01-09-68 BZA Minutes � �� REGULAR MDETING OF THE GOLDEN VALLEY BOAftD OF ZONING APPEAI,S January 9,. 1968 A regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday� Janua.ry 9, 1968 at 7:30 p.m. at the Golden Valley Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. Chairman Christiansen presided and the following members were present: Uelz, Jensen, Bruch, Swedberg. Also present was Jon Westlake. APPROVAL OF MINUTES MOV�D by Jensen, seconded by Velz, unanimausly carried to approve the minutes of December I2� i967. 68-1-1 (67-12-Itl) 6827 Kingston Circle (17) �ean Koutsky The petition is for the waiver of Section 3.Q?-(1) of 7.5� to a front yard setback of 27.5� for the protruding corner on �he Northeast corner of the proposed structure. MOVED by Jensen, seco�ided by Uelz, carried unanimously to approve the waiver. 68-1-2 {67-12-l�0) 120 Edgewood Avenue North (17) �9an J. Lynch The petition is for the waiver of Section 1.03 of (1) prineipal building on any such lot or parcel. The present lot size is 31,01�6 square feet �rhich is in excess of the required 12�500 square feet per lot. MOVED by Br uch, seconded by Jensen, caxried unanimously that tMe proposed structure be deemed as the principal building� The board noted that �it the time the lot would be divid�l, an easement would have to be provided for access to the .reax lot. Also, the boaxd noted the placement of the proposed structure meets the setback requirements to keep it in conformance. The proponent was in agreement to give a certain p€�rtion of this lot for ease- ment purposes as long as it did not detract from the required 12,500 square feet per lot as required under present ordinance. 68-1-3 (67-12-39) 5300 Wayzata Boulevard (19) Harry �l.don Gerrish Architecture- Planning _ The petition is for the waiver of landscaped areas of no parking �or a proposed pharmacy and restaurant building of 5ection 13.02 (?3) for 10� of landscaping a sideyard setback of O�off the West property line, (required 10� of landscaping). 13.02 (D) for 19� of landsc�ing to a frontyard setback of 16� off the South property line, (required 35' of landscaping). MOVID by Bruch, seconded by Ve1z, unanimously carried to approve the waiver of 10► to a sideyard setback of 0� for landscaping off West property line ONL3�. The board noted that in granting this waiver it would a11ow far contigu.ous paxking wi�h the Golden Hills Shopping Center parking, and for unification of similar operations. � � Board of Zoning Appeals January 9, 1968 page 2 The second motion - moved by Bruch, seconded by Velz, unanimously carried to deny the request for a waiver of 19� to a front yard setback of 16� off the South property line. The Board noted on this p+prtion of the request that there were other alternatives which would not require a waiver. 68-1-l� (67-12-37) 735 Colorado Avenue South (13) John H. �lson , The petition is for the waiver of Section 13.41 (a) Y)esign Standards� for removal of the curb in front of the bu.ilding for parking area, from the rail- road easement track, west to the east edge of the concrete walk (appro�mately 99' ). The e�.sting curb cut is now 35� which was installed w5.th the bituminous surfacing in September, 1967. Also a waiver of Sec. 5.05 and Sec. 13.02 of parking in the frontyard setback. MOVE�7 by Jensen, secoMded by Velz, unanimously carried to deny the petitioners request. The Board noted that there were other workable solutions to the proposal that would not require a variance. The Board also noted that the pro-- ponent was not represented at this meeting. However, the proponent did present his case at the November 13, 1967 and S)ecember 12, 1967 meetings. The Board was also informed of a letter received by the Secretary on January 8, 1968 raquesting that the Board rule on the petition even though the proponent did not plan to be present at the meeting. 68-1-5 5910 Wayzata Boulevard (13} Model Stone Company The petition is for the waiver of Section 13.02 (D) for 19� of landscapin to a frontyard setback of 16� off the South property line�required 35' of landscaping). 13.02 (D) for 10� of landsca in to a sideyard setback of 0� off the West property line, required 10� of landscaping). 13.02 (D) for 19� of a proposed buildin to a frontyard setback of 16� off the South property line, required 35' for building setback). 13.02 (i�) for 20� of a proposed building to a sideyard setback of 0� off the West property line, (required 20� for building setback). 13.�2 (D) for 10� of a proposed buildin to a sideyard setback of 10� off the East property line, required 20� for building setback). All on plot plan for proposed building. 13.02 ('�) for 18� of an existing buildin to a sideyard setback of 2t off the East property line, required 20� for building setback). The petitioner asked to have this matter deferred for one month for further study of the proposed. site plan. 6$-1-6 5725 �uluth Street (11) Byerly Foods The petition is for the waiver of Section 13.02 (D) for 20� to a rear yaxd setback of 0� for a buildin presently under construction, (required 20� for building . 13.02 (D) for 10� of landscapin ',to a rear yard setback of 0� on prop}sed South property line, �required 10� of landscaping). The lot line which is the South line of proposed Tract A. and the North line of proposed Tract B will run parallel with the South wall of the present structure. The waiver in question would extend from this proposed lot line. 4 � Board of Zoning Appeals January 9, 1968 Page 3 MOVED by Jensen, seconded by Bruch, carried unanimously to approve the request with the stipulation that the lot division be approved by the Village Council in accordance with the proposed survey. The Board noted that the 1ot Iine will run along the common wall of the present structure and the new structure. Tn so doing it will create two lots for different ownership� and yet allow a contigu.ous structure for the extension of the shopping center. It was also noted by the Board that the landscaping would follow the same pattern and provide for a unification of parking between the two areas. 68-1-7 800 Florida Averiue South (18) Prer�i.er Realty - A. J. Porter The petitian is for the waiver of Section 13.02 (D) for 10�� of landscaping to a sideyard setback of 0� off �he North property line, required 10r of landscaping) . 13.02 (D) for 10� for a proposed building to a side yard setback of 10� off the South property line, required 2�� for building) . 13.02 for 3 parking spaces for a total of 39, (required �2 spaces) . By' adjusting the parking on �he site, the proponent can conform to the ordinance, which would eliminate that portian of the request. MOVED by Jensen, secanded by Swedberg, unanimously carried to approve the waiver so stated for landscaping and the proposed structure, with the stip- ulation that said property, with the property ta the North, join in a common easement going with the tracts of land for proper access. Review By-Laws of the Golden Valley Board of Zoning Appeals The Board reviewed the By-1aws, and the following changes were made. They are as follows; Article II - Officers Sec��ar. 2 - To read as follows: The ordinance administrator of the Villa�e af Golden Valley shall serve as Secretary of the Board. Article III - Meetings Section I - To read as follows: A monthly agenda shall be prepared by the Secretar�r and mailed to each of the members of the Board. Completed petitions must be received by the Secretary at least by the last working day of the month prior ta the day of the meeting for which a hearing is scheduled. The Board looked favorable upon the above changes and proposed appraval. of the amended B�r-�aws at the next scheduled Board of Zoning Appeals meetin.g.
