PLANNING COMMISSION
January 28, 1980
A regular meeting of the Planning Commission was held at 7:30 p.m. on
January 28, 1g80, at the Civic Center, 7800 Golden Valley Road, Golden
Valley, Minnesota.
Chairperson Eastes called the meeting to order at 7:3� p•m. Those present
were Commissioners De Sautels, Eastes, Forster, Hughes, Levy, Polachek,
Sehlin, Spector, Swanson and Thompson. Atso present were Mike Miller,
Planning and Redevelopment Coordinator and Martin Farrell , Assistant City
Planner.
Commissioner Edstrom arrived at 7:40 p.m.
I . APPROVAL OF MINUTES
it was moved by Sehlin, seconded by Thompson and carried unanimously to
approve the Minutes of the January 14, 1g80 Planning Commission.
II . DISCUSSION OF T.H. 12 MORATORIUI� ORDINANCE
• At the request of the Planning Commission Chairperson, Assistant City Attorney
Allan Barnard addressed the Planning Commission. Mr. Barnard authored the
T. H. 12 Moratorium Ordinance and briefly described the purpose of the
ordinance.
III . INFORMAL PUBLIC HEARING - REZONING
�
APPLICANT: The New Life Aiano Society
LOCATION: 8401 Medicine Lake Road
REQUEST: Change Zoning from Residential to Institutional
Mike Miller briefly gave some background material about the Alano Society,
the property proposed to be rezoned and the reason for the rezoning request.
The Atano Society is proposing to purchase an otder, single family dwelling
for the purpose of using the property as a meeting place for their activities.
The property is presently zoned Resfdential and the proponent is requesting
a rezoning to Institutional to allow this type of land use. Donald Hughes
expressed concern and requested that it be noted that the Planning Commission
should not confuse the purpose of a rezoning with this particular use.
The proponent, represented by Robert Schum, addressed the Commission. Mr.
Schum stated that the structure would be used for evening meetings , between

tfie peak hours of 6:00 p.m. and 10:00 p.m. An average of 20 to 30 people
would attend these meetings, with the maximum number of occupants reaching
70 members at any one given time.
A neighborhood group, represented by Mary Nicholson, 2430 Zealand Avenue N. ,
presented a preliminary petition, signed by 40 of the local neighbors and
also a final petition signed by 50 of the local neighbors, opposing the
rezoning.
Paul Moquist, 2435 Xylon Avenue North, addressed the Commission and expressed
concern about the setback requirements.
Edward Zapple, 2460 Zealand Avenue North, stated that he opposed the rezoning
because of the potential parking nuisance.
Don Schaffer inquired about lighting the parking area and was informed if
the lot were lit, the lights could not shine onto a neighbor's property.
Tom Boyce, 2465 Xylon Avenue North brought up the issue of traffic safety
and the idea of preserving the character of the neighborhood.
Dave Gelperin, 2425 Zealand Avenue North, expressed concern about future
• zoning and the possible other uses that could occupy the property.
George Dodnick, a member of Alcoholics Anonymous described the function of
the group .and urged the commission to grant the rezoning request.
After hearing from all tf�e concerned citizens, Chairperson Eastes called
for further discussion from the Commission.
Dave Thompson stated decisions by the Planning Commission should be made on
the basis of good planning. He did not feel this type of rezoning was
good planning and wanted to keep the neighborhood residential .
Edstrom stated that institutional uses have traditionally been located in
residential neighborhoods. Swanson concurred with Edstrom. Hughes then
stated the rezoning went against the Comprehensive Plan for the residential
area. After further discussion it was moved by Thompson, seconded by Sehlin,
to deny the request. '
Roll Call was taken. Commissioners Thompson, Sehlin, Forster and Hughes
were for the motion. Commissioners Swanson, Edstrom, Spector, Levy, De Sautels,
Eastes and Polachek voted nay. The motion was not carried.

It was then moved by Swanson, seconded by Edstrom, to recommend approval of
the rezoning from Residential to '-��1 and requested that the project
be reviewed by the Planning Commission in 6 months and again in 12 months
• from this time and it was recommended that proponent landscape the property
as recommended by the City Planner.

Roll call was taken. Commissioners Spector, Swanson, Levy, De Sautels ,
Eastes, Edstrom and Polachek voted in favor of the motion. Commissioners
Sehlin, Forster, Hughes and Thompson voted nay. The motion to approve the
� rezoning was carried.
Commissioner Hughes requested it be noted in the minutes that Staff stated
stipulations could be placed on the rezoning recommendations by the
Planning Commission.
The Commission recessed for 10 minutes.
IV. SET DATE FOR INFORMAL PUBLIC HEARING - REZONING

LOCATION: 4232 - 4240 Olson Memorial Hwy.
REQUEST: Change Zoning from Light Industrial to
Industrial
Mike Miller recommended February 11 , 1980, for the informal public hearing
• date.
After some brief discussion, it was moved by Swanson, seconded by Forster,
and carried unanimously, to set February 11 , 1980 for the Public Hearing for
the rezoning from Light Industrial to Industrial .
V. REQUEST FOR BUILDING PERMIT - T.H. 12 MORATORIUM AREA
APPLICANT: Edwin J. Turnquist
, LOCATION: 6300 Wayzata Blvd.
REQUEST: Approval to develop a 151 unit "Thrifty Scot"
Motel
Mike Miller briefly explained the request and the concerns involving the
service road that would be serving the property.
Ed Turnquist, the proponent, addressed the Planning Commission and entertained
questions regarding the development.
It was then moved by Polachek, seconded by Thompson, and carried unanimously
to recommend the granting of a building permit for construction of the
151 unit "Thrifty Scot" Motel , based on the three recommendations in the staff
report which were as follows:

1 . further detailed study of this development proposal is unnecessary
to determine the appropriate location for such a proposed use;
2. it does not appear likely that the proposed land use at this
particular location within the T.H. 12 Area will be prohibited
by provisions of any proposed Zoning Ordinance or amended Compre-
hensive Plan for the T.H. 12 area; and
3. while the proposed land use will require the development of a new
service road, provision of the necessary right-of-way will not
adversely affect the upgrading of T.H. 12 nor will the provision
of utilities to the site adversely affect the upgrading of T.H. 12.
VI . BACKGROUND REPORT ON MIDDLE SCHOOL
Chairperson Eastes stated that the City Council would like the Planning
Commission to develop criteria for evaluating future land uses for the
Middle School Property. Commissioners Po.lachek and Levy were appointed
the Subcommittee and requested to have prepared a recommendation by
February 11 , 1980.
• VII . PROPOSED ZONING ORDINANCE APIENDMENT.
Terminal Warehouse Zone District
Mike Miller gave a Staff review of the need for this zoning ordinance
amendment and briefly explained t�e new Terminal Warehouse Zoning
District. -
It was then moved by Edstroma seconded by Levy and carried unanimously to
review the ordinance and di.scuss it further at the next Planning Commission
Meeting, February 11 , 1980.
VIII . WORK SESSION - PUBLIC FACILIT[ES COMPONENT OF�COMPREHENSIVE �PLAN
Transportation
Edstrom represented the Transportation Subcommittee and discussed the
revisions made in the Transportation section. All corrections and additions
were noted and will be written into the final draft.
It was moved by Spector, seconded by Hughes and unanimously carried to
accept the Transportation Plan subject to the proposed additions and
corrections.

It was decided that Thompson and Polachek will represent the Planning
Commission at the City Council Meeting scheduled for Monday, February 4, 1980.
Chairperson Eastes deferred appointing a Tax Exempt Subcommittee.

BACKGROUND AND ANALYSIS
The St. Regis Paper Company, 4300 Olson Memorial Highway, is proposing to expa�
their container division plant by edding approxima�ely 29,000 square feet of
warehouse facility onto the east end of their existing structure. �Severa

of the Action Electric property at 4224 and 4240 O1son Memorial Highway. In
addition, the property located at 621 Indiana Avenue will be involved in zhe �

�property proposed for building expansion and parking is zoned Light Industrial .
To facilitate their expansion plans , St. Regis Paper Company wishes to rezo
' hat property to Industrial so that alt of the property utilized by the Container

°St. Regis Paper Company is located in the southwest corner of the North Wirth�
• Parkway Redevelopment Project. The land to the north of the site is zoned bo�
Radio and Railroad District and Light Industrial . The property adjacent to
the site is occupied by Juhl Brokerage Company and is zoned Light Industrial

Residential , and consists primarily of low density, single family dwallings.
As a matter of background on the operations of the St. Regis Paper Company, the
Golden Valley plant is part of the Container Division of the Company. Its
principal activities are the construction, warehousing and sale of corrugated
shipping containers. St. Regis presently employs approximately 125 people at
their existing plant. Over the course of the last several years the business
originating from this plant fias grown considerably. The limitations of the present
physical facilities have caused St. Regis to consider the alternatives ava.il,able
to create a facility which can handle the present volume of business. The expressed
preference of St. Regis is to stay in Golden Valley and expand their existing
plant.
The proposed plant expansion wot�ld initially al_low St. Rec�is to emploY aaarox.i-
�tely 25 additiona]_peop�e._� The new addition to the exiszing building wilY
�be used initially as a warehouse. However, St. Regis anticipates the need t
use the expansion area for other activities in the near future. This is the '

St. Regis has the flexibility of using the entire plant for normal industrial

BACKGROUND AND ANALYSIS
Robert T. Steiner, 4322 Wayzata Boutevard, is requesting permission�
to subdivide one residential lot into two residential lots witho� .

Boulevard and Sunset Ridge.� -
�Mr. Steiner is making this request primarily as a result of the .
�` � pending i_mprovement of T.H. 12 and the future development of a new�
� interchange at T.H. 12 and T.H. 100. The Minnesota Department of t
�Transportation has already indicated that part of Mr. Steiner's propert
'�and his l�ouse will be acquired for right-of-way purposes. j�Anticipating
� i`'fi s eventual relocat�on, IN�r.�-St�ner��desires o sub�'rvizte his existing
lo�t�, creating a buildable lot fronting on Sunset Ridge. If approved,
Mr. Steiner intends to build a new home on Parcel A, fronting on Sunset
Ridge, to replace the home that will be acquired by Minnesota Department
of Transporation. Parcel A would be sufficient in size for a small ,
single family dwelling with an average lot depth of onty 85 feet, and
an average lot width of 166.5 feet. Not all of Parcel 6 will be acquired
by the Minnesota Department �of Transportation (Mn DOT) . They have
informed the City of Golden Valley and Mr. Steiner that they will not
acquire all of Parcel B. That portion of the parcel that is deemed
unnecessary for right-of-way purposes will not be purchased and will
remain in Mr. Steiner's ownership.
A review of this proposal with Mn DOT has indicated that they have no
objection to Mr. Steiner's request. However, it was emphasized by
representatives of Mn DOT that they have no intention of purchasing any
more right-of-way than they need, and under no circumstances would they
anticipate acquiring all of Parcel B.
A waiver of the requirement for platting is provided for in Section 440:150
Conveyance by Metes and Bounds, of the Platting Ordinance for Golden .
Valley in accordance with the provtsions of Minnesota Statues, 1965, 462.358,
Subdivision 4, which states in part:
" . . In any case in which compliance with the foregoing
restrictions will create an unnecessary hardsfiip and failure
� to comply does not interfere with the purpose of the sub-
division regulations, the platting authority may waive such
compliance by adoption of a r-esolution to that effect and the
conveyance may be then filed �or recorded."

Ordinance could be granted without a flagrant violation of the intent
of the subdivision regulations. If the issue is that imperative,
it would allow Mr. Stetner the convenience of being able to build a
� new home on Sunset Ridge prior to demolition of his existing home on
Wayzata Boulevard. It would also provide him with the opportunity
to sell the new lot on the speculative market if he so desired. I
frankly feel that this waiver is unnecessary.
