� June 8, 19$1
A regular meeting of the Planning Commission was held in the Council Chambers
of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota.
Chairman Thompson called the meeting to order at 7:30 p.m.
Those present were Commissioners: Forster, Leppik, Moede, Polachek, Singer
and Thompson.
Commissioner Eastes was absent.
Also present were Michael Miller, Director of Planning and Redevelopment,
and Alda Peikert, Assistant Planner.
I . Approval of Minutes - May 11 , 1981 _
It was moved by Moede, seconded by Polachek, and carried unanimously to approve
the minutes of the May 11 , 1981 Planning Commission Meeting.
II . Set Date for Informal Public Hearing - P.U.D. 31 ,
Fifty-Five-One Hundred Office Park

Chairman Thompson called on Planning and Redevelopment Director Mike Miller
to present the staff report. Mr. Miller suggested that the Planning Commission
set an informal public hearing date of June 22, 1981 for this item.
It was moved by Moede, seconded by Polachek and carried unanimously to set
an informal public hearing date of June 22, 1981 for the conditional use permit
requested by Reinartson and Associates.

V. Request for Waiver of the Platting Ordinance

REQUEST: Divide one Industrial Lot into two
Industrial lots.
Chairman Thompson noted that the staff recommendation was for favorable action
on this item and then calted on Planning and Redevelopment Director Mike
Miller to further explain the staff recommendation. Mr. Miller stated that

the proposed land division was satisfactory to all parties involved.
It was moved by Moede, seconded by Polachek and carried unanimously to
recommend approval of the request for waiver of the ptatting ordinance
submitted by Mr. J.V. Beal and Mr. W.M. Horner.
� Vi . Reyuest for Waiver of the Platting Ordinance
APPLICANT: West Suburban Builders, Inc.
LOCATION: 6435 Medicine Lake Road
REQUEST: Divide one Residential lot into two Residential
lots.
Planning and Redevelopment Director Mike Miller explained the site location
map illustrating the proposed lot division and the relationship of the new
parcel to adjoining parcels already owned by the buyer.
Chairman Thompson called on the property owner, Mr. William Haldy, who
referred questions to the buyer, Mr. Earl Wilson. Mr. Wilson answered
questions concerning his plans for use of the new parcel in conjunction
with adjoining lands in his ownership.
It was moved by Polachek, seconded by Leppik and carried unanimously to
recommend approval of the request from West Suburban Builders, Inc. , for
a waiver of the platting ordinance to divide one residential lot into
two residential lots.

Industrial lots.
Planning and Redevelopment Director Mike Miller presented the staff report
and confirmed that the proposed lot division conforms to requirements of
both the current and the proposed Radio District sections of the City
Zoning Ordinance.
Chairman Thompson called on the proponent, Mr. Jean Poole, General Manager,
Minnesota Communications, Golden Valley, to present his p.roposal . Mr. Poole
described the structures proposed for construction on the site and answered
questions from Commissioners regarding the proposed tower and impact on
neighboring residential development.
Mr. Miller answered questions from Cammissioners concerning precedent for
waiving park dedication requirements and concerning possible impacts on
natural areas. '
It was moved by Forster, seconded by Singer and carried unanimously to
recommend approval of a waiver of the platting ordinance for Minnesota
Communications subject to rezoning of the parcel from Industrial to Radio
District.
� It was moved by Polachek, seconded by Leppik and carried unanimously to
recommend approval of a waiver of park dedication requirements contained
in Section 440:80(2) of the City Ptatting Ordinance.
The Chairman and staff informed Mr. Poole tbat his request for a waiver of
the platting ordinance would be heard by the City Council at its next meeting
and that he could apply for the required rezoning at any time.
VIII . Request for Waiver of the Platting Ordinance
APPLICANT: Pietig Brothers, Inc.
LOCATION: 2551-2553 Douglas Drive
REQUEST: Divide one Double Bungalow into two
Residential lots.
Chairman Thompson requested that Planning and Redevelopment Director Mike
Miller expand on his recommendation presented in the staff report. Mr.
Miller pointed out that this was the first zero lot line division request
to be considered by the Planning Commission, that this particular proposal
presented a number of problems and that he would have preferred to deal with
an initial proposal involving fewer problems.
The Chairman called on the proponent, Mr. Mark Pietig, who explained that
• the reason for the request was to facilitate sale of the double bungalow
on the site by allowing separate sale of the individual units.

� It was moved by Singer, seconded by Forster and carried unanimously to
recommend approval of a waiver of the platting ordinance to allow
division of the double bungalow site into two residential lots, with the
condition that the proponent will be required to appeal �o the Board of
Zoning Appealsfor variances from side lot setback, minimum lot width
and minimum lot area requirements.
(X. Informal Pubtic Hearin - P.U.D. 30-A, Medley Park Townhouses
APPLICANT: Bor-Son Construction Co.
LOCATION: 7600 Mendelssohn Avenue North
REQUEST: Concept Approval for 29 unit partially subsidized
townhouse development.
Chairman Thompson reviewed the letter received from the proponent requesting
a continuance of the informal public hearing on PUD 30-A to June 22, 1981
to allow submittal of plan amendments.
The Chairman then called on Planning and Redevelopment Director Mike Miller
to brief the Commission on a new proposal received from Bor-Son Construction
Company. Mr. Miller informed the Commission that he had received a complete
new application for concept approval of a larger PUD combining the site of
the previous proposal with adjacent property. The new proposal will be known
as PUD 30-B. Mr. Miller then answered questions from the Commissioners regarding
� procedure for handling of two concurrent proposals involving the same site.
Chairman Thompson called on Mr. Don Jacobson, Director of Development, Bor-Son
Construction Co. , who explained the rationale for combining the two parcels
into one PUD and also expressed wiliingness to work with the. Kings Valley
Homeowners Association to assist in their review of the new PUD proposal.
Mr. Stephen Wells, 2228 Kings Valley Road East, representing the Kings
Valley Homeowners Association, requested that the Planning Commission schedule
the informal publit hearing on the new proposal , PUD 30-B, for July in order
to allow the Kings Valley Homeowners Association time to review the new plan.
It was moved by Moede, seconded by Forster and carried unanimously to set
the date for the informal public hearing on PUD 30-B for July 13, 1981 .
It was moved by Moede, seconded by Singer and carried unanimously to continue
the informal public hearing on PUD 30-A to July 27, 1981 •
Mr. Jacobson requested that the Planning Commission action be conveyed to
the Minnesota Housing Finance Agency, and Mr. Milter agreed to comply with
this request.
At the request of the Commission, Mr. Jacobson agreed to make available to
the Kings Valley Homeowners Association copies of all plans at the same
time that the plans are submitted to the City Planning and Redevelopment

• X. Work Session - Land Use Element of Comprehensive Plan
Planning and Redevelopment Director Mike Miller presented to the Commission
a revised version of the Land Use Plan map for inclusion in the Land Use
element of the Comprehensive Plan. The Planning Commission reviewed and
amended both the revised map and the revised text of the Land Use element.
It was moved by Moede, seconded by Leppik and carried unanimausly to approve the
revised Land Use Plan map and revised text of the Land llse element of the
Comprehensive Plan as amended.
XI . Work Session - Revisions to Zoninc� Ordinance
A. 4ight Industrial Zone District
B. Radio Zone District
C. Railroad Zone District
The concensus of the Planning Cammission was that the revised Light Industrial
and Radio Zone District sections of the City Zoning Ordinance were acceptable
as presented.
� It was moved by Polachek, seconded by Singer and approved unanimously to
recommend approval of the revised Light Industrial Zone District section of
� the City Zoning Ordinance.
It was moved by Forster, seconded by Moede and approved unanimously to recommend
approval of the revised Radio Zone District section of the City Zoning
Ordinance.
Following brief discussion questioning the necessity for a separate Railroad Zone
District, it was moved by Forster, seconded by Polachek and unanimously approved
to recommend deletion of the Railroad Zone District from the City Zoning Ordinance
and inclusion of the Railroad District uses in the Industrial Zone District
section of the Ordinance scheduled for revision in the near future.

AVENUE NORTH
The City of Golden Valley is requesting approval of a lot division
which would involve an exchange of Institutionally zoned land between
the City of Golden Valley and the Hennepin County Library. The
purpose of this exchange/division is to provide the necessary right-
of-way for the Tenth Avenue extension between Rhode island Avenue
and Winnetka. This lot division involves parts of Lot 31 , 32 and 33a
Auditor's Subdivision No 360. The attached map shows the properties
involved in the lot division.
Inasmuch as there would be no adverse effect or significant change in
land use, I would recommend that the Planning Commission give favorable
consideration to this request. It should be noted that this exchange/
division is necessary for the Tenth Avenue extension.

TENTH AVENUE AND WINNETKA
The City of Golden Valley is requesting approval of a lot division in
which the Chicago Northwestern Railroad is providing right-of-way
for the extension of Tenth Avenue between Rhode Island Avenue and
Winnetka. The property involved is shown on the attached map.
Inasmuch as this lot division is necessary to complete the Tenth
Avenue extension, and due to the fact that such a division would not
have any significant effect on the adjacent land uses, I would recom-
mend that the Planning Commission give favorable consideration to this
request.

SUBJECT: INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT
5800 DULUTH STREET
The proponent, R�-i:r�fi��-tm and Associates, requests approval of a conditional
use permit to allow construction of an office building exceeding
three stories in height at 5800 Duluth Street, located in the Business
and Professional Office Building Zone District. Section 10.091A of
the recently adopted revised Business and Professianal Offices Zoning
District Section of the City Zoning Ordinance allows buildings and
structures exceeding three stories in height as conditional uses.
The proposed building is a f.our story medical office building, the first
story of which will be entirely parking. In addition, a three level
. parking ramp is proposed adjacent to the building on the east.
The building height was previously approved as a waiver by the Board
. of Zoning Appeals (BZA) under provisions of the previous Business and
Professional Office Building Section of the Zoning Code. The BZA,
on February 12, 1980, granted Reinertson and Associates waivers of
height, parking, setback, yard, and maximum lot coverage restrictions
in the previous Zoning Ordinance, conditional upon Reinertson granting
the City a trail easement along Bassett Creek across the wes.t side of
the property. The waivers lapsed when Reinertson and Associates failed
to execute the easement document and proceed with construction within
a one year period after granting of the waivers.
Reinertson and Associates returned to the BZA on May 12, 1981 , and
was granted wa.i�vers of setback, yard and maximum lot coverage require-
ments contained in the revised Business and Professional Office Building
Zoning District Section of the City Zoning Ordinance. Although plans
for the proposed building have not been altered, due to the inter-
vening ordinance revisions, the setback and lot coverage waivers differ
from previous waivers and the parking waiver is no tonger necessary.
As already noted, the four story building height now requires a
conditional use permit rather than a waiver.

The waivers granted by the BZA on May 12, 1981 , were again conditional
on provision of the trail easement along Bassett Creek as approved
by the City Park and Recreation Director and the Open Space and
Recreation Commission. Reinertson and Associates has subsequently
executed an easement document granting a 50 foot easement along
Bassett Creek across the west side of the property, which will provide
access to the City property along Bassett Creek to the north of the site.
Surrounding land uses include the City park property already mentioned
to the north along Bassett Creek. Property to the west is single family
residential , but is separated by Bassett Creek and a street. The
property to the east is zoned Business and Professional Offices,
although a home remains on the adjacent lot. South of this site across
Duluth Street is a PUD including three story office buildings in Bassett 's
Creek Plaza and the five story Covenant Manor senior citizen residence. �
Staff suggests that the Planning Commission recomrnend approval of
a conditional use permit for Reinertson and Associates allowing construction
of a four story office building at 5800 Duluth Street, based on the fact
that the proposal is consistent with an earlier approval and based on
• the fact that the proposed building is compatible with surrounding land
uses.
