Chair- man Thompson called the meeting to order at 7:30 p.m. - Those present were Commissioners: Eastes, Leppik, Moede, Polachek, Singer and Thompson. Commissioner Forster was absent. Also present were Michael Miller, Director of Planning and Redevelopment, Alda Peikert, Assistant P]anner, and Dixie Peterson, Secretary. I. Approval of Minutes - March 23, 1981 • It was moved by Eastes, seconded by Moede, and carried unanimously to approve the minutes of the March 23, 1981 Planning Commission Meeting. II . Introduction of Alda Peikert, P1annPng Assistant, to the Ptanning Commission. Mike Mi11er introduced Alda Peikert as the new Planning Assistant. • I11 . Informal Pubtic Hearing - Preliminary Plat. APPLICANT: Taco Bell , Westmont, IL LOCATION: 2480 Winnetka Avenue North REQUEST: Approval of Preliminary Plat of "Teacher Addition" Mike Miller presented the staff report, and recommended denial of the Preliminary Plat due to land use discrepancies and potential non�conformities to the zoning code. John Lindstrom, Regional Construction Manager with Taco Bell , represented the proponent and addressed the Planning Commission. After seVeral questions from the Planning Commission, the hearing was opened to the public. Jean Hall , 2337 Winnetka, stated her concerns about the number of fast food restaurants already in the area, the garish decors, the cooking smells generated, and the traffic which is created, as well as the noise. A1 Hollenbeck, 2409 Winnetka, agreed with Mrs. Hall , and stated that he has talked with his neighbors and they also object to the noise, lights, and odors, � particularly the incinerators burning plastic in the surraner tfine. The hearing was then closed to the public and Mr. Lindstrom addressed the concerns raised by the two residents. Informal Public Hearing - General Plan P.U.D. 26-A APPLIC�NT: Calvary Community Services, Inc. LOCATION: 7600 Golden Valley Road REQUEST: Approval of General Development Plans for P.U.D. 26-A Calvary Square Apartments (Phase I !) Mike Miller briefly cover�d the staff report and recommended approvat . Clyde McCarty, President, Calvary Community Services, represented the proponent and addressed the Planning Commission. He addressed the concern for fire safety and stated that all apartments and all floors in both buildings will be sprinklered. Jay Johnson, represented the architectural firm for the proponent and addressed the Planning Cor�nission. The hearing was then opened to the public. There being no one present from the • audience who wished to address the issue, the hearfng was then closed to the public. Commissioner Eastes suggested tabling the motion until a traffic study has been done and stated her concerns for the density and heavy land use and the amount of traffic to be generated by this project. � Chairman Thompson stated that the HRA has approved a traffic study for the Valley Square Area which includes the Calvary Community Services project. Mike Miller said staff would be studying the rough draft of this traffic study �n tfte morning in detatl , fiut from w�at fie has seen, the pro�a6ilities of traffic increase in tfiis area is not significant. It was then moved by Moede, seconded by Polachek, to approve the General Development Plans for P.U.D. 26-A Catvary Square Apartmenfs tPhase I1) subject to incorporating the suggestions of the Public Safety Department Fire Marshall , and the City inspection Department, as follows: 1 . Kitchen area on second floor - hood protection. Fire Marshall will accept mist type sprinkler heads. 2. A'll exterior security doors must open on activation of the Fire Alarm System. 3. Fire extinguishers - type, size and distribution with cabinets shall be as recortanended by the Fire Marshalt . The Fire Marshall • will also assist with special types and placement. 4. Illumination of ineans of egress shalt conform to Life Safety Code 11-3•2•9. 1 , Section 5-8. 5• Emergency ligbting - Life Safety Code 11-3.2.10.1 , Section 5-9• . And, as suggested by the Inspection Department, carbon monoxide detectors should be installed in the garage area of the building. A vote was taken and the following Eommissioners voted Yes: Moede, Polachek, Singer and Thompson. Commissioners Eastes and Leppik voted No. Motion carried. V. Referral to Planning Commission from City Council of Request for Special Use Permit. APPLICANT: 5th Northwestern Bank (Banco) LOCATION: 650 Douglas Drive North REQUEST: Special Use Permit for a bank in an Industrial Zone District. Mike Miller presented a brief staff report to the Commission. Marilyn Hayes, 5th Northwestern Bank, represented the proponent, and addressed questions. • Ron Erickson, representing the architectural firm for the proponent, also - addressed the Commission. , Wally Kruse, Banco, also addressed the commission. It was then moved by Moede, seconded by Eastes, and carried unanimously, . to recort�end approval of a Special Use Permit for a bank in an Industrial Zone District. VI . Review and Discussion of Section 400:15 "Floor Area Requirements" City Building Code. Mike Miller presented a brief staff report. It was moved by Singer, seconded by Eastes, and unanimously approved to recommend that the Section 400. 15 "Floor Area Requirements" be deleted from the Building Code. VII. Review and Discussion of Merits of Introducin� "Zero Lot Line" Subdivision Procedures into City Platting Ordinance. Mike Miller presented. a brief staff report. Mary W�fnziorl owner of the duplexes on 23rd Avenue North and Winnetka, addressed the Planning Commission and stated that they have had requests from • some of the renters to have an option to buy, and for this reason were approaching the City. VIII . Subcommittee Reports on Review of Proposed Comprehensive Plan. A. Housing Subcommittee - Mona Moede Commissioner Moede covered the recommended changes in the Housing Section of the Comprehensive Plan as suggested by the Subcommittee. After considerable discussion, and additional changes by the Planning Commission members, it was the consensus of the Planning Commission to accept the changes that were made and refer the Housing Section to the City Council . B. Transportation Subcommittee - Bill Forster In Commissioner Forster's absence, Mike Miller reported that he and Commissioner Forster had discussed having a meeting with the City Engineering regarding the Transportation Plan. It was agreed that Commissioners Eastes, Leppik, and Thompson, along with Mike • Miller, would rr�et with the City Engineer, Lowell Odland, soon. IX. Report on City Council Meeting - April 7, 1981 . Commissioner Thompson reported on the City Council meeting of April 7, 1981 • X. Work Session on Proposed Zoning Ordinance Revisions A. Residential (Single-Family) B. R-2 Residential (Two-Family) C. Multi-Dwelling (Multi-Family) Each of the three zoning ordinance revisions were discussed and additional changes were suggested by the Planning Commission. It was moved by Polachek, seconded by Singer, and carried unanimously to approve the changes and refer the proposed zoning ordinance revisions to the City Council. XI. Distribution of Additional Zoning Ordinance Revisions: A. Industrtal Zone District B. Radio Zone District C. Meeting adJourned at 11 :20 p.m. � Respectfully submitted, ompson, a rman Mona Moede, Secretary e � April 21 , 1981 T0: Golden Valley Planning Commission FROM: Mike Miller, Planning � Redevelopment Coordinato.r SUBJECT: Appearance by Steven Wells, representing the King's Valley Homeowner's Association Steven Wells, a King's Valley resident, and a representative of the King's Valley Homeowner's Association, has requested time to appear before the Ptanning Commission to discuss the scheduling of the Informal Public Hearing for P.U.D. 30-A. On March 23, 1981 , the Planning Corrm�ission scheduled an Informal Public Hearing for Monday, May 11 , 1981 , to consider Concept Plan approval for a proposed partially subsidized townhouse development. This development is being represented by Henry Hyatt of Technical Assistance Corporation for Housing (TACH) on behalf of Bor-Son Construction Companies. Mr. Wells will be requesting that the Planning Corianission reschedule the Informal Public Hearing on this matter until June. This request is predicated on the fact that residents in the King's Valley area were unaware that any new or modified proposals had been proposed for the • 3.22 acre site immediatety north of King's Valley. Mr. Wells has further pointed out that the Homeowner's Association has not had sufficient time to examine the latest proposal and how it might impact the King's Valley P.U.D. In addition, Mr. Wells has informed me that he must be out of town on May 11 , 1981 , and inasmuch as he is the appointed spokesman for the Homeowner's Association on this subject, he feels that holding the hearing at a time when he would be unable to attend would create an unfair hardship on him and on members of the King's Valley Homeowners Association. It has also been poinfied out by Mr. Wells that tMe semi-annual Homeowner's Association meeting will be held in King's Valley on May 7, 1981 , affording the entire community the opportunity to become informed about the proposal and have an opportunity to discuss its impact on King`s Valley. �n order that all partJes con,cerned were aware of the pending request by Mr. Wells, both Mr. Henry Hyatt ard Donald A. Jacobson, Director of Development for Bor-Son Construction Companies were notified of Mr. Wells scheduled appearance, and the nature of his concern. Attached you will find a copy of a letter from Mr. Jacobson addressing the proponent's concerns regarding a rescheduling of the Informal Public Hearing. The Planning Cortonission might take interest in knowing that should they decide to reschedule the Informal Public HearZng, the Commission would not be setting a precedent. April 21 , 1981 reschedule hearings to allow the public and immedlate neighborhood the opportunity to have input, and be present. The entire purpose of the Informal Public Hearing is to provide both the proponent and the neigh- borhood that might be impacted to completely air the pros and cons of the issue at hand. To deny this opportunity to any parties involved would be a denial of due process as provided for in every zoning ordinance, regardless of whether a P.U.D. is involved. in conclusion, the allegation that any State or Federal agency .might be upset if the Planning CommPssion, or City Council , does not take swift action on any matter such as this is relatively immaterial . State and Federal agencies do not have the authority to dictate policy in matters such as this. The Planning Commission always has been, and hopefulty always will be concerned with their responsibilities to the Community as ,- a whole, as well as the rights of the individual . It is unfortunate that the spokesperson for the Ring's Valley Homeowner's Association can not be present on the May 11 date set by the Commission iu their March meeting. This additional delay would 3eopardize the funding for our pro3ect with the State Agency. I suggest that a special presentation be made at the Ring.'s Valley • development to acquaint residents with the preliminary plans. This ' would permit the group to give more thought to the concept and file informa.tion with the Coa�ission in advance of the hearing. This seems to be a more preferable arrangemeat and we certainly have no objection to this special effort. Please advise me if this is acceptable with the Chairman, protem, Mona Moede. The subject property is described as Lot 3, Block 2, Miller's Meadow, and presently consists of 62,151 square feet in land area. The property in question is located on the south side of 23rd Avenue North at the westerly terminus of that street where it would enter the Ktng's Valley P.U.D. King's Valley is a multi-family res�dential townhouse development forming the westerly boundary of Mr. Reinke's property. The property lying east and south of Mr. Reinke's property is zoned Residential and is utilized for single-family residential . development. Medley Park, a City owned and operated recreational facility is located along the north side of 23rd Avenue North� and is r zoned. lnstitutional . As shown on the attached subdivision map, Mr. Reinke's single-family dwelling is presently located on the westerly portion of his lot. If the waiver (Lot Division) should be approved, Mr. Reinke would retain . his existing two-story dwelling on Parcel A (31 ,452 square feet in area) and be.able to meet all minimum setback requirements of the City Zoning Ordinance. Parcel 6 (30,699 square feet in area) more than meets the minimum zoning standards for a single family. lot (100 feet in width and 12,500 square feet in area) . Parcel B would also meet the minimum standards for a double bungalow lot with the exception of lot width. A double bungalow lot must be at least 150 feet wide and at least 18,750 square feet in area. RECOMMENDATION: In view of the fact that all minimum zontng standards can be. met, and � that there appears to be no adverse impact on adjacent land uses, I would suggest that the Planning Commission make a favorable recommendation to the City Council on this reguest. Jopp BACKGROUND � ANALYSIS: Wayne R. Jopp, 1500 Rhode Island Avenue North, is requesting a waiver of the City Platting Ordinance to allow a lot division splitting one residential lot with a double bungalow into two lots, each lot having one-half of the double bungalow unit located thereon. The subject property is located at 1435 and 1437 Princeton Avenue South; adjacent _ to the T.H. 12--T.H. 100 interchange. Access to the subject property is via Princeton Avenue South which terminates at the southwest corner of the property (see attached Area Map) . The northwesterly propery 11ne borders the east bound on-ramp conne�ting T.H. 100 with T.H. 12. The remaining adjacent property is � all zaned and used for residential use in the South Tyrol area. The attached lot division survey shows a number of difficulties in dealing with this type of lot division. Obviously, s_ince this division involves a zero lot line situation on one side, this request is somewhat unique, but not .difficult to deat with. The more serious difficulties with this proposed lot division are outlined as follows: 1. Neither bf the two proposed lots meet with the minimum zoning requirements for single-family lots (100 feet in width and 12,500 square feet in area) ; 2. Access to. the dwetling unit located on Parcel 1 is by easement across Parcel 2, and therefore has no direct access to a public street; 3. There is a considerable amount of undeveloped land lying north of the dwelling unit located on Parcel 1 . Will there be a request for further waivers to allow construction of � another dwelling unit and another lot division on Parcel 1? 4. The purpose of this request is not to sell either parcel of property or dwelling unit, but to retain both units as rental property and simply allow the present owner/proponent to have the properties �eparated and to have separate tax statements • provided for each parcel . Should this lot division be approved, the proponent would still have to appear before the Board of Zoning Appeals to request a zoning variance from the side lot line setbacks for each parcet , plus variances from � Page 2 Memo to Golden Valley Planning Commission � RE: Request for Waiver of Platting Ordinance - Wayne R. RECOMMENDATION: While �taff has no specific pre,judice against a zero lot line subdivision, there are so many inconsistencies in this particular case that it would be impossible for Staff to make a favorable recommendation. Approval of this request would create too many nonconformities that blatantly violate the spirit and intent of both the Platting Ordinance and the Zoning Ordinance. Therefore, 1 strongly suggest that the Planning Corrmission recommend that the City Council deny this request for waiver of the Platting Ordinance.
