Commissioners Specktor, Levy and Sehlin were absent. I . Approval of the Minutes - May 12, 1980. It was moved by Hughes , seconded by Edstrom and carried unanimously to approve the May 12, 1980 Planning Commission Minutes. II . Report on the HRA Meeting - May 13, 1980. Dave Thompson represented the Planning Commission at the HRA meeting held � May 13, 1980. Commissioner Thompson then briefed the Commission on the decisions made at the HRA meeting and informed the Commission that a new Valley Square Commission has been formed by the HRA. Commissioners Thompson _- and Edstrom were appointed by -the HRA to the new Valley Square Commiss�on. III . Resetting the Informal Public Hearing Date - Rezoning APPLICANT: Bury � Carlson, Inc. LOCATION: 6008 Wayzata Blvd. REQUEST: Change zoning from "Open Development" to "Industrial" Martin Farrell explained the following reasons for resetting the Informal Public Hearing: ' 1 . Staff is waiting for a landscaping report from the City Forestor � 2. The Miqnesota Pollution Control Agency's Operation P=rmit has become outdated. Jim Bury, the proponent, entertained questions from the Commission regarding the"rezonjng request. it was then moved by Thompson, seconded by Polachek and carried unanimously � to reset the Informal Public Hearing date to June 9, 1980. � IV. ' He then recommended approval of the rezoning. Lowell Odland, City Engineer, then addressed the Commission and explained the types of uses that the Department of Public Works would have on the site. Bob Nelson, Manager of Pittsbury, was present at the meeting and stated that he had no problem with the rezoning request. It was moved by Edstrom, seconded by Potachek, and carried unanimously to recommend approval of the rezoning from "Light Industrial" to "Institutional (I-4)", and requested that any area that will be excavated be properly screened and fenced. . V. N. Lundstrom is requesting a zoning change from M-1 (Multiple Dwelting) to Business and Professional Office for a parcel of property located at 1725 Lilac Drive. The property is presently known and utilized as the Copacabana Apartments. It is Mr. Lundstrom's intention to convert the apartment structure to an office building if the property is rezoned. On March 24, 1980, Mr. Lundstrom appeared before the Planning Commission with the same request. At that time, the Commission deferred action � until the proponent provided a traffic study of the area. Since that time the proponent has presented a traffic study to staff and it is currently being analyzed. Staff feets they have enough information to constructively review the proponents rezoning request and make a recommendation. I suggest that the Planning Commission set the date for the Informal Public Hearing for June 23, 1g80. i � � � . � June 3, 1980 • T0: Gotden Valley Planning Commission FROM: Martin Farrell , Assistant City Planner � K SUBJECT: Request for Rezoning - 6008 Wayzata Blvd. „ BACKGROUND � ANALYSIS The proponent is the Bury � Carison Company located at 6008 Wayzata Blvd. , They are requesting that a section of the property they own be rezoned from "Open Development" to "Industrial". They operate an asphalt plant and have been stockpiling materials on approximately one acre of their property which currently is zoned "Open Development". The remaining four acres of their property is zoned "Industrial". Presently, their use of the property is not conforming with the City's Zoning Ordinance. By rezoning the property in � question to "Industrial", they would bring their entire property into conformance with the Zoning Ordinance. Stock piling of aggregate materials would be permitted use in an "Industrial" zoning district. The entire area south of Laurel Avenue, north of T.H. 12, and west of the M.N. � S. Railway all the way to Rhode Island Avenue is zoned as an Industrial zoning district. The M.N. � S Railway abutts the easterly edge of the subject property and the land east of the tracks is zoned "Light Industrial ." � Therefore, the proponent's request for a rezoning to an "Industrial" zoning district would be compatible with the surrounding land uses on the south, _ east and west side of the subject property. However, the property direr:tly to the north of the subject property is zoned residential and has b n recently approved by the City Council for the development of two �story condominium buildings. Construction of these two buildings should near completion some time in 1982• It is possible that the stock piling of aggregate materials could present an unsightly view for the proposed condominium buildings. This can be corrected by requiring a landscaped buffer that would screen the material piles from the residential area. Section 7.07 of the Zoning Ordinance states that , "In the Industrial Zoning District no materials or equipment shall be stored outside, unless screened in such a manner as not to be visible from adjacent properties or streets. Only those materials or equipment directly related to the principal use may be stored outside." This implies that the entire north end of the Bury � Cartson property will � eventually have to be landscaped. I have met with the City Forester and we have concluded that the type of vegetation that would adequately screen such a use would have to reach a mature growth of approximately 30 feet. Some variety of spruce should be planted to insure a screened buffer that will be at least 30 feet in height. Also, some sort of deciduous shrubs should be planted between the spruce to insure screening for the lower areas. June 3, 1980 Page 3 rMemo - Request for Rezoning - 6008 Wayzata Blvd. Atso, the City plans to extend Laurel Avenue from Colorado Avenue to Xenia Avenue. The proposed road is to be built witt► a width of 44 feet and it would be constructed at the same grade level as the railroad tracks. Completion of Laurel Avenue is expected some time in the later part of 1981 . Therefore, the condominium units and Laurel Avenue should be nearing completion around the same tirrre. It is recommended that a landscaped buffer be provided some time before the road and P.U.D. project are complete. If the property were to be rezoned, vehicular traffic should not be increased as the Company is not increasing its production because of the rezoning. Access to the site would continue to be from the south and filtered out onto Wayzata Blvd. From an environmental standpoint, the asphalt producing plant would continue as it has in the past. Production should not be significantly increased. The Minnesota Pollution Control Agency, at the request of staff, inspected the plant May 27, 1980 and found it to be in compliance with the Division of Air Quality Regulations. It has been recommended by the Engineering Department of the Division of Air Quality that their permit be renewed for another five years. � RECOMMENDATION The rezoning of• this property is not substantially inconsistent with the surrounding __ land uses. Staff feels that tt�e visuat problem on the north end of the� property can be corrected using the suggested landscaping. After looking over the area in queation, I have come to the following recommendation. I recommend planting one of the varietiea of spruce. The trees should be planted about 15 ft. apart. This is a good distance because when the trees reach maturity, they will mesh together forming a thicker buffer. BACKGROUND � ANALYSIS On March 17, 1980, Hennepin County requested that all of Blocks 7, 8 and 9, and vacated Fries Place adjoining said blocks 8 and 9, all being in Lakeview Heights Addition, be rezoned from "Residential" to "Institutional ( I-4)". That request involved the rezoning of approximately 10.5 acres. At that time the Planning Commission made two motions. (See attached minutes) . They recommended denial of the rezoning and they also recommended to the City Councit that it request Hennepin County to remove the firing range from the residential neighborhood. Shortly after the Planning Commission meeting, Hennepin County withdrew their rezoning request, before it went before the City Council . � They have now submitted a new rezoning petition. The rezoning from "Residential" to "Institutional (I-4)" is the same. However, the area that Hennepin County -- is requesting to be rezoned has been reduced to just that area around t�e Sheriff's Radio Station. The present subject property is approximately one third of the entire site which is owned by the County, and does not include the property on which the pistol range is located. The Sheriff's Radio Station site was originalty developed for its current use in 1947. The existing City Zoning Ordinance was adopted in 19�55 and this particular piece of property was zoned residential . Therefore, the Sheriff's Radio Station has become a legal non-conforming use. The existing structure and facility consist of a one story brick building which occupies a ground area of 2,149 sq. feet. Hennepin County is requesting the rezoning so they can legally add an addition on their building. They are proposing the addition of a one-story extension on the north and east sides of the existing building. (See attached site plan) . The addition would increase the overall ground area coverage of the building to a total of 5,244 sq. feet. This is still far below the maximum coverage of 25% allowed in our ordinance. The use of the subject facility includes police, fire and emergency medical radio dispatching services, as well as radio equipment installation and repair se,�cvices to 46 municipalities within Hennepin County. This is a 24-hour, 365 day per year operation which has a staff of ten persons per shift. The proposed expansion should increase the number of employees by one per shift . � The purpose of the proposed expansion is simply for the purpose of providing an improved level of service to the municipalities requiring radio installation and repair services to their vehicles and equipment. � Page 2 June 3, 1980 Memo - Request for Rezoning - Hennepin County, 9300 Naper Street The area is primarily residential in character and the neighborhood has developed since the Sheriff's Radio Facility was established in 1947. The area directly east of the subject property is also owned by the County and is the present site of the pistol range. The ,pistol range and the area to the north of the subject property would remain residential . The area on the eastern side of Flag Avenue is zoned industrial and is part of the General Mills Research Center property. The Comprehensive Ptan for the City of Golden Valley includes this site as a public land use. Staff feels that this ' land use would not be inconsistant with the surrounding land uses. Traffic would not be significantly increased according to the county and access to the site would remain on Naper Street. The problem that arises in this particular case is that this type of govern- mentat service facility does not fit neatly into any specific category in our zoning ordinance. The "Institutional (I-4)" subdistrict allows "Village Offices, fire stations and other lands incidental to the operation of the Village." In this instance, the (I-4� classification woutd be the most appropriate for this particular land use situation. Even though the subject property is owned and operated by the County, it does provide services to municipal governments. • Other land uses allowed within the "Institutional (I-4)" subdistrict include the following: � l . Golf Courses , country clubs and poto fields , excepting those carried on as a business, such as miniature golf courses. 2. Parks, playgrounds , Village offices, fire stations and other lands incidental to the operation of the Village. 3• Such other uses which, in the opinion of the City Council are Compatible with the uses specifically described above. Therefore, by rezoning the subject property to "institutional (I-4)", the types of allowable uses would be extremely limited. Provision #3 gives the City Council a good deal of control over any future development of the property if it were to be rezoned. RECOMMENDATtON As previously stated, whether the property is rezoned or not, the Sheriff's Radio Facility will continue as e legal nonconforming use. As is, the legal nonconforming use cannot be altered. If Hennepin County is to expand their station, 'then they need to be rezoned. Rezoning the area would make the Sheriff's Radio Facility a conforming use. . The Two Hundred ($200.00) Dollar filing fee; which was paid at the time of the filing the original Petition shall apply to the filing of this amended Petition as per the mutual agreement of the City of Golden Valley and the County of Hennepin (see Exhibit "B" attached) . The Sheriff's Radio Station �site was originally developed with and for its present use in 1947. The original zoning ordinance was enacted in 1955; and as the result of said adoption, rendered the subject property's use a legal conforming use. In 1975, the County was granted a zoning varience for the purpose of replacing the original radio tower; wl�ich had become unsafe and also obsolete and which was subsequently replaced with the existing 400 foot tower. At that time, the County circul�ted a petition asking the property owners' acquience in the requested vari- ence, which they received. The present structure and facility consists of a one-story masonry building with a brick veneer exterior which occupies a ground area �f 2,149 square feet. It is proposed to add a one-story addition to the east and north sides of the existing structure that would increase the overall ground area coverage to 5,244 square feet. ` � Hennepin County is an Affirmative Action Employer • Mr. Michael H. This is a 24-hour, 365-day operation which has a staff complement of approximately ten persons per shift. The purpose and intent of the proposed addition is simply for the purpose of providing an improved level of service to the municipalities requiring radio installation and repair services .• to their vehicles and/or portable transmitting equipment. The purpose and intent of the subject petition is to place the above- described property in a zoning district which will be compatible with the property's land use and which will also be compatible with the high- est and best use of said land as identified on the adopted comprehen- sive plan for the City of Golden Valley. Chairperson Eastes calle-d the meeting to order at 7:30 p.m. Those present were Commissioners: Eastes, Hughes, Polachek, Sehlin and Thompson. Also present were Mike Miller, Planning 6 RedeveloPment Coordinator and Martin Farrell , Assistant Planner. � Commissioners Forster, Specktor and Levy were absent. Commissioner Edstrom arrived at 7:45 p.m. 1 . APPROVAL OF THE MINUTES - March 10, 1980 It was moved by Thompson, seconded by Sehlin and carried unanimously to approve the March 10, 1980 Planning Cortxnission Minutes. II . PRESENTATION AND DISCUSSION OF THE PROPOSED CAPITAL IMPROVEMENTS PROGRAM Mayor Thorsen stated that one of the main goals of the City Council will be to better communicate with the Planning Commission. She then suggested that the City Council meet with the Planning Commission on April 14, 1980 in the Gold Room located in the City offices at Brookview. Mayor Thorsen suggested that • the Ptanning Commission members submit topics of conversation to Chairperson Eastes prior to the meeting. ,. Each member of the Planning Commission then received a copy of the Preliminary Report of the T.H. 12 Commission. Mayor Thorsen suggested that the T.H. 12 Commission present their Report in person to the Planning Commission in the near future. In February, 1976, the Council appointed a long range Capital Improvement Commission, which put together a Capital Improvement Plan. Mayor Thorsen presented the Capital Improvement Program to the Planning Commission for further review and future comment. Chairperson Eastes said she would like to see more detailed and written descriptions of the projects. Mayor Thorsen concurred and said she woul-d look into it. I11 . INFORMAL PUBLIC HEARING - REZONING APPLICANT: Hennepin County F LOCATION: 9300 NAPER STREET RE�,UEST: Change Zoning from Residential to (I-4) Institutional . Chairperson Eastes explained the Informal Public Hearing process. Mike Miller then gave a brief discussion of the proponent's request and a summary of the Staff's recomrt�ndation. Staff recommended that the Planning Commission consider favorable action on this zoning request. " Earl Johnson, Office of Property Management for1Hennepin County, represented the proponent. He requested that the 10.5 acres be rezoned to I-4 Institutional . Captain Vodegal , the Commander of the Sheriff's Radio Station, explained the reasons for the building expansion and stated that traffic would not be substantially increased in the area. The present number of employees would be increased by one or two. , Edstrom questioned whether or not Hennepin County would be able to build a larger structure in the future. Mike Miller stated that future construction would have to go to BZA for approval . Dave Phillips, 1712 Mendelssohn , was under the impression that his land was being rezoned. The confusion resulted from the map showing the information zone. Dick Fritz, 1628 Independence Avenue N. , expressed concern about the tax structure and market value effect on the surrounding properties. Mike Miller stated that the rezoning would not effect the tax structure of the adjacent structures. � � Diane Hanson, 2008 Gettysburg, expressed concern about the landscaping requirements and tree removal . Earl Johnson said that the building would be over 400' from Earl Street and no trees would be removed. Judy Metsola, 1817 Hillsboro Avenue - North, suggested only rezoning �he section of property that would be occupied by the building. Hennepin County would have to Plat the property befors they could attempt to rezone that portion of the property. Mark Lent, 1902 Independence Avenue N. , suggested that the rezoning be confined to the property and that the firing range be removed. Mary Gross, 1624 Hillsboro Avenue N. , has been a resident in the area before the county occupied the property, opposed the rezoning. Tim Strant, 3185 Duluth Street, would like to see the property platted and then partially rezoned around the existing structure. � ' Ginger Zoubek, 9345 Naper Street, is not bothered by the noise from the firing range, but is bothered by the black top stope that exists on the property and the potential ha�ard that it causes. Darlene Egolf, 1720 Independence, expressed concern about Wheeler Street. Bonnie HaXne, 2000 Gettysburg, stated she would like to see only the property around the existing building rezoned. • Chris Spotted Eagle, 1817 Hillsboro, expressed concern about additional vehicular traffic and he objected to the rezoning. Commissioner Thompson questioned the county's estimated cost of future relocation plans regarding this property. Captain Vodegal stated that the estimated cost would be too high to consider future relocation of the station. Commissioner Hughes emphasized that a rezoning deals specifically with land use and not the 1 �- � Page 3 Minutes of the Golden Valley Planning Commission March 24, 1980 � function of the building. Commissioner Edstrom felt that allowing the rezoning for the 10.5 acre site , � would detract from the City's control of the property.� Commissioner Sehlin moved to defer action on the rezoning until the Planning Commission hears from a representative f rom the firing range and the City obtains more information about future use of the entire site. The motion died due to a tack of a second. It was then moved by Edstrom, seconded by Hughes, and carried unanimously, to recomrt�nd denial of the rezoning request. With regard to the firing range, Commissioner Hughes, suggested that the neighbors offended by the use go to the City Council with their problem. �It was then moved by Thompson, seconded by Sehlin and carried to recommend to the City Council that it request Hennepin County to remove the firing range from the residential neighborhood. Commissioner HugheS voted against the motion. IV. INFORMAL PUBLIC HEARING - REZONIN6 � APPLICANT: L. N. Lundstrom LOCATION: 1725 N. Lilac Drive (Copacabana Apts.) .- REQUEST: Change�'Zoning from M-1 (Multiple Dwelling) to Business and Professional Office Martin Farrell briefed the Planning Commission as to the current use of the property, which is zoned M-1 (Multiple Dwelling) and the proposed use of the �p:roperty by L. N. Lundstrom as a Business and Professional Office use. ;Staff felt . that traffic generation and flow is a definite problem in this ;p,articular area of Golden Valley. The proposed rezoning would definitely ;increase the traffic generated and therefore, requested the Planning +Commission defer any action on this request until the proponent provide a traffic study. ,L. N. Lundstrom, the proponent, addressed the Planning Commission and stated that' in his opiniorr, the rezoning would be consistent with the surrounding :land use. He would like to convert the existing 31 unit, multiple dwelling structure into an...office complex. He feels the property is not presently used to its full potential . Olaf Aho, 5631 St. Croix Avenue, expressed concern about the current amount of treffic�on St. Croix and opposed the rezoning. Lorraine Aho, 5631 St. Croix Avenue, would like to see the p�operty better � landscaped and the garbage cleaned up around the building. � Mary Gibson, 5615 St. Croix Avenue, complained about the current heavy traffic on St. Croix. �
