over continuation of the use and , assures compatibility with future use of the General Mills property. As noted above, the heliport is screened from the residential land use to the west by trees and berming. Planning staff does not believe that the heliport use would have a negative impact on value of surrounding property. Golden Valley Planning Commission NovembQr 19, 1986 • Page 5 4. Effect of any anticipated traffic generation upon the current traffic flow and congestion in the area. " The proposed heliport use does not result in traffic generation. 5. Effect of any increases in population and density upon surrounding land uses. There will be no increases in population and density resulting from the proposed heliport use. 6. Increase in noise levels to be caused by the proposed use. As noted above, helicopter noise level is not expected to create a problem. The type and size of the helicopter are such that noise generation is on the low end of the range for helicopters. The only residential development is to the west screened by trees and berming, and helicopter operations will be limited to day- light after 8:00 A.M. , thus eliminating any nighttime disturbance of surrounding residential development. Approach and landing will be to and from the east over the goif course and not over residential areas. 7. Any odors, dust, smoke, gas, or vibration to be caused by the proposed use. � There will be no odors, dust, smoke or gas caused by the proposed use. Any vibration resulting from the helicopter will not affect property as far away as the single-family residential development to the west of the heliport site. 8. Any increase in flies, rats, or other animals or vermin in the area to be caused by the proposed use. The proposed heliport use will not result in any increase in flies, rats, or other animals or vermin in the area. 9. Visual appearance of any proposed structure or use. The only structure at the heliport site will consist of low fencing to define the area. The use will not result in negative visual impact on surrounding property. 10. Any other effect upon the general public health, safety, and welfare of the City and its residents. The only other possibie effect on community welfare is potential for public safety benefits afforded by availability of a helicopter within the community. Recommendation Review of the proposed KARE TV 11 heliport in view of the ten factors for examin- ation of a Conditional Use Permit request and under the additional guidelines for • review of a Conditional Use Permit application for a heliport indicates a favorable recommendation. Staff suggests that the Planning Commission recor�nend City Council approval of the Conditional Use Permit requested by KARE TV 11 for a heliport on General Mills property to the south of the KARE location at 8811 Olson Memorial Highway, subject to the following conditions: Golden Valley Planning Commission November 19, 1986 Page 6 � l. Heliport improvements shall conform to the Site Plan prepared by Armstrong, Torseth, Skold and Rydeen, Inc. , dated October 30, 1986. 2. Installation of required improvements shall be completed by May 15, 1987. 3. The two southerly light standards in the KARE parking lot shall be removed in accordance with direction in the June 7, 1985 Federal Aviation Administration review of the heliport proposal. 4. A non-obstructing wind indicator shall be maintained adjacent to the take off/landing area. b. A 100 pound minimum capability of dry chemical in containers in accordance with NFPA National Fire Code standards shall be located at the heliport site. 6. There shall be no fuel storage or maintenance facilities at the heliport site. 7. The helicopter approach/departure pattern shall conform to the marked aerial photograph prepared by Armstrong, Torseth, Skold and Rydeen, Inc. 8. Helicopter operations shall be limited to daylight hours no earlier than � 8:00 A.M. 9. A minimum altitude of 300 feet shall be maintained except for take off and landing. 10. Usage of the heliport shall be limited to one helicopter. 11. Failure to comply with one or more of the above conditions shall be grounds for revocation of the Conditional Use Permit. Attachments: 1.
