P LANNING COMMISSION
May 9, 1983
A regular meeting of the Planning Comnission was held in the Council Chambers
of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota.
C hairman Thompson called the meeting to order at 7:00 P.M.
Those present were Comnissioners Polachek, Prazak, Singer, Thompson and
Tubman. Comnissioner Leppik was not present at the beginning of the meeting.

C hairman Thompson introduced this agenda item and recognized the proponents,
Mr. Steve Meyer and Mr. Henry Meyer, who were present. Chai rman Thorr�son
n oted the staff recommendation for a May 23, 1983 informal public hearing date.

c arried unanimously to set an informal public hearing date of May 23, 1983 for
c onsideration of the Conditional Use Permit application received from Mr.

McCombs-Knutson Associates, Inc. , who was present to represent the proponent,
Amoco 0i1 Company. Planning Comnissioners had no questions for staff.
C hairman Thompson opened the informal public hearing for public input. There
w as no one present who wished to speak to this agenda item, and Chairman
T hompson closed the public hearing.
It was moved by Comnissioner Polachek and seconded by Comnissioner Singer to
recommend City Council approval of the Preliminary Plat of "Standard Oil 3rd
A ddition", which proposes division of the Standard Oil site located at 900
M endelssohn Avenue North.
C hairman Thompson noted that staff will not place setting of a hearing date on
the City Council agenda until the City En gineer is satisfied with coordination
between Standard Oil and Northwestern Bell on storm drainage plans. Mr. Jerry
H auer reported that consulting engineers for both Standard Oil and Northwestern
B ell met the afternoon of May 9, 1983 with City Engineering staff and that a
� letter documenting coordination between Standard Oil and Northwestern Bell
w ould be delivered to the City Engineer.
A vote was taken and the motion carried unanimously.
IV. Informal Public Hearing - Conditional Use Permit

C hairman Thompson introduced this agenda item and recagnized Mr. Jerry Hauer,
who introduced himself as consulting engineer for the proponents and intro-
duced the proponents, Mr. Jim Johnson and Mr. Marvi n Johnson of Medi ci ne Lake
6 us Lines, who were present.
C hai rman Thomp son revi ewed for the record di scussi on i n the staff report of
the ten factors on which the Planning Comnission is required by Section
20.03 G. of the Conditional Uses Chapter of the City Zoning Ordinance to make
findings and recommendations to the City Council. Chairman Thompson conti�nued
with review of the six conditions of approval recommended in the staff report
a nd suggested addition of a condition ,requiring approval of the plat of
"Standard Oil 3rd Addition". Assistant Planner Alda Peikert confirmed that
approval of the Conditional Use Permit should not be granted prior to approval
of the final plat of "Standard Oil 3rd Addition", but suggested that the con-
dition not be listed as a continuing condition on the Conditional Use Permit.

• Comnissioner Tubman asked the reason for City acquisition of the 20 foot strip
of land separating the current Medicine Lake Bus Lines site from the proposed
b us storage yard. Di rector of Publ i c Work s Lowel l Odl and i nformed the
C ommission that the property was acquired for storm drainage purposes and that
a storm sewer pipe is located in the 20 foot strip of land. Mr. Odland added
that City Engineering staff is willing to recommend that the City Council
grant an easement over the City owned strip of land and that the request for
a n easement should go to the City Council at the time of the Conditional Use
P ermit hearing.
C hairman Thomp son called on representatives of the proponent, and Mr. Jerry
H auer stated that the proponent had nothing to add to the discussion.
C hairman Thompson opened the informal public hearing for public input. There
w as no one present who wished to speak to this agenda item, and Chairman
T hompson closed the public hearing.
C omnissioner Tubman stated that she feels the Planning Comnission should make
a definite recommendation for granting of the required access easement across
the City owned strip of land separating the current Medici�e Lake Bus Lines
f acility from the proposed bus storage site. Chairman Thompson directed that
the record reflect emphasis on the approval condition concerning negotiation
of an access easement from the City.
• C hairman Thompson asked the proponent what type of vines would be added to the
w est and east perimeter fences in response to the recommendation for addition
of vines for screening. Mr. Hauer stated that climbing vines would be planted
along the fence in the recommended locations. Mr. Hauer stated that the con-
sulting landscape architect for the proponent would be asked for a recomnen-
� dation as to variety of vine and that the selection would be submitted to the
C i ty Bui 1 di ng I nspector for approval.
I t was moved by Comni ssioner Tubman and seconded by Comni ssioner Prazak to
recommend conditional City Council approval of the Conditional Use Permit
requested by Medicine Lake Bus Lines for a bus storage yard located at 9125
lOth Avenue North in an Industrial Zoning District based on favorable findings
resulting from consideration of the ten factors stipulated in Section 20.03 G.
of the Conditional Uses Chapter of the City Zoning Ordinance. The motion
recommended approval subject to the following conditions:
1 . Conformance with the Site Plan Sheet No. 2 dated April 7, 1983
p repared by McCombs-Knutson Associates, Inc.
2 . Installation of landscaping in accordance with the Landscape�
Planting Plan Sheet No. 4 submitted by Roy A. Anderson, Wehrman
Consultants Associated; Inc. , on April 13, 1983, with the addi-
tion of vines on the eastern and western perimeter fences.

• 3. Provision of a landscape bond in the amount of $24,000 which
s hall run for two (2) full growing seasons and until released
by the Golden Valley Inspection Department. The bond shall be
executed and delivered to the Golden Valley Inspection
D epartment prior to initiation of the site work.
4 . Protection of all green areas ad,jacent to parking and access
areas by concrete curb.
5 . Negotiation of an easement from the City of Golden Valley for
access across Tract C of R.L.S. No. 1293.
6 . Failure to comply with one or more of the conditions of appro-
val shall be grounds for revocation of the Conditional Use
P ermi t.
T he motion further recommended that final City Council action to approve the
C onditional Use Permit not take place until after final plat approval of
"Standard Oil 3rd Addition". A vote was taken and the motion carried unani-
mously.
V . Revi ew of Ca pi tal I mp roveme nt P rogram
C hairman Thompson introduced this agenda item and recognized Director of
• Public Works Lowell Odland who was present to provide the Comnission with an
o verview of the Capital Improvement Program and to answer questions.
A t the request of the Comnission, Mr. Odland gave an explanation of the State
Aid Street Fund and then reviewed specific projects listed in the State Aid
S treet Fund portion of the Capital Improvement Program.
C orrnnnissioner Leppik arrived during Mr. Odland's presentation.
F ollowing discussion of the State Aid Street Fund, Mr. Odland answered
C omnissioner questions concerning park and community center projects.
C omnissioner Tubman expressed appreciation of Mr. Odland's overview as very
h elpful in understanding the Capital Improvement Program. Mr. Odland stated
that the Capital Imp rovement Program will be referred to the Planning
C o�nission again next year earlier in the process, possibly in November or
D ecember 1983. �
C hairman Thompson noted that Planning Comnission comnent to the City Council
is requested on the State Aid Street Fund portion of the Capital Improvement
P rogram. It was moved by Comnissioner Polachek, seconded by Comnissioner Singer
a nd carried unanimously to recommend that the City Council implement the five
y ear State Aid Street Fund plan included in the Capital Improvement Program for
the period 1983 through 1987 as proposed. Planning Comnissioners thanked Mr.

VI. Discussion of Accessory Apartments
C hai rman Thomp son i ntroduced thi s agenda i tem and reported that he met wi th
Planning and Redevelopment Coordinator Mike Miller to discuss the question of
accessory apartments. Chairman Thompson reported that as a result of his
, meeting with Mr. Miller, it was concluded that there is not a pressing need
f or a recommendation to the City Council on accessory apartments at this time.
C hai rman Thomp son sug gested that the P1 anni ng Cor�ni ssi on defer di scu ssi on of
accessory apartments.
C ommissioner Tubman stated that she does not oppose a short term deferral but
that based on experience in the community of Babylon, New York, she would
a dvise against deferring the question until after creation of illegal apart-
ments becomes a probl em. Comni ssi oner Tubman poi nted out that the cormiu ni ty
of Babylon delayed action until ten percent of the homes in the comnu nity had
c reated illegal apartments.
The Planning Comnission agreed on a deferral of one month to allow staff to
p repare information on the question of need for accessory apartments. Planning
C omnissioners requested information on the number of inquiries and complaint
c alls received by City Staff concerning accessory apartments and on the
accessory apartment situation in the ad,jacent communities of Minneapolis,
Robbinsdale, Crystal and New Hope.
• Comnissioner Leppik reported that the League of Women Voters recently initiated
a study af housing and discussed at their last Board meeting the possibility
of conducting a survey to determine the number of existing accessory apart-
m ents in the City and to assess public reaction to a proposal for accessory
apartments. Staff agreed to i nvesti gate the possi bi 1 i ty of Ci ty subsi dy of a
L eague survey similar to provision made for the Leagu e Tax and Service survey
c onducted in 1981.
` VII. Discussion of 1984 Operating Budget
C hairman Thompson introduced this agenda item and asked Planning Comnissioners
f or suggestions for the 1984 Operating Budget of the City. Comnissioners had
no suggestions for the Operating Budget. Chairman Thompson said that he would
send a response to the Cit�y Mayor stating that the Planning Commission has no
suggestions to make at this time.
VIII. Report on City Council Meeting - May 3, 1983
C omnissioner Leppik provided the Planning Commission with a report on the May 3,
1983 Ci ty Counci 1 meeti ng.

C o�nissioner Prazak, Ci�y representative to the Urban Hennepin County Comnunity
D evelopment Block Grant (CDBG) Planning Area Citizen Advisory Comnittee (PACAC)
f or Planning Area One, provided the Planning Comnission with a repgrt on the '
A pril 26, 1983 PACAC meeting. Co mnissioner Prazak reported that the PACAC
p repared comments on proposed CDBG Programs for each Planning Area One com-
munity and that the PACAC will be preparing guidelines for use of contingency
f unds at the next meeting.
X . Discussion of Comnissioner Information Meetings
C hairman Thompson reported that he received f rom the City Mayor a questionnaire
concerning information sessions for City Comnissioners. The questionnaire asks
f or preferences in topics and meeting times. Ch airman Thompson asked staff to
distribute copies of the questionnaire with the next Planning Comnission
a genda in order to give each Planning Comnissioner the opportunity to indicate
p references.
XI. Update on Valley Square Project
C hairman Thompson provided the Planning Comnission with an update on the
V alley Square Redevelopment Project.

SUBJECT: INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT - 8000 OLSON
. MEMORIAL HIGHWAY - CLASS II RESTAURANT IN A COMMERCIAL ZONING DISTRICT
The proponents, Mr. Steve Meyer and Mr. Henry Meyer, request a Conditional Use
Permit to allow establishment of a take out barbecue restaurant at 8000 Olson
Memorial Highway in the Golden Valley Shopping Center located northwest of the
intersection of Winnetka Avenue North with Highway 55• The take out barbecue
restaurant is proposed for a currently vacant space approximatety 530 square feet
in area located to the rear of the central mall within the Golden Valley Shopping
Center. Attached are a description of the proposed operation provided by the
proponents, a plan of the Shopping Center identifying the space proposed for the
take out restaurant and a proposed floor plan of the restaurant space.
The Golden Valley Shopping Center is in a Commercial Zoning District, in which a
take out or Class II restaurant is a Conditional Use. Section 20.03 G. of the
Conditional Uses Chapter of the City Zoning Code requires that the Planning
Commission make findings and recommendations to the City Council concerning ten
factors, not necessarily given equal weight. Review of the requested Conditional
• Use Permit with respect to each of the ten factors listed by Ordinance follows:
1 . Demonstrated need for the proposed use.
The proponents state that a quality barbecue product of the. type they propose
to sel ] is not available in Golden Valley. Their confidence in demand for the
product is such that they are willing to sign a two year lease for the proposed
space in the Golden Valley Shopping Center.. Although other take out and fast
food is available in the Valley Square Area surrounding Highway 55 and
Winnetka Avenue North, staff recognizes that the proposed barbecue take out
would add variety to the food service already existing in the area.
2. Consistency with the Comprehensive Plan of th� City.
The subject location is within the Valley Square Study Are.a designated on the
City of Golden Valley Comprehensive Land Use Plan. Th.e plan for the Valley
Square Redevelopment Area approved by the City Housing and Redevelopment
Authority (HRA) on September 30, 1g83 designates the area northwest of the
intersection of Hlghway 55 and Winnetka Avenue North as a consolidated
Commercial area. The use proposed under the subject Conditional Use Permit is
consistent with long term Commercial Land use and zoning.
3• Effect upon property values in the neighboring area.
The proposed take out barbecue restaurant use would not adversely affect
� property values in the surrounding area. The proposed operation may have
a positive effect on business of other tenants in the Golden Valley Shopp+ng
Center.

4. Effect of any anticipated traffic generation upon the current traffic flow
and congestion in the area.
Staff feels that parking in the Golden Ualley Shopping Center is adequate to
accommodate the proposed use and that the� relatively small scale of the proposed
take out restaurant operation will not measurably increase existing traffic
congestion at points of access to the Shopping Center.
An analysis of parking needs in existing shopping centers in the City of Golden
Valley conducted in April 1982 in conjunction with revision of the Commercial
Section of the City Zoning Code reveals that all three commercial shopping
centers in the City fail to meet the parking requirements stipulated by
Ordinance. The three shopping centers surveyed were the Golden Hills, Springgate
and Golden Valley Shopping Centers. Existing park'rng ratios based on retail
floor space were one space for every 220 square feet at Golden Hills, one space
for every 215 square feet at Golden Valley Shopping Center, and one space for
� every 16g square feet at Springgate. Although the Golden 1lalley Shopping
Center figured in the middle in terms of parking ratios, the study noted that
Golden Valley Shopping Center appears to have the least used parking lot of any
of the three shopping centers. Availability of parking is not a problem in
practice at Golden Valley Shopping Center.
� The traffic problem at Golden Valley Shopping Center is congestion at acess
points off of Winnetka Avenue North. However, the proposed barbecue take out
operation is relatively small scale and should not add appreciably to traffic
congestion caused by Shopping Center patrons. Projected numbers of customers
outlined in the narrative provided by theproponents are only ten to twelve per
hour during peak hours. Furthermore, the proponents anticipate that 70 percent
of their customers will be Shopping Center employees or patrons of oth.e.r businesses
within the Shopping Center. They estimate th.at only 30 percent of th.eir business
will consist of customers driving to the Shopping Center specif'ically for
their product.
Staff suggests that any approval be conditional on limitations on space�
number of employees and menu designed to maintain the small scale of the
operation as described in the proposal presented by t�e proponents.
The proponents request approval for delivery and catering service in addition
to take out service. Catering establishments are a permitted use in the �
Commercial Zoning District, and staff feels that the detivery would not add
to traffic congestion and should be allowable.
5• Effect of any increases in population and density upon surrounding land uses .
The proposed use adds no population.
6. Increase in noise levels to be caused by the proposed use.
� The proposed use would not increase noise levels.

7. Any odors, dust, smoke, gas , or vibration to be caused by the proposed use.
The proposed use would not cause odors, dust, smoke, gas or vibration.
8. Any increase in flies, rats, or other animals or vermin in the area to be
caused by the proposed use. °
The proposed use would not cause any increase in flies , rats, or other animals
or vermin in the area.
9. Visual appearance of any proposed structure or use.
The outward appearance of the Golden Valley Shopping Center will not be altered
in any way to ac�ommodate the proposed use. The proponents describe a ranch
style atmosphere for the take out waiting room planned at the front of their
proposed facility and possibly visible from the central mall area. In addition,
the proponents state that they will be responsible for any problems such as
littering. Staff suggests that any approval of the requested Conditional Use
Permit be. conditional upon absence of littering in the area caused by customers
of the establishment.
10. Any other effect upon the general public health, safety, and welfare of the
• City and its residents.
Staff does not anticipate that the proposed use will have any other effect
on the public health, safety or welfare.
Based on favorable findings with respect to the ten factors stipulated by Ordinance
for examiniation of Conditional Use Permit applications, staff suggests that the
Planning Commission recommend City Council approval of the request received from
Mr. Steve Meyer and Mr. Henry Meyer for a Conditional Use Permit to allow a take
out barbecue restaurant at 8000 Olson Memorial Highway in the Golden Valley Shopping
Center located in a Commercial Zoning District, subject to the following conditions :
l . There shall be no expansion of the operation beyond the space represented in
the original Conditional Use Permit application dated April 21 , 1983 and
included on the proposed floor plan dated March 31 , 1983 prepared by Nielsen
Sheet Metal , Inc.
2. No more than three employees shall be working on the premises at any one time.
3• The menu shall be limited to barbecued ribs, chicken and beef wi.th accompanying
meal items.
4. There shall be no littering in the area by customers of the operation.
5• Failure to comply with one or more of the conditions of approval shall be
. grounds for revocation of the Conditional Use Permit.

The proponents have been informed that the proposed take out �arhecue restaurant
is subject to applicable Building Code, Health Code and fire protection regulations
and that inspections by the City $uilding Inspector, Fire Marshal and Sanitarian
should be arranged. The proponents indicated that inspections will be requested
following Planning Commission action and prior to City Council consideration of the
requested Conditional Use Permit.

aoaaiodate 8-10 cusstaners.
It is our anticipatiar� that 70$ of our custcmers will derive fran tt�e
Golde� Valley Shopping Center "Those shopping and F3nployees". R9�ey
will onne to us fran the o�thier stores in the area as they shop, w�e
feel that aur st�ore will bring busi.ness to their stores also.
Because we are located in the back of the mall, those that know of
us will c�ne off t1�ee sidewalks and dc�an the mall, those that will
oot�e by aut�atiobile will be the other 30$ of our busirbess and will
park in spaoes available in the frca�t parking lot. We feel tl�at
parking will be no p�obl�n for the 4-6 cars per hour exoepts for
Swx3ay there will be approxin�ately 15-20 apen spaoes for them to park
as ootutted by our feasability persoa� 4 co�nsecutive days in April.
