Chairperson Eastes called the meeting to order at 7:30 p.m. Those present were Commissioners : Eastes, Forster, Hughes , Polachek, Sehain and Thompson. It was moved by Thompson, seconded by Polachek and carried unanimously to � - approve the June 9, 1980 Planning Commission Minutes. • II . Report on the HRA Meeting - June 10, 1980. Dave Thompson and Bill Forster represented the Planning Commission at the last HRA meeting. They briefed the Commission on the meaning of "conflict or interest reqarding the Valley Square Commission. - Ilt . Report on the City Council Meeting - June 16, ig80. Herb Polachek attended the meeting and briefly explained the use of a consent agenda. Don Hughes will represent the Planning Commission at the next City Council Meeting on July 7, 1980. IV. Set Date for Informal Public Hearing - Rezon_ing. APPLICANT: Bob Martinson LOCATION: Just west of the White House on T.H. 55 REQUEST: Rezone from "Commercial" to "Terminal Warehouse" zoning district. Bob Martinson, the proponent was not present. Martin Farrell suggested that the Planning Commission set the date for the Informal Public Hearing for July 14, 1980. It was then moved by Thompson, seconded by Polachek and unanimously carried to � set July 14, 1980 as the informal public hearing date. VII . Response to the T.H. 12 Subcommittee • Members of the Planning Commission were requested to attend the T.H. 12 ° Commission Meeting on June 17, 1980. Sue Eastes explained the purpose of the meeting and what the T.H. 12 Commission expected from the Planning Commissi�n. They requested that the Planning Commission address the following three Gu�s�ia��s: 1 . What advantages do you see occurring to Golden Valley if the current MnDOT proposal is adopted? 2. What disadvantages do you see occurring to Golden Valley if the current MnDOT proposal is adopted? 3. We all have been forced to react to the MnDOT proposal . However, if you had the option of designing the highway, what plan would you propose and how would it differ from the current MnDOT proposal ? Jody Sehlin expressed concern about MnDOT's presentations to various communities and suggested that the Commission answer these questions in the form of a position paper. Smuda, 5001 Circle Downs has requested a waiver from the requirements of the T.H. 12 Moratorium. Mr. Smuda desires to enclose an existing front entry to his home located at 5001 - Circle Downs. The neighborhood in question is zoned residential and is located approximately one block from a small commercial shopping center and T.H. 12. A careful review of this request for a small enclosure of an existing � entry way clearly indicates that there would be no interference with the future expansion and improvement of T.H. 12. Our home is a split level and the ma.in entry is the front door. (The lower C le��el is a walkout and it is almost impossible for people to walk around to the back doors because of the drop i.n elevation. Our present situation is that when you enter the house there is only a very narrow (3 x 7) landing/entry space, then a flight of stairs that goes up and a flight of stairs that goes down. There is barely � enough room for two people there at the same time and it is almost impossible to have someone remove overshoes in this small space. t�'A ha��A ��„° �r;ldren and they each have five+ friends. You can �u�ii� �,��a�,�..0 the cha.os that regularly ensues at the entry. An additional benefit will be the fact that we will be able to orientate the front door so that it faces west instead of north as it now does, At present when the door opens in the winter a tremendous blast of cold air comes down into the family room. We feel the proposed addition will subsequently minimize the infiltratian into our living areas. The construction will match our existing house and will be quite inobtrus- ive. Our present landscaping screens our neighbors view of the addition. We have been residents of Golden Valley for ten years and our plans are to remain here for the foreseeable future. We back up to Highway 12 and the proposed I394/100 intercha.nge. Johnson and Phyllis R. Johnson, and Wayne P. Johnson and LaVonne A. Johnson, are requesting a waiver of the City Platting Ordinance which would allow them to divide one parcel of land into two parcels. The property in question is zoned "Commercial", as are the properties on the east and west. The properties adjacent to the north along Golden Valley Road are zoned "Business and Professional Office (B�PO)'! and multifamily. According to the information provided by the proponents, Parcel B of the proposed subdivision would be utilized for commercial development at some future date. This would be permissible, provided that the proponent adheres to the zoning requirements of the City Zoning Ordinance. It should be pointed out that in order for the City Council to grant a variance • such as requested, the City Council , as well as the Planning Commission may grant a variance following a finding that all� of the following conditions exist: n.. T!-:��� are special circumstances or conditions affecting said property so that the strict application of the provisions of this Ordinance would deprive the applicant of the reasonable use of his land. B. The variance is necessary for the preservation and enjoyment of a substantial property right of the petitioner. C. The granting of the variance will not be detrimental to the public welfare or injurious to the property in the neighborhood in which said property is located. In making this finding, the Council (and the Planning Commission) shall consider the nature of the proposed use of land and the existing use of land in the vicinity, the number of persons to reside or work in the proposed subdivision and the probable effect of the proposed subdivision upon traffic conditions in the vicinity. RECOMMENDATION Reviewing the information provided by the proponent, it is quite clear that a variance is unwarranted, and that the proponent should be required to plat the • property in question. There is no apparent hardship in requiring that the Piatting Ordinance be adhered to in this case. Denial of the variance will have no bearing on the proponents rightful use of his property. The petition is for the rezoning of approximately 3 acres of land currently zoned "Commercial" to an "Industrial" zoning district. The address of the subject property is 4920 Olson Memorial Highway and is located just west of the White House Restaurant and Motel and east of the . Valley Village Apartments. Originally, the proponent had requested to rezone the property from "Commercial" • to a "Terminal Warehouse" zoning district. This would have been the first formal request for the newly adopted zoning district. However, after several � discussions with City Staff and the Minnesota Department of Transportation, the proponent has decided that the "Terminal Warehouse" zoning district would not be the highest and best use of the subject property. (See attached memorandum of record for the meeting.) A terminal warehouse zoning district wni,ld oPnPrate iarge truck and semi-trailer traffic. This would create a definite access problem to and from T.H. 55• Therefore, the proponent has changed his request to a use that would generate smaller truck and van traffic. The property directly east of the subject property is also zoned "Commercial", with a large industrial area located further east of Ottawa Avenue. The City of Golden Valley owns the property adjacent to the site on botfi the north and the west boundary. The City's property is zoned "Institutional" and a good deal of the property lies within the Flood plain. The City has no plans of developing any of its property at this time. Further west of the creek is the location of the Valley Village Apartments which is zoned "Multiple Dwelling". The surrounding land uses are mixed without any one dominant land use. The proponent is proposing to build a 32,500 square foot industrial building that would have approximately 10-12 tenants. The front of the building would be office and the rear would be used for loading and unloading. Such a use would be designed for tenants looking for small (2,000 - 3,000 sq, ft.) industrial uses. This type use would generate small truck and van traffic as opposed to large truck and semi-trailer traffic. _ The Comprehensive Plan calls for general business at this particular site � and for industrial uses for the �entire area east o� Ottawa Avenue all the way to the railroad tracks. Traffic that will be generated to and from the site could be a problem. T.H. 55 runs along the south of the site, but access onto and off T.H. 55 is poorly designed. This is why the "Terminal Warehouse" idea was rejected. The proposed use will cause less of a problem because the smaller uses would not generate the semi-truck traffic. The major problem with access would result from traffic headed east on T.H. 55 attempting to enter the service road on the north of T.H. 55. Access is a problem in the area regardless of the type of use allowed at the subject property. Actually, the existing commercial zoning would generate more vehicular traffic than an industrial use. Both the proponent and the City have met with the Minnesota Department of Transportation and State highway funds are not currently available to redesign either of the two intersections on T.H. 55 between T.H. 100 and the M.N. � S Railroad. Ideally, both intersections would be combined into one main intersection located between the two existing intersections. There are no plans to alleviate the problem in the near future either. Thus far, there have not been enough traffic accidents at the intersection to justify any work by the Highway Department. � Parking should not be a problem. The proposed plan allows for 82 parking spaces. The required amount of parking required by the ordinance will be , determined once the final building design is determined. It does not look as though any variance will have to be obtained from the BZA for parking. The current proposed layout of the building would require a waiver for the • setback on the west side of the parcel . The proponent is well aware of the flood plain and has received preliminary approval from the Bassett Creek Flood Control Commission. RECOMMENDATION As previously stated, there is no one dominant land use in the area. An Industrial type of use would not be unreasonably inconsistent with the surrounding land uses. The major concern with the site is adequate and safe access to and from T.H. 55. The proponent has taken some measures to help remedy the access problem. The proposed industrial use would generate less traffiic than if a commercial use were 6uilt on the sixe. Unfortunately, access seems to be a problem that we are and will be plagued with until state highway funds become available. ' Given the aforementioned considerations, I do not feel that this is an unreasonable request. Therefore, I recommend that the Planning Commission give favorable consideration to this rezoning petition and recommend approval of the rezoning from "Commercial" to an "Industrial" zoning district. � . Mike Miller explained that the property is zoned commercial and the proponent is requesting a waiver of the platting ordinance in order to subdivide an existing lot into two lots. He read the requirements for granting a waiver of the platting ordinance. He stated that he felt the proponent would not suffer any undue hardship by complying with the platting ordinance. He then recommended that the Planning Commission deny the request for the waiver of the platting ordinance. Wayne Johnson, the proponent, explained that he and his associates were unaware of the platting requirements when they purchased the property. • It was then moved by Thompson, seconded by Forster and carried unanimously that in the best interests of the City, as well as the proponent, the request for the waiver of the platting ordinance be denied. Sue Eastes expressed concern about allowing any sort of development in an area where there is an existing traffic problem. Martin Farrell stated that both the Minnesota Department of Transportation and the Golden Valley Police Department have made reports on the intersection and there have not been a significant number of accidents at the intersection of the service road and T.H. 55• Bob Martinson, the proponent and future developer of the property, gave a brief background report regarding his reasons for requesting the rezoning and entertained questions from the Planning Commission. . Findings � Recommendations in the Transporta- tion Section of the Golden Valley Comprehensive Plan, five provisions for upgrading roads have been established. If any improvements are to be made on T.H. 12, then these improvements will have to adhere to these provisions. The Ptanning Commission has reviewed MnDOT's proposal for I-3g4 and subsequently addressed each of these provisions. These provisions have been listed, along � with the Planning Commission's suggestions regarding MnDOT's I-394 proposal . ThP Plannino Commission that the Golden Valley City Council the Minnesota Department of Transportation adhere to the following provisions: A. "Prevent further encroachment on land resources by containing any improvement of Trunk Highway 12 within the existing right-of-way boundary." In September, 1979, the Golden Valley City Council , in cooperation with MnDOT and the Federal Government, instituted a one year moratorium on development within the T.H. 12 corridor. This moratorium severely limited development on the north side of T.H. 12 while St. Louis Park seems to have encouraged development on the south side of T.H. 12. The Planning Commission is concerned that the moratorium could make the City of Golden Valley more � vulnerable to property acquisition byMnDOT. This moratorium expires September 15, 1980• Page 2 • Golden Valley City Council Position Paper on MnDOT's Proposal for I-394 The Planning Commission would like to know the exact amount of acreage and the total number of families that wilt be affected by the latest proposal from MnDOT. The impact on the residential character of the neighborhood will definitely be disturbed. The Planning Commission would like to see any detrimental impact on neighborhoods adjacent to T.H. 12 kept to a minimum. B. "Provide more efficient, channelized access for the City, without deprivation of local service now available." The existing proposal will virtually landlock the South Tyrol Hills neighborhood. This neighborhood would not be provided with access • to T.H. 12. This creates a health and safety problem. Adequate police and fire protection would be difficult to provide for the ������ Tyrol Hills neighbo�hood. The South Tyrol Hills neighborhood would also be separated from Golden Valley's Central Business District, according to the latest proposals. Under the current Valley Square Redevelopment Plan, the City is making a concentrated effort to attract more business into their downtown. Alienating neighborhoods from the rest of the City would make the task of attracting business to the CBD increasingly more difficult. Also, the neighborhood south of T.H. 12 and west of Winnetka would not be provided with proper access to the rest of the City. Again, police and fire protection would be rr�re difficult to provide, as well as the fact that another neighborhood has become isolated from the rest of the City. � Pa ge 3 • Golden Valley City Council Position Paper on MnDOT's Proposal for I-394 C. "Protect the people of Golden Valley and the natural resources in the City from the air, noise, and other forms of pollution by all possible means of separation and screening, avoidance of further encroachments, and maximum implerr�ntation of aesthetic design considerations." The current I-394 proposal provides for the construction of noise barriers; however, the HOV lanes will be elevated, and, therefore, noise barriers should be built up to the appropriate heights. These noise barriers should be built as aesthetically pleasing as possible and generously landscaped. The Planning Commission recommends that the City of Golden Valley provide its own noise impact analysis. This would mean that the � City would establish the existing noise levels and record these through � the efforts of City Staff. Brook#-i-�1-d. Golf Course and recreation area is an area of concern, as well as the residences and businesses directly along T.H. 12. Our own impact analysis would give the City additional leverage in dealing with MnDOT concerning the construction of the noise barriers. Such a study would not be very expensive or difficult for staff to handle, and the cost should be justified by the results from the analysis. D. "Provide adequate pedestrian and vehicular connections among the various parts of the City, and between Golden Valley and neighboring Communities." The I-394, MnDOT proposal does not adequately provide for pedestrian crosswalks. Pedestrian traffic has been totally neglected by the , current proposal . Also, the trail system which exists throughout Golden Valley would be cut off from the residential areas south of T.H. 12. Page 4 � Golden Valley City Council Position Paper on MnDOT's Proposal for I-394 The proposed T.H. 12 severely limits, if not totally cuts off, any possibitities of extending Golden Valley's Trail Systems across T.H. 12. E. ''Increase the mass transit services throughout the entire west suburban area." The type of mass transit services that will be provided is still under consideration. Therefore, it is difficult to form an opinion at this point. The Planning Commission was also asked to respond to the following question : "We all have been forced to react to the MnDOT proposal . However, if you had the option of designing the highway, what plan would you propose • and how would it differ from the current MnDOT proposal?" In response to this question, the Planning Commission would like to make the L;,; ��.:ir,y y�;,�;�1 recommendations: l . Add one lane for eastbound traffic and one lane for westbound traffic, for a total of six lanes. 2. Eliminate the stop light at Louisiana Avenue and bridge the intersection. 3. Eliminate the stop light at Turner's Crossroad/Xenia Avenue and bridge the intersection. 4. Provide one lane in each direction for a rapid transit lane for buses and car pools. 5. Look at the total amount of land used by the proposed MnDOT I-394 plan and then the total amount of land that would be needed if one lane were added in each direction. The Planning Commission would like to know if there is enough right of way available to construct a six lane freeway. � 6. Most importantly, the Planning Commission is concerned that any proposal should serve Golden Valley and its neighborhoods in the best manner possible.
