� September 24, 1984
A regular meeting of the Planning Commission was held in the Council Chambers of
the Civic Center, 7800 Golden Valley Road, Golden Valley, MN. Chairman Forster
`called the meeting to order at 7:00 p.m.
Those present were Commissioners Forster, Leppik, McAleese, McCracken-Hunt,
Prazak, Russell and Singer. Also present were Alda Peikert, Planner, and Towhid
Kazi, Planning Intern.
I. APPROVAL OF MINUTES - SEPTEMBER 10, 1984
It was moved by Commissioner Leppik, seconded by Commissioner McCracken-Hunt and
carried unanimously to approve the minutes of the September 10, 1984 Planning
Commission meeting as recorded.
II. PRESENTATION ON RESIDENTIAL FACILITIES FOR THE CHRONICALLY MENTALLY ILL
Chairman Forster introduced Ms. Eileen Moran, Executive Director, Northwest
Hennepin Human Services Council to speak on this agenda item. Ms. Moran made a
presentation on the issue of residential facilities for the chronically men-
tally ill . Ms. Moran answered questions from the Commissioners on the sub�ect.
� III. DISCUSSION AND COMMENT ON GOLDEN HILLS REDEVELOPMENT PLAN
Chairman Forster introduced this agenda item. Planner Alda Peikert reviewed
the draft of the Golden Hills Redevelopment Plan and answered questions.
It was moved by Commissioner Russell , seconded by Commissioner Singer and
carried unanimously to transmit to the Housing and Redevelopment Authority and
the City Council the following Planning Commission reco�nendations concerning
the proposed Golden Hills Redevelopment Plan:
1 . Promotion of hotel development in the Central Area.
2. Extension of the Golden Hills Shopping Center in the East Area to include
additional retail businesses.
3. Inclusion of a convenience store in the Redevelopment Area.
4. Closing of the access off of Circle Down in the East Area.

5. Consideration to pedestrian crossings and circulation in the Redevelopment
Area.
6. Inclusion of multiple family housing, either apartments or condominiums, in

clearance of St. Louis Park properties located to the north of I-394 and to
the south of the Golden Valley/St. Louis Park �nicipal boundary line.
IV. REPORT ON BZA MEETING - SEPTEMBER 12, 1984
Commissioner Prazak provided a report on the September 12, 1984 BZA meeting.
V. REPORT ON CITY COUNCIL MEETING - SEPTEMBER 18, 1984
Commissioner McCracken-Hunt provided the Planning Corrmiission with a report on �
the September 18, 1984 City Council meeting.
� VI. DISCUSSION OF PROPOSED 1985 OPERATING BUDGET
The Planning Commission reviewed the proposed Planning Commission portion of the
proposed 1985 City of Golden Valley Operating Budget.
The meeting was adjourned at 9:30 P.M.

GOLDEN VALLEY ROAD - RESIDENTIAL FACILITY FOR THE CHRONICALLY N�NTALLY
ILL IN A MULTIPLE DWELLING ZONING DISTRICT
The proponent, OASIS, requests a Conditional Use Permit to allow conversion of
an existing eight unit apartment building located at 6739 Golden Valley Road to
a residential facility for the chronically mentally ill. The site is currently
zoned Multiple Dwelling (M-1 ). The Multiple Dwelling Zoning District Section of
the City Zoning Code allows as conditional uses ali uses permitted in the
Residential Zoning District, and the Residential Zoning District Section of the
Code lists group homes as a permitted use with special requirements for group
homes outlined in Section 3A.11 of the Residential Zoning District Section of
the Code.
Staff suggests that the Planning Cormnission set an informal public hearing date
of October 22, 1984 for consideration of a Conditional Use Permit for a residen-
tial facility for the chronically mentally ill at 6739 Golden Valley Road.
The proponent has offered Planning Commissioners the opportunity to tour the
� Bill Kelly House, an existing facility administered by the proponent and similar
to the facility proposed in Golden Va11ey. A representative of the proponent
will be present at the October 8, 1984 Planning Commission rr�eting and Planning
Commissioners, who wish to tour the Bill Kelly House prior to the October 22,
1984 informal public hearing, may arrange a time for a visit. The proponent has
scheduled a visit to the Bill Kelly House for the City Mayor on October 10, 1984
and invites Planning Commissioners to tour the facility at that time or at
another mutually convenient time.

SUBJECT: Removal of Collector Designation From Duluth Street
On October 18, 1983, the Golden Valley City Council passed a resolution
directing the Planning Commission to review and evaluate the present and ,
potential status of Duluth Street and the designation of Duluth Street in
the Comprehensive Plan. The City Council in the same resolution directed
the Planni�ng Commission to consider among other things:
1 . The relation of Duluth Street with 23rd Avenue and Plymouth
� Avenue.
2. County plans for the potential upgrading of Medicine Lake
Road.
3. Future service to properties which miyht be developed within
• the area.
Collector Designation of Duluth Street
Duluth Street west of Winnetka Avenue North is designated as a collector in
the Golden Valley Comprehensive Plan. The portions of Duluth Street that
are already constructed are Winnetka Avenue North to Aquila Avenue North,
Ensign Avenue North to Flag Avenue North, and Gettysburg Avenue North to
Independence Avenue North. The portions of Duluth Street that are not yet
constructed are Aquila Avenue North to Boone Avenue North, Flag Avenue
North to Gettysburg Avenue North, Independence Avenue North to Mendelssohn
Avenue North, and Boone Avenue North to Ensign Avenue North (which goes
through General Mills property) . Attached is a map illustrating completed
portions of Duluth Street.
Collectors are usually spaced between principal and minor arterials.
Collectors are two-lane undivided roadways serving as low speed traffic
feeders to principal , intermediate and minor arterials and local streets.
Further characteristics of collectors are listed in the functional classi-
fication chart on pp. 9-12 of the adopted Comprehensive Plan included with
the earlier staff report attached.

• Impact of Removal of Collector Designation
During October 1983 staff sent an inquiry to the Minnesota Department of
Transportation (MnDOT) concerning the ramifications of removal of the
collector designation from Duluth Street. Staff inquired about the
following three concerns:
1. Can Duluth Street continue to be regarded as a State Aid Street
if the collector designation is removed?
2. Would the City of Golden Valley be required to reimburse MnDOT
for the funds expended to date in the event Duluth Street is
removed from the State Aid System?
3. If the City chose not to complete construction of Duluth
Street, what impact would such action have on Medicine Lake
Road and 23rd Avenue North?
A copy of the letter received in response from MnDOT is attached.
Responses to all three questions are summarized in the following:
First, in order to qualify as a State Aid Street, a municipal street must:
(1) Carry relatively heavier traffic volumes or be functionally classified
• a collector or arterial as identified in the City's functional plan
approved by the City Council; (2) connect the points of major traffic
interest within the City; and (3) provide an integrated street system
affording, within practical limits, a State Aid Street System consistent
with traffic demands.
Secondly, if Duluth Street is removed from the State Aid System, the City
would be required to reimburse MnDOT for the State Aid funds expended to
date. The total amount of State Aid funds expended as of November 9, 1983
is $183,000.
Thirdly, if the collector designation is removed from Duluth Street or if
Duluth Street is not completed, Duluth Street traffic would find other
routes. A traffic study would have to be undertaken in order to determine
the deyree of impact on other streets such as 23rd Avenue North and
Plymouth Avenue. At this time, MnDOT does not have any plans to do such a
study.
Upgrading of Medicine Lake Road
Hennepin County does not have any plans to upgrade Medicine Lake Road at
the present time. However, County staff informed the Planning Department
that the City of New Hope has applied for Federal funding to upgrade
Medicine Lake Road from County Road 18 to Douglas Drive. The proposed plan
calls for a four lane facility along with typical curb and gutter. The
• plan also suggests a speed limit of 35 miles per hour.

• The proposed plan has a good chance of approval as a Federal Aid Urban
(FAU) project eligible for 75 percent Federal funding. However, actual
construction would require approval of all cor�nunities adjoining Medicine
Lake Road, including the City of Golden Valley. According to the City
Engineer, only half of FAU projects receive the additional approvals
required for actual construction.
Development of General Mills Property
The Planning Department's findings indicate that General Mills has a total
of 55.88 acres (approx.) of undeveloped property through which Duluth
Street passes. The City of Golden Valley at this point is not aware of any
plans for the development of this property by General Mills. However, the
City anticipates that General Mills would develop the property in the ,
future. Zoning of the property is Industrial , allowing development of
offices, warehouses, manufacturing plants or any other use permitted in the
Industrial Zoning District. It would require the completion of Duluth
Street to accommodate the increased traffic if the General Mills property
is developed.
Recommendation
Staff suggests that the Planning Commission recommend that the City Council
take no action to change the collector designation of Duluth Street in the
• adopted City of Golden Valley Comprehensive Plan at this time. The primary
reason for the recommendation against consideration of a change in the
collector status of Duluth Street is need for a collector at such time as
the adjacent General Mills property is developed. On the other hand, no
further construction of additional sections of Duluth Street will be
necessary until the General Mills property is developed. Therefore, Duluth
Street may remain as currently constructed and used until such time as
development of the General Mills property requires completion as a collector.

Dear Mr. Miller:
Your letter of November 10 requested answers to three specific questions con-
cerning Duluth Street.
The first question is: Can Duluth Street continue to be regarded as a State Aid
Street if the eollector designation is removed?
� Answer: A municipal State Aid street must (1) ca.rry relatively heavier traf-
fic volumes or be funetionaily classified as a collector or arterial as ident-
ified on the city's funetional plan approved by the city council, (2) connect

Answer: Yes.
The third question is: If the City chose not to complete construction of
Duluth Street, what impact would such aetion have upon Medicine Lake Road and
23rd Avenue?
Answer: If Duluth Street was not completed, Duluth Street traffic would find
other routes. It would ta,ke a traffie study to determine the degree the other
streets in the area would be effeeted.

III. Discussion and Outline of Procedures Involved in Amending the

Chairman Thompson introduced this agenda item and reviewed the City Council
resolution requesting Planning Conmission review of the status of Duluth Street
and designation of Duluth Street in the Comprehensive Plan. Chairman Thompson
stated that the Planning Commision has three options for action:

� i. Initiate study at this time by the full Comnission.
2. Initiate study at this time by a three member conmittee of
Planning Comnissioners.
3. Oefer study until such time as the total Comprehensive P1an
is scheduled for updating.
Planning and Redevelopment Coordinator Mike Miller stated that according to
State Statute only the Planning Conmission can amend the Comprehensive Plan.
When the City Council initiates consideration of an amendment by resolution,
the Planning Conmission may respond in one of two ways:
1. The Planning Com�nission may draft an amendment, hold a public
hearing on the amendment, adopt the amendment and refer it to
the City Council.
2. The Planning Co�nission may recornrnend against amendment and
. provide documentation for its negative reco�aendation. The
City Council must then plead its case with the Planning
Commission if it desires an amendment. According to State
Statute, the Planning Commission is the only body with the
authority to prepare Plan amendments.
Mr. Miller stated that in the case of either response, the Planning Commission
t, pasition should be well documented including input from all affected jurisdic-
tions.
Co�nissioner Singer observed that it appears that documentation is more impor-
tant in the event that the Planning Commission decides to prepare an amendment.
Mr. Miller stated that documentation is important in either case.
Commissioner Prazak stated that it was his impression that City Council intent
was' to provide an opportunity for citizen input into the process. Mr. Mi11er
suggested that the Planning Commission has the option of holding a public
meeting at any point in the process whether or not a Comprehensive Plan amend-
ment is drafted. Notice could be sent to residents that the Planning
Cortanission will receive citizen input at such a meeting.
Chairman Thompson suggested that direction to the Planning Commission in the
RESOLYED clause of the City Council resolution requests review of Comprehensive
Plan designation of Duluth Street but does not suggest that the Planning
Commission consider 3ustification for construction of remaining segments of
Duluth Street. Chairman Thompson stated that he �es not feel that the
question of construction of Duluth Street is a Planning Commission matter.

. Conenissioner Tubman suggested that there is need for a hearing in either event
with or without a Comprehensive Plan amendment. Cort�nissioner Tubman questioned
whether the Planning Conanission has the option of deferring study of the
Duluth Street issue in light of the resolution by the City Council. Chairman
Thompson stated that the Planning Conmission can always refer a �atter back to
the City Council with a recomnendation of deferral.
Commissioner Singer asked whether there would be duplication of costs and
effort in studying the Duluth Street question now and then reviewing it again
Mfien the Comprehensive Plan is due for updating. Commissioner Tubman asked
the reason for targeting Duluth Street for accelerated attention. Cortmissioner
Prazak stated that he feels City Council initiation of the study was in
response to resident input concerning the current Duluth Street construction
pro3ect. Conenissioner Prazak stated his impression that the City Council is
expecting a Planning Commission recomnendation 9n response to their resolution
sooner than in two years.
Mr. Miller observed that even if the Duluth Street designation is changed from
Collector to Local street, completion of the street would result in similar
neighborhood opposition. Mr. Miller suggested that if residents understand
that there is no plan to build further segments of the street in the next five
to ten years, then possibly there would be acceptance of the classification.
Cor�nissioner Tubman suggested that an additional reason for deferral might be
unknown effects of I-394 construction on Highway 55 and areas to the north.
� Chairman Thompson observed that construction of Duluth Street is tied to
upgrading of Medicine Lake Road, which will not occur until the Cities of
Crystal, New Hope and Golden Valley agree to a four lane road. Chairman
Thompson stated that this would not happen for five to ten years. Chairman
Thompson further observed that the key to construction of Duluth Street is
development of the General Mills property.
Commissioner Prazak stated that residents believed that there would be no
further construction of Duluth Street until upgrading of Medicine Lake Road,
but that at City staff initiation a two block segment of Duluth Street is
currently under construction. The neighborhood did not desire the construc-
tion project, and due to the Collector status the specifications call for
greater street width. Residents wish assurance that there will be no further
construction of Duluth Street.
Cortenissioner Forster asked how Duluth Street became a Collector in the
Comprehensive Plan. Mr. Miller recalled that the Planning Com�nission formed
subcommittees for preparation of the various sections of the Comprehensive
Plan. The Transportation Subcommittee studied the street classification
system and determined eventual need of a Collector at that point in the City.
Mr. Miller added that staff has requested in writing State clarification of
the State Aid status of Duluth Street in the event the Collector designation
is removed.

` • Chairman Thompson observed that State aid becomes an issue only if the
Planning Con�nission determines that removal of the Collector designation is
preferable. Chairman Thompson stated that the first decision to be made is
when to initiate the study. Secondly, Chairman Thompson stated that the
Planning Cor�nission should consider only the Collector status and not the
question of construction.
Conmissioner Leppik suggested that eventual construction is presumed if recom-
mendation is made that Duluth Street remain a Collector.
Chairman Thompson observed that the Collector/Local designation determines the
width of the street if and when constructed, not whether the street should be
constructed. If the General Mills property is developed, then the street must
be constructed. If the street is constructed, then the decision is whether
the amount of traffic �ustifies Collector status.
Co�nissioner Prazak asked the role of staff in obtaining required background
information for the study and whether there is enough information available
without initiating further traffic studies. Mr. Miller stated that required
background information would include review of potential development of adja-
cent areas, examination of routing of traffic from potential development loca-
tions to majar traffic corridors, determination of locations where traffic
would build if Duluth Street is not completed, and also consideration of
effects on transit provision. Mr. Miller stated that adequate information is
- available from the City, County and Minnesota Department of Transportation
; � (MnDOT).
Chairman Thompson stated his concern that there is no more infarmation
available now than at the time the Comprehensive Plan was prepared, specifi-
cally concerning development of General Mills property. Chairman Thompson
stated that the choice is whether to initiate a study at this time or to tell
the City Council that the Planning Commission does not feel a study at this
time would be profitable. Chairman Thompson suggested that perhaps the
Planning Com�nission should see what information is available and then decide.
Mr. Miller stated that the study, including staff collection of information
and Planning Commission consideration, would take six months and that the
Planning Commission would not be ready for a hearing by the end of the year.
Canmissioner Prazak suggested that since the study will take considerable
time, the Planning Com�nission should not delay but should initiate the study
and praceed at a reasonable pace. .
It was rtaved by Commissioner Prazak and seconded by Conanissioner Tubman to ask
staff to proceed with assemby from appropriate sources, including other
governmental bodies, information readily available, without initiation of new
studies, for the purpose of reaching a determination of whether amendment of
the Collector status of Duluth Street in the Comprehensive P1an is
appropriate.

FROM DULUTH STREET
The Golden Valley City Council on October 18, 1983 passed the attached resolution
requesting that the Planning Commission review the present and potential status
of Duluth Street with respect to two questions:
1 . Continued designation of Duluth Street as a collector in the Golden Valley
Comprehensive Plan. '
2. Justification for construction of remaining portions of Duluth Street.
The first of the two questions, concerning designation of Duluth Street as a
collector, involves a possible amendment to the Comprehensive Plan. Attached for
information and background are the City of Golden Valley Functional Classification
Map and a chart of Functional Classification Characteristics from the Transportation
section of the City of Golden Valley Comprehensive Plan adopted November 16, 1982.
• Procedure for amendment of the Comprehensive Plan is governed by Minnesota planning
enabling legislation and by the Metropolitan Land Planning Act. Copies of
Minnesota Statute 462.355 Subd. 2 concerning adoption and amendment of comprehensive
plans and of a Metropolitan Council newsletter item on amendment procedure under
the Metropolitan Land Planning Act are attached. Steps for comprehensive plan
amendment are as folTows:
1 . Initiation of a plan amendment. As stated in the statute, the Planning
Commission (planning agency) may initiate an amendment, or the City Council
(governing body) may by resolution to the Planning Commission (planning agency)
propose an amendment. In the case of Duluth Street, the City Council
(governing body) has proposed consideration of an amendment to the Planning
Commission (planning agency) .
2. Planning Commission consideration and evaluation followed by preparation of
an amendment if determined appropriate.
3. Planning Commission (planning agency) public hearing and adoption of the
amendment. The statute requires that notice of the public hearing be published
in the official City newspaper a minimum of ten days prior to the hearing date.
4. City Council (governing body) adoption of the amendment. Under the Metropolitan
La�d Planning Act, Metropolitan Council review is required. As noted in the
Metropolitan Council newsletter, the City Council has a choice of either
adopting a comprehensive plan amendment subject to Metropolitan Council approval
� or of approving the amendment for referral to the Metropolitan Council with
final adoption delayed until after Metropolitan Council review.

5. Review by adjacent jurisdictions. The Metropolitan Land Planning Act requires
distribution of comprehensive plan amendments to adjacent local units of
government and to affected �school districts. The Metropolitan Council newsletter
item notes that Metropolitan Council review guidelines allow submittal to
affected communities only rather than to all adjacent communities. A change
in classification of Duluth Street would require review by the following at
a minimum: Cities of Crystal and New Hope, Hennepin County and the Minnesota
Department of Transportation (MnDOT) .
6. Metropolitan Council review. A proposed comprehensive plan amendment must be
referred to Metropolitan Council along with a three page submittal form explaining
the amendment and assessing effects on metropolitan systems. Any amendment
affecting one of the four major metropolitan systems (sewers , transportation,
parks and airports) requires a 90 day review, and other amendments receive a
60 day review. Within the first 10 days after submittal , Metropolitan Council
makes a determination as to which review is required.
7. Final adoption by the City Council if withheld until after reviews.

The City Council requests in its resolution of referral that the Planning Commission
consider effects on 23rd Avenue North and Plymouth Avenue, County plans for upgrading
of Medicine Lake Road, service to undeveloped lands which might be developed in
• the future (General Mills property) and other pertinent issues in reviewing both
the collector designation of Duluth Street and need for completion of Duluth Street
through from Winnetka Avenue North to Mendelssohn Avenue North.
An additional consideration is eligibility for State Aid Street funds. State Aid
funds expended on Duluth Street construction to date, including the current con-
struction project for the segment from Gettysburg Avenue North to Independence
Avenue North, amount to approximately $183,000. Staff has sent an inquiry to the
Minnesota Department of Transporation (MnDOT) concerning ramifications of removal
of the collector designation from Duluth Street. Questions to be resolved are:
l . Whether Duluth Street can continue to be a State Aid Street if no longer
classified as a collector.
2. Whether reimbursement of State Aid funds already expended is required in the
event Duluth Street is removed from the State Aid system.
3. If reimbursement is required, whether the State has a formula or requirements
for method and timing of refund.
At this time, staff suggests that the Planning Commission initiate a study of the
present and future status of Duluth Street with the objective of determining both
suitability of the collector designation and need for future construction of additional
segments. A list of required background information items, questions, concerns and
potential impacts may be complied as a snarting point to the study. Thorough

investigation of these items must precede a determination of whether preparation of
a Comprehensive Plan amendment is warranted. If the Planning Commission should
dectde to proceed with a Comprehensive Plan amendment, justification for the

Subd. 4. Interim ordinance. Ii a municipality is wnducting studies or has �
suthorized a study to br eonducted or has held or has uh�duled a hearing for
the purpose of eonsidering adoption or amendment of a comprehensive plan or
o�cial controls as defined in section 462.352. subdivision 16, or if nev►'territory
!or v►�hich plans or controls fiave not been adopt�d is annexed to a municipality.
tAe govern�ng body of the municipatity may adopt an interim ordinance applica-
ble to all ot part of ita jurisdiction for the purpose of protecting the planning
process and the health, safety and welfare of its citizens. The interim ordinance
may regulate. restrict or prohibit any use� development, or subdivision a�ithin
the j4risdiction or a portion thereof for a period not to exceed on� year from
the date it is eff�ctive, and may be extended ior such additionat periods as the
municipality may deem appropriate, aot exceeding a total additionaf,�eriod of •
]6 months. No interim ordinance may halt, delay, or impede a subdi�•is�on v►fiich
has been given preliminary appreval prior to the effective date of the interim
ordinance.

THE COMPUTER Information on 80 grant and loan programs became aveilable on a computerized system
.�ne 15.These programs are ali state,edministered,but include both ctate and federal
funds.
The system wes set up because the Office of Local Government staff,in working with
locel officials,found that those eligible to apply for financial assistance were sometimes
unaware of what was available.
The 80 programs are grouped into 15 cetegories for easy reference.The categories are:
arts,business development,communications,community development,employment,
health end welfare,historic preservation,information systems,law enforcement,legal
servi�s,naturel resources,outdoor recreation,public safety and transportation.
Information is further categorized by eligible applicants. If,for example,the person
seeking information is from a city,the system will list all the grant artd loan programs
fo�which cities are eligible to apply.After reviewing the list,the inquirer can esk for
information about one or ell of the programs listed.
Descriptions include each pragram's purpose,selection criteria and other key factors
• the applicant should be aware of,the timetable for making application or disbursing
funds,amount of funding available for each fiscal year,and the name,eddress and phone
number of someone to contact for deteiled information.
The rystem�nteins programs for which both public and private sector entities may
apply.The list of eligible public sector epplicants includes units of povernment,state
agencies,American Indian reservetions and public oorporations.Eligible private s8ctor
organizations include nonprofit carporations,businesses and i�ividuals.

HOW TO AMEND A Re�ntly there has been some confusion regarding what local governments are�equired
COMPREHENSIVE PLAN to do prior to submitting amendments to their comprehensive plans to the Metropolitan
Council for review.These requirements are set forth in two state laws.
Under the Metropotiten Lanti Planning Act(Minn.Stat.,Ch.473),communities ere
required to send copies of proposed plan amendments to adjacent jurisdictions.Council
�view guidelines allow local governments to send amendments only to affected
communities,however.
Before submitting plan amendments for Council review,amandr�nts must be considered
by the community't governing body,Communities have two options.First,�e govern-
ing body mayapprove a plen amendment oontingent uponfavorable Metropolitan Council
review.Or sec;ond,it may consider an amertdment,but withhold final action until the
• � Metropoliten Council completes its review.Local govemmerns also must still comply with
the applicable planni�and zonir�enabling stetutes(for cities,Minn.Stet.,Ch.462.351,
eL seq.).
