Planning Commission
� August 25, 1980
A regular meeting of the Planning Commission was held at 7:30 p.m. on August
25, 1980 in the Council Chambers at the Civic Center, 7800 Golden Valley Road,
Golden Valley, Minnesota.
Chairperson Eastes called the meeting to order at 7:30 p.m.
Those present were Commissioners: Eastes, Forster, Hughes, Polachek, Specktor,
and Thompson.
Commissioners: Edstrom and Se�lin were a�sent.
Also present was Martin Farrell , Assistant City Planner, and Dixi.e Peterson,
Secretary.
I . Approval of the Minutes = August 11 , 1980
It was moved by Forster, seconded by Polachek, and. carried unanimously to
approve the August 11 , 1980 Planning Commission Minutes.
Commissioner Specktor raised the question of whether all necessary information
regarding the Planning Commission's denial of the Calvary Square's General
Plan Approval was assembled for the coming September 8 Public Hearing with the
• City Council . A discussion followed. The Planning Commission recommended that
staff provide the density figures for all of Dover Hill .
It was then moved by Specktor, seconded by Forster, and carried unanimously to
move directly to item IV. on the agenda.
II . Set Date for Informal Public Hearing - Rezoning �
APPLICANT: H. I . Enterprises , Inc.
LOCATION: 7901-7921 Wayzata Blvd.
REQUEST: Change zoning from "Open Development" to
"Commercial"
It was moved by Thompson, seconded by Hughes, and carried unanimously to set
the date for the Informal Public Hearing for September 22, 1980.
III . Set Date for Informal Public Hearing - Rezoning
APPLICANT: General Mills, Inc.
LOCATION: 9200 Wayzata Blvd.
REQUEST: Change zoning from "Open Development" to
"Industrial"
• Martin Farrell gave a brief report on the two rezoning requests by General
Mills. It was moved by Specktor, seconded by Thompson, and carried unanimousty
to set the Informal Public Hearing Date for September 22, 1980.

REQUEST: Change zoning from "Open Development" to
"Business and Professional Office"
It was moved by Hughes, seconded by Polachek, and carried unanimously to set
the Informal Public Hearing date for September 22, 1980.
Commissioner Specktor requested information for the Informal Public Hearing
on how General Mills' property relates to the proposed I-394.
Chairperson Eastes requested the "Open Space Report" recommendations relevant
to General Mills' property.
V. Set Date for Informal Public Hearinc�- ,Rezoning.
APPLICANT: City of Golden Valley
� LOCATION: Northwest corner of Lilac Drive � Lindsay Street
REQUEST: Change Zoning from "(I-4) Institutional" to
"Residential"
Martin Farrell gave a brief report. It was moved by Thompson, seconded by
Polachek, and carried unanimously to set the Informal Public Hearing date
for September 22, 1980.
VI . Report on the August 18, 1980 City Council Meeting.
Commissioner Forster gave a brtef report of the August 18, 1g80 City Council
Meeting. Commissioner Specktor requested a copy of the I-3g4 posttion paper
be sent to the Planning Commission members. �
At this time, Martin Farrell reported that United Properties have requested
that the Infbrmal Public Hearing to consider General Plan Approval for P.U.D.
29 be reset for September 22. It was moved by Specktor, seconded by Thompson,
and carried unanirrrously to set the Informal Public Hearing for General Plan
Approval of P.U.D. 29 to September 22, 1g80, in accordance with the letter
received by the Planning Department Staff.
VI1 . Report on the August 18, 1980 HRA Meeting.
Commissioner Hughes reported on the August 18 HRA Meeting.
• At this time the Planning Commission again addressed the Calvary Square General
Plan Approval and the upcoming September 8 Public Hearing. Commissioner Specktor
requested the General Plan Requirements for a P.U.D. and Martin Farrell provided
this information.

• Martin Farrell also supplied the Planning Commission with information regarding
"Section 202 Housing Requirements". Commissioner Specktor asked to be informed
of the format for the September 8 Public Hearing.
VIII . Work Sesston
The Planning Commission reviewed the revised Business � Professional Office
Zoning District and Conditional Use Section of the Zoning Ordinance.
Martin Farrell explained that the three primary changes were: 1) Semantics;
2) Separating the Conditional Use Section; and 3) Setback requirements.
It was moved by Specktor, seconded by Thompson, and .carried unanimously to
approve the Business � Professional Office Zoning District as revised, but that it
not be sent to the City Council- until after the Planning Commission has
reviewed and approved the Conditional Use Section.

A regular meeting of the City Council was held on Tuesday, September 2,
1980, in the Council Chambers. Attached is a copy of the agenda. Donald
Hughes represented tfie Planning Commission.
There will be a special City Council Meeting on Monday, September 8,
1980, at 6:30 p.m. in the basement of the Public Safety Building.
Calvary Square Apartments (P.U.D. #26) will be the topic of discussion.
The City Council requests that the entire Planning Commission attend
this meeting.
The next HRA Meeting will be held on September 16, 1980 at 7:30 p.m. in
the Gold Room. Jody Sehlin is scheduled to represent the Planning '
• Commission.
The first regularly scheduled meeting of the Planning Commission in ,
October would normally be held on October 13, 1980. In honor of
Colum6us Day, City Hall will be closed. I recommend that the Planning
Commission reschedule the October 13, 1980 meeting to Tuesday, October 14,

Henry Hyatt, the proponent, has requested that his application for
Concept Plan Approval for Planned Unit Development #30 be reviewed.
The request involves the construction of 37 rental units on 3.03
acres of land. This project would be funded in part under the
Section 8 Rental Assistance program through HUD. Attached is a map
showing the location of the proposed development.
I would recommend that the Planning Commission set the date for the
informal public hearing .for Monday, September 22, 1980.

SECTION 19•00 Conditional Uses.
• SECTION 19.01 . Short Title. This ordinance shall be known, cited and referred
to as the City of Golden Valley Conditional Use Ordinance.
SECTION 19.02. Purpose � Intent. A conditional use shall be defined as those
occupations, vocations, skilts, businesses, professions, or uses specifically
designated in each Zoning Use District, which for their respective conduct,
exercise or performance in such designated use districts may require reasonable
but special or unusual limitations, conditions, or regulations in such use
district for the promotion or preservation of the general public health, welfare,
or safety therein and in the City and therefore may be permitted in such use ,
district only by a Conditional Use Permit.
It is the intent of this section to provide a means to allow certain uses with
unique characteristics which may be necessary or appropriate within a given
district but which might have an unusual impact upon surrounding properties or
adversely affect the future development of the City of Golden Valley.
SECTION 19.03. Procedures. �
A. An application may be made by any governmental body, department, board, or
cortmission, or by any person or persons having a legal interest in the
parcel described in the application. All applications shall be filed in
triplicate.
B. Applications may not be made for non-contiguous or scattered sites. Each
• site shall require its own application and each application shall be considered
on its own merits.
C. A fee of twenty-five ($25•00) dollars shall be required for the filing of
each ,application.
D. An informal public hearing shall be held on each application within 30 days
� after submittal of the application to the Planning Commission. The Planning
Commission shall make its findings based on the following points :
1 . Anticipated traffic generation will not significantly disturb the
current traffic flow in the area or create unnecessary traffic
congestion.
2. Increases in population and density shall be controlled to the
point where they do not adversely affect the surrounding land uses.
3. Any increase in noise should be kept to a minimum.
4. Conditional uses should be encouraged to enhance the visual
appearance of any structure. .
5• Conditional use should remain consistant whenever possible with the
Comprehensive Pla�.
6. Conditional uses should never infringe upon the public health, safety
• and general welfare. '

E. All property owners within 500 feet of the subject site shall be notified
� of the public hearing by U.S. mail not less than ten (10) days prior to the
date of the informal public hearing by the Planning Commission. Such notice
shall include the date, time and place of the informal hearing and reasonable
identification of the subject site.
F. The Planning Commission shall present its findings and recommendations to
the City Council within 30 days following the date of the public hearing.
G. Following the Planning Commission's informal hearing and recommendations
to the City Council , the City Council shall conduct an official public
. hearing.
Notice of the pubtic hearing shall be published in the official newspaper
of the City not less than ten (10) days prior to the date of the hearing.
Such notice shalt include the date, time, and place of the hearing and a
reasonable identification of the site. In addition, copies of such written
notice i� the form thus published shall be mailed to all property owners
within 500 feet of th� subject site not tess than ten (10) days prior to
the date of such official public hearing.
H. The City Council may impose such conditions and safeguards upon the premises
benefited by a conditional use permit as may be deemed necessary to prevent
injurtous effects therefrom upon other properties in the neighborhood. The
City Councit may also request that evidence of sufficient bonding be supplied
by the property owner to insure satisfactory compliance with the conditions
established by the conditional use permit.
• . I . Denial of a conditional use permit shall constitute a finding that the
conditions required for approval do not exist. No application which has
been denied wholly or in part shall be resubmitted for a period of six (6)
months from the date of said denial , except on new grounds of new evidence
or proof of changes of conditions as determined by the Planning Commission.
Each resubmission shall constitute a new filing and a new filing fee of twenty-
five ($25) dollars shall be required.
J. Upon denial of a conditional use permit the applicant shall be notified in
writing of the denial and the reasons for the denial .
K. All work relating to an approved conditional use permit must begin within
twelve months of the date that the conditional use permit is approved or
the conditional use permit shall be deemed and considered invalid.
