Planning Commission
April 27, 1981
A regular meeting of the Planning Commission was held in the Council
Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley,
Minnesota. Acting Chair, Mona Moede called the meeting to order at
5:05 p.m.
Those present were Commissioners: Eastes, Leppik, Moede and Singer.
Commissioners Polachek, Thompson and Forster were absent as they were
attending the Arr�rican Planning Association National Conference in
Boston, along with Mike Miller, Director of Planning and Redevelopment.
Atso present were Alda Peikert, Assistant Planner, and Joan Thompson,
Secretary.
I . Approval of Minutes - April 13, 1981 .
It was moved by Eastes, seconded by Leppik, and carried, to approve the
minutes of the April 13, 1981 Planning Commission meeting.
il . A�pearance by Steven Wells, representing the Kings Valley Home
� Owners Association.
REQUEST: To delay informal public hearing scheduled
for May 11 , 1981 until June, 1g81 .
Mr. Steven Wells, 2228 Kings Valley Road East, represented Kings Valley
Homeowner's Association, and requested a delay in the informal public
hearing date regarding P.U.D. 30-A, in order to compile information on
recent changes in this project, and inform the other residents of Kings
Valley of the revised proposal .
Mr. Donald A. Jacobson, Director of Development, Bor-Son Construction ,
was present to represent the proponent, and to oppose the hearing date
change, and expressed his frustration with the many delays already imposed
upon this project. He also presented letters docurr�nting that the Minnesota
Housing Finance Agency (M.H.F.A.) would expect some kind of progress, to
insure fund availability, after Bor-Son's past requests for extensions.
Commissioner Eastes questioned Mr. Jacobson regarding the extension of
funding commitment.
Mr. Jacobson responded by saying that Bor-Son Construction needs to justify
the length of extensions, or show some progress with the City of Golden
Valley.
� It was moved by Eastes, seconded by Singer, and carried to delay the
public hearing on P.U.D. 30-A until June 8, to provide the neighborhood
time to research the project. Also, it was agreed to send a letter to
M.H.F.A. advising them of Golden Valley's interest in developing the
property.

It was moved by Singer, seconded by Eastes, and carried to recommend

SUBJECT: Preliminary Plat of Hamman First Addition
BACKGROUND � ANALYSIS:
Harry W. Hamman, 6001 Glenwood Avenue, is requesting approval of a
preliminary plat to be known as Hamman First Addition. This sub-
division is a replat of Lot 8, Block 2, Hamman Addition originatly
platted in 1980 by Richard Neslund. This parcel , which is approx-
imately 2.27 acres in area was left as one large lot to accommodate
Mr. Hamman whose home is located on that parcel . At this time, Mr.
Hamman wishes to resubdivide this parcel into three single family
lots, with two developable lots fronting on Glenwood Avenue. The
third, and largest tot which would remain, would be retained as Mr.
Hamman's homesite. The land to be subdivided and all adjacent land
is zoned Single Family Residential . Existing land use on all developed
• property adjacent to the proposed plat is all single family dwellings.
The land along the east, west, and south boundaries of the proposed
plat is presently undeveloped, but is intended for development of
single famity detached dwellings.
Sanitary sewer is existing on King Hill Road and Glenwood Avenue.
Services for Lots 1 , 2 and 3 of the proposed plat would be provided
from Glenwood Avenue. There is an existing watermain on King Hilt
Road and Glenwood Avenue. Again, the proposed subdivision would be
serviced from Glenwood Avenue. King Hill Road is presently under
construction. The bituminous base for this street �ill be in place
in 1981 , with concrete curb and gutter to be installed in 1982 or
1983• There is an existing culvert under ICing Hill Road that drains
the low area west of the road to the east. This drainage must be
maintained until the area west of the road is filled.
RECOMMENDATION:
The City Platting Ordinance requires that each new subdivision (plat)
grant to the City ten percent of the land area to be platted, or cash
in lieu thereof, for park and/or open space purposes. Inasmuch as the
original plat of Hamman Addition provided such a land donation, I would
recorranend that Mr. Hamman not be required to make any additional donations
of land or money. I would also suggest that the Planning Commission
recommend that the City Council approve the preliminary plat of Hamman
� First Addition.

SUBJECT: Request from Kathy Gray for Zoning Ordinance Amendment to Allow
Home Occupations
The Golden Valley City Council , at their regular Council meeting held
April 22, 1981 , referred to the Planning Commission for comment and
recommendation a request from Kathy Gray for amendment of the residential
section of the zoning ordinance to allow operation of a business out of
a residence.
Mr. and Mrs. Gray, as explained in Mrs. Gray's attached letter, wish to
move into a home located in a residential district in the northeastern
portion of Golden Valley and plan to conduct their business out of that
home. The business involves production of hand painted glass window
ornaments, presumably by the Grays in their own home, as well as by
55 other persons on contract to produce the product in their individual
homes. Traffic generated by the business would consist of trips by
contract workers to pick up and deliver their work and a daily stop by
• a UPS truck.
The residential section of the Golden Valley Zoning Ordinance makes no
provision for home occupations. The Grays request an amendment to the
Zoning Ordinance providing for home occupations as a conditional use in
residential districts.
Communities which make provision for home occupations typically allow
for them as conditional or special uses with most or all of the following
restrictions:
1 . The business use must be clearly secondary or incidental to primary
use of the house as a residential dwelling.
2. The business must be carried on within the house, not in an
accessory building. such as a garage.
3. There may be no exterior evidence of business use such as addition
of a separate entrance, outside storage of materials , or signs.
4. No rrrore than a specified percentage of the house, such as 20 percent
of the total floor area or 25 percent of any one level , may be
occupied by the business.
5• Only family members living in the house may be involved in the business;
no outside persons may be employed.
• 6. The business must be of a service nature; there may be no manufacture
of a product.

7. There may be no retail sale of a product.
8. No equipment may be used other than that normally found within
a home.
9. The business may not create disturbances such as noise or vibration,
odor or fumes, glare, or radio or television interference detectable
from adjacent or neighboring properties.
10. The business must not result in generation of additional traffic
or parking requirements.
The home occupation proposed by the Grays does not appear to meet the
traditional home occupation specifications listed above. .
Kathy Gray submitted for City Council consideration a set of less
restrictive home occupation guidelines proposed by the City of Maplewood
Planning Commission, a copy of which is attached. These guidelines
suggest that the traditional home occupation be allowed as a permitted
use and that home occupations involving outside employees, customer visits
and manufacture of products be reviewed as special uses.
Staff feels that it is both inappropriate and not in the best interests of
• Golden Valley residents as a whole to consider a zoning amendment which
could alter the character of Golden Valley's residential neighborhoods
based on the request of one potential Golden Valley resident. Traditional
Golden Valley policy has been protective of residential neighborhoods,
and staff is unaware of any past initiatives on the part of Golden Valley
residents to make provision for the operation of businesses in residential
neighborhoods.
If in the future a representative number of Golden Valley residents should
request a provision allowing home occupations, staff would suggest
consideration of home occupations as conditional uses with all the traditional
restrictions listed above. Staff feels that a less restrictive home
occupation provision would not be appropriate to Golden Valley under any
circumstances.
Staff suggests the Planning Commission recommend the City Council take
no action to amend the residential section of the Zoning Ordinance to
provide for home occupations.
Alternatives available to the Grays are to locate their business in an
appropriate zoning district separate from their home, or to move to a
community which allows horr� occupations of the type they propose.

RE: Request by Kathy Gray for Business in Home
Kathy Gray discussed her desire to operate a business out of a residential
home with Mike Miller. Mike advised her that under the current zontng code
the only way that a business could be operated at 1917 Xerxes Avenue North,
would be to rezone the property to a business use from residential .
M�s. Gray requested that the business use be allowed under a conditional use.
She was informed that neither the current nor the proposed conditional use
sections would permit businesses in residential areas. Her recourse would be

Residential Zoning Code - Kathy Gray
Mrs. Kathy Gray presented a proposal for a change in the present residential zoning
code. expressing her desire to have a business in her home. It was her feeling that
the City should allow a special use permit for certain businesses in the home, and
sited other citles who do allow such a permit.

occupation. It is also felt that while certain occupations require' the issuance of a
special use •permit, other activities such as those that do not have ar�y of the following
should be allowed without a permit: •
, 1 . Employment of any person not residing in the dwelling unit
2. Customers visiting the premises �
3. Manufacture of products on the premises.
The Planning Commission proposes the following guidelines for a Home Occupation:
Home Occupation requiring a permit is defined as that occupation conducted in a
dwelling unit involving the manufacture and/or sale of a product or service, subject
to the following limitations:
1 . Is conducted on a continuing basis, that is, for more than 30 days out of the
year.
2. Not more than one person other than members of the family residing on the
premises shall be allowed to engage in such occupation. .
3. The use of the premises for the home occupation shall be clearly incidental and
subordinate to its use for residential purposes by its occupants, and no more
than an area equivalent to 20X of the dwelling unit floor area shall be used in
the conduct of the home occupation.
4. There shall be no change in the outside appearance of the building or premises,
� or other visible evidence of the conduct of such home occupation other than
one sign, not exceeding twQ square feet in area, non-illuminated, and mounted
flat against the wall of the principal building.
5. There shall be no retail sales of products produced off site in connection
with such home occupation.
6. No traffic shall be generated by such home occupation in greater volumes than
would normally be expected in a residential neighborhood, and the need for off-
street parking shall not exceed more than three off-street parking spaces for
the home occupation at any given time in addition to the parking spaces required
by the resident occupants; in no event shall such number of off-street parking
spaces exceed a total of five such spaces for the premises and shall be off
of the street other than in a required front yard.
7. No equipment or process shall be used in such home occupation which creates
noise, vibration, glare, fumes, odors, or electrical interference detectable
- to the normal senses off the lot, if the occupation is conducted in a single
family residence, or outside the dwelling unit if conducted in other than a
single family residence. In the case of electrical interference, no equip-_
�nt or process shall be used which �creates visual or audible interference in
any radio or television receivers off the premises, or causes fluctuations in
line voltage off the premises.
8. No fire, safety, or health hazard shall exist for the residents of the dwelling
� unit, customers, or employee.

The Planning Commission has had the draft copies of revisions to
the Industrial , Radio, and Railroad Zone Districts since April .
Hopefully, each Commissioner has had time to carefully review the
proposed revisions and take note of any questions or changes that they
might have. If possible, the Planning Commission should try to
complete their review on May 11 and send this portion of the Zoning
Ordinance on to the City Council .
