02-13-68 BZA Minutes 49 REGULAR MEETZNG OF THE GOLDEN VALLEY BQARD OF ZONTNG APPEALS February 13, 1968 ' A regu].ar meeting of the Golden Va11ey Board of Zoning Appeals was held Tuesday, February 13, 1968 at 7:30 p.m, at the Golden Valley Civic Center, 7800 Golden Va11ey Road, C�olden Va11ey, Minnesota. Chairman Christiansen presided and the following members were present: Jensen, Bruch, Hoover, Anderson. Also present was Jon Westlake. Jordan The petition is for the waiver of Section 3.07-(3-c) of 1.3� to a sideyard setback of 10.9� off the South property line of the proposed hause. (required sideyard 12.2�) No action was taken on the petition by the Board because the applicant or his representative did not appear. 68-2-q 6610 Wayzata Boulevard (18) Watson Construction Company The petition is for the waiver of Section 13.02 (D) for 10� of landscaping to a sideyard setback of-0� off the East property line. (required 10i of landscaping) No action was taken on the petition by the Board because the applicant or his representative did not appear. 68-2-10 5730 Wayzata Boulevard (13) Natalie Stuart The petition is for the waiver of Section 13.02 (D) for 10� of landscaping to a sideyard setback of 0' off `the East property line. (required 10� of landscaping) 13.02 (D) for 10� of landscaping to a sideyard setback of Ot off the West property line, (required 10� of landscaping) 13.02 (D) for l0i of landscaping to a rear yard setback of Ot off the North prQperty line. (required 20� for building setback) � After discussing the waiver, the Board noted that the proposed building site and surrounding area is non-conforming as to the present requirements. In view of' this, with the present petition before them, the Board directed the staff to coordinate a list of violations. The assortment of non- conforming uses, as it now stands, up grades the problems in this area. The Board requests the Planning Commission to review this area because of the present violations and problems that may arise in the future, �� Board of Zoning Appeals February 13, 1968 Page 2 By-Laws of the Golden Valley Board of Zoning Appeals The following are the corrections of the By-Laws of the Board of Zoning Appeals in said sections: Article II - Officers Section 2 - to read as follows: The Ordinance Administrator of the Vi1.lage of Golden Valley shall serve as Secretary of the Board. Article III - Meetings Section 1 - to read as follows: A monthly agenda shall be prepared by the Secretary and :mailed to each of the members of �he �'Board. Completed petitions must be received by the Secretary at least by the last working day of the month prior to the day of the meeting � for which a hearing is scheduled. It was noted that a11 the corrections and changes suggested at the January 9, 1968 meeting have been entered. It was MOVED by Jensen, seconded by Bruch, unanimously carried to approve the B�r-Laws as amended. SECTION 7_!.i.08 AI�tINISTRATION UNDER ZONTNG CODE (Board of Zoning Appeals) Following are corrections of Section 1.1G.08-C PROCEDURE of the Zoning Code. Section 1l�.08-C PROGEDURE to read as follows: (underlined portions are the corrections) C, Procedure, Appeals to the Board of Zoning Appeals may be taken by any affected person upon the filing of a petition with the Village Ordinance Administrator. Such petitions shall be heard at the next regular month7.y meeting of the Board of Zoning Appeals, provided that petitions must be received by the Secretary at least by the last working da� of the month priar to the day of the meeting for. Tr1r.a.�h a hearing is scheduled. If it does not follow this �5rocedure i� sha1T nat be eri�i�lect to be heard until the following � regular monthly meeting. Each petition shall be comprised of a registered survey of the property involved therein which shall show the locations of all buildings thereon, a 'completed petition form as shall be provided by the Village, and a $25.00 filing fee. The petition form shall be completed in sufficient detail to clearly demonstrate the variance applied for or the admi.nistrative act being appealed therefrom, and shall set forth the reasons being advanced by the petitioner as grounds for the granting of the petition. The petition form sha11 also provide for the written consent of all adjacent property owners, and when such written consent does not appear thereon, then the Board sha11 give written notice of the time and place of the hearing respecting said petition to a11 such adjacent property or�mers in accordance with the provisions of this Section. Within thirty (30) days after receipt of the final written order of the Board of Zoning Appeals, an,y petitioner feeling aggrieved therel�y� may file a written brief with the Village Ordinance Administrator, thereby appealing the decision of the Board of Zoning Appeals to the Village Council. Thereafter the Village Council sha11, within thirty (30) days from the date of the filing of such appeal with the Village Ordinance Administrator, make its findings � � Board of Zoni.ng Appeals February 13, 1968 Page 3 and determinations with respect to the appeal and serve a written report thereof upon theappellant by depositing the same in the United States mails, postage prepaid, to the address of the said appellant as reflected upon his written brief. If no appeal is taken by the petitioner from the decision of the Board of Zoning Appeals in the manner hereinabove provided, then the deeision of said Board of Zoning Appeals sha11 be final. It was noted that all the corrections and changes suggested at the January 9, 1968 meeting have been entered.
