Chai.rman Tha�son inkroduced this agen�da item and reeo�iized Mr. Gerye
Sylvestre, oonsultant to the HLanan Rights Co�.ssion, who was present to
represent the H�snan Rigfits Cbmmission. Chairman Thcnps� asked Mr.
Sylvestre to explain the question ar�d a,nswer format used in the Managemerzt
P lan.
Assistant Planner Alda Peikert informed the Planning Comnissi� that the
Manag�nent Plan was received frcrn the project developer, Bor-Son Investsnerit
P roperties Corporation, in the question and az�swer forniat. Ms. Peikert
iritroduced Mr. Gen.y Kimrier of R�alty Managemenk Senrioes, the firm which
will manage the project ar�d which is responsible for the Management Plan,
and suggested that he would be able to explain the format. Mr. Kinmer
O stated tha#. the format of the Medley Park Management Plan is a standard
format which Realty Managemenk Servioes has used far o�kher projeck
Manag�nent Plans ar�d which covers standard questioa�s stipulated by the
Mirmesota Housing Finance Agency ([�IFA) and HUD Area Office.
Mr. S�lvestse passed o�ut to Planning Comnissioners a listing of basic ele-
ments of a Managemerit Plan comp i 1 ed at the t-.ir�e of revie�a of the Managemerit
P lan for the Dover Hill Project ar�d used by the HLUnan Ric,�ts Comnissi� in
e xamining the content of t.1� Medley Park Manag�rent Plan.
Comnissioner Leppik asked Mr. Kimner a series of questioa�s regarding the
Medley Park Manag�rnerYt Plan. �mmissioner Leppik's first questicn oon-
cerned a statemenk on pp. 8-9 of the Managemenk Plan that prospective rerr
ters would nak be sha�an the actual apartment to be rented until the tin�e
the lease is to be sigr�ed. Mr. Ki�ner explained tha+_ the discussion per-
tai.ns to rental units under crnstruetion ar�d nak available for shaaing to
prospective renters. Mr. Ki�rnr provided assurance that if the actual unit
should nat measure up to expections, the prospeckive renter would have the
right of refusal of a specific unit ar�d would 'be under no o�ligati� to
sign the lease.
Conmissioner Leppik's second question referred to paymerik of late fees
charged on delinquerrk rent payments oovered on p.15 of the Medley Park
Managemerit Plan. Conrnissioner Lepik questioned whe�ther such fees wauld not

� be a hardship for laa ar�d moderate irbocsne p�x�sons in subsidized uni.ts. Mr.
Kiimier stated that the maragement wr�uld give oonsiderati� to the cir-

Conmissioner Leppik referred to the iten► on parking availability in the
April 15, 1982 meimrandwin reeording a meeting of the H�nan Ric�ts
Coirmission Housing Conmittee with representatives of Bor-Son and Realty
Management Sexvices ar�d suggested need for a c,�-eater number of Y�eater pluy
.ir�s. Qomnissioner Forster, fonner me�nber of the Board of Zoning A�eals
(BZA) , informed the Gomni.ssion tl�at garage and heater plug in requirements
were established by the BZA.
Comnissioner Leppik pointed aut s�veral correckions to P,ddenchun #1 of the
Medley Park Managsnent Plan, including oorrect reference to tr►e Golc3en
Valley Human Rights (3�mmission arr3 �orrection of the Golden Valley Civic
Ceriter address in t� instances. Mr. Ki�ner stated that these oorreckions
would be made to P,ddendi�t #1.
Commissioner Leppik naked that a mu«ber of the questic�s raised in the
Medley Park Managemenk Plan are simply answered i.n the affirmative and
directed attenta.on specifically to such a question � p. 20 asking whether
the lease would be fair and nazpunitive. Qo�ssioner Leppik asked who
determines whether the lease is fair and nonpunitive. Mr. Kirrmer replied
#.hat the lease to be used is orfe approved b� HIJD for Secti� 8 use.

While the Planning Conmi.ssion was waiting for a cx�py of the Calvary Projeck
Manag�ent Plan, Plan�;ng ar� Redevelopment Cbordinator Mike Miller took
the o�ortunity to natify N1r. Kimrer that the April 15, 1982 mennrandum rn
the meeting of the H�unan Rights Qo�ni.ssion Housing CoMnittee with Mr.
Kimner and Betty Kaelke of BQ�Son eoaztains an err�eous statement oor�
c erning provisions for washers arid dryers. �e merrorandum states that
there will be hook ups for washers ar�d clzyers in each rental unit but that
these apliances will nok be pravided with the units. Mr. Miller notified
Mr. Ki�ner arx3 stated that he would separately rx�t.ify Bor-Son that the PUD
Permit for the projeck, scheduled for referral to the City Council on July
20, 1982, will nat c�o to the City O�uncil unta.l such t�me as Bor-Son
assures the City that they intend to go along with their ori�inal agreerrer�
to provide v�rashers arY3 dryers for eveYy unit within the Secki� 8 porkian
of the Medley Park ZbFantnus�s Projeck.
Planning Comnissioners ca�ared the format of the Calvaxy Projeck
Manag�enk Plan with tY�at of the Medley Park Management Plan and faurr3 that
the two plans caver th� same topics in the same order, but that the Calvary

DATE: JULY 21 , 1982
The developers of four twin homes located at the southeast corner of
23rd Avenue and Winnetka Avenue North would now like to convert their
development to a P.U.D. to enable them to sell each dwelling unit as
a single-family dwelling on a zero lot line basis. The developers are
requesting that a date be set for an informal public hearing on their
proposed Preliminary Design Plan.
1 would recommend that the Planning Commission consider the date of
August 9, 1982 for an inforrnal public hearing on P.U.D. #36.

SUBJECT: P.U.D. #37 - BRAPJDON TERRACE TOWNHOUSES
Please be advised that the informal public hearing scheduled by the Planning
Commission for Monday, July 26, 1982 to consider the Preliminary Design Plan for
P.U.D. #37 has been canceled in accordance with Section 15.07 (2) of the P.U.D.
Ordinance which states:
"Each application for a PUD permit must contain all data required
by this section and, until it does, it will not be eligible for
consideration by the Plenning Department, the Planning Commission
or any other commission, committee or body of the City."
More specifically, the proponent to date has not provided the Planning Department
with the specified number of copies of the Preliminary Design Plan. The proponent
has not, to date, provided signed statements from those adjacent property owners
whose property would be included in construction (grading) of the P.U.D. site
acknowledging that they are aware of what would occur and that they have no
objection to the use of their property.
• I would also request that the Planning Commission consider re-setting the date for
an informal public hearing to consider the Preliminary Design Plan for P.U.D. �37.
The date suggested would be �londay, August 9, 1982, provided that the proponent
submits all required plans, data, and documents to the Planning Department no later
than 4:30 p.m. Tuesday, July 27, 1982.

SUBJECT: INFORMAL PUBLIC HEARING - AMENDl1ENT TO PUD #1-B, COLONIAL ACRES
(COVENANT MANOR)
Covenant Manor, a senior citizen residential building located at 5�00 St. Croix Avenue,
requests approval of the Preliminary Design Plan for an amendment to PUD #t-B,
Colonial Acres, to allow addition of a nine stall garage structure in place of
11 open parking spaces.
Existing parking space for Covenant Manor consists of 33 garage spaces, of which
31 are available for resident use and two house the Covenant Manor bus and other
facility equipment, along with 50 open parking spaces, of which 17 are provided
with outlets for heaters, for a total of 83 parking spaces. The existing parking
provisions exceed parking stipulated by the Golden Valley Board of Zoning Appeals
(BZA) in a waiver granted May 9, 1978. The parking variance reduced parking require-
ments to 22 covered garage spaces and 45 open parking spaces for a total of 67
spaces. The reduction in total number of parking spaces proposed in the amendment,
resulting from replacement of 11 open spaces with 9 garage spaces, is from 83 to 81
spaces, still substantially more than the 67 parking spaces required under the waiver.
• The proposed additional garage structure will match the three existing garage
buildings which house 11 , 13 and 9 cars respectively. The proposed front setback
of the new garage structure from the right of way of St. Croix Avenue is 28 feet,
7 feet less than the 35 foot front setback required in all zoning districts, but in
direct line with the 28 foot setback of the end wall of the nine unit garage structure
already existing along the eastern perimeter of the site.
Staff recommends favorable consideration of the proposed PUD amendment to allow
addition of a fourth garage structure at Covenant Manor based on the fact that
addition of garage space in place of open parking constitutes a convenience to
residents and a desirable amenity which enhances the residence, based upon conformance
with parking requirements stipulated in the parking waiver for the development, and
based upon continuity of the proposed structure with the desi,gn and setback of existing
garage structures constructed under the original PUD approval . Staff suggests that
the Planning Commission recommend City Council approval of the Pretiminary Design
Plan for an amendment to PUD #1=6, Colonial Acres, which proposes addition of a
nine stall garage building in place of open parking space at Covenant Manor, a
senior citizen residential building located 5800 St. Croix Avenue.

Dear Mr. Miller,
In the 5 years which have e7apsed since we first began the process of
developing senior adult living units, Covenant Manor has become a reality,
housing 131 senior adults. The building and its well landscaped grounds
have attractively enhanced the neighborhood. During construction it
O became apparent that many people desired covered parking, and we modified
the original plans to include a total of 31 covered spaces. Now after a
very difficult winter, several people on the waiting list who have open
spaces, have asked us to construct additional garage space. Through the
generosity of a resident, we are able to proceed with such space at this
time.
Essentially this request is to cover nine spaces which are now open spaces.
The building will be identical to the existing ones. Should you have
questions or wish to visit the site, I'll be happy to be available.
