A regular meeting of the Ptar!ning Commission was held in the Council Chambers
of the Civic Center, 7800 Golden Valley Road, Golden Valley, MN. Chairman
Thompson called the meeting to order at 7:00 p.m.
Those present were Commissioners: Eastes, Polachek, Singer and Thompson.
Commissioners Forster, Leppik and Moede were not present.
Also present were Mike Miller, Director of Planning and Redevelopment, and
Alda Peikert, Assistant Planner.
I . Approval of Minutes - December 14, 1981
It was moved by Commissioner Polachek, seconded by Commissioner Singer and carried
unanimously to approve the minutes of the December 14, 1981 Planning Commission
meeting as recorded.
I1 .. Informal Public Hearing - Conditional Use Permit
APPLICANT: Reinertson � Associates, Inc.

REQUEST: Approval of a Conditional Use Permit allowing a
5-story office building plus 23 feet additional

Zone District.
Chairman Thompson recatled for the Commission that the proponent, Mr. Mark
Reinertson, requested a change in his application at the tii�ie the Planning Com-
mission set a hearing date at the previous meeting. Chairman Thompson informed
the Commission that Mr. Reinertson had not provided the City Planning and Redevel-
opment Department with a complete revised application and the Planning Commission
could neither hold a hearing nor set a new hearing date on this item. Therefore,
the Chairman was obliged to pass over this agenda item.

Chairman Thompson introduced this agenda item and asked whether there were any
questions of staff. The Commissioners had no questions for staff. The Chairman
recognized Mr. Leo Martin, Executive Leasing Corporation, who was present to
represent the proponent.
Chairman Thompson opened the informal public hearing. There was no one present
who wished to speak on this agenda item, and the public hearing was closed.
In response to an invitation from the Chairman, Mr. Martin stated that he had
nothing to add.
Chairman Thompson revlewed the staff report including items specified by Ordinance
for consideration and the staff recommendation for conditional approval .
It was moved by Commissioner Singer, seconded by Commissioner Eastes and carried
unanimously to recommend City Council approval of the Conditional Use Permit
requested by Executive Leasing Corporation to all�ow operation of a gasotine service
station at 6980 Wayzata Boulevard in the Industrial Zoning District subject to
the following conditions:
1 . The car wash facility shall not be open to the general public. Violation of
this condition shall be grounds for revocation of the Conditional Use Permit.
• 2. Vehicle parking on-site shall be restricted to those areas designated for
parking on the site plan only. Violation of this condition shall be grounds
for revocation of the Conditional Use Permit.
IV. Informal Public Hearing. - Conditional Use Permit
APPLICANT: Executive Leasing Corporation
LOCATION: 6980 Wayzata Boulevard
REQUEST: Approval of a Conditional Use Permit to operate a
"U-Haul" truck and trailer rental service within an
Industrial Zone District.
Chairman Thompson introduced this agenda item and asked whether there were any
questions of staff. Planning Commissioners had no questions for staff at that time.
Chairman Thompson opened the informal public hearing. There was no one present
who wished to speak on this agenda item, andthe public hearing was closed.
The proponent, Mr. Leo Martin of Executive Leasing Corporation, stated that he
had nothing to add, and Planning Commissioners had no questions for the proponent.

At this point Commissioner Eastes directed a question to staff concerning
enforcement of the condition of approval recommended in the staff report stating
that rental trucks and trailers should not be parked in the off street parking
area required by City Ordinance. Planning and Redevelopment Director Mike Miller
explained that both he and City Inspection Department staff have occasion to
drive by and check the subject site often enough to notice should a parking
problem develop and that stipulation of this condition in the conditional use
permit would afford the City added leverage to correct any parking problem which
might develop at this site in the future.
Commissioner Eastes further questioned whether the off street parking require-
ment stipulated by the City Zoning Ordinance could not be enforced based on the
Ordinance without addition of a condltion in the conditional use permit approval .
Mr. Miller replied that the condition is not technically necessary for enforce-
ment of the off street parking requirement, but that further stipulation as a
condition of the permit approval serves to inform the proponent and to reinforce
the requirement in ordinance form, as City Council action on conditional use
permits is passed as ordinance.
It was moved by Commissioner Eastes, seconded by Commissioner Polachek and carried
unanimously to recommend City Council approval of the request by Executive
• Leasing Corporation for a conditional use permit to rent "U-Haul" trucks and
trailers at 6g80 Wayzata Boulevard in the Industrial Zoning District subject to
the following conditions:
l . The operators of said business understand and agree not to park any rental
trucks and/or trailers within any parking area needed for required off
street parking as noted by the City Zoning Ordinance in accordance with the
approved site plan.
2. Alt vehicles and equipment used for rental purposes must be stored elsewhere
on the site and properly screened from view.
V. Informal Public Hearing - Conditional Use Permit
APPLICANT: Jim Lupient Oldsmobile Company
LOCATION: 7000 Wayzata Boulevard
REQUEST: Approval of a Condittonal Use Permit to operate a car
rental business within an Industrial Zone District.
Chairman Thompson introduced this agenda item and noted revisions to the recommend-
ation in the staff report, including clarification of the first and sixth recom-
mended conditions of approval and addition of a seventh condition of approval .

represent the proponent.
Chairman Thompson opened the informal public hearing. There was no one present
who wished to speak on this agenda item, and the public hearing was closed.
It was moved by Commissioner Eastes, seconded by Commissioner Polachek and carried
unanimously to recommend approval of the conditional use permit requested by °
Jim Lupient Oldsmobile Company for a car rental business and for an automobile
servicing and repair operation .accessory to Jim Lupient Oldsmobile Company sales
and rental located at 7000 Wayzata Boulevard subject to the following conditions:
l . Restriction of automobile servicing and repair, including diesel pump repair,
to the Jim Lupient Oldsmobile Company sales , service and rental business.
2. Board of Zoning Appeals (BZA) approval of a waiver of the 20 foot west side
yard bu.ilding setback requirement and of the 10 foot landscaped west side
yard parking setback requirement.
3. Landscaping to the specifications of the Building Board of Review of the
35 foot front yard area on the three sides of the site facing streets.
• 4. Removal of gasoline pumps and underground fuel storage tanks in accordance
with City Tank Removal Guidelines promulgated by the City Fire Marshall and
City Building Inspector, except for one pump island which may be retained for
Jim Lupient sales and rental car use.
5• Use of permanent exterior buildtng materials on the two sides of the building
addition facing public streets unless use of inetat exterior is approved by the
Building Board of Review. �
6. Limitation of the number of cars parked to the south and east of the building
to 11 as indicated on the site plan and limitation of the number of cars parked
to the north of the building to the number reasonably spaced outside of the
35 foot minimum setbacks from the streets on the east and north, to be delineated
on plans submitted for approval of the Building Board of Review prior to
issuance of a building permit for the proposed addition.
7. Violation of any of the above conditions shall be grounds for revocation of
the conditional use permit.
VI . Report on HRA Meeting - December 15, 1981
Prior to presenting his report on the December 15, 1981 HRA meeting, Commissioner
Singer requested a change in the proposed schedule for Planning Commissioner
representation to City Council meetings in 1982. Commissioner Polachek agreed to
• attend the March 16, 1982 City Council meeting, and Commissioner Singer will attend
the February 16, 1982 meeting.

Commissioner Singer provided Planning Commissioners with a report on the
December 15, 1981 HRA meeting, covering extension of the closing date on Calvary
Community Services property, a request from the HRA Cheir for a timetable for
the Valley Square Redevelopment Project, a report on the informational meeting
with the South Wirth Neighborhood Committee, and settlement of .the Ewald property
purchase.
V11 . Report on City Council Meeting - December 15, 19a1
Commissioner Forster was absent, and it was necessary to postpone his report on
the December 15, 1981 City Council meeting until the next Ptanning Commission
meeting.
However, in conjunction with the report on the Council meeting, Chairman Thompson
asked Planning and Redevelopment Director Mike Miller to explain the reasons for
an upcoming PUD application for the North Wirth Redevelopment Project. Mr. Miller
explained that an application for PUD General Plan of Development approval ,
without the Concept approval step, would be coming before the Planning Commission
and that the North Wirth Parkway Redevelopment Project should have been presented
to the Planning Commission as a PUD from the beginning.
� VIII . Schedule of Planning Commission Representatives to City Council and
HRA Meetings
Chairman Thompson called attention to the proposed schedules of Planning Commission
representatives to City Council and HRA meetings for the months of January
through March 1982 and asked whether there were any problems with the schedules
in addition to the change requested earlier by Commissioner Singer. Planning
Commissioners had no other problems with the proposed schedules. Planning and
Redevelopment Director Mike Miller informed the Commissioners that schedules for
the remainder of 1982 would be prepared following City Council reappointment and/
or appointment of Planning Commissioners scheduled for the end of March 1982•
The meeting was adjourned at 7:45 p.m.

SUBJECT: SET DATE FOR INFORMAL PUBLIC HEARING P.U.D. #33
M.A. Mortenson Company, developer and general contractor of the North
Wirth Parkway Redevelopment Project, has made application for General
Plan Approval without Concept Plan Approval of a Planned Unit Development
(P.U.D.) consisting of three office buildings and a parking structure
known as North Wirth Parkway. The site is located within the Northeast
quadrant of the intersection of Meadow Lane and T.H. 55 �Olson Memorial
Highway) .
The proponent is requesting an informal public hearing be set for
Monday, January 25, 1982. I would recommend that the Ptanning Commission
set January 25, 1982 as the date for an informal public hearing on this
matter.

SUBJECT:- PRELIMINARY PLAT OF "TEACHER ADDITION"
BACKGROUND AND ANALYSIS
Taco Bell , Westmont, Illinois, is proposing to subdivide 1 .76 acres of land located
at 24�80 Winnetka Avenue North. The Preliminary Plat of "Teacher Addition" would
create two commercial lots. Lot 1 would contain 30,060 square feet and would be
developed by Taco Bell for a drive-in restaurant, and Lot 2 would contain 38,410
square feet and is currently the site of the Town Crier Restaurant. The property
- in question is zoned Commercial , as is the property adjacent to the �dorth. The
property lying immediatety East and South of the proposed subdivision is zoned
Light � lndustrial , and the property located along the West side of Winnetka Avenue
North is zoned Residential and Business and Professional Office.
At the present time, the Town Crier Restaurant utilizes the entire 1 .76 acre site
for its building and required parking area. If the preliminary plat of "Teacher
Addition" is approved and two separate lots are created and developed as proposed,
it would create two nonconforming uses under our existing City Zoning Ordinance
• as well as the City Platting Ordinance. While the existing and proposed land
uses are permitted within a Commercial Zoning Dist�ict, such uses must comply
with all applicable zoning standards or otherwise obtain necessary variances from
the Board of Zoning Appeals (BZA) . In this situatton the nonconformities that
would be created would include lack of minimum required off-street parking for
both restaurants and lack of minimum required side yard setback along the common
lot 11ne between Lot 1 and Lot 2 (see proposed plat) . In addition, the preliminary
plat proposes to use a single common driveway as a means of ingress and egress
from Winnetka Avenue North with the common tot ltne between Lot 1 and Lot 2
dividing that driveway entrance.
The proponent has proposed utitizing the land located between the East property
line and Rhode Island Avenue North to provide for necessary off-street parking fo�
both restaurants. However, while the owner of that parcel , Custom Tool , Inc. ,
has provided a letter expressing an interest in selling the property to the pro-
� ponent, the proponent has not provided City Staff with any documentation that they
have in fact acquired a proprietary interest in said property. If this were
the case, then that property should also be included in the proposed subdivision.
Hennepin County Department of Transportation has reviewed the proposed subdivision
(see attached letter) and has requested that the subddvider dedicate an additional
seven (7) feet of right-of-way along Winnetka Avenue (CSAH 156) . This would
require a possible adjustment in setbacks from Winnetka Avenue. Hennepin County
has also pointed out that "any change in land use which increases traffic generataon
requires an approved Hennepin County entrance permit before beginning any construction".
Inasmuch as the development of a drive-in restaurant would constitute a change in
• land use that would increase traffic generation, such a permit would be necessary.
An important factor here is that the intended land use for Lot 1 , includes a
"drive-thru" lane for Taco Bell proposed to exit onto Winnetka Avenue, which has
the potential for a severe increase in traffic generation that would most certainly
have an adverse impact on Winnetka Avenue if approved.

Therefore, in addition to the questionable suitability of both the existing and
proposed� land uses on parcels of land obviously too small to adequately
. accommodate said uses, there is also the question of increased traffic generation
and congestion that has not been addressed by the proponent.
RECOMMENDATION
In view of the aforementioned land use and/or zoning discrepancies and potential
nonconformities, I would suggest that the Planning Commission recommend that the
City Council deny approval of the preliminary plat of "Teacher Addition". To
recommend approvat of this preliminary plat would be contrary to the spirit and
intent of both the City Platting Ordinance and the City Zoning Ordinance, not
to mention the fact that approval of said plat would in no way benefit the Community.
In addltion, reviewing both the proposed plat and site plan cl�arly indicates
that approval of the plat would not be a good land use decision.

Minnesota Statutes 505.02 and 505.03, Plats and Surveys, require County review
of proposed plats abutting County roads. We reviewed the above plat and fowld
• it acceptable with consideration of these conditions:
-For future improvements to CSAH 156 (tiVinnetka Ave) the developer should dedicate
an add.itiona.l 7 feet of right of way making the right of way 40 feet from the
. center of CSAH 156.
-No additional direct access to CSAH 156 (Winnetka Ave) . All access must be via
the existing driveway to CSAH 156 or Rhode Island Avenue to the east.
