Chairman Thompson called the meeting to order at 7:00 p.m. Those present were Commissioners: Eastes, Forster, Leppik, Moede, Polachek, Singer and Thompson. Also present were Mike Miller, Director of Planning and Redevelopment, and Alda Peikert, Assistant Planner. I . Approval of Minutes - September 28, 1981 : , It was moved by Commissioner Eastes, seconded by Commissioner Singer and carried unanimously to approve the minutes of the September 28, 1981 Planning Commission meeting as recorded. II . Informal Public Hearing - Preliminary Plat: APPLICANT: Robert L. Halseth LOCATION: Southeast Quadrant of Intersection at Coonty Road #18 and Medicine Lake Road • REQUEST: Approval of Preliminary Piat of "Westview Development" This agenda item wa�s introduced by Chairman Thompson, who then recognized Mr. Ron Alwin, Consulting Engineers Diversified, who was present to represent the proponent. Chairman Thompson asked whether the Commissioners had any questtons of staff. In response to questions concerning rezoning of the undeveloped lot in the proposed plat for construction of a radio tower, Planning and Redevelopment Director Mike Miller exptained that the radio tower is not an issue at the time of platting and that after platting the proponent will be required to apply for rezoning of the one lot to the Radio Zoning District . if he intends to pursue construction of a radio tower. Mr. Alwin offered the proponent's viewpoint that the proposed pl.at would create a salable undeveloped lot with or without the rezoning required for construction of a radio tower. . Chairmao Thtimpson a�ked whether Gortmis�sioners had��-ar�y 'questions of tbz pro�sonent, but there were no questions. Chairman Thompson opened the informal public hearing and invited interested persons to speak. Hearing no response to his invitation, the Chairman closed the public hearing. . It was moved by Commissioner Forster and seconded by Commissioner Leppik to recommend City Council approval of the preliminary plat of Westview Development subject to the following conditions: Planning Commission Meeting of October 26, 1981 Page 2 • 1 . That the name of the Plat be changed so as not to be confused with the P.U.D. Plat of "Westview Business Center"; 2. That the owner/developer comply with the requests listed in the attached letter from Hennepin County Department of Transportation; 3. That the owner/developer be required to donate a cash sum of $14,800 in lieu of land as required by Section 440:80 of the City Subdivision Regulations; and; 4. That approval of the Preliminary Plat in no way guarantees approval of the rezoning of Lot 3 from Commercial to Radio District. Mr. Alwin asked whether the proponent could appeal the amount of the appraisal on which the park dedication fee is based. Mr. Miller replied that the pro- ponent may appeal an appraisal to the Planning Commission or City Council by submitting evidence documenting a different appraisal figure. Request for Special Use Permit within a Commercial Zone District: � • APPLICANT: Mr. Steve Sussman LOCATION: Springgate Shopping Center REQUEST: Permission to operate coin-operated video games � in a Commercial Area. Chairman Thompson introduced this request for a special use permit and distri- buted to Commiss`ioners copies of the proposed floor plan of the operation pro- vided by the proponent. Chalrman Thompson asked whether Commissioners had any questions �of staff. Commissioner Moede asked about procedure for notification of surrounding property owners, noted that merchants in the shopping center proposed for location of the video game operation had not been notified, and stated she felt this should be taken into account in considering the special use permit request. Planning and Redevelopment Director Mike Miller informed the Commis.sion that the existing City Zoning Ordinance does not require a public hearing on special use � permit applications and that staff has no authority to c�ll a hearing or notify surrounding property owners. Mr. Miller reported that he and the City Juvenile Officer had met with the proponent, the owner of the Springgate Shopping Center which is the proposed location, and the Coldwell Banker rental agent for the shopping center. • Planning Commission Meeting of October 26, 1g81 Page 3 � Commissioner Eastes asked whether the Planning Commission could recommend that the City Council hold a public hearing on the special use permit, and Mr. Miller replied that it is within the province of the Planning Commission to make such a recommendation. Corrrnissioner Moede reported that she had discussed with the City Police Chief hts concerns regarding location of a video game operation at the Springgate Shopping Center, where there have been past problems with juvenile vandalism. Mr. Miller stated that he is aware of past problems at Springgate Shopping Center and that in response to his request to the City Police Chief for a revTew of the proposal , the City Police Department had provided the memorandum prepared by the City Juvenile Officer included in the staff report. Commissioner Moede asked whether staff was aware that video game operations such as the Circus in Brooklyn Park require full time employment of off duty policemen for security purposes. Mr. Miller indicated that he is familiar with operations in other communities. and that he feels there are some differences in this proposal . Mr. Miller suggested that the proposed combined learning and video game center offers an opportunity to test a video game operation in the community and to develop policy on regulation of such operations in Golden Valley. Mr. Miller added that the City would have the authority to close the operation in the event it became a law enforcement problem. • Chairman Thompson called on the proponent, Mr. Steve Sussman, who gave a stide presentation on the proposed learning and video game center. Mr. Sussman's presentation included the site location, the floor plan of the proposed facility, proposed house rules and curfew hours, computer systems to be installed, and the unique qualities of the proposed operation as a prototype test center for possible expansion into additional learning and video game centers. Mr. Sussman informed the Commi:ssion that 25 percent of the floor space tn the center will be devoted to video games and that he expects to derive 20 percent of his total income from the video games. Chairman Thompson asked for Commissioners' questions of the proponent. Commissioner Eastes questioned the proponent concerning qualifications of employees. Mr. Sussman reptied that the learning and video game center would be staffed at first by the instructors for the computer classes and introduced ' his partner, Mr. David Lewis, Control Data, who will be qualifying the employees. Commissioners Moede, Eastes and Leppik questioned the proponents concerning the necessity for additton of video games to the computer learning center, location of the video games at the front of the fiacility, and the relationship between the video game area and the computer learning area. The proponents explained that the facility will serve as an Atari test center for Atari video games, as well as Atari computer eqwipment. The video games will be located at the front of the faci.lity in order to maintain the computer learning center at the back as a quiet and secure area. Mr. Sussman added that he feels the traffic of computer i Planning Commission Meeting of October 26, 1981 Page 4 • learning center patrons through the vtdeo game area witl provide a beneficial influence on the game area. Concerning means of drawing young people �fram the games into the computer learning center, Mr. Sussman explained that juvenile patrons of the games will be subtly solicited to investigate facilities available in the computer learning area. Commissioner Moede suggested that it would be worthwhile to talk with the other merchants in the Springgate Shopping Center prior to taking action on the special use permit request. Commisstoner Moede stated that if the merchants agree that the proposal would 6e good for the shopping center, she would be the first to vote for a recommendation of approval . However, she said she felt uncom- fortable recommending approval as long as. the other merchants in the shopptng center remain unaware of the proposal . Mr. Sussman expressed agreement with Commissioner Moede's opinion that the merchants in the shopping center should be consulted and further expressed willingness to personally contact the merchants. . At this point, although this agenda item was not a public hearing, the Planning Commission Chairman offered to hear comments from the public. Mr. Leslie P. Slater, owner of The Phone Booth, Inc. located in the Springgate Shopping Center, reported that he had first heard of the proposal the afternoon of the October 26, 1981 Planning Commission meeting from the manager of the • Walgreens Drug Store in the shopping center. Mr. Slater said that he was speaking not only for himself, but also for the manager's of both Walgreens and Brown Photo in the shopping center. Mr. Slater presented to the Planning Com- mission letters from Walton Travel and Pleasantries Gift Shop in the shopping center, but explained that he would prefer not to read the letters into the , record, as they reflect a misunderstanding of the concept of the propased learning and game center as presented at the meeting by the proponents. Mr. Slater summarized the concerns expressed in the letters as inctuding vandalism, teenage traffic, late hours and noise. Mr. Stater concluded by expressing regret that the .proponents were risking an excelleht business in the learning center by adding the volatile issue of video games. Mr. Dick Clark, General .Manager af Byerly Foods, expressed agreement with remarks made by Mr. Slater. It was moved by Commissioner Moede and seconded by Cortr�issioner Polachek to defer action on this item until such time as Mr. Sussman has had an opportunity to discuss his proposal with merchants in the Springgate Shopping Center and then request that Planning and Redevelopment Director Mike Miller present the item to the Golden Valley Planning Commission for consideration of the special use permit request at that time. The Chairman asked for discussion on the motion. • Planning Commission Meeting of October 26, 1g81 Page 5 � Commissioner Eastes spoke against the motion, suggesting that the Planning Commission decision should be based not on the popularity of the proponent with his potential future netghbors in Springgate Shopping Center, but on land use considerations such as negative impact on the social environment, extra police . protection requi.red, and promotion of the health, safety and general welfare of the community. Commissioner Leppik proposed an amendment to the motion stipulating that a spokesman for the merchants at Springgate Shopping Center be heard by the Planning Commission at the time Mr. Sussman returns to the Planning Commission for consideration of his special use permit application. Commissioners Moede and Polachek accepted the amendment to the motion. The motion was passed by a vote of four to three. Commissioners Eastes, Singer and Thompson voted against the motion. IV. Report on City Council Meetings October 6, 1981 - Sue Eastes October 20, 1981 - Mona Moede � Commissioner Eastes gave a report on the City Council meeting of October 6, 1981 . Commissioner Eastes reported that the Council agenda did not include any items of interest to the Planning Commission. Commissioner Moede reported that she was unable to attend the City Council . meeting of October 20, 1981 , but that she reviewed the agenda and determined that there were no items of interest to the Planning Commission. V. Report on HRA hieeting - October 13, 1981 Dave Thompson Mona Moede , Chairman Thompson gave a report on the HRA meeting of October 13, 1981 , and r.eported that the major item on the HRA agenda was authorization for purchase of the Ewald Dairy property. Vi . Report on BZA Meeting - October 13, 1981 - Bill Forster Commissioner Forster gave a report on the BZA meeting of October 13, 1981 , and reported that most items before the BZA that evening were return items carried over from previous meetings. � Planning Commission Meeting of October 26, 1981 Page 6 • " VI1 . Inittation of Comprehensive Land Use Study of Park Lands - Dave Thompson Chairman Thompson suggested that the Planning Commission initiate a comprehensive land use study of park lands in the City with the objective of preparing guidelines for determining appropriate multiple uses of park lands. The Cortunissioners discussed the proper role of the Planning Commission in contributing to a study of park land usage. It was moved by Chairman Thompson and seconded by Commissioner Leppfk that the Planning Commission Chairman send a letter to the City Mayor suggesting that a comprehensive examination of all City parks and the variety of uses that coutd be made of them be undertaken by the appropriate body as soon as possible. Commissioner Eastes asked whether the Chairman would be willing to draft a letter for r.eview by the Planning Commission at the next meeting. Chairman Thompson agreed to this suggestion. Planning Commissioners made suggestions to t'he Chairman for items to be included in the letter. Corrmissioner Eastes suggested thatttie:letter explain the need for the study, which is lack of available park land for various uses. Commissioner � Leppik suggested that the City Council be requested to develop policy and procedure for citizen input at the time of change in park use. CommissToner Eastes further � suggested that the letter express Planning Commisssion willingness to assist in the study as a part of the Planning Commission comprehensive planntng responsibility. Chairman Thompson accepted all of these suggestions for incorporation into the draft letter. Chairman Thompson asked for discussion on the motion. Commissioner Eastes questioned the need for a motion at this time and suggested that action in the form of a motion be deferred until after the Planning Commission has reviewed the draft letter. Chairman Thompson withdrew his motion, and a substitute motion was made by Comrt�issioner Singer to defer action pending Planning Commission review of the draft letter. The motion was seconded by Commissione�r Eastes and carried unanimously. The meeting was adjourned at 9:20 p.m. Respectfully submitted, David Thompson, Chairman Mona Moede, Secretary • � • T0: GOLDEN VALLEY PLANNING COMMISSION DATE: NOVEMBER 4, 1981 FROM: MIKE MILLER, PLANNING � REDEVELOPMENT COORDINATOR SUBJECT: REQUEST FOR SPECIAL USE PERMIT TO OPERATE VIDEO GAMES IN A COMMERCIAL ZONE DISTRICT A request by Mr. Steve Sussman, representing Computer Gametown � Learning Center, for a Special Use Permit to install and operate coin-operated video games as part of a new business operation to be located in the Springgate Shopping Center, was originally reviewed by the Planning Commission on October 26, 1981 . The Planning Commission deferred action untit such time as a report from the Public Safety Director relative to the operation, and until such time as the proponent has had an opportunity to discuss his proposed business with the other businesses and merchants located within the Springgate Shopping Center. Mr. Sussman has informed Staff that he expects to complete his meetings with the businesses and merchants within Springgate by Friday, November 6, 1981 • A merr� from James Crawford, Public Safety Director, is attached hereto. The proponent is Mr. Steve Sussman of Computer Gametown � learning Center, who proposes to estabtish a computer learning center within the Springgate Shopping Center at T.H. 100 and Duluth Street. In addition to providing services � to educate and instruct the ever increasing number of personal home computer buyers, Mr. Sussman proposes to utilize approximately 25 to 33 percent of his building area for the use of video games (coin-operated) which would be open to the general public. According to the provisions of the current Commercial Zoning Ordinance,. a computer learning center would be a permitted use in that Zone District. However, coin- operated game machines are permitted only as a Special Use approved by the City Council . Attached, you will find a letter from Mr. Sussman outlining his proposed oper- ation along with a map of the Springgate Shopping Center indicating the location of his proposed Computer Gametown � Learning Center. Mr. Sussman has informed staff that normal operating hours would be from 11 :00 a.m. to 11 :00 p.m. daily. Strict rules and supervision woutd be applied to the entire operation, especially the coin-operated video games area. Custorr�rs 17 years of age, or younger would be required to leave the premises no later than 10:00 p.m. House rules would include no gambling, no smoking, no loitering, etc. Mr. Sussman proposes to use an I .D. card system for patrons, with a cotor code for age group. Whether or not such a system would be practical or not remains to be seen. The video game- room would be capable of handling 25 to 28 coin-operated video games which trans- lates to a maximum occupancy of that area of between 40 to 60 people. � � Golden Valley Planning Commission -2- November 4, 1981 A primary concern of City Staff, including the Police Department, is the possible negative impact that any coin-operated game center might have on the Community. Game centers have a tendency to attract teenagers and other young people so as to become "Hang-outs" and potential trouble spots. Such facilities require constant strict supervision, strict rules that are enforced, and willing coop- eration with law enforcement agencies. The proponent has stated that the video game area would be adequately supervised at all times by adult employees, and that all rules set up for this operation would be strictly enforced. To consider the merits of any game center to be established in the City of Golden Valley, it is only reasonable to request comment from the Golden Valley Police Dep�rtment. In response to this request the Police Department provided the attached memorandum from City Juvenile Officer Dennis Smith. Officer Smith's review conc��udes that the proposed video game operation should present no special law enforcement problems, providing the center is run as proposed by Mr. Sussman. As positive features of the proposal , the review cites the presenc� of adult customers frequenting the computer learning center and the proponent's stated willingness to enforce house rules and cooperate with City law enforcement officers. One recommendation made by the Juvenile Officer for alteration of operating procedures for the center is an earlier closing time for juveniles. The City � curfew for juveniles 15 years of age and under is 9:30 p.m. and 10:00 p.m. for teenagers 16 and 17 years of age. In order to allow time for teenage customers to return home prior to curfew, a 9�00 p.m. closing time for persons 17 years old and younger is suggested by the Police Department. Attached, you will find a memo from the Public Safety Director as requested by the Planning Commission. As you can see from the Memo, Mr. Crawford is� in agreement with the original recommendations of Juvenile Officer Dennis Smith, and recommends approval of the Special Use Permit with proper safeguards (restrictions) included. Staff suggests that the Planning Commission recommend City Council approval of a special use permit for Mr. Steve Sussman of Computer Gametown and Learning Center to operate coin-operated video games in conjunction with a computer learning center located at the Springgate Shopping Center subject to the following conditions: 1 . No more than 33 percent of the total computer learning center and video game facility floor area shalt be occupied by video games. 2. A maximum number of 25 video games shall be allowable. 3. The video game area shall be supervised by at least one adult aged 21 years or older at all times. An evidence of failure to maintain specified supervison shall be grounds for revocation of the Special Use Permit. � • Golden Valley Planning Commission -3- November 4, 1981 4. Juveniles 17 years of age and under shall be required to leave the premises at 9:00 p.m. Any evidence of failure to enforce this closing time for juveniles shall be grounds for revocation of the Special Use Permit. 5. Facility staff shall contact the City Juvenile Officer for removal of any juveniles on the premises during school hours. Any evidence of failure to notify juvenile authorities as specified shall be grounds for revocation of the Special Use Permit. 6. House rules prohibiting smoking, gambling and loiterirog shall be strictly enforced. Any evidence of failure to enforce these house rules shall be grounds for revocation of the Special Use Permit. 7. Facility owners and staff shall maintain contact with and shall cooperate with the City Police Department concerning any law enforcement problems oc.curring on the facility premises or resulting from location of the facility within the Springgate Shopping Center. Any law enforcement difficulties on the premises or resulting from location of the facility within the Shopping Center shall be grounds for revocation of the Special Use Permit. � MHM:kjm • . Crawford, Director of Public Safety SUBJECT: Special Use Permit Regarding Permission to Operate Coin-Operated Video Games in a Commercial Area ` Recently, Commissioner Mona Moede contacted me and asked me for my opinion on the current proposal before the Planning Commission. At that particular tPme I was unaware that our Juvenile Officer had already made a recommendation to your office. I advised Commissioner Moede that I would be concerned with such an operation if it meant that additional police resources would have to be used in response to problems at such a location. . Since that time I have spoken to my Juvenile Officer and he has in- dicated to me that the owner, Mr. Sussman, has agreed to have constant supervision of all customers and to adequately control all teenagers who must obey our curfew laws and be orderly. It is my recommendation that this permit be approved but with certain restrictions which will insure an orderly and lawfut operation. Violations of these restrictions in the future could be documented by our department and be presented to the City Councit for their determinations. Shellum FROM: Dennis Smith SUBJECT: Request for Special Use Permit - Computer Game Town and Learning Center On October 16, 1981 at 1330 hours, I did attend the meeting held in Mike Miller's office in regard to the above proposed business to be placed in the Springgate Shopping Center. After hearing and seeing Steve Sussman's proposal and listening to his response to questions asked by members present, it is my opinion that this would not be a typical coi� operated video game center such as Time Out, Picadilly Circus or others that are noted as juvenile hangouts. It appears that the coin operated video games are only a portion of what the business will deal with and that business is aimed at attracting people who are interested ln learning more about computers or who know about computers and cannot afford to have their own computer in their home. . I believe that this will bring a large number of responsible adults into the center both during the day and the evening hours. Steve Sussman appears to be very concerned and aware of the potential for juvenile problems and this becoming ajuvenile hangout. He indicates that they will not allow any smoking, food, drink, loftering, and that_.they will not allow kids to be in the video game room after curfew. Mr. Sussman indicates that this is a prototype operation for hopefully a regional if not national chain of Computer Game Town and Learning Centers. As a result, they have made plans to have constant supervision of the video game area. It is my recommendation that although Steve Sussman indicates that they will not allow any teenagers after 10 o'clock, that this should possibly be moved back until 9:30 or even 9 o'clock as this falis closer with our juvenile curfew ordinance and would allow kids time to get home after leaving the video center. Mr. Sussman further indicated that during the school year he would be contacting either the police or school authorities if juveniles would show up in the video game room and have them removed f�om his business location. • It appears that if the operation is run as Mr. Sussman hopes to have it ' run, that there should be no unique problems with juveniles hanging out at the center and Mr. Sussman does indicate that he would like to work very closely with the police in the City of Golden Valley in making this a successful operat�on. � � . rir. Following discussion of this matter, the Planning Commission moved to defer action until after the Planning Commission has reviewed a draft letter prepared by the Chair- man to the City Council explaining the need for such a study. A copy of the draft letter should be available to the Planning Commission at the November g, 1981 meeting. . . MHM:kjm •
