Vice Chair Leppik called the meeting to order at 7:00 P.M. Those present were Commissioners Kapsner, Leppik, Lewis, McAleese, and Russell . Also present were Mark Grimes, Director of Planning and Development; Alda Peikert, City Planner; and Gloria Anderson, Planning Secretary. Commissioners Prazak and McCracken-Hunt were absent. I. APPROVAL OF MINUTES - OCTOBER 14, 1985 It was moved by Commissioner Kapsner, seconded by Commissioner McAleese, and carried unanimously to approve the minutes of the October 14, 1985 Planning Commission meeting. II. SET DATE FOR INFORMAL PUBLIC HEARING - PRELIMINARY DESIGN PLAN APPLICANT: Nortronics Company, Inc. � LOCATION: 8101 Tenth Avenue North REQUEST: Approval of Preliminary Design Plan of PUD #50, Nortronics This item was introduced by Vice Chair Leppik. City Planner Alda Peikert gave a brief review of the request for approval of the Preliminary Design Plan of PUD #50, Nortronics. It was moved by Commissioner McAleese, seconded by Commissioner Kapsner and carried unanimously to set an informal public hearing date of November 25, 1985 for consideration of the Preliminary Design Plan of PUD #50, Nortronics. Commissioner McCracken-Hunt arrived at the meeting. III. ZONING CODE AMENDMENT - HOME OCCUPATION ORDINANCE Director Mark Grimes gave a review of the changes requested by the Planning Commission .at the October 14, 1985 meeting. Some of the concerns discussed by the Planning Commissioners were the number of car trips per day, incidental sales, signage, sale and repair of firearms and day care. • Planning Commission Minutes . October 28, 1985 Page 2 � The following changes to the home occupation ordinance were recommended: 1. 1.L. should read "A home occupation shall not generate more than eight client trips per day nor serve more than two clients at a time." 2. It should be noted under definitions that Day Care is not included in the home occupation ordinance. 3. The sale and repair of firearms should remain a prohibited home occupation. �- Mr. Helmut Maier, 115 Florida Court, was present at the meeting and stated that he felt limiting the client trips to eight per day and the number of clients being served at one time to two seemed fair. It was moved by Commissioner McCracken-Hunt, seconded by Commissioner McAleese and carried unanimously to recommend City Council approval of the home occupation ordinance as edited. IV. PRESENTATION ON TAX INCREMENT FINANCING Mr. Don Taylor, City Finance Director, made a presentation on tax increment financing and answered questions from the Planning Commissioners. � V. REVIEW OF TURNER DEVELOPMENT/EMBASSY SUITES DEVELOPMENT AGREEMENT Vice Chair Leppik introduced this agenda item and invited Commissioners not present at the time of previous discussion on October 14, 1985 to make further comment for consideration by the HRA. Planning Commissioners had no comments to add to those recorded at the previous meeting. Planning and Redevelopment Director Mark Grimes confirmed that site plan considerations may be addressed as part of the PUD approval process. VI. REPORT ON HRA MEETING - OCTOBER 15, 1985 Commissioner McCracken-Hunt provided the Planning Commission with a report on the October 15, 1985 meeting of the Housing and Redevelopment Authority (HRA). VII. RESCHEDULING OF NOVEMBER 11, 1985 PLANNING COMMISSION MEETING The Planning Commission discussed rescheduling or cancellation of the November 11, 1985 Planning Commission meeting which falls on a holiday. The Planning Commission by consensus authorized staff to schedule a study meeting for Tuesday, November 12, 1985 in the event the Board of Zoning Appeals (BZA) does not have items for a November meeting regularly scheduled for November 12, 1985. If the BZA meets November 12, 1985, the Planning Commission study meeting will be scheduled for Thursday, November 14, 1985. � Planning Commission Minutes . October 28, 1985 Page 3 � Commissioner McCracken-Hunt left the meeting. VIII. ZONING CODE AMENDMENTS - DAY CARE Following brief discussion, it was moved by Commissioner Russell , seconded by Commissioner Lewis and carried unanimously to amend the Residential Section of the City Zoning Ordinance as proposed to bring the provision for day care into conformance with recent State legislation. IX. REPORT ON CITY COUNCIL MEETING - OCTOBER 15, 1985 Commissioner McAleese reported that he did not attend the October 15, 1985 City Council meeting due to the fact that agenda items pertinent to Planning Commission business were minimal . X. INDIVIDUAL LAND USE AND HOUSING COMMITTEE WORK SESSIONS ON COMPREHENSIVE PLAN It was moved by Commissioner McAleese, seconded by Commissioner Kapsner and carried unanimously to postpone Comprehensive Plan work sessions until the study meeting to be scheduled for November 12 or November 14, 1985. T0: Golden Valley Planning Commission FROM: Alda Peikert, City Planner SUBJECT: Set Date for Informal Public Hearing - Amendment to Conditional Use Permit No. 82-9 to Allow Expansion of Golden Ualley Tire - 600 Decatur Avenue North Mr. David L. Almich and Mr. James A. Pauley of Time Master, Inc. request an amendment to Conditional Use Permit (CUP) No. 82-9 to allow expansion of the Golden Valley Tire Center located at 600 Decatur AveRUe North. The original Conditional Use Permit for a tire service and automobile repair service in a Commercial Zoning District was approved by the City Council on December 21, 1982. One of the conditions in the approved Conditional Use Permit stipu- lates use of no more than four service bays. The applicants request approval for six service bays and submit documentation of adequate parking to accommo- date the proposed expanded operation. Staff suggests that the Planning Commission set an informal public hearing • date of December 9, 1985 for consideration of the requested amendment to Conditional Use Permit No. 82-9 for Golden Valley Tire. As described in the attached letter from Nortronics dated October 11, 1985, the proposal is to sell a two-story building addition constructed in 1979 by separate address as 8121 Tenth Avenue North. Reduced Nortronics operations would be consolidated into the original Nortronics building located at 8101 Tenth Avenue North. The proposal includes adequate parking attached to each proposed separate ownership portion of the building. Parking provisions are described in an attached memorandum provided by an agent for the applicant, Nortronics. The parking lot on the building site south of Tenth Avenue North will be sold with the 8121 building and provides four more parking stalls than the 107 spaces required by City Ordinance based on current uses within the building. A separate parking lot located to the north of Tenth Avenue North will remain � with the continuing Nortronics operation at 8101 Tenth Avenue North and pro- vides 80 additional parking spaces over the 116 required based on current building use. The separate parking lot on the north side of Tenth Avenue North does not have curb separation from landscaped area and requires the addition of curb and the addition of gutter as required for drainage. The separate parking lot should be included in the PUD and in the plat, and this adjustment should be made in the General Plan of Development, the second phase of the PUD approval process. In addition, the City requires dedication of 10 foot utility easements adjacent to all street right-of-way lines. These utility easements also should be included on the plat with the General Plan of Development. The PUD proposal includes three existing variances from setback requirements. The Board of Zoning Appeals (BZA) on March 13, 1979 granted a variance of the 35 foot setback required from street right-of-way line to parking for the parking lot fronting on Lewis Road. The variance was granted based on hardship created by a site entirely surrounded by street. Additional variances existing on site and included in the proposal are a distance of approximately 18 feet from the southeast corner of the 8101 Tenth Avenue building to the Lewis Road street right-of-way and a distance of approximately 18 feet from pavement to Tenth Avenue street right-of-way on the separate parking lot parcel . Staff recommends approval of the existing setback variances considering the fact that the building is already in place and considering the fact that the separate parking lot serves the facility across the street. � Golden Valley Planning Commission • November 20, 1985 Page 2 City staff foresees no problems with separation of the building as requested. A joint maintenance agreement is a standard requirement in the case of zero lot line division of a building and is required with the General Plan of Development. The City Fire Marshal reports that there is separation wall as required and that the two buildings have separate sprinkler systems. Based on City utility billing records, it appears that there is separate water service to each build- ing. There are two water meters for 8101 Tenth Avenue North and two separate fire lines. If there is necessity for an agreement on division of water� billings or for private easements for private water connections crossing property in other ownership, copies of documents should be provided to the City with the General Plan of Development. Separate sanitary sewer connections serve the two buildings, but one private sanitary sewer connection line to 8101 Tenth Avenue crosses the property designated as 8121 Tenth Avenue North. The General Plan of Development should include a copy of a private easement agreement to handle the line crossing adjacent property. Staff suggests that the Planning Commission recommend City Council approval of the Preliminary Design Plan for PUD #50, Nortronics, which proposes zero lot line division of the Nortronics building located at 8101 Tenth Avenue North, subject to the following conditions: l. The separate parking lot parcel located to the north of Tenth Avenue North � shall be included in the PUD and in the plat in the General Plan of Develop- ment application. 2. Ten foot utility easements adjacent to all street right-of-way lines shall be dedicated on the plat. 3. Office use of the building designated as 8121 Tenth Avenue North shall not be expanded beyond the 17,859 square feet currently in office use. 4. Parking area and landscaped area on the separate parking lot parcel north of Tenth Avenue North shall be separated by curb, and gutter shall be installed as required for drainage. 5. A joint maintenance agreement and water and sanitary sewer connection easements and agreements as required shall be submitted with the General Plan of Development application. 6. A landscape plan shall be submitted with the General Plan of Development application. 7. As one part of this reduction program we are offering for sale the two-story facility which was built in 1979, which we refer to as 8121 Tenth Avenue North. We will consolidate our opera- tions into our original building, which is just to the east at 8101 Tenth Avenue North. • As the attached preliminary plat shows, we would establish a new property line essentially on the west side of the west wall of the original 8101 Tenth Avenue building. The 8121 two-story structure would claim the entire parking lot oR the south side of that structure. Nortronics parking would continue using only the parking lot across Tenth Avenue to the north. Present use of the 9121 building is a combination of office and light manufacturing. Eventual use will depend upon who might buy the the structure, but it is being offered for sale as . potential office and manufacturing space. Data to Consider: a 1. ) At present the Nortronics facility consists of a total of 81 �531 sq. ft. with 7.12 acres . land a1loWing for a total of 307 improved car stalls. 2. ) Nortronics wishes to sell the 8121 building which consists of a total of 35,724 sq. ft. of which one upper level of 17�859 sq. ft. is all office and one lower level of 17,865 sq. ft. is industrial. This sale would include 2.3 acres of land and 111 car stalls. Given the current use car stalls needed basec3 on one stall for each 250 sq. ft. of office and 500 sq. ft. for industrial, only 106 stalls are required. 3. ) Upon sale of the 8121 building� the 8101 build- ing would be retained by Nortronics. The 8101 building has 1.85 acres plus the 2.97 acres across lOth Ave. and a total of 196 car stalls. The 8101 building has 45,807 sq. ft. of which no more than 12,000 sq. ft. is office. The required car stalls would be 116. Request: On a preliminary basis, we would like to know if such a split vould be permissable and, if so, What steps would have to be taken to gain � approval .
