December 14, 1981
• A regular meeting of the Planning Commission was held in the Council Chambers of
the Civic Center, 7800 Golden Valley Road, Golden Valley, MN. Chairman Thompson
called the mee�ing to order at 7:05 p.m.
Those present were Commissioners: Forster, Polachek, Singer and Thompson.
Commissioner Eastes was absent. Commissioners Leppik and Moede were not present
at the beginning of the meeting.
Also present were Mike Miller, Director of Planning and Redevelopment, and
Alda Peikert, �sststant Planner.
1 . Approval of Minutes - November 9, 1981 :
It was moved by Commissioner Singer, seconded by Commissioner Polachek and carried
unanimousty to approve the minutes of the November 9, 1981 Planning Commission
meeting as recorded.
II . Set Date for Informal Public Hearing - Preliminary Plat:

that the Planning Commission set a January 11 , Ig82 hearing date.

unanimously to set January 11 , 1981 as the date for an informal public hearing
on the request received from Taco Bell for preliminary plat approval of "Teacher
Addition".
Commissioners Leppik and Moede arrived at the meeting.
I11 . Set Date for Informal Public Hearing - Conditional Use Permit:

REQUEST: Approval of a Conditional Use Permit allowing a
4-Story building in a B � P 0 Zone District
Chairman Thompson introduced this agenda item and noted the staff recommendation
that the Planning Commission set a December 28, 1981 hearing date. Commissioners
discussed the probability of having a quorum present for a meeting on December 28,
1981 . Commissianers Forster, Leppik and Moede will not be available on that date,
. but Commissioners Polachek, Singer and Thompson verified that they would be present.

� ChaTrman Thompson suggested that the Plan�ing Commission proceed on the assumption
that Commissioner Eastes will be present and that the.re will be a quorum for the
meeting.
It was moved by Commissioner Polachek, seconded by Commissioner Leppik and carried
unanimously to set December 28, 1g81 as the date for an informal public hearing
on the request received from Reinertson and Associates for a conditional use permit
to allow construction of an office building over three stories in height in the
Business and Professional Offices Zoning District.
The proponent, Mr. Mark Reinertson, requested permission from the Planning Commission
Chairman to clarify his request. Chairman Thompson recognized Mr. Reinertson,
and Mr. Reinertson explained that he is requesting a conditional use permit for
a five story building rather than a four story building since he has adequate
parking for an additional story under revised parking requirements. Planning and
Redevelopment Director Mike Miller informed Mr. Reinertson that he would need a
letter and plans detatling the change in his application.
IV. Set date for Informal Public Hearing - Conditional Use Permit:
APPLICANT: Executive Leasing Corporation
LOCATION: 6980 Wayzata Boulevard
, REQUEST: Approval of a Conditional Use Permit to operate a
gasoline service station in an Industrial Zone District.
Chairrr�n Thompson introduced this agenda item and noted the staff recommendation
that the Planning Commission set a hearing date of December 28, 1981 .
It was moved by Commissioner Singer, seconded by Commissioner Polachek and carried
unanirr�usly to set an informal pubtic hearing date of December 28, 1981 for con-
sideration of an application from Executive Leasing Corporation for a conditional
use permit to operate a gasoline service station at 6980 Wayzata Boulevard in
the Industrial Zoning District.
Commissioner Moede informed the Commission that the attendant at the Shell Station
at 7000 Wayzata Boulevard has been handing out Skelly credit card applications in
anticipation of the closing of the Shell Station and opening of the proposed
Skelly Station at 6980 Wayzata Boulevard, the subject of this conditional use
permit request. Commissioner Moede questioned the apparent assumption on the part
of the proponent that the conditional use permit would be approved. Mr. Leo Martin,
Executive Leasing Corporation, present to represent the proponent, explained that
applications were handed out based on the possibility of obtaining permission for
the proposed new Skelly Station to replace the Shell Station, which will close when
Shell moves out of the state of Minnesota as of December 31 , 19$l . Mr. Martin
stated that there was no intent to give the impression that Executive Leasing felt
assured of approvat .

Chairman Thompson introduced this agenda item and noted the staff recommendation
for a December 28, 1981 hearing date.
Commissioner Leppik requested an exptanation of the three related conditional
use permit requests for the two locations at 6g80 and 7000 Wayzata Boulevard.
Mr. Leo Martin, Executive Leasing Corporation, explained the proposed operations
at the two locations.
Commissioner Leppik requested that the hearing date for this item be set for
January 11 , 1982 when she would be present and abl�e to participate. Commissioner
Moede suggested that with Shell moving out of the state December 31 , 1981 , the
Planning Commission should try to take action before the end of the year in order
to accommodate the businesses proposed for both of the two tocations. Chairman
Thompson pointed out that this conditional use permit request is related to the
previous agenda item for which the Planning Commission already set a December 28,
1981 hearing date.
• It was moved by Commissioner Moe.de, seconded by Commissioner Polachek and carried
unanimously to set an informal public hearing date of December 28, 1981 to consider
approval of a conditional use permit for operation of a "U-Haul" truck and trailer
rental service at 6g80 Wayzata Boulevard.
VI . Set date for Informal Public Hearing - Conditional Use Permit:

Chairman Thompson introduced this agenda item, and Planning and Redevelopment
Director Mike Miller offered an explanation of the proposal .
It was moved by Commissioner Moede, seconded by Commissioner Forster and carried
unanimously to set an informal public hearing date of December 23, 1981 for
consideration of a conditional use permit applicat.ion received from Jim Lupient
Oldsrrrobile Company to operate a car rental business and auto diesel service stalls
at 7000 Wayzata Boulevard.

Commissioner Moede expressed a desire to make a statement considering the fact
that she will be absent at the time of the hearing and stated that she hoped
the Planning Commission would be able to act favorably on the request from
Jim Lupient Oldsmobile Company.
VII . Request for Waiver of Platting Ordinance:
APPLICANT: Kenneth and Patricia McGowan � Daniel and
Colleen Dooley
LOCATION: 8815 Elgin Place
REQUEST: Permission to rearrange two residential lots by adjusting
a common lot line without being required to replat.
Chairman Thompson introduced this agenda item and called on the proponents.
Mr. Patrick Neaton, Attorney representing the proponents, explained the exchange of
properties proposed in the request for a waiver of the platting ordinance. Also
present were the proponents Mr. and Mrs. Daniel Dooley and Mr. Kenneth McGowan.
Commissioner Moede requested an explanation of the two conditions of approval
recommended in the staff report. Planning and Redevelopment Director Mike Miller
� explained the recommended conditions.
Commissioner Moede asked whether either of the two storage sheds to be relocated
on the property have permanent cement foundations. Mr. Dooley and Mr. McGowan
both replied that their storage sheds do not have cement foundations.
It was moved by Commissioner Leppik, seconded by Commissioner Singer and carried
unanimously to recommend City Council approval of the request for a waiver of the
platting ordinance to allow adjustment of the lot line between 8815 Elgin Ptace
and 8825 Elgin Place as proposed by Daniel and Colleen Dooley and Kenneth and
Patricia McGowan conditional .on the fotlowing:
l . Removal of that portion of the pool apron within the 6 foot utility and
drainage easement at any time directed by either the City Engineering
Department or the City Inspection Department.
2. Relocation of the two metal sheds to the two respective yards outside of
the 6 foot utility and drainage easement along the rear property lines.
Chairman Thompson explained to the proponents the conditions in the Planning
Commission recommendation for approval .
VI11 . Report on BZA Meeting - November 10, 1981 :
Commissioner Forster provided a report on the November Board of Zoning Appeals
� (BZA) meeting and reported that the major item on the agenda was a proposed
addition to Christ Unity Church, for which the Church has worked out parking
arrangements.

IX. Report on HRA Meeting - November 10, 1981 :
Commissioner Polachek pravided a report on the November HRA meeting, including
financial figures presented on the Calvary senior citizen housing project, an
update on completion of the development agreement for the South Wirth condominium
project, and an update on Ewald property purchase negotiations.
X. Report on City Council Meeting - November 17, 1981 :
Commission�er Eastes, who represented the Planning Commission at the November 17,
1981 City Council meeting, was not present. Therefore, Chairman Thompson deferred
the report on the Council rr�eting until the next Planning Commission meeting.
XI . Report on City Council Communications Subcommittee Meeting with Planning
Commission - November 20, 19$1 :
Chairman Thompson and Commissioner Leppik provided a report on the November 20,
1981 City Council Communications Subcommittee meeting.
Chairman Thompson reported that he argued against a Planning Commission role in
a traffic and safety study of Pennsylvania Avenue South, based on the fact that
the question does not involve a large enough portion of the City to constitute
a planning issue and based on the fact that the City Council has handled simitar
� situations by addition of stop signs without Planning Commission involvement.
Commissioner Leppik reported on traffic control measures recommended by a separate
residents committee in which she participated.
Chairman Thompson reported that City Council Member Mary Anderson is drafting for
City Council review a �re specific charge to the Planning Commission on the
Housing Policy.
XII . Report on Ptanning and Zonfng Institute: _
Chairman Thompson gave a report on the Seventh Annual Planning and Zoning Institute
held in', early December at the Radisson South Hotel . Chairman Thompson served on
the American Planning Association (APA) Educational Subcommittee which assisted
in planning the Institute and also served as faculty for the Institute, leading
a workshop on the Role of the Planning Commissioner.
VIII . Update on the Valley Square Commission:
Chairman Thompson, as Chairman of the Valley Square Commission, provided the
Planning Commission with a report on recent decisions made by the Valley Square
Commission concerning upgrading of Highway 55 and realignment of Golden Valley
Road.

• XIV. Report on Tax Exempt Finance Committee:
Chairmam Thompson, as a member of the Tax Exempt Finance Committee, gave a report
on the �'ast meeting of the Committee held December 2, 19s1 . Chairman Thompson
reporte�l that the Committee deferred for additional information a request from
H and I ' Enterprises for tax exempt financing and recommended approval of tax exempt
financing for expansion of General Sheet Metal Corporation.
XV. Di�cussion of Proposed City Council Projects for 1982-$3 Term:
Chairmafi Thompson requested Commission input into response to a memorandum
solicit�ng suggestions for City Council priorities and projects for 1982 and 1983•
Plannin� Commissioners suggested the following items for inclusion in the listings
" of priol-ities and projects:
1 . Study of the use of tax increment and tax exempt financing.
2. Pre�baration of informational handouts and/or newsletter artictes outlining
pro�edure for resident requests of traffic control signs.
3. Initiation of a quarterly City wide informational mailing.
4. Hiring of a consultant to study the City pa rk and recreation system for
� future uses.
5. Continued pursuit of the Valley Square Redevelopment Project.
6. Exp�oration of joint City and School District use of O1son �School for� �
community center purposes.
7. Organization of a City fire department independent of the City Public Safety
Department.
8. Con'�inued support of the use of Light Rail Transit (LRT) through the City of
Golklen Valley.
9. Inventory of the City housing stock.
Commissioner Leppik requested a substitute to cover the December 15, 1981 HRA
meeting; which she will be unable to attend. Commissioner Singer agreed to take
her pla�e at the meeting.

unanimously to record Planning Commission appreciation of staff support during 1981 .
Chairman Thompson added recognition of faithful attendance of Planning Corrrnissioners
during the year.

Executive Leasing Corporation, operators of Boulevard Shell , 7000 Wayzata
Boulevard (T.H. 12) , are requesting a Conditional Use Permit to operate
an automotive service station at 6980 Wayzata Boulevard (see attached map) .
The Shell Service station currently operated by Executive Leasing
Colrporation, located on the Northwest corner of the intersection of
Lo�isiana Avenue South and 1�layzata Boulevard, witl be ceasing operations
ef�,fective December 31 , 1931 due to the fact that Shell Oit Company is
le�aving Minnesota. In addition, Jim Lupient Oldsmobile Company, owner
of',l�sith.properties wishes to relocate the auto rental agency from 69$0
Wayzata Boulevard to 7000 Wayzata Boulevard where it can be adjacent
to' their new and used car facilities. As a result of these circumstances,
Jim Lupient Oldsmobile Company has agreed to lease the property at
6980 Wayzata Boulevard to Executive Leasing Corporation who would then
move their service station operations to this site and be serviced by
• Skelly Gil Company.
Th�e site in question is zoned Industrial as is all adjacent properties.
� Sulrrounding land use is somewhat varied. To the west, along Louisiana
Av�enue South land use consists of the Shell service station (soon to be
di�continued) , new car storage for Jim Lupient Oldsmobite Company, and
thle Samuri Steak House at the Northwest corner of Market Street and
Lo'�uisiana Avenue South. The North half of this site is used for storage
of' autos for Jim Lupient Car Rental , and along the North side of Market
Street is the Mr. Steak Restaraunt. Land use to the East consists of
an office building immediately adjacent and Perkins Cake � Steak House
adjacent to the office building. To the South is Wayzata Boulevard (T.H. 12)
and the City of St. Louis Park.
Selction 20.03 (G) of the City Zoning Ordinance lists the items which the
P1'anning Commission must consider in making findings and recommendations
tol, the City Council . This Section on Conditional Uses states as follows:
G.', The Ptanning Commission shall make findings and recommendations
' to the City Council based upon any or atl of the following factors
(which need not be weighed equally) :
1 . Demonstrated need for the proposed use.
2. Consistency with the Comprehensive Plan of the City.
• 3. Effect upon property values in the neighboring area.

4. Effect of any anticipated traffic generation upon the current
traffic flow and congestion in the area.
', 5. Effect of any increases in population and density upon
'� surrounding land uses.
6. Increase in noise levels to be caused by the proposed use.
7. Any odors, dust, smoke, gas or vibration to be caused by the
, proposed use.
18. Any increase in flies, rats or other animals or vermin in the
area to be caused by the proposed use.
9. Visual appearance of any proposed structure or use.
10. Any other effect upon the general public health, safety, and welfare
, of the City and its residents.
Prior to addressing the above listed items it should be pointed out that
the site tn question was formerly used as an automotive service station
� prior to the auto rental agency being established.
Relsponding to the ten items listed in subsection G, the following findings
ca!n be made:
l . In recent years, the number of service stations open to the general
public along Wayzata Boulevard in Golden Valley have been slowly
. dwindling. With ever increasing traffic volumes on Wayzata Boulevard
there is a definite need for a reasonable number of automobile service
� stations.
2. The proposed land use would be compatible with both the existing and
the proposed Comprehensive Plans for Golden Valley.
3. The proposed land use would have no effect on property values in the
neighboring area.
4., The only increase in traffic generation resulting in additional con-
gestion in the area would be caused by allowing access to the general
public to the car wash presently located in the building on the subject
site, which is now used only for the auto rental agency. Use of this
car wash facility by the general public should not be allowed.
5.'�� There should be no increase in population and density as a result
I of this land use.
• 6. There is no evidence to indicate any significant increase in noise
levels caused by the proposed land use.

� 9• The visual appearance of the proposed land use should not differ
greatly from the appearance now presented on the property.
10. The proposed land use should have no other effect on the general
public health, safety, and welfare of the City and its residents
� than it has in its present locatton across the street.
In view of the information and facts thus far presented, I would recommend
that the Planning Commission give favorable consideration to this Conditional
Use Permit. Moving from one side of the street to another should not
prbduce any adverse impact upon the adjacent neighborhood. However, any
fa',vorabte recommendation should be conditioned on the following:
l .l The car wash facility shall not be open to the general public.
Violation of this condition shall be grounds for revocatton of the
Conditional Use Permit.
• 2. Vehicle parking on-site shall be restrFcted to those areas designated
for parking on the site plan only. Violation of this condition shail
be grounds for revocation of the Conditional Use Permit.

WITHIN AN INDUSTRIAL ZONE DISTRICT
B�CKGROUND AND ANALYSIS:
Executive Leasing Corporation, Golden Valley, in addTtion to seeking a
Conditional Use Permit to operate an automotive service station at
6g80 Wayzata Boulevard, is also requesting a second Conditional Use
Permit that would allow them to rent "U-Haul" trucks and trailers in
conjunction with the operatTon of an automotive service station. This
proposed land use would be located within an Industrial Zone District as
i� all of the adjacent properties.
Th�e site in question is owned by Jim Lupient Oldsmobile Company and is
c�Yrrently being used for offices and service center for the Jim Lupient
C�r Rental agency. The car rental agency is being proposed to be moved
across Louisiana Avenue South to the location of Boulevard Shell (see
attached map) which will cease operations as a Shell Service Station
� on December 31 , 1981 • Executive Leasing Corporation, operators of the
Shell station, wish to move to the 6980 Wayzata Boulevard location and
cdntinue operation as a service station associated with another oil company.
A�jacent land uses include the Shetl service station at the Northwest
c rner of Louisiana Avenue South and Wayzata Boutevard (T.H. 12) along
wi!,th new car storage along the West side of Louisiana Avenue South to
Market Street. The Samurai Steak House is located on the Northwest corner
of Market Street and Louisiana Avenue South. Mr. Steak is located on the
North side of Market Street on the Northeast corner of Market Street and
Louisiana Avenue South. Adjacent to the site on the East is an office
b�ilding, and adjacent to that structure on the East is Perkins Cake and
S�eak House. The South boundary of the site is occupied by a service
rc�ad, Wayzata Boutevard (T.H. 12) and the City of St. Louis Park.
A$, shown on the attached site plan and area map, the existing and proposed
l�nd use would not change as a result of any of the requested Condltional
Use Permits. However, some of the land uses would be rearranged, although
with little or no adverse impact on the neighborhood.
Im accordance with Section 20.03 (G) of the City Zoning. Ordinance regarding
Cmnditional Us� Permits, the Planning Commission is required to make
c�rtain findin�s and recommendations to the City Council . Subsection "G"
l �sts these considerations as follows:

Add�ressing the above listed items, the following findings can be made:
l . ' While truck and trailer rental is not an essential need within the
�,, Community (such services are available in adjacent communities) ,
there is no other such service avaitable within Golden Valley.
It would seem that, if properly managed, the proposed land use would
provide a convenience and service to the residents of the Community.
2. The proposed land use would be consistent with both the existing and
I the proposed Comprehensive Plan for the C1ty of Golden Valley.
3. �I The proposed land use should have no effect on property values in the
', neighboring area.
4. Effects of any anticipated traffic generation upon the cu_rrent traffic
flow and congestion in the area should be slight inasmuch as truck
� and trailer rentals do not normally produced a high volume of turnover
traffic movements.

10. According to the information provided by the proponent, there should

RECOMMENDATION
In view of the information provided above it would appear that the
proposed land use would not have a negative impact on either the neighbor-
� hood, or the Community. Therefore, I would recommend that the Planning
Commission act favorably on the request by Executive Leasing Corporation
for a Conditional Use Permit to rent "U-Haul" trucks and trailers at
6980 Wayzata Boulevard. However, any favorable consideration should be
conditioned on a restriction that the operators of said business under-
stand and agree not to park any rental trucks and/or trailers within any
parking area needed for required off-street as noted by the City Zoning
Ordinance in accordance with the attached site plan. In addition, all
vehicles and equipment used for rental purposes must be stored elsewhere
on the site and properly screened from view.

SUBJECT: REQUEST FOR CONDITIONAL USE PERMIT - 7000 WAYZATA BOULEVARD
JIM LUPIENT CAR RENTAL AND DIESEL SERVICE
Jim Lupient Oldsmobile Company requests a conditional use permit for a car rentat
business and diesel car service operation located at 7000 Wayzata Boulevard.
� Mr. Jim Lupient proposes to rr�ve his car rental business currently located at
6g80 Wayzata Boulevard directly to the west across Louisiana Avenue South to the •
site of the Shell Gas Station currently located at 7000 Wayzata Boulevard.
� Mr. Lupient owns both of the two properties located at 6g80 and 7000 Wayzata
Boulevard on the east and west sides of Louisiana Avenue South. The site west of
Louisiana is currently leased to Executive Leasing Corporation for a Shell Station,
and Shelt is moving out of the state of Minnesota as of December 31 , 1981 •
Mr. Lupient proposes to move his car rental business at that time to the current
Shetl site which is adjacent to and more convenient to the Jim Lupient Oldsmobile
Company at 7100 Wayzata Boulevard.
At the same time that he rr�ves his car rental business to the current Shell site,
� Mr. Lupient proposes to construct an addition to the Shetl Gas Station building
for automobile servicing and repair. The new construction will include space
for ten car service stalls in addition to the three existing service stalls in the
current building. The ne►NService area will replace and expand service facilities
presently located at Jim Lupient Oldsmobile Company with the addition of a diesel
pump repair area. Jim Lupient Oldsmobile Company presently sends diesel fuel parts
to a service center in Eagan for repair. The proposed dtesel pump repair area,
which occupies two of the ten new service stalts, will provide Jim Lupient Oldsmobile
Company with the capacity to accomplish this type of repair in house. The proposed
service center is entirely for the purpose of service and repair of the car inventory
associated with Jim Lupient Oldsmobile Company and Jim Lupient Car Rentals.
The proposed location of the conditional use, 7000 Wayzata Boulevard, is in the
Industrial Zoning District and is surrounded by Industrial Zoning. The site is
adjacent to Jim Lupient Oldsmobile Company in the Industrial Zoning District to
the west. The site fronts on streets on three sides, with Market street to the
north, Louisiana Avenue South on the east, and Highway 12 (Wayzata Boulevard)
on the south forming a physical barrier between City of Golden Valley and City of
St. Louis Park land uses. The site to the east across Louisiana Avenue South,
zoned Industrial , is the current site of Jim Lupient Car Rentats and is the proposed
site of a Skelly Gas Station in replacement of the Shell Gas Station. The properties
to the north of Market Street are zoned Industrial to Laurel Avenue, as are properties
further to the west and east of Jim Lupient properties.

In the IndUStrial Zoning bistrict, both motor vehicle rental and automobile service
or repair accessory to sales are conditional uses. In accordance with the
Conditional Use Section of the Zoning Ordinance, Section 20:03 (G) , the Planning
Commission should base its findings and recommendations to the City Council
concerning a conditional use permit application on ten considerations, which
the Ordinance specifies need not be given equal weight. Discussion of application
of the ten consi�derations to the subject conditional use permit request follows:
i . Demonstrated need for the proposed use.
The two conditional uses proposed for the site, car rental and car service
incidental to sales and rental , replace existing facilities presently located
on neighboring sites, the car servicing presently taking place at Jim Lupient
Oldsmobile Company and the car rental presently located at the site directly
across Louisiana Avenue South. The car service is a necessary accessory use
incidental to the Jim Lupient Oldsmobile Company car sales and showroom. The
car rental business 1s a viable existing business apparently fulfilling a need
in the area.
2. Consistency with the Comprehensive Plan of the City.
� The City of Golden Valley Comprehensive Land Use Plan specifies long term
industrial use of the subject site, which is consistent with the current
zoning and with the proposed use.
3. Effect upon property values in the neighboring area.
Effect on property values in the neighboring area would be negligible.
Neighboring properties to the west and to the east of the site are in the
same ownership as the subject site.
4. Effect of any anticipated traffic generation upon the current traffic flow and
congestion in the area.
No additional trafflc generation is anticipated. Mr. Lupient states that
the volume of rental business and volume of car service or repair operations
will be unchanged from present volumes currently handled on adjacent sites.
5. Effect of any increases in population and density upon surrounding land uses.
This item is not• applicable.
6. Increase in noise levets to be caused by the proposed use.
Proposed activities are the same as those currently conducted on adjacent sites
except for the addition of the diesel pump repair service which will not result
. 1n increased noise levels.

7. Any odors, dust, smoke, gas or vibration to be caused by the proposed use.
Proposed activities are the same as those currently conducted on adjacent sites
with the addition of the diesel pump repair service. Normal car servicing and
repair operations do not create any problems related to odors, dust, smoke,
gas or vibration. Mr. Lupient explains that the diesel pump repair service
requires a strictly controtled work area even less likely to result in such
problems.
8. Any increase in flies, rats or other animals or vermin in the area to be caused

by the proposed use.

g. Vi'sual appearance of any proposed structure or use.
The proponent, Mr. Lupient, has proposed use of inetal exterior materials on
the building addition due to probable elimination of the building at the time
of upgrading of Highway 12 to I-394. Section 405:30 of the City Code pro-
hibits use of inetal exterior on any side of a building abutting a pubtic street.
Use of inetal exterior will require special consideration from the Buitding
� Board of Review.
� 10. Any other effect upon the general public health, safety, and welfare of the
City and its residents.
There are no other apparent effects on the general public health, safety and
welfare of City residents. .
Dimensions of the subject parcel are approximately 150 feet by 505 feet for a
total lot area of approximately 1 3/4 acres. The existing building is approximately
30 feet by 65 feet with a proposed addition of 65 feet by 70 feet for a total
building area of approximately 6600 square feet. The lot coverage of the building
amounts to only 8.7 percent, and a major portion of the site will be used for
storage of Jim Lupient Oldsmobile Company new, used and rental automobile inventory.
The rear or north portions of both 7000 and 6980 Wayzata Boulevard are presently
used for automobile inventory storage. Mr. Lupient reports that there are currently
106 automobiles stored to the rear of the Shell Gas Station on the subject parcel .
The existing Shell Gas Station building is located 10 feet from the west property
line, which-is less than the 20 foot minimum building setback required for Industrial
zoned property adjacent to other Industrial zoned property. The proposed building
addttion extends the same line 10 feet from the west property line, which would
require a waiver from the Board of Zoning Appeals (BZA) of the side yard minimum
building setback. In addition, the west side of the property is paved to the property
line, excluding the required 10 foot landscaping strip required between the property
� line and parking area. Waiver from the BZA of the minimum parking setback is also
required. The site plan accompanying the application indicated the 35 foot yard
requirements abutting streets on three sides of the site. The 35 foot setback area
on the north, east and south perimeters of the lot should be landscaped according
to the City Landscape Standards enforced by the Building Board of Review.

Provision for parking shown on the site plan includes 16 spaces shown on the south
and east sides of the building presumably to accommodate customers of the car
rental service. The northern portion of the site to the rear of the building
provides adequate space for employee and service stall parking as required with
additional space for rental car inventory or Jim Lupient Oldsmobile new and used
car inventory. However, the parking arrangement should be delinerated on final
plans submitted to the Bu� lding Board of Review for approval prior to issuance of
a building permit for the'� proposed building addition.
Staff suggests that the Planning Commission recommend approval of the conditional
use permit requested 6y J�m Lupient Oldsmobil.e Company for a car rental business
and for an automobile servicing and repair operation accessory to .Jim Lupient
Oldsmobile Company sales �nd rental located at 7000 Wayzata Boulevard subject to
the following conditions:
l . Restriction of automobile servicing and repair, including diesel pump repair,
to the Jim Lupient Oldsmobile Company sales, service and rental business.
The automobile servic� and repair facilities shall not be available to the
general public.
2. Board of Zoning Appeals (BZA) approval of a waiver of the 20 foot west side yard
� building setback requirement and of the 10 foot landscaped west side yard parking
setback requtrement.
3. Landscaping to the specifications of the Building Board of Review of the
35 foot front yard area on the three sides of the site facing streets.
4. Removal of gasoline pwmps and underground fuel storage tanks in accordance
with City Tank Removal Guidelines promulgated by the City Fire Marshall and
City Building Inspector, except for one pump island which may be retained for
Jim Lupient sales and rental car use.
5. Use of permanent exterior building materials on the two sides of the building
addition facing publi� streets unless use of inetal exterior ls approved by the
Building Board of Review.
6. Limitation of the num�er of cars parked to the south and east of the building
to 16 as indicated on' the site plan and limitation of the number of cars parked
to the north of the b�ilding to the number reasonably spaced within the 35 foot �
minimum setbacks from' the streets on the east and north, to be delineated
on plans submitted fol- approval of the Building Board of Review prior to issuance
of a building permit �or the proposed addition.
