Planning Commission
February 23, 1981
A regular meeting of the Planning Commission was held in the Council Chambers
of the Civic Center, 7800 Golden" Valley Road, Golden Valley, Minnesota.
Chairperson Eastes called the meeting to order at 7�30 p.m.
Those present were Commissioners : Eastes , Forster, Hughes , Thompson, Polachek,
Sehlin and Moede.
Commissioner Specktor was absent.
Also present were Michael Miller, Director of Planning and Redevelopment and
Martin Farrell , Assistant City Planner.
I . Approval of Minutes - February 9, 1981 •
It was moved by Forster, seconded by Thompson and carried unanimously to
approve the minutes, as amended, of the February 9, 1981 Planning Commission
Meeting.
II . Set Date for Informal Public Hearing for Concept Approval - P.U.D. 30A
� APPLICANT: Henry Hyatt
y LOCATION: Hillsboro Avenue and Mendelssohn Avenue North

REQUEST: Concept Approval for a 29 unit Townhouse
Development (Section 8 Housing)
Mike Miller distributed a copy of the letter written by Mayor Thorsen, to
the Planni.ng Commission regarding the City Council 's consideration of concept
approval for P.U.D. 30. When the Golden Valley City Council reviewed this
' proponent 's original request for Concept Approval , the Council expressed the
following concerns :
(1) Density - the Council would like to use staff's recommendation
of seven (7) units per acre as a beginning guideline, but would
be open to variations.
(2) Mix - subsidized versus market rate explored, using the housing
policy as a guide for 50 to 60 percent subsidized.
Henry Hyatt, 1324 Mount Curve Avenue, Minneapolis, represented the proponent.
Mr. Hyatt began by requesting the Planning Commission visit similar develop-
ments that his firm, Housing Technical Assistance Corporation, has developed
throughout the Metropolitan area.
Chairperson Eastes again addressed the letter from Mayor Thorsen and asked
� Mr. Hyatt if it would be possible to meet the recommended 50 to 60 percent
of subsidized units that is suggested in the City of Golden Vatley's Housing
Policy.

Commissioner Moede then stated that she felt that the Planning Commission
has a definite obligation to the City's adopted Housing Policy.
Mr. Hyatt stated that this figure is not realistic unless the City of Golden
Valley is willing to allocate a great deal of Community Development Block
Grant money toward his project. Commissioner Thompson then requested that
Mr. Hyatt document in writing why a partially subsidized project of 50 to 60
percent would not be feasible.
Mr. Hyatt stated that he would provide this information to Mr. Miller as
soon as possible.
Commissioner Thompson then questioned why Mr. Hyatt had not met the density
suggested by the City Council at seven (7) units per acre.
_ Mr. Hyatt then stated that his revised site plan would provide nine (9) units
per acre.
It was then moved by Commissioner Thompson, seconded by Commissioner Moede,
and carried unanimously to deny an informal public hearing �on the grounds
that the proposal is two (2) units per acre over the guidelines of seven (7)
• units per acre as established by the City Council and is in direct opposition
to the Housing Policy guidelines of 51 to 60 percent subsidized units.
III . Set Date for Informal Public Hearing - Rezoning
APPLICANT: Vanman Construction Company
LOCATION: 9201 Plymouth Avenue
REQUEST: Change Zoning from Multiple Dwelling to Industrial
Mike Miller stated that the site was originally zoned Industrial and rezoned
to Multiple Dwelling at a time when the site was being considered as a
scattered site housing development. He then suggested that the Planning
Commission set March 23, 1981 as the date for the informal public hearing.
Jack Hotmes, 830 Baum Road, Elk River, represented the proponent, and agreed
to March 23, 19�1 as being a reasonable date for the informal public hearing.
It was then moved by Commissioner Sehlin, seconded by Polachek, and carried
unanimously that the Planning Commission set March 23, 1981 as the date for
the informal public hearing for this rezoning.
IV. Review and Discussion of Proposed Amendments to the Planning Commission
Bylaws.
t It was moved by Commissioner Forster, seconded by Sehlin and carried unanimously
to approve the Planning Commission By-Laws as they were amended.

V. Review of Recommendation to Cit Council re arding the Duties of the
Planning Commission.
It was moved by Thompson, seconded by Sehlin and carried unanimously to
amend the Motion with duties of the Planning Commission to read as follows :
e. Advise and make recommendations relative to housing, new develop-
ment , and redevelopment projects proposed by the HRA prior to the
final commitment of such projects by the HRA. This charge shall
also relate to such responsibilities as :
l . Make recommendations to the City Council and/or HRA on the
use of Federal and State Funds received for housing and
community development.
� _ VI . Review of Recommendation to City Council regarding the Amendments to
Ordinance No.
It was moved by Thompson, seconded by Polachek and carried unanimously to
amend Ordinance No. 488 to read as follows :
• "Section 170:05. Planning Commission. There is hereby created a
Golden Valley Planning Commission consisting of seven (7) members ,
the duties of which commission shall be not as individual members ,
but as a body, to advise, recommend, and assist the Council in
matters relating to planning and growth of the City. This shall
include matters relating to the social , economic and physical
environment."
VII . Report on City Council Meeting - February 17, 1981 .
Dave Thompson and Mona Moede represented the Planning Commission. Commissioner
Thompson stated that the City Council recommended that the Building Code
Revision be referred back to the Planning Commission for further review.
Chairperson Eastes requested that the Building Code Revision be placed on
the next Planning Commission agenda so that the proposed floor requirements
can be reviewed.
VIII . Report on HRA Meeting - February 10, 1981 .
Commissioner Thompson represented the Planning Commission and briefed the
Commission on the HRA meeting.
IX. Discussion on Attendance of Planning Commission Members at American
Planning Association National Conference, Boston, April 25-29, 19 1 •
Mike Miller briefed the Commission on the APA National Conference schedule.

recommend that the City Council consider approving the attendance and
funding of three Planning Commissioners and the Director of Ptanning and
Redevelopment at the American Planning Association 's National Conference in
Boston, Massachusetts, April 25 - 29, 1981 •

place the review and discussion of the P.U.D. Ordinance (with the changes
hightighted) on the March 9, 1981 Planning Commission meeting agenda.
XI . Report on Progress af Valley Square Commission - Dave Thompson
Dave Thompson explained the status of the Valley Square Consultant's report
that is being written by the Galpin-Poppleton Corporation. He then went
�` over the consultant's preliminary land use recommendations for part of the
Valley Square Redevelopm�nt Area.
It was moved by Forster, seconded by Moede and carried unanimously that
the Planning Commission (through the Chairperson) recognize in writing the
dedicated ten years of service to the Planning Commission that Commissioner
� Hughes has contributed.
Chairperson Eastes stated that she would draft a letter thanking Commissioner
Hughes for his contribution to the Ptanning Commission.
Commissioner Moede asked Chairperson Eastes to abolish the formation of
the Planning Commission nominating committee and that the Commissioners be
allowed to make recommendations for nomination directly from the floor.
Chairperson Eastes concurred and said she would handle the matter as suggested.
The meeting was adjoured at 10:00 p.m.

of "Teacher Addition"
Taco Bell of Westmont, Illinois is requesting that a date be set
for an informal public hearing to consider their proposed plat of
"Teacher Addition", located at 2480 Winnetka Avenue North. The
site in question is a subdivision of the property on which the Town
Crier Restaurant is located. The plat would contain two lots, one
of which would be used for a Taco Bell Restaurant.
I would suggest either March 23, 1981 , or April 13, 1981 as possible
dates for an informal public hearing.

The pubiic hearing to be conducted on March 9, 1981 will be the official
public hearing on the Comprehensive Plan. The Planning Commission is
conducting this hearing on behalf of the City Council . Since the
Planning Commission is the author of this document and has worked closely
�, with each of its elements , the City Council feels that the Commission
is best equipped to explain the Comprehensive Plan to the public and
to answer questions relating to the plan.
I would suggest that each Planning Commission member carefulty read
this document and be prepared to answer questions from the public.
• There has been quite a bit of interest expressed by the public in the
new Comprehensive Plan.

RE: Community Communications
� The entire City Council has become concerned about the communication process
between the City and its citizens and has appointed a subcommittee consisting

of Councilmembers Johnson and Stockman to prepare recommendations on ways of
improving communications. Basically, communications between the City and its
residents fall into three areas. First, informing them of pending actions;
second, seeking their input regarding contemplated actions by the City; and
finally, informing them of actions taken by the City.
In the past, we have used mailings, bulletins, the Post Newspaper, etc. to
try tosatisfy these three communication needs. What we as a subcommittee
would like from you would be any suggestions you might have as to the ways
to best satisfy these three communication needs. We would like to get your
suggestions back to us by the end of January. After we have received all
the comments, we will prepare a recommendation to the City Council and you
will be informed of any action taken by the Council on this matter. Thank
you for your cooperation.

SUBJECT: Referral from City Council regarding "Zero Lot Line"
Subdivision Regulations
At their February 17, 1981 City Council meeting, the Council reviewed
a request from Burnet Realty to consider amending the City's Subdivision
Plattin°g Regulations to allow "zero lot line" subdivisions. The City
Council in turn referred the matter to the Planning Commission for
recommendation, and has also requested that the recommendation be
submitted by April 21 , 1981 .
The issue at hand centers on properties that have been developed with
double bungalows. At the present time, these properties cannot be
subdivided, and sold as individual dwellings and lots because one side
lot line would split the dwelling and not provide for a minimum 15 foot
side lot line as required by the City 7_oning Ordinance. The Subdivision
Platting Regulations require plats to meet the minimum zoning requirements.
• Therefore, the concept of "zero lot line" subdivision is presently
precluded from the City Subdivision Platting Regulations.

Within the past year, there have been a number of inquiries from owners
of double bungalows requesting permission to provide for a "zero lot
line" subdivision that would then allow them to sell one, or both
dwelling units with accompanying property. In almost all of such cases
encountered by Staff, the reason for such subdivisions are purely
economic.
The immediate question before the Planning Commission is whether or not -
the City of Golden Valley desires to amend its subdivision ordinance
to allow "zero lot line"' subdivisions to occur. I am presently
researching this matter in more detail , and I hope to have more information
to present on March 9, 1981 •

SUBJECT: Referral by City Council to Planning Commission for Recommend-
ation on Possible Changes to Section 400:15 (City Building
Code) Dealing with Floor Area Requirements
The City Council is currently considering ordinance changes to the
City Building Code. At their February 17 meeting, the City Council
referred Section 400:15 Floor Area Requirements to the Planning
Commission for recommendation as to possible changes. The Planning
Commission is asked to review this Section and recommend whether the
- � requirement should be dropped altogether, or modified upwards or downwards
in any fashion. Councilperson Mary Anderson has requested time to address
the Planning Commission on this issue. Attached for your review is a
copy of Section 400:15 of the City Code.
I will make more specific recommendations when the Planning Commission
� addresses this issue.

SUBJECT: Revisions to P.U.D. Ordinance
Enclosed you will find a copy of the revised P.U.D. Ordinance for
your review and comment. The changes made in this draft are high-
lighted in yellow. If you have any questions, feel free to contact
me. Considering the fact that the meeting March 9th may run quite
late due to the public hearing on the Comprehensive Plan, I would
suggest that the Planning Commission consider completing its review
and recommendation on the P.U.D. Ordinance at the next meeting on
March 23, 1981 •
